Abstract

Traditional villages in Bali have the potential to become tourist destinations that benefit the local community. Culture and customs are what set apart traditional villages. The legal politics of the Bali tourist village have deteriorated into the new normal. This research aims to develop a tourist village model, a new theory for elaborating Balinese cultural values based on local wisdom values, a creative economy, and human resource management during the COVID-19 pandemic. The research method is a qualitative descriptive empirical legal analysis based on a socio-anthropological approach and law sociology, supplemented with cultural studies. The findings revealed that the value of local wisdom in the traditional village adds value to a tourist village in Bali. The Ceking traditional village's tourist rice terraces are appealing due to the culture of farmers becoming a tourist village. The Penglipuran traditional village's artistic potential, social capital, nature, and local wisdom are the codification of culture in power politics. Tourism is a helpful tool for economic development. Bali must explore the potential for increased innovation and community participation as a tourist destination by using traditional villages as a buffer for culture, Hinduism, and local wisdom. Furthermore, Bali tourism is exceptionally vulnerable to health concerns that affect tourism and ecotourism activities.

Abstract

This Community Service is focused on socializing the legal legality of controlling coastal land by foreigners in Bali for tourism business purposes. The method used is empirical legal research with a statutory regulatory approach, conceptual approach, sociological approach and case approach. Based on authority theory, benefit theory and legal protection theory as analytical tools, it can be understood that the tourism business in Bali cannot be separated from the presence of foreigners. Likewise, the control of coastal land in Bali is not free from control by foreigners, either through legal or illegal investment, by taking advantage of mutually beneficial cooperation between local residents, as well as with Ada Village officials on the basis of sharing profits. The Balinese people, who have a unique culture with Hindu religious nuances, in their daily lives and in running business in the tourism sector are always based on the "Tri Hita Karana Philosophy" which is manifested in behavior that maintains a harmonious relationship between "Man and God", Man and Nature, and “Humans with other Humans”. In this philosophy, the principle of good faith in investing is reflected, so that control of coastal land by foreigners for tourism business purposes is obliged to respect this very noble principle; However, in empirical facts it turns out that the control of coastal lands in Bali by foreigners under the guise of mutually beneficial cooperation actually tends to be detrimental to the use of traditional villages in implementing the religious values attached to these coastal lands. In the concept of mutually beneficial cooperation, it actually contains the bad intentions of foreigners to control Balinese land just to gain personal benefits at the expense of Bali's nature which is wrapped in mutually beneficial cooperation.

Abstract

The primary goal of this study is to explore the legal underpinnings of electronically registering fiduciary guarantees through public notaries, as well as to examine the legal implications of not electronically registering fiduciary guarantees through public notaries. This study employs normative legal research methodology and utilizes both statutory interpretation and legal conceptual analysis. This research highlights that the legal foundation for electronic registration of fiduciary guarantees is established by Minister of Law and Human Rights Regulation Number 9 of 2013, which addresses the Implementation of Electronic Fiduciary Registration, and Minister of Law and Human Rights Regulation Number 10 of 2013, which outlines the Procedures for Registering Fiduciary Security Electronically. If the fiduciary guarantee remains unregistered, it will result in legal consequences, as it will lack legal force. Although a fiduciary guarantee deed executed before a notary will be considered a notarial deed, it will not hold legal validity without registration. The notarial deed will have the same legal force as a private deed because the notary has not registered the fiduciary guarantee electronically.

Abstract

The aim of this research is to analyze the function of notaries in the establishment of individual companies after the Job Creation Law. The type of research used is normative legal research which focuses on primary, secondary and tertiary legal materials and uses a statutory and conceptual approach. The research results show that the notary does not have a function in making authentic deeds for the establishment of individual limited liability companies because the establishment of individual limited liability companies does not require an authentic deed and a statement of establishment that is registered electronically is sufficient. The notary will function when an individual company decides to change to a capital partnership where the notary can provide legal counseling and assess the validity of the documents. The establishment of an individual company is based on the provisions of PP No. 8 of 2021 by making a statement of establishment in Indonesian and registering it via the AHU Online portal. With the change in the function of notaries in making authentic deeds of company establishment, there are still concerns regarding the legal validity and security of the identity of founders, directors and shareholders during the electronic registration process. The government is advised to change the regulations by involving a notary to make authentic deeds and create new regulations that specifically contain provisions relating to individual limited companies.

Abstract

In the case of a land sale and purchase agreement carried out by both parties, it often creates problems when the agreement is canceled, in this case it is canceled or null and void because of the unfulfilled conditions of the validity of an agreement so that BPHTB that has been paid as a result of the agreement will be submitted for cancellation by the parties or intermediaries, in this case a notary. The research method used is empirical legal research. The analysis used is descriptive analysis, namely the data that has been collected is processed to formulate the research conclusions. Then the research data were analyzed in depth. Based on the results of the research that the legal consequence of the cancellation of the sale and purchase agreement against the BPHTB that has been paid is that it can be returned but must include a valid cancellation deed from a notary, this is used to be taken into consideration as the basis for returning the BPHTB that has been paid Then the BPHTB that has been paid will be returned. Then the basis for considering the return of BPHTB by the Denpasar City Regional Revenue Agency against the cancellation of the land sale and purchase agreement is the completeness of the documents attached to the application in accordance with the Mayor of Denpasar City No. 13 of 2020 as strong evidence that the agreement is legally accompanied by the reasons that have been in the cancellation of the sale and purchase agreement.

