Abstract

This study aims to determine and analyze the existence and implementation of postnuptial agreement deeds after the Constitutional Court Decision Number 69 / PUU-XIII / 2015 (hereinafter referred to as the MK 69/2015) in Denpasar City. In essence, the Constitutional Court Decision 69/2015 provides an opportunity that a marriage agreement can be made during the marriage (postnuptial agreement). In order to ensure that the value of justice can actually be realized, it is necessary to study the implementation of the postnuptial agreement deed drafting. Based on this, two problems can be formulated as follows: (1) how is the existence of the postnuptial agreement deed after the Constitutional Court Decision 69/2015 in Denpasar City ?; (2) how is the implementation of the postnuptial agreement deed after the Constitutional Court Decision 69/2015 in Denpasar City? This research is an empirical legal research with descriptive-qualitative characteristics. The results showed that the making of the postnuptial agreement deed by a notary after the MK 69/2015 decision in the Denpasar City area proved to exist and was first made in 2017. The implementation of the postnuptial agreement deed by a notary after the MK 69/2015 decision in the Denpasar City area has not yet been implemented effective, for 2 reasons, namely differences in views on the calculation of the time frame for the application of postnuptial agreement deeds in the internal notary profession and a lack of understanding of the urgency of marriage agreements among people in the city of Denpasar.

Abstract

The Balinese indigenous people adopt the patrilineal family system, or paternity, or better known in the Balinese indigenous people as kepurusa or purusa. In accordance with the general principles adopted in the patrilineal family system, at least three basic principles are adopted in the purusa family system, among others the lineage traced from the line of man or father, in a woman's marriage is released from her legal relationship with her original family, as a result of marriage is the formation of a core family that ideally consists of father, mother and child. Whereas if a boy from a family that has only one son, will have a marriage with a daughter who comes from a family that has only one daughter, then there will be a debate between the family about the form which marriage to choose. If you choose the usual form of marriage, then the woman's family will definitely object, because the family will later become divorced. Similarly, on the contrary, if you choose the form of nyeburin marriage, then the family of the male party will object because it will also cause a state of hereditary rupture, or so-called ceput or putung. Therefore, women and men who are the only children in the family can have alternative marriages outside of the two forms of marriage above. The marriage is a double state marriage or in this case the husband does not enter the wife's family, and the wife will not enter the husband's family. Of course, it will bring different legal consequences from ordinary marriage or marriage to the marriage property, the position of the child, and his inheritance.In order to avoid a putung condition, a legal breakthrough is needed other than the usual form of marriage and the intermarriage, namely the negen dadua form of marriage. In Semarapura Kaja Village, there are several cases like this. For this reason, assistance is carried out in the context of increasing awareness and knowledge of the law of the inheritance rights of children in negen dadua marriage.

Abstract

The tourism business is the mainstay of the Small Island of Nusa Penida as an inseparable part of the Island of the Gods, Bali. The existence of the COVID-19 Pandemic has made Bali tourism and is no exception also an impact on the tourism business in Nusa Penida. The people's economy in Nusa Penida experienced very severe shocks and even eroded almost all economic sectors; including the impact on the financial services sector owned by a traditional village called The village credit institution (The Village Credit Institution). The aim research is to know how are the efforts to save problem loans carried out by the Management of The Village Credit Institution Desa Adat Ped in the post-Covid-19 pandemic era. This legal issue will be studied using a normative legal approach complemented by a sociological approach carried out by The Village Credit INSTITUTION administrators throughout the Nusa Penida sub-district, Klungkung regency - Bali. Normative legal theory is concerned with the ends and justifications for the law as a whole and for particular legal rules. The result shows that Through Restructuring, namely efforts in the form of changing the terms of the credit agreement or converting all or part of the credit into company equity, which is carried out with or without Rescheduling and/or reconditioning.

