Abstract

Corporate Social Responsibility (CSR) merupakan salah satu program yang dilakukan oleh perusahaan sebagai bentuk tanggung jawab sosial dengan memperhatikan jangka panjang. CSR sendiri telah diatur dalam Undang-Undang Nomor 40 tahun 2007 tentang Perseroan Terbatas dan Undang-Undang Nomor 25 Tahun 2007 tentang Penanaman Modal. CSR dinilai dapat meningkatkan citra perusahaan lebih positif dimata masyarakyat yang tentunya meningkatkan reputasi perusahaan. Penelitian ini bertujuan untuk mengkaji efektivitas dari implementasi CSR di institusi perbankan dampaknya terhadap kepercayaan konsumen dan reputasi perusahaan di Kota Batam. Jenis penelitian dalam penelitian ini menggunakan penelitian hukum empiris dengan pendekatan perundang-undang dan empiris. Penelitian ini menunjukan bahwa pembuatan CSR dilakukan oleh tim pusat dimana implementasi yang dilakukan oleh bank BCA adalah pendidikan, bisnis, kesehatan, dan lingkungan. Sedangkan, Bank Maybank berfokus pada pendidikan, pemberdayaan masyarakyat, kesehatan, seni dan budaya, dan lingkungan. Juga Bank Permata melalui program Permata Bangkit Cilik melakukan literasi keuangan, serta melakukan enhancement, dan empowerment. Dengan adanya program CSR yang dilakukan oleh Bank BCA, Maybank, dan Permata dapat membuat kepercayaan nasabah meningkat yang mempengaruhi reputasi perusahaan semakin baik di mata masyarakyat. Implementasi CSR efektif terhadap kepercayaan konsumen dan meningkatkan reputasi perusahaan melalui teori efektivitas Soejono Soekanto.

Abstract

he integration of artificial intelligence (AI) into various sectors, including banking, has grown increasingly prevalent. AI holds significant potential in the banking system, particularly in financial risk analysis. However, its utilization requires a robust legal framework to ensure ethical and accountable application. This study aims to analyze the direction of Indonesia's legal policy and develop a legal framework model that supports the ethical use of AI for financial risk analysis in the banking sector. The research employs a normative legal research method. Through this method, the study identifies several normative issues that may negatively impact the use of AI for financial risk analysis. These issues range from fundamental legal norms, such as accountability for AI utilization, to more technical concerns, including transparency, cybersecurity, and data privacy. The findings highlight gaps in the current regulatory framework, necessitating an urgent response to accommodate the complexities introduced by AI technologies in financial systems. This research proposes a legal framework development model to provide a normative construction for relevant regulations. The proposed model emphasizes the pivotal role of the Financial Services Authority (OJK) in implementing and monitoring regulations based on the framework. By addressing these regulatory challenges, the model seeks to facilitate the ethical and responsible deployment of AI in financial risk analysis while safeguarding stakeholder interests and ensuring compliance with prevailing legal principles. Pemanfaatan artificial intelligence (AI) dewasa ini semakin terintegrasi ke dalam berbagai sektor, seperti salah satunya sektor perbankan. AI memiliki potensi yang signifikan dalam sistem perbankan, khususnya untuk digunakan dalam analisis risiko finansial. Namun pemanfaatan ini perlu diakomodasi dengan kerangka hukum yang memadai, untuk memastikan pemanfaatan sistem AI yang etis dan bertanggung jawab. Tujuan penelitian ini adalah untuk menganalisis arah politik hukum Indonesia serta mengembangkan model pengembangan hukum yang dapat diterapkan untuk mendukung pemanfaatan AI yang etis untuk tujuan analisis risiko finansial dalam sistem perbankan. Metode penelitian yang digunakan adalah metode penelitian hukum normatif. Dengan menggunakan metode penelitian hukum normatif, hasil penelitian ini menemukan beberapa permasalahan normatif yang dapat berdampak negatif terhadap pemanfaatan AI untuk analisis risiko finansial, mulai dari norma hukum yang mendasar seperti pertanggungjawaban mengenai pemanfaatan AI, hingga yang bersifat lebih teknis seperti transparansi, keamanan siber, dan privasi data. Penelitian ini mengusulkan model pengembangan hukum yang dapat dimanfaatkan untuk memberikan gambaran konstruksi normatif bagi beberapa peraturan perundang-undangan relevan, dengan mendukung OJK sebagai bagian sentral dari penerapan dan pengawalan regulasi berdasarkan model tersebut.

