Abstract

Sebagai sebuah lembaga pendidikan tinggi, Universitas Warmadewa harus dapat dipastikan selalu taat melaksanakan Tridharma Perguruan Tinggi sesuai dengan visi misi yang telah ditentukan. Kini setiap dosen didorong untuk bisa mengemas kegiatan pengabdian kepada masyarakat baik secara berkelompok maupun perorangan yang nantinya menunjukkan kepedulian terhadap masyarakat. Kegiatan pengabdian kepada masyarakat dapat dilakukan dengan melakukan pencerahan dengan cara memberikan penyuluhan dan konsultasi hukum kepada masyarakat dalam berbagai bidang kehidupan di bidang perekonomian. Salah satu hal yang patut dicermati adalah keberadaan perjanjian kredit, dimana diharapkan setiap badan usaha koperasi wajib memiliki suatu perjanjian dalam hal ini perjanjian kredit.Perjanjian yang dibuat biasanya merupakan hal-hal prinsip saja, dengan maksud agar sesuai dengan peraturan perundang-undangan dalam hal ini KUH Perdata. Hal-hal lain akan dimuat dalam suatu perjanjian yang lebih mudah untuk diubah sesuai perkembangan perekonomian. Pada akhirnya program ini diharapkan mampu memberikan pemahaman dan solusi kepada badan usaha koperasi khususnya Koperasi Simpan Pinjam Tridana Mandiri Denpasar, dapat tetap eksis sebagai bagian dari badan usaha yang sedang berkembang keberadaannya. Ketika terjadi kasus nasabah tidak bayar kewajiban yang disebut wanprestasi, proses penyelesaian sengketa diupayakan dengan cara musyawarah atau kekeluargaan.

Abstract

The rapid advancement of information and communication technology has made it easier for some unscrupulous business actors to do online business illegally in cryptocurrency, cryptocurrency itself is a digital asset on the internet. The problem that can be raised is, how is the legal protection for investors against illegal online businesses? And what are the legal consequences for business actors who do illegal online business? This thesis uses a normative legal research method and uses a conceptual approach and legislation. After conducting research, it is known that cyber crime is difficult to overcome by the government which only relies on conventional positive law. There are two forms of legal protection for investors, namely, preventive and repressive legal protection. Based on the Consumer Protection Act, investors can file a class action lawsuit against business actors who conduct online business illegally, especially in the case of cryptocurrencies. The legal consequences for business actors who conduct online business illegally in cryptocurrencies are contained in Bappebti regulation 5/2019, precisely in Article 21 Paragraph 2.

Abstract

Gubug Belodan Village is located in the scope of the Tabanan Regency area with a strategic location on the edge of the city, has a high lure to be used as a residential or commercial area which certainly greatly affects the agricultural land in Gubug Belodan Hamlet where the land used is finally in a shifting condition. Based on this, how is the granting of building approval (PBG) in the green belt area? And how is the policy of granting building approval (PBG) in the green belt of Gubug Belodan Hamlet, Tabanan Regency? This research uses empirical legal research. The green line, which is a public infrastructure and facilities, the establishment of buildings on the green line must have PBG based on Law No. 28/2002 on Building. Regarding the green belt development policy, it is also explained in the Tabanan Regency Regional Regulation No. 6/2014 concerning the Green Belt Area which provides an understanding that the establishment of buildings is not allowed permanently or not which is contrary to the functional and use of the defense area concerned in the green belt area, except with the permission of the Regent with the recommendation of the DPRD.

Abstract

A will or testament is a document that records a person's wishes regarding what they want to happen after death, and the document can be revoked by the maker in accordance with the provisions of Article 875 of the Civil Code. As a notary, his/her duty is to create an official document that has greater legal force than a document created without the signature of an authorized party. In creating a testament deed, a notary has specific responsibilities related to reporting the will as stipulated in Article 16 paragraph (1) letters i and j of UUJN-P. However, if a notary does not register a deed of testament, the consequence is the downgrading of the document's status to an underhand deed. This could potentially lead to the invalidation or invalidity of the document as evidence made by the notary. This research uses a normative method with a statutory approach and concludes that the non-registration and online reporting of a deed of testament to the Central Register of Testaments by a notary can result in the downgrading of its status to an underhand deed, threatening the validity of the document created by the notary.

