Peredaran kosmetik ilegal melalui sistem perdagangan elektronik (e-commerce) telah memunculkan permasalahan serius terkait perlindungan konsumen dan pengawasan standar keamanan kesehatan di Indonesia. Tantangan hukum muncul ketika produk yang tidak memenuhi standar BPOM, seperti produk yang mengandung merkuri atau tanpa izin edar, dapat dengan mudah diakses oleh masyarakat melalui platform digital. Penelitian ini bertujuan untuk menganalisis pengaturan hukum mengenai syarat izin edar produk kosmetik di Indonesia serta mengkaji bentuk pertanggungjawaban hukum bagi pelaku usaha dan penyedia platform digital atas peredaran kosmetik yang tidak memenuhi standar BPOM di e-commerce. Jenis penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan kasus. Hasil penelitian menunjukkan pengaturan izin edar kosmetik bersifat imperatif berdasarkan Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan dan Peraturan BPOM guna menjamin keamanan, mutu, dan kemanfaatan produk. Pertanggungjawaban hukum dalam ekosistem digital bersifat berlapis, di mana pelaku usaha bertanggung jawab secara mutlak atas kerugian konsumen, sementara penyedia platform digital memikul tanggung jawab hukum apabila lalai dalam melakukan pengawasan dan kurasi terhadap konten produk ilegal di sistem elektroniknya.

The marriage of nyeburin changes the position of women into purusa and men into pradana. Then in terms of inheritance, the priority in the nyeburin marriage is the woman, but the status of the man who becomes pradana is questioned when nyeburin marriage ends and the status of the man is returned to his family of origin. This study aims to analyze the inheritance rights of men who do nyeburin’s marriage on inherited land in their origin family and to analyze the implications of inheritance rights of men who do nyeburin’s marriage in right and obligations of origin family. The research method used is normative legal research. In addition, the data collection technique used is the library study technique. The results of this study revealed that (1) a man who does a nyeburin marriage will lose his right to inherit in his family of origin because of a change in his status to pradana in his wife's family. A man who does a nyeburin marriage will be considered to have left kedaton so that he has the same position as a woman who marries out. (2) Burden marriage has implications for the position of the husband so that here the husband follows the wife. The rights and obligations as husband and wife are still the same as in a normal marriage, only in a marriage where the wife's position is higher than that of the husband.

The Balinese customary law community recognizes kepurusa system; the status of boys is steady, while the status of girls changes, because women after marriage follow their husbands. On that basis, daughters in kepurusa system are never traced or taken into account in inheritance. The purpose of this study is to examine the legal status and the legal position of mulih daha woman in Penarungan Village, Mengwi, Badung, Bali. The method used in this study is an empirical method. Furthermore, this study was carried out by means of field studies, namely by conducting field observations and interviews with respondents and informants. Based on the analysis, the results of this study showed that the legal status of mulih daha woman is received through a procedure with acceptance by the family on a scale and a niskala ceremony is carried out, namely arranging piuning or notification to the ancestral gods that with a divorce from her husband, her daughter has returned to her parents and ask to be accepted back as a damuh or part of her parents' ancestral family so that she can be held accountable again one day when the woman experiences something related to banjar. The legal position of mulih daha women in inheritance is related to the kinship system adopted by the Hindu community in Bali, namely the patrilineal system (fatherhood) where only boys have the right to inherit while girls have no right to inherit but girls can only enjoy the property.

This study aims to find out the potential conflicts on Land Deeds made by Notaries and to find out Notary efforts in making Land Deeds to minimize potential land conflicts. The method used in this study is the normative legal research method. In addition, the statute approach, conceptual approach, and analytical approach are the approach used in this study. The results of this study showed that (1) potential conflicts on Land Deeds made by Notaries are due to Notaries in carrying out their positions tend to be in a dilemma which on the one hand must comply with legal provisions with a normative nature, and on the other hand, empirical facts are so complex and often cannot be handled and accommodated by regulations that tend to be rigid. This is because when carrying out its positions, the Notary must serve the client, while the client needs service without being too concerned with the regulations that bind the Notary. (2) Notary efforts in issuing Land Deeds to minimize the potential for Land Conflicts are required to examine the completeness of documents by applying the precautionary principle to protect the real owner and reduce conflicts in the land sector. The application of the precautionary principle of the Notary in producing the PPJB deed and the Lease Agreement deed to registered land rights to be registered at the Land Office must start from the stage before the deed, the stage at which the deed is made and the reading of the deed.

