Abstract

Gelgel Village is one of the villages in Bali known for producing Balinese woven fabrics, namely songket and endek fabrics. Songket/endek fabric is one of the characteristics of Balinese cultural products. In order to preserve songket weaving, legal protection is necessary. Moving on from this matter, there are several problems experienced by participants in this program, namely: 1) Lack of interest of the younger generation in working as weavers, 2) Lack of compatibility of work results required by employers with weavers, and 3) Legal protection for workers and employers of songket/short cloth weaving in Gelgel Village, Klungkung. The activities carried out in this program were to provide counseling on the importance of preserving songket weaving as a cultural characteristic. These activities increased the younger generation's interest in weavers by counseling them on preserving songket weaving as a cultural characteristic. In addition, a good working relationship is needed in the songket/short woven fabric production process so that the weaving results are by the expectations of employers and consumers. Legal protection for weaving workers is to provide their rights as workers by applicable laws and regulations. Entrepreneurs are also encouraged to get legal protection by making Intellectual Property Rights (IPR) in the form of Copyright.

Abstract

The Constitutional Court has issued Decisions Number 18/PUU-XVII/2019, Number 2/PUU-XIX/2021, and Number 71/PUU-XIX/2021, in which the three decisions have a major impact on the special characteristics of fiduciary guarantees, namely the execution of guarantees that easy with parate execution. This research uses normative legal research methods. The results of this research are the Execution of Fiduciary Guarantees After the Constitutional Court Decision Number 71/PUU-XIX/2021 execution with parate execution becomes ineffective. The legal standing of the Fiduciary Giver is benefited, the Fiduciary Giver has legal protection over the execution parate of the fiduciary recipient. The legal standing of the Fiduciary Recipient is aggrieved due to the loss of legal certainty over the execution parate. The fiduciary recipient in his position as a creditor loses his legal protection in terms of making settlements for bad loans due to complicated execution conditions..

Abstract

The Land Bank Agency faces various challenges, these challenges include limited accurate spatial data, frequent agrarian conflicts between indigenous peoples, farmers, and large companies, and weak coordination between government institutions. In addition, policy implementation is often hampered by bureaucratic issues, overlapping regulations, and low community participation in the decision-making process. Therefore, an innovative approach and learning from best practices in other countries that have previously implemented similar policies are needed. One country that has long experience in implementing agrarian reform is Malaysia. Through the establishment of The Federal Land Development Authority (FELDA) in 1956. The type of research that researchers use in this study is a qualitative descriptive research method. The approach used in this study is normative juridical descriptive. The research was conducted by literature study to obtain legal materials and using document study techniques. The Malaysian land bank, FELDA, has been established for a long time, namely in 1956, compared to the Indonesian Land Bank Agency, which only had definite regulations in 2021 and FELDA has a different implementation mechanism compared to Indonesia, namely FELDA focuses more on implementing land banks in the agricultural sector, while the implementation of land banks in Indonesia tends to be relatively new.

Abstract

Merek adalah tanda pengenal yang digunakan sebagai pembeda antara satu produk terhadap produk lain secara spesifik. Seiring perkembangan teknologi dan informasi, justru terjadi banyak sengketa terkait merek. Seperti sengketa MS GLOW dan PS GLOW, merek tersebut terlibat sengketa plagiasi merek. Oleh karena itu, bagaimana penyelesaian persengketaan merek dagang di antara MS GLOW dan PS GLOW? Serta bagaimana upaya perlindungan hukum terhadap merek dagang terdaftar MS GLOW dan PS GLOW dalam proses perdagangan barang di Indonesia?. Penyelenggaraan riset menerapkan metode riset yuridis normatif dan berpendekatan perundang-undangan, pendekatan kasus, kemudian pendekatan konseptual. Penyelesaian sengketa ini dilakukan di dua Pengadilan Niaga. Gugatan di PN Niaga Medan dimenangkan oleh MS GLOW, sedangkan gugatan di PN Niaga Surabaya dimenangkan oleh PS GLOW. Putusan di PN Niaga Surabaya diketahui bahwa merek MS GLOW yang dipakai tidak sejalan terhadap kelas merek yang terdaftarkan. First to file system merupakan suatu usaha perlindungan hukum preventif, sedangkan upaya hukum represif diberikan melalui penerapan sanksi pidana.

Abstract

Gubug Belodan Village is located in the scope of the Tabanan Regency area with a strategic location on the edge of the city, has a high lure to be used as a residential or commercial area which certainly greatly affects the agricultural land in Gubug Belodan Hamlet where the land used is finally in a shifting condition. Based on this, how is the granting of building approval (PBG) in the green belt area? And how is the policy of granting building approval (PBG) in the green belt of Gubug Belodan Hamlet, Tabanan Regency? This research uses empirical legal research. The green line, which is a public infrastructure and facilities, the establishment of buildings on the green line must have PBG based on Law No. 28/2002 on Building. Regarding the green belt development policy, it is also explained in the Tabanan Regency Regional Regulation No. 6/2014 concerning the Green Belt Area which provides an understanding that the establishment of buildings is not allowed permanently or not which is contrary to the functional and use of the defense area concerned in the green belt area, except with the permission of the Regent with the recommendation of the DPRD.

Abstract

A will or testament is a document that records a person's wishes regarding what they want to happen after death, and the document can be revoked by the maker in accordance with the provisions of Article 875 of the Civil Code. As a notary, his/her duty is to create an official document that has greater legal force than a document created without the signature of an authorized party. In creating a testament deed, a notary has specific responsibilities related to reporting the will as stipulated in Article 16 paragraph (1) letters i and j of UUJN-P. However, if a notary does not register a deed of testament, the consequence is the downgrading of the document's status to an underhand deed. This could potentially lead to the invalidation or invalidity of the document as evidence made by the notary. This research uses a normative method with a statutory approach and concludes that the non-registration and online reporting of a deed of testament to the Central Register of Testaments by a notary can result in the downgrading of its status to an underhand deed, threatening the validity of the document created by the notary.