Abstract

As a higher education institution, Warmadewa University must ensure that it always adheres to the Tridharma of Higher Education in accordance with the predetermined vision and mission. Now every lecturer is encouraged to be able to package community service activities both in groups and individually which will later show concern for the community. Community service activities can be carried out by providing enlightenment by providing legal counseling and consultation to the community in various fields of life in the economic field. One thing that should be observed is the existence of a credit agreement, where it is expected that every cooperative business entity is required to have an agreement in this case a credit agreement. Civil Code. Other matters will be contained in an agreement that is easier to change according to economic developments. In the end, this program is expected to be able to provide understanding and solutions to cooperative business entities, especially the Tridana Mandiri Denpasar Savings and Loans Cooperative, to be able to continue to exist as part of a business entity that is developing its existence. When a customer does not pay an obligation, which is called a default, the dispute resolution process is attempted by way of deliberation or kinship.

Abstract

Empowerment, preservation and legal protection of Dewi Ratih Balinese Dance Studio in Banjar Busana Kaja, Baha Village, Mengwi District, Badung Regency are very important to maintain the existence of an art studio and keep their work from being claimed by other parties. With the issuance of the operational permit for Dewi Ratih Busana Kaja Dance Studio in 2019, therefore through the community partnership program, the PKM Team of the Faculty of Law, Warmadewa University Denpasar provided assistance in drafting a cooperation agreement with other parties. This aims to have authentic evidence that the Balinese dance studio Dewi Ratih is officially an association of organizations with legal status. In addition, as a legal entity, Dewi Ratih Balinese dance studio in Banjar Busana Kaja has rights and obligations as a legal subject, which will be entitled to receive cooperation with other parties and grant programs from both private and government parties.

Abstract

This study examines the legal validity of electronically signed supporting documents (warkah) in notarial deeds within the framework of Indonesian notarial and cyber law. The rapid development of information technology and the increasing use of electronic signatures in legal transactions have created legal uncertainty due to the lack of synchronization between the Notary Office Law (UUJN-P) and the Information and Electronic Transactions Law (UU ITE). The research aims to analyze the validity of electronically signed warkah in notarial practice and to formulate future regulatory frameworks to support the implementation of cyber notary services in Indonesia. This study employed a mixed-method approach combining normative juridical analysis and empirical legal research. Normative analysis was conducted through the examination of legislation, legal doctrines, and legal theories, while empirical data were collected through interviews, observations, and documentation involving practicing notaries in Badung Regency. The findings reveal that electronically signed warkah have not yet obtained full legal recognition under the current UUJN-P because notarial protocols still require the physical binding of documents. This condition creates a legal antinomy between conventional notarial regulations and electronic transaction laws, potentially weakening the evidentiary value of authentic deeds and degrading them into private deeds. The study concludes that legal harmonization between the UUJN-P, UU ITE, Archives Law, and Stamp Duty Law is urgently required to establish a secure and legally certain cyber notary framework. Future regulations should recognize certified electronic signatures and electronic protocols as integral components of modern notarial services.

Abstract

Pembangunan ekonomi nasional tidak terlepas dari peran investasi, termasuk penanaman modal asing yang umumnya dilakukan melalui Perseroan Terbatas Penanaman Modal Asing (PT PMA). Penyetoran modal awal merupakan syarat penting dalam proses pendirian guna menjamin keseriusan pendiri serta memberikan perlindungan bagi pihak ketiga. Namun dalam praktik, penyetoran modal seringkali hanya dibuktikan melalui surat pernyataan tanpa verifikasi yang memadai, sehingga menimbulkan ketidakpastian hukum. Penelitian ini bertujuan untuk menganalisis peran notaris dalam pendirian PT PMA serta mengkaji bentuk perlindungan hukum bagi pihak ketiga terhadap penyetoran modal awal yang tidak sesuai. Metode penelitian yang digunakan adalah hukum normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa notaris memiliki peran penting sebagai pejabat umum yang memastikan terpenuhinya persyaratan formal pendirian perseroan. Namun, ketidakjelasan norma mengenai bukti penyetoran modal yang sah menyebabkan keterbatasan dalam melakukan verifikasi materiil. Oleh karena itu, diperlukan penguatan pengaturan hukum guna meningkatkan kepastian hukum dan perlindungan bagi pihak ketiga.
