Abstract

Peraturan Pemerintah Pengganti Undang-Undang merupakan produk hukum yang ditujukan guna mengatasi permasalahan dalam keadaan kegentingan yang memaksa. Namun, penetapan perppu harus tertib prosedur pembentukan peraturan perundang-undangan. Oleh karenanya, diperlukan sebuah pengaturan prosedur penetapan perppu menjadi UU yang berkepastian guna menciptakan tertib hukum. Penelitian ini mencoba meneliti terkait keabsahan penetapan perppu cipta kerja menjadi UU 6/2023; dan memberikan gagasan penataan terhadap prosedur penetapan perppu menjadi UU. Dengan menggunakan penelitian hukum doktrinal yang dielaborasi dengan metode Reform-Oriented Research, penelitian ini menemukan bahwa penetapan perppu cipta kerja menjadi UU 6/2023 tidak memiliki keabsahan. Namun, hal ini disebabkan pengaturan prosedur penetapan perppu menjadi UU yang tidak berkepastian. Ketidakjelasan dalam menakar “hal ihwal kegentingan memaksa”, interpelasi atas makna “persidangan yang berikut”, dan tidak dibatasinya materi muatan suatu perppu. Puncaknya, penulis menggagas penataan prosedur penetapan perppu menjadi UU melalui (i) mengatur “hal ihwal kegentingan memaksa” secara normatif dalam UU P3; (ii) membatasi makna “persidangan yang berikut” secara ketat; dan membatasi materi muatan suatu perppu. Penataan prosedur tersebut ditujukan guna memberikan kepastian hukum agar tercipta tertib hukum dalam penetapan perppu menjadi UU.

Abstract

This study examines customary land disputes among indigenous communities in Papua, focusing on the alignment of existing legal mechanisms with the justice values held by these communities. Employing a normative legal approach and socio-legal analysis, this research explores the philosophical, cultural, and legal dimensions of the land, emphasizing its communal and spiritual significance. Findings reveal that Indonesia’s formal legal framework, grounded in individual ownership and state-centric policies, often overlooks indigenous rights, causing unresolved conflicts and cultural disenfranchisement. The research proposes a hybrid dispute resolution model integrating customary practices with state recognition, including specialized customary land tribunals and mandatory consultation processes. This model seeks to bridge the gap between formal and customary laws, promoting equitable dispute resolution and safeguarding the cultural heritage of Papua’s indigenous communities. Recommendations aim to enhance legal recognition and foster sustainable land management in Papua.

Abstract

The relationship between ethical norms and legal norms is different for experts, especially concerning their position. Moreover, legal norms seem to be superior to ethical norms. This study aims to analyze the position of ethical norms and legal norms. The dignified justice theory was chosen because it seeks to orient the divine and human aspects, which can only be fulfilled if ethical and legal norms synergize. This research is juridical-normative research. The juridical-normative research was chosen because it confirms the existence of ethical norms and legal norms as part of the system of norms prevailing in society. The study's results confirm that, in practice, legal court decisions are often considered higher and more authoritative than ethical court decisions. This has implications for the position of ethical norms that are considered inferior to legal norms. Furthermore, the theory of dignified justice seeks to see the relationship between ethical norms and legal norms as different norms, but in its implementation in society, the two norms must synergize and complement each other.

