Abstract

The USA as a pioneer has published Antitrust Law since the XIX century. Indonesia also has business competition laws which are regulated in Law No. 5 of 1999. However, the scope of the definition of business actors in Indonesia is still very narrow. It does not strictly regulate the extraterritorial principle in Article 1 paragraph 5 so that there are legal loopholes for business actors who are outside the jurisdiction. However, KPPU has already made decisions on business actors domiciled abroad from the case Temasek Holdings, Ltd. (No. 07/KPPU-L/2007) and VLCC (No. 07/KPPU-L/2004). Problem formulation of this research is: how is the definition of a business actor based on Indonesian law and USA law; and how is the application of Extraterritorial Jurisdiction in Indonesia law and USA law? The methodology of this research is normative legal research with library research method by tracing secondary data in the form of primary legal materials, secondary legal materials, and tertiary legal materials. Data were analyzed using qualitative analysis. The results of this study, there are differences in the understanding of business actors in Law No.5 of 1999 and Antitrust Law. Uncertainty regarding foreign elements in Law No.5 of 1999 makes judges use "Effect Doctrine" and "Single Economy Entity" in categorizing business actors who are outside the jurisdiction of Indonesia. From the existing problems, the Indonesian government should amend the definition of business actors in Law No. 5 of 1999 and provide the principle of extraterritoriality in the duties and powers of the KPPU.

Abstract

In early 2020, the global shock of the Covid-19 outbreak led to the rapid development of vaccines in several countries. In Indonesia, PT Bio Farma was designated by the government to procure Covid-19 vaccines, as outlined in Presidential Regulation Number 99 of 2020. This study examines the legality of PT Bio Farma's direct appointment in vaccine procurement under business competition law and its compliance with antitrust immunity. Through normative legal research, it is found that while some regulations are adhered to, others are violated by the government, indicating that PT Bio Farma's direct appointment does not align with principles of fairness and economic democracy in business competition law. Moreover, Presidential Decree No. 99 of 2020 provides antitrust immunity, subject to fulfilling specific criteria, in line with certain articles of the Antitrust Law, as an exception to the prohibition of monopolistic practices.

Abstract

Indonesia’s Sustainable Finance Roadmaps (2015-2019; 2021-2025) elevate renewable-energy investment to a national priority, yet the 2023 primary-energy mix is still dominated by coal (39.7 %) and petroleum (29.9 %), with new-and-renewable energy (NRE) at just 13.3 % far short of the 23 % statutory target for 2025. This article undertakes a doctrinal methodology to determine whether the country’s current legal architecture furnishes the pro-competitive conditions required to mobilise private capital toward NRE in harmony with the Roadmaps and Sustainable Development Goals 7, 13, and 16. The study systematically interprets (i) Law No. 30 of 2009 on Electricity, Law No. 22 of 2001 on Oil and Gas, and Law No. 21 of 2014 on Geothermal; (ii) implementing regulations and ministerial decrees on grid access, procurement, and feed-in tariffs; (iii) the Law No. 5 of 1999 and its 2023 implementing guidelines; and (iv) OJK Regulation No. 51/POJK.03/2017 on sustainable-finance disclosure. Statutory provisions are examined for hierarchical consistency, internal coherence, and conformity with Article 33(3) of the 1945 Constitution and Indonesia’s treaty obligations under the Paris Agreement. Doctrinal scrutiny reveals three normative defects: (1) the electricity law’s exclusive procurement mandate enables PLN’s de facto monopsony, contravening the non-discrimination principle in the Competition Law; (2) opaque tariff-setting regulations conflict with transparency duties embedded in the sustainable-finance framework; and (3) sectoral licensing rules omit explicit alignment with OJK’s green-taxonomy criteria, undermining legal certainty for renewable-energy sponsors. The article recommends statutory amendments to embed open-access grid clauses, mandate competitive tendering consistent with fair-competition norms, and cross-reference green-taxonomy thresholds in energy licences. These reforms would synchronise Indonesia’s competition regime with its sustainable-finance objectives and supply the legal certainty essential for a just energy transition.

Abstract

ABSTRACT Nursing is an integral part of the healthcare system and plays an important role in improving the quality of hospital services. The nursing care model implemented by nurses directly contributes to patient satisfaction, in terms of communication effectiveness, continuity of care, and coordination within the medical team. Various nursing assignment methods have been applied, such as the functional method and the team method, each with its own strengths and weaknesses in influencing service quality. However, there is still a gap in the application of the optimal method, particularly related to the level of nurses’ knowledge in choosing and implementing the appropriate assignment method. Therefore, this study aims to analyze “The Relationship Between Knowledge of Nursing Care Assignment Methods and Patient Satisfaction at Karya Medika II Tambun Hospital.”  This study aims to determine the relationship between nurses’ level of knowledge regarding nursing care assignment methods and patient satisfaction at Karya Medika II Tambun Hospital. This study uses a quantitative approach with a cross-sectional design. The research instrument is a questionnaire distributed to nurses and patients in the inpatient ward of Karya Medika II Tambun Hospital. Data analysis was conducted using the chi-square statistical test to examine the relationship between the independent variable (knowledge of assignment methods) and the dependent variable (patient satisfaction). The results showed that 65% of respondents had good knowledge of the Functional Assignment Method. Bivariate analysis showed a p-value of 0.016, indicating a significant relationship between knowledge of the functional method and patient satisfaction. Meanwhile, 85% of respondents had good knowledge of the Team Assignment Method, with a p-value of 0.010, indicating a stronger relationship with patient satisfaction compared to the functional method. The results of the study indicate a significant relationship between knowledge of nursing care assignment methods and the level of patient satisfaction. The team assignment method is more effective in improving patient satisfaction compared to the functional method. Therefore, increasing knowledge and appropriate implementation of nursing methods is essential to improve the quality of healthcare services in hospitals. Keywords: Nursing Relationship, Nursing Assignment Method, Nursing Care Model, Patient Satisfaction, Quality of Health Services. Abstract

Agency relationships constitute a fundamental pillar of modern commerce. Large companies generally manage their corporate affairs through a series of agency activities, particularly in conducting their business operations. In Indonesia, however, the regulation of agency relationships is highly diverse. It can be said that the normative and academic understanding of agency law has not kept pace with regulatory developments responding to commercial activities. Therefore, this article examines the inconsistencies in the regulation of agency under the Job Creation Law and discusses their implications. To address this research focus, the author employs a normative legal research method. The study finds that the regulation of agency in the Job Creation Law is varied and inconsistent with the proper concept and legal framework that should apply to agents. The lawmakers appear not to have harmonized agency-related provisions across the various laws amended under the Job Creation Law as an omnibus law. Considering the significant role of agency in modern commercial life, there is a pressing need for a comprehensive legal framework that clearly regulates and properly positions agents in commercial transactions, thereby preventing overlaps in rights, obligations, authority, and responsibilities with principals and other intermediaries.
