Abstract

Land acquisition problems in public interest development raise various psychosocial problems in the community so psychosocial aspects must be taken into account along with the role of independent assessment experts and procurement management needed so that the community can receive compensation from the release of their land. The purpose of the author's analysis is related to the land implementation acquisition in Badung Regency and how to resolve land acquisition rejection disputes in Badung Regency. The author uses an empirical legal research method that has a function in showing the real law that exists in people's lives. The results of the study are on land acquisition for public interest for road construction in Badung Regency using the Land Acquisition Procedures and Procedures in accordance with Law Number 2 of 2012, where Badung Regency, especially the Public Works and Spatial Planning Agency of Badung Regency, Highways Sector as an Agency that requires land on a Small Scale, submits a Work Plan that is in accordance with the Badung Regency Medium-Term Development Plan and the existence of land acquisition and rejecting the compensation value has the right to reject land acquisition by filing an objection to the legal institution, namely the State Administrative Court and the District Court in the rejection, in resolving the rejection dispute, Badung Regency in resolving the dispute by means of Litigation and Non-Litigation.

Abstract

Purpose:This research aims to analyze and examine the premises' position in an authentic deed made by a notary. It is motivated by the absence of explicit regulations regarding the premise in the Notary Position Law, even though the premise plays a vital role in explaining the background and intention of doing the deed. Legal uncertainty related to the premise can cause legal uncertainty in the practice of notary, especially in proving in court in the event of a dispute.Methodology:This research uses normative research methods with legislative approaches and conceptual approaches. The data used consisted of primary legal materials in the form of laws and regulations and secondary legal materials in the form of literature and scientific journals. The data collection technique was carried out through a literature study and analyzed qualitatively using the legal interpretation method with deductive reasoning.Findings:The results of the study show that although the position of the premise is not expressly regulated in Article 38 of the Law on the Position of Substitute Notary regarding the anatomy of the deed, in practice, notary, the premise is still used and considered necessary. The premise is generally laid after the comparison and before the content of the deed, serving as an explanation of the background, facts, and reasons for the parties to do the deed. The premise also helps notaries explore the material truth so that the deed can provide maximum legal protection.Implication:This research implies a need for a regulatory update in the Notary Office Law to explicitly regulate the position of the premise in the anatomy of an authentic deed. This arrangement will provide legal certainty for notaries and interested parties and strengthen the function of authentic deeds as valid and perfect evidence before the law.

Abstract

The focus of the study in this paper is the legal aspects of coastal land control by foreigners in Bali to benefit the tourism business. In analyzing these legal issues, the author uses empirical legal research methods with a statutory approach, a conceptual approach, a sociological approach, and a case approach. Based on the theory of authority, the theory of expediency, and the theory of legal protection as an analytical knife, the tourism business in Bali cannot be separated from the existence of foreigners. Similarly, the control of coastal land in Bali-pun does not escape the control of foreigners, both through legal investment and some illegal, by utilizing mutually beneficial cooperation between residents and with prajuru Indigenous Villages on the basis of sharing profits.It is in this philosophy that the principle of good faith in investing is reflected so that the possession of coastal lands by foreigners for the benefit of the tourism business is obliged to respect this very noble principle; however, in empirical facts, it turns out that the control of coastal lands in Bali by foreigners under the guise of mutually beneficial cooperation is likely to harm the use of indigenous villages in carrying out the religious values attached to these coastal lands. So that in this case, the concept of mutually beneficial cooperation is contained in the lousy faith of foreigners to control the land of Bali to get personal benefits at the expense of Balinese nature wrapped in mutually beneficial Works.