Abstract

DPRD is said to be a regional legislative body because it has the authority to make local regulations, several local government laws that have been in force mention that DPRD has a legislative function, similar to the DPR. The filling of positions for DPRD members is also done together with the filling of positions for DPR members in legislative elections. This has created the impression that DPRDs and DPRs are both legislative institutions, even though they are different. To make the difference more significant, there must be a revision/reorganization of the Local Government Law. The purpose of this research is to understand and find out about the problems and structuring of DPRD in the implementation of local government. The type of research used is normative juridical, while the approaches used in this research are three, namely legislative approach, conceptual approach, and historical approach. The results of the research in this journal are that the DPRD as an organizing institution of local government should be regulated in the Local Government Law together with the regional head and not regulated in other laws such as the MD3 Law. The Local Government Law also needs to organize the functions of the DPRD where the first order of functions should be the functions of supervision, budgeting, and the formation of local regulations. This is because DPRDs more often or routinely carry out supervisory functions, rather than budgetary and local regulation formation functions. The filling of the positions of DPRD members is carried out simultaneously with the positions of regional heads, not through elections together with members of the DPR. The nomenclature of DPRDs should also be changed, i.e. Provincial DPRDs should be changed to Provincial Councils, while DPRDs at the Regency/City level should be changed to Regency/City Councils. Suggestions in this research are aimed at making a new law on legislative institutions that does not include provisions on DPRDs, considering that DPRDs are not legislative institutions, but regional government organizing institutions.

Abstract

Era digital telah membawa perubahan signifikan dalam industri perbankan. Kemajuan teknologi mempermudah berbagai transaksi keuangan, namun juga meningkatkan risiko kejahatan perbankan seperti pencurian identitas, peretasan akun, dan penipuan online. Kejahatan perbankan ini memerlukan sistem penegakan hukum yang efektif untuk melindungi nasabah dan integritas sistem keuangan. Tujuan penelitian ini membandingkan sistem penegakan hukum kejahatan perbankan di era digital di negara maju dan berkembang. Penelitian ini menggunakan metode penelitian Systematic Literature Review (SLR). Data yang telah terkumpul kemudian dianalisis dalam tiga tahapan yakni reduksi data, penyajian data dan penarikan kesimpulan. Hasil penelitian menunjukan bahwa sistem penegakan hukum kejahatan perbankan di era digital di negara maju dan negara berkembang memiliki perbedaan dan persamaan. Negara maju umumnya memiliki sistem hukum yang lebih kuat, sumber daya yang lebih memadai, dan teknologi yang lebih canggih untuk memerangi kejahatan perbankan. Namun, negara berkembang juga memiliki beberapa keunggulan, seperti budaya hukum yang lebih fleksibel dan kemampuan untuk beradaptasi dengan perubahan dengan lebih cepat. Sehingga untuk memperkuat sistem penegakan hukum kejahatan perbankan di era digital, negara berkembang perlu meningkatkan kerjasama internasional, memperkuat kapasitas penegak hukum, dan meningkatkan kesadaran masyarakat tentang kejahatan perbankan.

Abstract

A covernote is a statement letter containing the notary's ability to carry out what the debtor wants. The notary has full responsibility for the contents contained in a cover note. Covernotes are not textually part of the authority of a Notary, this is interesting to study in more depth regarding the form of notary responsibility for the covernote that has been made. The research method used in this research is a normative juridical method. The conclusion obtained is that covernotes are not part of the authority of a notary as regulated in the Law on the Position of Notaries, but are a habit that grows and develops in society and is made into customary law. So that the notary's responsibility regarding the covernote that is made can be called for criminal, civil or moral sanctions imposed by the community.

Abstract

The criminal law paradigm has begun to change since the emergence of the new Criminal Code (KUHP), where criminal punishment is emphasized not only as retaliation but also as recovery. Diyat punishment is one solution to restore victims. By giving property to the victim, you can make the victim's life easier financially. However, it is different from the diyat punishment for perpetrators of murder, not torture, which in this case has a perspective from the view of Islamic inheritance law. How is the diyat punishment given to the victim who is the heir of the murder victim from the perspective of Islamic inheritance law? This research uses normative legal research methods, namely by examining legal norms regarding diyat punishment from the perspective of Islamic inheritance law. Meanwhile, this research approach uses a statutory approach and a case approach related to diyat punishment. The results of research into the diyat punishment which should be the victim's right will be transferred to the victim's heirs considering that the victim has died as a result of murder. The concept of diyat punishment from the perspective of Islamic inheritance law is one of the appropriate solutions and is in accordance with the principles of the new Criminal Code.

