Abstract

Hukum persaingan usaha merupakan rambu-rambu yang berfungsi menjaga perilaku pelaku usaha agar tunduk kepada aturan main yang berlaku.Dalam dunia usaha sekarang banyak sekali ditemukan perjanjian yang mengandung unsur yang kurang adil dalam sebuah persaingan yang disebabkan kurangnya pemahaman pelaku usaha terhadap Undang-Undang No 5 Tahun 1999 tentang Larangan Praktik Monopoli dan Persaingan Usaha Tidak Sehat. Penetapan harga adalah salah satu perjanjian yang dilarang yang dilakukan oleh para pelaku usaha pesaingnya untuk menetapkan harga atas mutu suatu barang dan atau jasa yang harus dibayar oleh konsumen atau pelanggan pada pasar bersangkutan yang sama. Tulisan ini membahas tentang dugaan pelanggaran perjanjian penetapan harga terhadap putusan KPPU No 08/KPPU-L/2018 tentang jasa freight container pada rute Surabaya menuju Ambon.   Metode penelitian yang digunakan untuk menjawab permasalahan dalam skripsi ini yaitu metode penelitian hukum normatif dengan sifat penelitian deskriptif yang dilakukan dengan cara meneliti bahan pustaka atau data sekunder guna memperoleh bahan hukum primer, sekunder maupun tertier terkait dengan permasalahan yang sedang dibahas.   Skripsi ini membahas mengenai bagaimana terjadinya proses penetapan harga dan pemberian sanksi administratif oleh KPPU selaku komisi pengawas persaingan usaha yang berwenang untuk melakukan pengawasan dan penyelesaian perkara hukum persaingan usaha di Indonesia. Berdasarkan penelitian, penetapan harga yang dilakukan oleh pelaku usaha dalam putusan 08/KPPU-L/2018 termasuk per se illegal yang artinya dalam melakukan pemeriksaan KPPU hanya perlu membuktikan adanya pelanggaran terhadap Pasal 5 ayat (1) Undang-Undang No 5 Tahun 1999 tanpa harus membuktikan adanya dampak dari perjanjian penetapan harga tersebut. Selain itu penelitian menemukan bahwa pemberian sanksi oleh KPPU nyatanya tidak memiliki efek jera kepada pelaku usaha. Dalam Putusan 08/KPPU-L/2018 pelaku usaha kembali dinyatakan terbukti sah dan meyakinkan melanggar Pasal 5 ayat (1) Undang-Undang No 5 Tahun 1999 tentang Larangan Praktik Monopoli dan Persaingan Usaha Tidak Sehat.   Kata kunci: Perjanjian yang dilarang, Perjanjian Penetapan Harga, Komisi Pengawas Persaingan Usaha (KPPU)

Abstract

Dalam penggunaan fasilitas parkir,konsumen harus membayar biaya parkir.Awalnya pembayaran biaya parkir hanya menggunakan uang tunai.Namun, pembayaran biaya parkir dengan uang tunai sudah mulai berkurang dan beralih kepada pembayaran non-tunai yangkini tengah digandrungi masyarakat.Menyikapi banyaknya keuntungan dari transaksi non-tunai menyebabkan menjamurnya aplikasi pembayaran digital. Pembayaran digital adalah sebuah cara pembayaran yang menggunakan media berteknologi seperti SMS, Mobile Banking, Internet Banking, Digital Wallet, dan sebagainya. Dalam Pasal 4 UU Perlindungan Konsumen, disebutkan bahwa salah satu hak konsumen adalah hak untuk memilih barang dan/atau jasa.Dengan banyaknya pilihan aplikasi pembayaran digital tersebut, maka timbul pertanyaan yaitu haruskah konsumen memakai semua penyedia jasa transaksi digital tersebut?Bagaimana jika suatu sarana parkir tidak menyediakan metode pembayaran yang konsumen gunakan? Dan bagaimana jika konsumen dipaksa memakai salah satu aplikasi penyedia jasa saja dikarenakan tidak ada pilihan lain? Bagaimana juga jika metode pembayaran secara tunai dihapus? Metode yang digunakan dalam penelitian ini adalah metode penelitian hukum normatif dengan menggunakan data sekunder berupa bahan hukum primer, sekunder dan tertier yang dikumpulkan dengan metode studi pustaka.Penelitian juga didukung oleh data primer yang dikumpulkan dengan menggunakan   kuesioner secara online dengan menggunakan Google Form.Data seluruhnya dianalisis dengan menggunakan metode analisis data kualitatif. Berdasarkan hasil penelitian, pelaksanaan perlindungan hak konsumendalam menentukan pilihan metode pembayaran parkir belum sesuai dengan ketentuan Undang-Undang Nomor 8 tahun 1999 tentang Perlindungan Konsumen. Ditemukan fakta-fakta bahwa pengelola parkir tidak menyediakan beragam pilihan metode pembayaran, bahkan konsumen dipaksa menggunakan satu jenis metode pembayaran saja.Pembatasan terhadap hak pilih konsumen ini bertentangan dengan Pasal 4huruf b UU No. 8 Tahun 1999. Konsumen dapat menggugat pengelola parkir tersebut karena telah merampas hak konsumen.Berdasarkan Pasal 45 ayat (1) UU Perlindungan Konsumen bahwa setiap konsumen yang dirugikan dapat menggugat pelaku usaha melalui lembaga yang bertugasmenyelesaikan sengketa antara konsumen dan pelaku usaha atau melalui peradilan yang berada dilingkungan peradilan umum.Selainmelalui jalur Pengadilan, konsumen juga dapat membuatpengaduan tertulis maupun lisankepada Badan Penyelesaian Sengketa Konsumen (BPSK) tentangterjadinya pelanggaran terhadap hak konsumen.