Abstract

Land sales and purchases must be completed prior to the PPAT that intended to give legal clarity and protection to the owner of a land parcel or other registered right so that he may readily establish his ownership of the relevant right and for the efficient administration of property. Fundamental guidelines that must be followed when purchasing and selling land are the transaction procedure and the certificate document's validity. The government released Presidential Instruction of the Republic of Indonesia (Inpres) Number 1 of 2022 on Optimum Implementation of the National Health Insurance Program (JKN). The Presidential Instruction regulates the requirements for managing a number of public services such as buying and selling land, making SIM, STNK, SKCK, Haji and Umrah which must be registered as BPJS Health participants. In the Inpres Number 1 of 2022, the government instructed 30 ministries/agencies to require JKN-KIS for various purposes to ensure that all people are protected by health insurance. Some of these policies seem to have no relationship or connection, but they are actually very closely correlated. The government wants to ensure that all levels of society have health insurance, especially the upper middle class who have not been registered with the JKN-KIS program. BPJS Health participant cards is one of the requirements for buying and selling land. The BPJS Health participant card is a requirement in the application for registration services for the transfer of land rights or ownership rights to flat units due to buying and selling.

Abstract

This study analyzes the inheritance rights of children from interfaith marriages under Balinese customary law. It was found that children who followed the mother's religion only inherited from the mother's side, not from the father's side. This is supported by the decision of the Denpasar District Court Number 483/Pdt.G/2020/PN Dps, which states that non-Hindu children cannot inherit from their Hindu father's family. This study concludes that religious changes during marriage affect children's inheritance rights in Balinese customary law.

Abstract

This study examines the effectiveness of Government Regulation Number 24 of 2016 which expands the work area of PPAT from districts/cities to one province. The method uses empirical legal research by elaborating the theory of legal certainty, legal effectiveness, and legal authority. Data was obtained through observation and interviews in Badung and Bangli Regencies. The results show that the implementation has not been effective due to the absence of implementing regulations, thus causing legal uncertainty and potential conflicts of authority. This study recommends accelerating the preparation of technical regulations to support the effectiveness of land administration.

Abstract

Purpose:The purpose of this study is to find a legal protection model for tenants of buildings whose land is used as collateral by the landowner. Therefore, the relevant issues to be discussed are legal protection for tenants of buildings whose land is used as collateral by the landowner and the function of good faith in protecting tenants of buildings whose land is subject to foreclosure.Methodology:The research method used is normative legal research with a legislative approach, conceptual approach, and case study. The analysis of legal materials used is analysis with interpretation and content techniques.Findings:The results of the study indicate that the principle of horizontal separation provides a basis for separating building rights from land rights, thereby ensuring that tenants retain a strong legal position. In addition, the principle of good faith is a key consideration in protecting tenants' rights, as emphasised in SEMA No. 4 of 2014, which stipulates that tenants' rights shall be respected throughout the term of the leaseImplication:This study recommends strengthening regulations, transparency regarding the status of leased properties, and legal education for the public to create legal certainty and fairness in the practice of leasing buildings on land that is used as collateral for mortgage rights.