This study aims to determine and analyze the existence and implementation of postnuptial agreement deeds after the Constitutional Court Decision Number 69 / PUU-XIII / 2015 (hereinafter referred to as the MK 69/2015) in Denpasar City. In essence, the Constitutional Court Decision 69/2015 provides an opportunity that a marriage agreement can be made during the marriage (postnuptial agreement). In order to ensure that the value of justice can actually be realized, it is necessary to study the implementation of the postnuptial agreement deed drafting. Based on this, two problems can be formulated as follows: (1) how is the existence of the postnuptial agreement deed after the Constitutional Court Decision 69/2015 in Denpasar City ?; (2) how is the implementation of the postnuptial agreement deed after the Constitutional Court Decision 69/2015 in Denpasar City? This research is an empirical legal research with descriptive-qualitative characteristics. The results showed that the making of the postnuptial agreement deed by a notary after the MK 69/2015 decision in the Denpasar City area proved to exist and was first made in 2017. The implementation of the postnuptial agreement deed by a notary after the MK 69/2015 decision in the Denpasar City area has not yet been implemented effective, for 2 reasons, namely differences in views on the calculation of the time frame for the application of postnuptial agreement deeds in the internal notary profession and a lack of understanding of the urgency of marriage agreements among people in the city of Denpasar.

Pelestarian lingkungan kawasan wisata alam oleh Kesatuan Pelestarian Hutan Konservasi Taman Nasional Bali Barat saat ini telah dilakukan dengan melibatkan berbagai pihak (mitra), salah satunya adalah kerjasama dengan Pemerintah Desa hingga kelompok masyarakat. Keterlibatan mitra dalam hal ini adalah Pemerintah desa yang disekitarnya terdapat Desa Penyangga pada Taman Nasional Bali Barat, mengakibatkan ketertarikan untuk mengajukan kerjasama dengan kesatuan pelestarian hutan Konservasi, yang berpotensi meningkatkan nilai keberadaan hutan dan fungsi pemberdayaan sosial, tetapi juga meningkatkan risiko kerusakan fungsi hutan akibat perilaku oportunitas mitra. Hubungan antara kesatuan pelestarian hutan Konservasi Taman Nasional Bali Barat dengan mitra pengelola dalam hal ini Pemerintah Desa, dapat dipandang sebagai sebuah hubungan kontrak antara Taman Nasional Bali Barat dan mitra yaitu Pemerintah Desa. Dalam hubungan antara Taman Nasional Bali Barat dan mitra dalam hal ini Pemerintah Desa tersebut dapat muncul berbagai permasalahan seperti ketimpangan informasi, hingga pelanggaran kesepakatan yang telah dibuat. Identifikasi atas biaya pengawasan yang dikeluarkan oleh Taman Nasional Bali Barat juga menjadi aspek penting dalam hubungan kontrak dengan mitra. Tujuan utama dalam penelitian ini adalah untuk menentukan hubungan usaha kontrak kemitraan yang optimal dalam pemanfaatan wisata alam Kesatuan Pelestarian Hutan Konservasi Taman Nasional Bali Barat, yang dapat dicapai dengan menganalisis kebijakan pemerintah desa yang mempengaruhi hubungan Taman Nasional Bali Barat, serta mengidentifikasi struktur hubungan kontrak dan menganalisis peran desa penyangga Taman Nasional Bali Barat. Berdasarkan hasil penelitian ini diharapkan dapat menjadi bahan pertimbangan bagi mitra dan Taman Nasional Bali Barat dalam menyusun kontrak kerjasama Konservasi, terutama pada kegiatan peran desa penyangga dalam pelestarian lingkungan wisata alam pada kesatuan pelestarian hutan Konservasi di Taman Nasional Bali Barat. Dalam hal ini Bendesa adat berperan mengawasi prilaku masyarakatnya agar tidak terjadi pelanggaran serta beperan manjaga harmonisasi keseimbangan sesuai konsep Tri Hita Karana, yaitu memprioritaskan keseimbangan hubungan antara manusia dengan penciptanya, hubungan manusia dengan manusia dan hubungan manusia dengan alam. Adapun luaran jurnal ilmiah yang menjadi sasaran adalah artikel yang di publikasikan dalam Jurnal Nasional Terakreditasi Kerta Wicaksana Fakultas Hukum, dan Laporan Penelitian Tahun 2022, serta HKI.