Abstract

Restructuring credit serves as a strategic avenue to ameliorate the financial status of businesses facing adversity, especially those entwined with creditor banks, to assist struggling debtors in meeting their obligations. This study delves into the restructuring initiatives undertaken by BPD Bali amid the Covid-19 pandemic, scrutinizing the associated legal implications. This research uses empirical legal research methodology, using a qualitative approach. The data collection techniques used in this research are in-depth interviews, observation, and document analysis. Data obtained from interviews, observations, and document analysis will be analyzed qualitatively. Qualitative analysis is carried out by interpreting the data in depth and thoroughly to produce meaningful conclusions. The result of this study show that the Bali Regional Development Bank's approach involved a meticulous assessment of debtors' integrity and reliability, prioritizing trustworthy customers for credit restructuring. Specifically, for loans ranging from fifty million to five hundred million, the bank adopted reconditioning and rescheduling techniques. The repercussions for debtors entailed a modification in the original agreement with the bank, resulting in the nullification of the initial credit terms initially committed to by both the creditor and debtor.

Abstract

Kredit merupakan salah satu layanan yang dapat diberikan oleh bank. Dalam pemberian kredit, kreditur memerlukan jaminan, dan objek jaminan memiliki peran yang sangat penting. Jaminan dapat berupa benda bergerak, seperti jaminan fidusia, atau benda tidak bergerak. Dalam hal jaminan fidusia, pendaftaran jaminan menjadi hal yang krusial untuk memberikan perlindungan hukum dan hak yang memadai kepada semua pihak terkait. Penelitian ini bertujuan untuk mengevaluasi perlindungan hukum bagi kreditur ketika debitur mengalami wanprestasi dalam perjanjian kredit dengan jaminan fidusia yang tidak didaftarkan. Pendekatan hukum empiris digunakan dalam penelitian ini. Perjanjian jaminan fidusia yang terjadi di PT. BPR Mertha Sedana merupakan perjanjian aksesoris dari perjanjian kredit utama. Ketika jaminan fidusia tidak didaftarkan, perlindungan hukum dapat dilakukan dengan cara preventif dan represif. Saran yang penulis berikan adalah dalam pelaksanaan perjanjian kredit dengan jaminan fidusia, pihak kreditur sebaiknya selalu mendaftarkan jaminan fidusia tersebut ke kantor pendaftaran fidusia. Dengan demikian, jika terjadi wanprestasi oleh debitur, pihak bank akan mendapatkan perlindungan hukum sesuai dengan undang-undang yang berlaku.

Abstract

Tujuan dari penelitian ini adalah untuk mengkaji status kekayaan maya dalam hukum kekayaan Indonesia dalam kaitannya dengan wujudnya sebagai benda berwujud maupun tidak berwujud. Hal ini disebabkan adanya aset virtual itu sendiri yang hanya ada di dunia virtual, namun aset virtual diperlakukan sama dengan objek di dunia nyata, dan game online saat ini bukan hanya sekedar game, tetapi mencakup fungsi jual beli virtual. Rumusan masalahnya adalah Bagaimana kedudukan Virtual Property dalam transaksi jual beli menurut hukum positif di Indonesia? Bagaimana keabsahan dan akibat hukum dari jual beli Virtual Property dengan transaksi Real Money Trading? Tujuan penelitian adalah untuk mengetahui dan mengidentifikasi kedudukan Virtual Property dalam transaksi jual beli menurut hukum positif di Indonesia dan keabsahan dan akibat hukum dari jual beli Virtual Property dengan transaksi Real Money Trading. Penelitian ini dilakukan dengan menggunakan ilmu hukum normatif, yaitu. hukum dan peraturan yang berlaku. Bahan penelitian dikumpulkan melalui kajian literatur, yang tentunya menimbulkan argumen-argumen baru. Hasil penelitian ini menunjukkan bahwa virtual property telah memenuhi semua unsur dari suatu benda tidak berwujud yaitu benda, bagian dari property, dapat dimiliki.

Abstract

Purpose:Electronic transaction certification is another form of authority a notary possesses, and more study still needs to be done on this matter. Hence, this research attempts to examine this matter in more depth. The rapid development of technology has given birth to convenience for human life, including in law, especially notaries. The existence of a cyber notary formulated in Article 15 paragraph (3) of the Notary Office Law gives a notary the authority to certify transactions electronically.Methodology:The method chosen for this research is normative legal research by analyzing and interpreting legal and social facts.Findings:This authority still needs clear guidelines, so it is necessary to have a formulation regarding its regulation.Implication:Based on the theory of authority, a notary has the right to certify transactions electronically which is included in attributive authority and is a derivative of the law. It is appropriate that the authority to certify electronic transactions is further regulated so that later it will facilitate the work of notaries and follow utilitarian theory, where good law can provide the broadest possible benefits for society.

Abstract

The Consumer Protection Act 0.8 of 1999 contains provisions regarding the rights and obligations that consumers and business actors have. For example, consumers who have not received legal justice in standard agreements that create business actors, seeing the phenomenon that occurs, namely agreements made by parking business actors for consumers who use parking services, basically to meet the needs of a significant number of consumers, to make it easier for parking business actors, agreements that made for consumers who use parking services to be printed in bulk in the form of standard clauses contained in parking tickets that are made unilaterally. However, this authority contains the potential for fraud for parking business actors through the existence of a clause that is not permitted. The contents of this clause are based on the UUPK which is a clause that contains the loading of the responsibility of the businessperson for the consumer which is contained under Article 18 paragraph 1. From this it can be said that there are still many parking business actors who, in stipulating standard clause agreements in the form of parking tickets, violate the provisions of the Protection Act. Consumers are related to the discrepancy of the clause in UUPK to obtain contractual justice for consumers. With the existence of an agreement that uses the standard clause it is not allowed so that the legal consequences according to the explanation of Article 18 paragraph 3 UUPK are null and void.