Abstract

Metode pembayaran merupakan cara teratur yang digunakan untuk memindahkan sejumlah dana dari pembayar kepada penerima baik secara langsung maupun tidak langsung. Dalam transaksi bisnis internasional, metode pembayaran yang umum digunakan antara lain letter of credit, wesel, open account dan advance payment.PayPal adalah sebuah layanan sistem pembayaran online terbesar di dunia yang bertindak sebagai alternatif pembayaran tradisional.Dengan efisiensi dan efektivitasnya, PayPal menjadi salah satu pilihan metode pembayaran yang banyak digunakan oleh masyarakat internasional.PayPal sendiri belum memiliki pengaturan yang jelas di Indonesia.            Penelitian ini dilakukan secara yuridis normatif yakni penelitian berdasarkan bahan-bahan hukum berupa peraturan perundang-undangan, asas-asas hukum, jurnal, skripsi, tesis, dan bahan lainnya yang diperoleh dari data sekunder maupun data tersier.Penelitian ini bersifat deskriptif yaitu dengan mengemukakan data dan informasi yang telah dianalisis secara sistematis, mendalamdanmenyeluruh. Ditinjau dari fungsinya, PayPal dalam hukum Indonesia memiliki kesesuaian terhadap Peraturan Bank Indonesia No.20/6/PBI/2018 tentang Uang Elektronik serta Peraturan Bank Indonesia No.18/40/PBI/2016 tentang Penyelenggaraan Pemrosesan Transaksi Pembayaran.Namun, PayPal belum mendapat izin dari Bank Indonesia untuk beroperasi sebagai uang elektronik maupun sebagai penyelenggara pemrosesan transaksi pembayaran. Penggunaan PayPal didasari pada user agreement yang merupakan kontrak atau perjanjian baku. Transaksi menggunakan PayPal dapat dikategorikan sebagai transaksi yang dilakukan secara elektronik, sehingga sengketa yang terjadi dalam penggunaan PayPal tunduk pada Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik (UU ITE). Dalam UU ITE dikatakan bahwa para pihak yang melakukan transaksi elektronik diberi kebebasan untuk memilih hukum yang diberlakukan. Abstract

ABCTRACT Free trade interaction one state with another, should have any regulation of law international. Obviously, to arrange trade regulation with another states, and obligate any law regulation to captivate, if appear any dispute on that trade transaction According from that idea, issues that appointed on this observation are law international regulation about liberation trade in service, regulation dispute settlement on WTO frame agreement and ASEAN frame agreement, position of regulation AFAS directed regulation on GATS as frame agreement WTO. This observation using yuridis normative approach which to learn assembling law international principles about liberation trade on service. From the result of the observation, that law international regulation about liberation trade in service on frame agreement WTO is General Agreement Trade in Service (GATS)  which the rule of basic to enclose on Annex 1b GATS. Whereas on frame agreement ASEAN, through implementation AFAS (ASEAN Framework Agreement on Service) within elimination trade border on services with on member of ASEAN. Dispute settlement on frame agreement WTO through Special Body , there is Dispute Settlement Body, whereas on ASEAN, through High Council which formed by Senior Economic Officials Meeting (SEOM) and the rule of law suitable with Treaty of Amity and Cooperation in South-East Asia (TAC). Abstract