Perjanjian perkawinan atau perjanjian pranikah yang diumumkan Notaris melalui media cetak merupakan pelanggaran kode etik Notaris, karena Notaris merupakan pejabat umum membuat akta otentik dibutuhkan masyarakat. Diperlukan tanggung jawab terhadap jabatannya, sehingga diperlukan lembaga kenotariatan mengatur perilaku profesi Notaris. Pada hakekatnya Kode Etik Notaris merupakan penjabaran lebih lanjut Undang-Undang Nomor 2 Tahun 2014 Tentang Jabatan Notaris, mengingat Notaris dalam melaksanakan jabatannya tunduk dan mentaati ketentuan Undang-Undang mengatur jabatannya, termasuk wajib menerapkan prinsip tata kelola perusahaan baik dengan menerapkan prinsip pengelolaan lingkungan hidup seperti diatur dalam Undang-Undang Nomor 32 Tahun 2009 tentang perlindungan dan pengelolaan lingkungan hidup. Tujuan penelitian ini adalah untuk mengetahui Apakah perjanjian perkawinan yang diumumkan oleh Notaris melalui media cetak merupakan pelanggaran kode etik seorang Notaris. Metode yang di gunakan dalam penelitian ini adalah metode penelitian adalah cara-cara berpikir dan berbuat, yang dipersiapkan dengan baik untuk mengadakan penelitian dan guna mencapai tujuan. Berdasarkan hasil penelitian hukum perjanjian perkawinan yang diumumkan melalui media cetak oleh Notaris merupakan perbuatan melanggar kode etik Notaris yang diatur dalam Undang-Undang Nomor 2 Tahun 2014 tentang Jabatan Notaris, tercantum dalam kode etik organisasi Ikatan Notaris Indonesia (INI) merupakan satu-satunya organisasi Notaris berbadan hukum sesuai Undang-Undang Nomor 2 Tahun 2014 tentang Jabatan Notaris. Artinya seluruh Notaris wajib tunduk kepada Kode Etik Notaris, adapun sanksi dijatuhkan Organisasi Ikatan Notaris Indonesia terhadap Notaris melanggar kode etik berupa : teguran, peringatan, schorshing (pemberhentian sementara), dan Onzetfing (pemecatan) yang ditugaskan Dewan Pengawas Notaris untuk menegakkan sanksi.
The Legal Consequences of Debtor Transfer Carried out under the Agreement, House Ownership Loans

Mortgage agreements often find cases, including the transfer of rights to the mortgage object, namely the house, which is carried out under the hands of the debtor to another party before the mortgage is paid off without the knowledge of the bank. This research aims to examine the validity of the house sale and purchase agreement on house ownership loans (KPR), through the debtor transfer process and to examine the legal consequences of the transfer of debtors carried out under the hands of a mortgage agreement, and also to examine the efforts have been taken by the bank to overcome it. This research used normative legal research. The results of this research showed that the transfer of debtors in general can occur with the knowledge of the bank and without the knowledge of the bank (under the hands). It can be concluded that the debtor transfer process is a form of sale and purchase agreement made between the old debtor, who is still bound by the bank credit agreement, and the new debtor. The process of transferring debtors legally must be carried out between three parties, namely the bank, the old debtor and the new debtor. The debtor transfer process must meet the requirements for a valid credit agreement, which is based on Article 1320 of the Civil Code. If there is a transfer of the debtor without the knowledge of the bank, legal remedies must be taken by the new debtor by filing a lawsuit against the old debtor and the bank to the District Court. This decision from the District Court which has permanent legal force (inkracht) is evidence of the existence of an agreement between the old debtor and the new debtor, and can be the basis for the bank to submit certificates and other documents to the new debtor. In order to avoid problems in the future, people who want to transfer debtors to mortgages can do so after obtaining approval from the bank as creditor.

The purpose of this study is to examine and describe the urgency of establishing a land bank and the implications of the authority of a land bank in realizing land acquisition for the public interest that is equitable in Indonesia. The method used in this research is normative legal research and the approaches used are the legislative approach, the historical approach, the comparative approach and the conceptual approach. The results of this research indicated that land is driven by Indonesia's urgency to the problem of very large land needs, which will later be used as a forum for investment activities. The implication of the Land Bank's Authority in the Job Creation Act and the government regulation of land banks raises several problems, namely, firstly, overlapping authorities with other land institutions. Second, the strengthening of Land Management Rights related to the authority of the land bank is intended to provide facilities and/or licensing services more aimed at increasing investment than as much as possible for the prosperity of the people, this has a very broad impact including 1) Causing an increase in the number of Agrarian Conflicts; 2) Bringing back the principle of Domein Verklaring; 3) Weakening of the existence of customary law communities and their ulayat lands; and 4) the overlapping authority of the land agency

In the case of a land sale and purchase agreement carried out by both parties, it often creates problems when the agreement is canceled, in this case it is canceled or null and void because of the unfulfilled conditions of the validity of an agreement so that BPHTB that has been paid as a result of the agreement will be submitted for cancellation by the parties or intermediaries, in this case a notary. The research method used is empirical legal research. The analysis used is descriptive analysis, namely the data that has been collected is processed to formulate the research conclusions. Then the research data were analyzed in depth. Based on the results of the research that the legal consequence of the cancellation of the sale and purchase agreement against the BPHTB that has been paid is that it can be returned but must include a valid cancellation deed from a notary, this is used to be taken into consideration as the basis for returning the BPHTB that has been paid Then the BPHTB that has been paid will be returned. Then the basis for considering the return of BPHTB by the Denpasar City Regional Revenue Agency against the cancellation of the land sale and purchase agreement is the completeness of the documents attached to the application in accordance with the Mayor of Denpasar City No. 13 of 2020 as strong evidence that the agreement is legally accompanied by the reasons that have been in the cancellation of the sale and purchase agreement.