Abstract

ABSTRACTThis Community Partnership Program (PKM) was implemented in Padangsambian Village, Bali, as an effort to support the 12th Sustainable Development Goal (SDG) on responsible consumption and production. The program focused on utilizing sugarcane and coffee pulp waste into value-added products, such as recycled paper, through appropriate technology, education, and community empowerment. The implementation methods included technical training, demonstrations of simple tools, support for digital marketing, and institutional strengthening through basic accounting guidance and assistance with Intellectual Property Rights (IPR) registration. The results showed a significant increase in the community's capacity to manage waste independently and productively, the emergence of new economic opportunities, and increased environmental awareness. This program successfully created social and economic innovation at the community level, reinforcing the circular economy and supporting the reduction of organic waste at the local level. Future recommendations include strengthening local business institutions, expanding market access, providing legal assistance for product certification and IPR, and replicating the model in other villages with similar waste potential. This PKM serves as a concrete example of synergy between appropriate technology, community empowerment, and sustainable development goals. Keywords: waste management, SDG 12, sugarcane pulp, coffee pulp, community empowerment, circular economy.   ABSTRAK Program Kemitraan Masyarakat (PKM) ini dilaksanakan di Desa Padangsambian, Bali, sebagai upaya mendukung tujuan Sustainable Development Goals (SDGs) ke-12 tentang konsumsi dan produksi yang bertanggung jawab. Kegiatan ini difokuskan pada pemanfaatan limbah ampas tebu dan kopi menjadi produk bernilai tambah, seperti kertas daur ulang, melalui pendekatan teknologi tepat guna, edukasi, dan pemberdayaan masyarakat. Metode pelaksanaan melibatkan pelatihan teknis, demonstrasi alat sederhana, pendampingan pemasaran digital, serta penguatan kelembagaan melalui bimbingan akuntansi sederhana dan pengurusan HAKI. Hasil kegiatan menunjukkan peningkatan signifikan dalam kapasitas masyarakat untuk mengelola limbah secara mandiri dan produktif, munculnya peluang ekonomi baru, serta peningkatan kesadaran lingkungan. Program ini berhasil menciptakan inovasi sosial dan ekonomi berbasis komunitas, yang memperkuat ekonomi sirkular dan mendukung pengurangan limbah organik di tingkat lokal. Rekomendasi ke depan mencakup penguatan kelembagaan, pengembangan akses pasar, pendampingan legalitas usaha, dan replikasi model ke desa lain dengan potensi serupa. PKM ini menjadi contoh nyata sinergi antara teknologi sederhana, pemberdayaan masyarakat, dan tujuan pembangunan berkelanjutan. Abstract

The development of the Penglipuran tourism village based on culture ensures the welfare of the Penglipuran indigenous community. The profit-sharing management pattern with the Bangli Regency government Based on the Cooperation Agreement with the Penglipuran Traditional Village Concerning the Management of Tourism in the Penglipuran Tourism Village Number 415.4/23/PKS/PKKP/2020; Number 01/S.P/X/2020; concerning the Management of the Penglipuran Tourism Village. The Penglipuran traditional village is entitled to a reward of 60% (sixty percent) of the gross levy results. Deposit all levy results (gross) every week/7x24 (seven times twenty-four) hours to the Regional Treasury through the Receiving Treasurer at the Bangli Regency Tourism and Culture Office. This Cooperation Agreement is valid for five (five) years starting from January 1, 2021. No later than 2 (two) months before this cooperation agreement ends, the parties agree to notify each other of their intentions if they wish to extend this cooperation.

Abstract

Desa Adat Penglipuran di Kabupaten Bangli, Bali, dikenal karena tata ruang unik, kebersihan lingkungan, dan konsistensi mempertahankan arsitektur tradisional. Perekonomian masyarakatnya bergantung pada pariwisata berbasis kearifan loskal yang diatur melalui Perjanjian Kerja Sama (PKS) dengan Pemerintah Kabupaten Bangli. PKS ini mengatur pembagian hasil, tanggung jawab pengelolaan, dan perlindungan nilai budaya. Peningkatan kapasitas masyarakat dalam memahami dan merancang PKS menjadi faktor strategis untuk memperkuat posisi desa adat. Pendekatan yang digunakan meliputi analisis regulasi terkait antara lain Pasal 18B UUD 1945, UU Desa, UU Pemerintahan Provinsi Bali, dan Perda Desa Adat serta pelatihan penyusunan draft PKS terbaru yang sesuai peraturan perundang-undangan. Perumusan draft diarahkan pada klausul pembagian hasil yang adil, perlindungan ekspresi budaya tradisional, mekanisme penyelesaian sengketa, dan strategi negosiasi kemitraan. Keterlibatan aktif masyarakat adat dan pelaku pariwisata menghasilkan rancangan PKS yang partisipatif dan adaptif terhadap tantangan pariwisata kontemporer. Hasil menunjukkan bahwa PKS partisipatif mampu mengintegrasikan kepentingan ekonomi dan pelestarian budaya, meningkatkan kapasitas pengelolaan pariwisata berkelanjutan, dan memperkuat legitimasi hukum desa adat.