ABSTRACTThe effectuation of free flow of workforce in AEC (ASEAN Economic Community) has brought some impacts on the mobility of skilled workforce such as medical practitioners. International trade of service is then regulated in MRA (Mutual Recognition Arrangement) that has been approved in ASEAN countries’ regions. The research problems are how the legal aspect of MRA in the formulation of AEC (ASEAN Economic Community) is, how ASEAN agreement in the field of medical practitioners’ service is, and how the legal protection by ASEAN in the field of medical practitioners’ service is. The title of this research is “International Trade of Medical Practitioners via MRA (Mutual Recognition Arrangement) in ASEAN Regions”. Normative juridical research method is used in this research. The material or data are secondary legal materials. The data are collected through library study and analyzed by descriptive qualitative method. The legal aspect of MRA is that is acts as an agreement between two countries or more to reach an agreement which regulates each country’s interest of something. ASEAN Agreement in the field of medical practitioners’ service is made in Mutual Recognition Arrangement on Medical Practitioners, Mutual Recognition Arrangement on Dental Practitioner, and Mutual Recognition Arrangement on Nursing Services which has provided free entry for skilled medical practitioners to the other ASEAN countries stipulated in ASEAN MRA. The legal protection for the medical practitioners provided by ASEAN is also stipulated in Article 2, Article 5, and Article 6 of ASEAN MRA on Medical Practitioners through the receiving countries with good faith. Abstract

ABSTRACTThe development of information technology is currently experiencing rapid progress. This development apparently brings impacts on a variety of life sectors including trading world. One form of the uses of much developing, most influential, and most widely used information technology is e-commerce (Electronic Trade). The development in trading world with this e-commerce has to be supported by the development in the law that regulates trade related problems in internet media. This technology and information facility development or commonly called cyberspace also brings quite big impacts on the regulation in national and international laws. The research problems are how the concept of e-commerce transaction is, how e-commerce is regulated in international laws, an how e-commerce is regulated in national laws. This research is entitled “The Juridical Analysis of E-Commerce Transactions according to International and National Laws”. This is a descriptive normative juridical research. The data used in this research are secondary legal materials. They are collected through library study and analyzed qualitatively. The legal problems resulted from e-commerce transactions is the problems in data verification in e-commerce creating obstacles to state policies that impedes e-commerce transactions. E-commerce is regulated in UNCITRAL Model Law on Electronic Commerce which is not enforceable, but it is the reference to be implemented in national law by the countries. UNCITRAL has regulated the validity requirement to bind all parties in an e-commerce transaction. the Law No. 11/ 2008 on Electronic Information and Transaction, the Law No. 82/2012 on the Conduct of Electronic System and Transaction, and the Law No. 8/1999 on UUPK (Consumer’s Protection) as the national laws regulate the provisions of e-commerce transactions and the adequate legal protection for consumers to make e-commerce transactions. Abstract

Mutual Recognition Arrangements (MRAs) in ASEAN Economic Community in the perspective of International Law and its effect in National Law. ABSTRACT   Tony Kesuma* Sutiarnoto** Mahmul Siregar***   ASEAN (Association of South East Asian Nations) is a regional organization that is composed of 10 Nations, namely Indonesia, Thailand, Malaysia, Brunei Darussalam, Lao, Cambodia, Singapore, The Phillippines, and Vietnam. ASEAN  is created to strengthen the diplomatic bond and increase the economies between member states. Because ASEAN also focuses on economy section, of course ASEAN already made quite a lot of programs to increase and generalizing the quality of human resources and chance of work, which one of their program is Mutual Recognition Arrangements (MRAs). The method author uses in this Journal is a Juridical Normative methods with category of Non Judicial Case Study, where author will explain about Mutual Recognition Arrangements (Especially in Service Sector), what MRA is in International Law, and its effects in Indonesia, especially in Legal sector. Resources in this Journal is mainly quoted from books, Law Articles, or other literatures.   The Effect of Mutual Recognition Arrangements (MRAs) in National Law is the making of Presidential Decree Number 82 Year 2002 about endorsement of ASEAN Framework on Mutual Recognition Arrangements (ASEAN MRAs), and Ministerial Regulation of Communication and Informatics Number 16 year 2012 about Guidance on the Implementation of the Recognition of a Foreign Country Test Center. Abstract

ABSTRACT Dr. Chairul Bariah, S.H., M.Hum* Dr. Mahmul Siregar, S.H., M.Hum** Anita*** Disputes can be happen anywhere and to anyone. Disputes can occur between individual with individual, individual with groups, groups with groups, or countries with other countries. In other words, dispute can be a private, public, national or international problem. Dispute is a situasion where there are parties who feel harmed by another parties, which afterwards the parties expressed his dissatisfaction to the second parties. If both parties shows different opinion, then there is what called a dispute. Disputes between members of the international community can occur due to several reasons, such as for military, political, economic and ideological reasons. A hostile attitude that begins because of dissent can also lead to disputes. It is not imposible when disputes between nations lead to be an armed conflict if both parties do not agree to make peace. As the problem in this research is the role of regional international organizations in international dispute resolution. The research used is normative juridical with descriptive. The data used in this study are primary legal materials, secondary legal materials and tertiary legal materials. Methods of datacollection are using literature study. Data analysis is done qualitatively. The Regional International Organization may serve as a platform for resolving disputes among its members. The role of this organization continues to grow because the international community tends to establishinstitutions in the scope of its territory. Settlement of disputes through regional international organizations also has more value in peaceful dispute settlement in its territory.   Keyword: The Regional International Organization, Regional Disputes Resolutions