Abstract

Pelestarian lingkungan kawasan wisata alam oleh Kesatuan Pelestarian Hutan Konservasi Taman Nasional Bali Barat saat ini telah dilakukan dengan melibatkan berbagai pihak (mitra), salah satunya adalah kerjasama dengan Pemerintah Desa hingga kelompok masyarakat. Keterlibatan mitra dalam hal ini adalah Pemerintah desa yang disekitarnya terdapat Desa Penyangga pada Taman Nasional Bali Barat, mengakibatkan ketertarikan untuk mengajukan kerjasama dengan kesatuan pelestarian hutan Konservasi, yang berpotensi meningkatkan nilai keberadaan hutan dan fungsi pemberdayaan sosial, tetapi juga meningkatkan risiko kerusakan fungsi hutan akibat perilaku oportunitas mitra. Hubungan antara kesatuan pelestarian hutan Konservasi Taman Nasional Bali Barat dengan mitra pengelola dalam hal ini Pemerintah Desa, dapat dipandang sebagai sebuah hubungan kontrak antara Taman Nasional Bali Barat dan mitra yaitu Pemerintah Desa. Dalam hubungan antara Taman Nasional Bali Barat dan mitra dalam hal ini Pemerintah Desa tersebut dapat muncul berbagai permasalahan seperti ketimpangan informasi, hingga pelanggaran kesepakatan yang telah dibuat. Identifikasi atas biaya pengawasan yang dikeluarkan oleh Taman Nasional Bali Barat juga menjadi aspek penting dalam hubungan kontrak dengan mitra. Tujuan utama dalam penelitian ini adalah untuk menentukan hubungan usaha kontrak kemitraan yang optimal dalam pemanfaatan wisata alam Kesatuan Pelestarian Hutan Konservasi Taman Nasional Bali Barat, yang dapat dicapai dengan menganalisis kebijakan pemerintah desa yang mempengaruhi hubungan Taman Nasional Bali Barat, serta mengidentifikasi struktur hubungan kontrak dan menganalisis peran desa penyangga Taman Nasional Bali Barat. Berdasarkan hasil penelitian ini diharapkan dapat menjadi bahan pertimbangan bagi mitra dan Taman Nasional Bali Barat dalam menyusun kontrak kerjasama Konservasi, terutama pada kegiatan peran desa penyangga dalam pelestarian lingkungan wisata alam pada kesatuan pelestarian hutan Konservasi di Taman Nasional Bali Barat. Dalam hal ini Bendesa adat berperan mengawasi prilaku masyarakatnya agar tidak terjadi pelanggaran serta beperan manjaga harmonisasi keseimbangan sesuai konsep Tri Hita Karana, yaitu memprioritaskan keseimbangan hubungan antara manusia dengan penciptanya, hubungan manusia dengan manusia dan hubungan manusia dengan alam. Adapun luaran jurnal ilmiah yang menjadi sasaran adalah artikel yang di publikasikan dalam Jurnal Nasional Terakreditasi Kerta Wicaksana Fakultas Hukum, dan Laporan Penelitian Tahun 2022, serta HKI.

Abstract

Perjanjian perkawinan atau perjanjian pranikah yang diumumkan Notaris melalui media cetak merupakan pelanggaran kode etik Notaris, karena Notaris merupakan pejabat umum membuat akta otentik dibutuhkan masyarakat. Diperlukan tanggung jawab terhadap jabatannya, sehingga diperlukan lembaga kenotariatan mengatur perilaku profesi Notaris. Pada hakekatnya Kode Etik Notaris merupakan penjabaran lebih lanjut Undang-Undang Nomor 2 Tahun 2014 Tentang Jabatan Notaris, mengingat Notaris dalam melaksanakan jabatannya tunduk dan mentaati ketentuan Undang-Undang mengatur jabatannya, termasuk wajib menerapkan prinsip tata kelola perusahaan baik dengan menerapkan prinsip pengelolaan lingkungan hidup seperti diatur dalam Undang-Undang Nomor 32 Tahun 2009 tentang perlindungan dan pengelolaan lingkungan hidup. Tujuan penelitian ini adalah untuk mengetahui Apakah perjanjian perkawinan yang diumumkan oleh Notaris melalui media cetak merupakan pelanggaran kode etik seorang Notaris. Metode yang di gunakan dalam penelitian ini adalah metode penelitian adalah cara-cara berpikir dan berbuat, yang dipersiapkan dengan baik untuk mengadakan penelitian dan guna mencapai tujuan. Berdasarkan hasil penelitian hukum perjanjian perkawinan yang diumumkan melalui media cetak oleh Notaris merupakan perbuatan melanggar kode etik Notaris yang diatur dalam Undang-Undang Nomor 2 Tahun 2014 tentang Jabatan Notaris, tercantum dalam kode etik organisasi Ikatan Notaris Indonesia (INI) merupakan satu-satunya organisasi Notaris berbadan hukum sesuai Undang-Undang Nomor 2 Tahun 2014 tentang Jabatan Notaris. Artinya seluruh Notaris wajib tunduk kepada Kode Etik Notaris, adapun sanksi dijatuhkan Organisasi Ikatan Notaris Indonesia terhadap Notaris melanggar kode etik berupa : teguran, peringatan, schorshing (pemberhentian sementara), dan Onzetfing (pemecatan) yang ditugaskan Dewan Pengawas Notaris untuk menegakkan sanksi.

Abstract

Notary Deed Signing is not in the notary’s office, even though the act is at risk of violating the rules of the notary position law and notary code of ethics, but it is still carried out by certain notaries. This type of research is normative legal research. With normative juridical methods. Legal materials consist of primary, secondary and tertiary legal materials. The analysis method uses the description technique, construction technique, and systematic technique. The validity of a deed not signed before a notary, the deed is only valid as an agreement, where a valid agreement is an agreement that has fulfilled the legal requirements of an agreement such as an agreement, the ability of the parties, the object of the agreement, and the agreement made is not contrary to the law applicable. The validity of the deed is invalid, because in signing the deed that was not performed before a notary, the authentic deed did not fulfill the formal requirements to become an authentic deed as regulated in Article 16 paragraph (1) letter m of Law Number 2 of 2014 concerning Amendment to the Law Number 30 of 2004 concerning Notary Position. Where in this provision that the Notary must be physically present and sign the deed in front of the parties, witnesses, and the Notary himself. Notary Deed that is not signed by the registrar before a notary public and signed outside the Notary’s office, even though on the grounds that one of the registrants cannot be present at the signing of the deed by the tappers, and witnessed by witnesses and Notaries, resulting in the degradation of the authentic deed becomes the only deed has a proof of deed under the deed. In Act Number 2 of 2014 concerning amendments to Act Number 30 of 2004 concerning Notary Position, no regulation is found concerning sanctions against Notaries that are significant for violations of Article 16 paragraph (1) letter m of Act Number 2 of 2014 concerning amendments to Law Number 30 of 2004 concerning Notary Position.