Abstract

This research explores the legal framework governing trade secret protection in Indonesia, aligning with international standards set by the TRIPS Agreement of the WTO. Utilizing normative legal research and legislative analysis, the study evaluates the effectiveness of Law No. 30 of 2000 on Trade Secrets in providing crucial legal safeguards for economically valuable confidential information. The dispute resolution process for trade secret violations in Indonesia involves legal steps such as violation identification, evidence collection, mediation, arbitration, and civil proceedings, culminating in court decisions determining compensation and, if necessary, criminal penalties. The study finds that Indonesia's trade secret laws significantly impact innovation, trade, and investment, playing a vital role in international dispute resolution and providing robust rights to trade secret owners. Highlights: The study evaluates the effectiveness of Indonesia's Law No. 30 of 2000 in aligning with international standards for trade secret protection, specifically those outlined in the TRIPS Agreement of the WTO. Abstract

In the era of globalization, addressing the complex challenges of state financial recovery due to corruption and illicit practices necessitates a holistic approach that integrates legal, economic, and social aspects. This research employs normative research methods and a conceptual approach to analyze the legal framework and economic concepts related to the Economic Analysis of Law (EAL) in the context of national financial recovery. By synthesizing legal and economic principles, the study demonstrates that EAL proves highly effective in confronting the challenges of state financial recovery. The integration of economic principles in legal analysis allows governments to craft policies that are not only legally robust but also economically efficient. Through a focused examination of the economic impact of illegal actions on state finances, EAL facilitates the identification of losses and the design of precise recovery strategies. The findings underscore the potential of EAL as a valuable tool for governments worldwide in formulating sustainable policies for financial restitution.Highlights: Holistic Approach: The study advocates for a holistic approach to state financial recovery by integrating legal and economic perspectives, emphasizing the interconnectedness of legal principles and economic efficiency. Abstract

Pemberdayaan ini bertujuan untuk meningkatkan kualitas hidup di level rumah tangga dalam pengelolaan sampah organik minim resiko dengan menerapkan prinsip kehati-hatian khususnya di Desa Sumberkejayan, Kecamatan Mayang, Kabupaten Jember. Proses pengelolaan sampah organik dengan output berupa eco enzymeyang dimanfaatkan berupa pupuk cair ramah lingkungan menjadi trend saat ini meskipun beberama kelompok masyarakat masih membakar sampah yang dimiliki. Adapun metode pelaksanaan meliputi: (1) Edukasi dan penyuluhan terkait dengan pengelolaan sampah organik minim resiko dengan metode 3R  dengan memberikan materi terkait dengan prinsip kehati-hatian dalam pengelolaan sampahdengan output eco enzyme yang dimanfaatkan sebagai pupuk cair alami ramah lingkungan dan minim resiko bagi rumah tangga; (2) Workshop pembuatan eco enzyme yang melibatkan kurang lebih 30 peserta yang terdiri dari ibu-ibu dan remaja masjid; (3) Pendampingan melalui instagram komunitas masyarakat untuk edukasi dan promosi eco enzyme melalui media sosial dalam pemanfaatan sampah organik dengan output eco enzyme. Hasil evaluasi menunjukkan: (1) peserta sangat antusias, mengingat ternyata sampah organik yang dihasilkan diubah menjadi pupuk cair ramah lingkungan yang dapat digunakan untuk kebutuhan sehari-hari dalam skala rumah tangga, (2) Kegiatan workshop juga berjalan lancar dengan output seluruh kelompok berhasil dengan masa panen 3 bulan setelah mengikuti workshop (bulan Mei-Agutus), (3) harapan lain dari perserta workshop dapat memberikan dampak positif dalam pengelolan sampah yang bermanfaat dan ramah lingkungan.