Abstract

Surya Nusantara Sandan***) Sovereignty over territory or territorial sovereignty is the most important element of a country, and that sovereignty is what distinguishes a country from other subjects of international law. In forming an international law in the economic field, the agreement of rights and obligations that are formed can override the sovereignty of a country that approves it. The possibility of overruling sovereignty raises several issues that will be discussed in this thesis, namely: first what is sovereignty of the state in the view of international law, secondly how does the force bind of international law in the economic field and its impact on state sovereignty, and thirdly how is the standing of the Republic of Indonesia’s sovereignty in scope of international law that govern the field of international economics. The method used in this thesis is a normative descriptive legal research method. The data used as the source of this research are secondary data, obtained from research and analysis of written law and other literature reference materials related to state sovereignty and international law in the economic field. State sovereignty is recognized in international law as an authority to carry out law in its jurisdiction, to regulate the country's international relations activities, as well as to transfer ownership of a foreign property with specified compensation. However international law prohibits the use of national law to renege on the agreement. Civilized countries voluntarily respect that provision as a gesture of good faith. So does the Indonesian state, Indonesia was once bound by obligations in an agreement which turned out to worsen the national economic situation. Obligations carried out by Indonesia include, among others, the drafting of an Act that replaces the division system of duties and authority of state organs which is part of state sovereignty, permits the privatization of SOEs, and the termination of national projects that have the potential to compete in international environment. PERAN UNITED NATIONS INTERNATIONAL CHILDREN’S EMERGENCY FUND (UNICEF) TERHADAP PEMULIHAN KONDISI PENDIDIKAN DI SULAWESI TENGAH INDONESIA PASCA GEMPA BUMI Ladyta Tahany Reformita Marpaung ABSTRAKSI Penelitian ini bertujuan untuk mengetahui bagaimana peran yang dilakukan oleh organisasi internasional yaitu United Nations International Children’s Emergency Fund (UNICEF) dalam membantu pemulihan pendidikan di Sulawesi Tengah Indonesia pasca gempa bumi. Sedangkan kegunaaan penelitian ini adalah untuk menambah wawasan bagi pembaca mengenai bantuan apa saja yang diberikan UNICEF terhadap pemulihan pendidikan di Sulawesi Tengan Indonesia pasca gempa bumi. Permasalahan dalam skripsi ini adalah bagaimana kedudukan UNICEF sebagai organisasi internasional menurut hukum internasional, bagaimana perkembangan UNICEF di Indonesia, dan bagaimana peran UNICEF terhadap pemulihan kondisi pendidikan di Sulawesi Tengah Indonesia pasca gempa bumi. Metode penelitian yang digunakan adalah yuridis normatif dengan dilakukan penelitian kepustakaan guna memperoleh data-data sekunder yang dibutuhkan yang meliputi bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier yang dibutuhkan dalam penelitian ini. Hasil penelitian ini disajikan secara deskriptif juga memperoleh penjelasan dari masalah yang dibahas. Hasil penelitian menunjukkan bahwa kedudukan UNICEF adalah sebagai subjek hukum internasional yaitu organisasi internasional dibawah PBB dan merupakan bagian dari organisasi internasional antar pemerintah yaitu bersifat semi otonom dan memiliki badan pengatur sendiri. Perkembangan UNICEF di Indonesia juga berjalan dengan baik ditunjukan dengan kerjasama yang terus dilakukan UNICEF dengan Indonesia selama lebih dari enam puluh tahun sampai saat ini. Pasca gempa bumi di Sulawesi Tengah Indonesia pendidikan disana menjadi terbengkalai karena banyaknya sekolah yang rusak dan tidak dapat digunakan kembali. Dalam membantu pemerintah Indonesia mengatasi pemulihan pendidikan disana, UNICEF dengan cepat dan sigap mengirimkan bantuan berupa tenda darurat dan paket sekolah untuk anak-anak sehingga pendidikan di daerah tersebut dapat berjalan kembali dan pemerintah Indonesia sangat mengapresiasi bantuan yang diberikan UNICEF tersebut.   Kata Kunci: UNICEF, Peran UNICEF, Pendidikan Pasca Gempa Bumi di Sulawesi Tengah