Abstract

There is a need to investigate the regulation of legal accountability of a Sole Director who is also the founder of the company in a micro and small Limited Liability company based on Article 153 letter J of the Job Creation Law, because of the possibility of an ill-intentioned Director trying to protect his/her personal assets and assuming liability only for the shares he owns. Based on the aforementioned background, the problems in this study can be formulated as follow: 1. How is the accountability of a Sole Directors in a micro or small Limited Liability company regulated? and 2. What is the form of legal accountability for the sole Director in a micro and small Limited Liability company? The type of legal research used in this study is normative juridical research. The form of legal liability of a Sole Director in a micro or small Limited Liability company is closely linked to the principle of limited liability of the Board of Directors. If the requirement of having 2 (two) persons is not met, it will result in the limited accountability of the Limited Liability company becoming unlimited accountability. Unlimited accountability means that all legal actions and losses of the Limited Liability company become the personal liability of the founder or shareholder.

Abstract

One model of tourism development that is in line with alternative tourism is community-based tourism as a pattern that is believed to provide economic benefits and equity, environmental preservation, local culture preservation, social empowerment, community empowerment. Community-based tourism is a tourism development with a high level of local community involvement and can be accounted for from the socio-cultural and environmental aspects. So far, there are no clear rules that explicitly regulate the arrangement of profit sharing, especially in the field of agro-tourism. According to Article 1320 of the KUHPerdata, an agreement is valid if it meets the following four conditions: Agree of those who bind themselves, The ability to make an engagement, a certain thing, a lawful cause—referring to the Legal Principles of Agreement as contained in the KUHPerdata (KUHPerdata), namely Personality Principles (Article 1315 jo 1340 KUHPerdata), Consensualotas Principles (Article 1320 KUHPerdata), Freedom of Contract Principles (Article 1338 paragraph (1) KUHPerdata). In the current reformation era, the legal development strategy is directed towards responsive law characterized by the large role of judicial institutions and the broad participation of social groups or the participation of individuals in society to determine the direction of legal development, resulting in the formation of clear legislation. Furthermore, provide legal certainty in making agreements for agricultural land products related to agro-tourism with environmental insight.

Abstract

Since the establishment of the Covid-19 virus as a pandemic, it has brought a huge downturn in the national and global economy. Various efforts have been made by the Indonesian government to increase economic growth so that Indonesia can avoid the economic crisis. The Indonesian government in its various policies has created pro-community programs to accelerate economic recovery. The aim is to provide convenience in the establishment of a limited liability company which originally had to be established by at least two founders based on an agreement, so that the establishment of a limited liability company called a limited liability company can now be established by one person. by simply making a statement. The technique used in this research is a systematic and interpretive descriptive-analytical technique, which describes the strengths and weaknesses of a legal product being analyzed, and tries to find a relationship between the formulation of a legal concept or legal argument between the articles contained. in the same legal product. Based on the research results, the government encourages the development of micro and small businesses as an effort to encourage the people's economy which can accelerate the recovery of the national economy with the enactment of Law Number 11 of 2020 concerning Job Creation.

Abstract

This article analyzes the "Implications of Coastal Land Tenure By Foreigners in the Tourism Business." The focus of the study in this paper is the legal aspects of coastal land control by foreigners in Bali to benefit the tourism business. In analyzing these legal issues, the author uses empirical legal research methods with a statutory approach, a conceptual approach, a sociological approach, and a case approach. Based on the theory of authority, the theory of expediency, and the theory of legal protection as an analytical knife, the tourism business in Bali cannot be separated from the existence of foreigners. Similarly, the control of coastal land in Bali-pun does not escape the control of foreigners, both through legal investment and some illegal, by utilizing mutually beneficial cooperation between residents and with prajuru Indigenous Villages on the basis of sharing profits. Balinese people who have a unique culture with nuances of Hinduism in daily life and in running a business in the field of tourism are always based on the "Tri Hita Karana Philosophy" which is manifested in behavior that significantly maintains a harmonious relationship between "Man with God" Man with Nature, and "Humans with other Humans." It is in this philosophy that the principle of good faith in investing is reflected so that the possession of coastal lands by foreigners for the benefit of the tourism business is obliged to respect this very noble principle; however, in empirical facts, it turns out that the control of coastal lands in Bali by foreigners under the guise of mutually beneficial cooperation is likely to harm the use of indigenous villages in carrying out the religious values attached to these coastal lands. So that in this case, the concept of mutually beneficial cooperation is contained in the lousy faith of foreigners to control the land of Bali to get personal benefits at the expense of Balinese nature wrapped in mutually beneficial Works.