Abstract

To date, Indonesia is still grappling with waste management issues, which is a significant obstacle to realizing Sustainable Development Goals (SDG) 11. One of the ways to deal with this issue is through the development of the waste-to-energy (WtE) system, which can be utilized to transform waste into precious energy resources. However, this system must also be supported with robust legal compliance to ensure that its development is not solely focused on generating profits through energy production but also meets its noble purpose of improving sustainability as conceptualized within SDG 11. This study utilizes the normative legal research method, along with a statutory approach. Analysis of this study finds that the current Indonesian legal framework is insufficient in providing a robust mechanism of compliance to ensure that the waste-to-energy system can contribute to the broader waste-management issues and their ramifications, specifically due to the lack of recognition of the unique intricacies of the development of WtE systems, along with the lack of normative implementation of SDG 11. The paper proposes a model of normative construction to cover these issues as a way of ensuring growth and environmental sustainability in Indonesia, particularly regarding waste management.

Abstract

This study examines the implementation of dispute resolution effectiveness for breaches of vessel charter agreements in Batam City, Indonesia. Despite the existence of clear contractual provisions and applicable legal frameworks, breaches of contract—such as delayed payments and extended vessel use—remain prevalent, posing financial risks to involved parties. The research aims to analyze the effectiveness of current dispute resolution practices and identify the factors influencing their implementation. An empirical legal research method was employed, utilizing statutory and sociological approaches, with primary data collected through interviews and observations at PT Pelayaran Nasional Pasifik Samudera Shipping and PT Pasifik Jaya Maritim. The findings indicate that both companies prioritize non-litigation approaches, emphasizing negotiation and familial cultural values to maintain long-term business relationships. However, the reliance on internal mechanisms and the limited involvement of professional legal personnel often result in challenges related to legal certainty and prolonged conflict resolution. The study concludes that while non-litigation strategies effectively minimize formal disputes, achieving a balance between cultural negotiation practices and firm legal frameworks is essential to improving dispute resolution outcomes in the vessel charter sector.   [Studi ini mengkaji efektivitas penyelesaian sengketa atas wanprestasi dalam perjanjian sewa kapal di Kota Batam, Indonesia. Meskipun terdapat ketentuan kontrak yang jelas dan kerangka hukum yang berlaku, wanprestasi—seperti keterlambatan pembayaran dan penggunaan kapal yang melebihi waktu yang disepakati—masih terjadi secara signifikan, yang menimbulkan risiko finansial bagi pihak-pihak terkait. Penelitian ini bertujuan untuk menganalisis efektivitas penyelesaian sengketa yang ada saat ini dan mengidentifikasi faktor-faktor yang memengaruhi pelaksanaannya dengan menggunakan teori efektivitas. Penelitian ini menggunakan metode penelitian hukum empiris, dengan pendekatan yuridis dan sosiologis, dan data primer dikumpulkan melalui wawancara serta observasi di PT Pelayaran Nasional Pasifik Samudera Shipping dan PT Pasifik Jaya Maritim. Hasil penelitian menunjukkan bahwa kedua perusahaan lebih mengutamakan pendekatan non-litigasi, dengan penekanan pada negosiasi dan nilai-nilai budaya kekeluargaan untuk menjaga hubungan bisnis jangka panjang. Namun, ketergantungan pada mekanisme internal dan keterlibatan terbatas dari tenaga profesional hukum sering kali menimbulkan tantangan terkait kepastian hukum dan penyelesaian sengketa yang memakan waktu lama. Penelitian ini menyimpulkan bahwa meskipun strategi non-litigasi efektif dalam meminimalkan sengketa formal, pencapaian keseimbangan antara praktik negosiasi, budaya, dan kerangka hukum yang tegas sangat penting untuk meningkatkan hasil penyelesaian sengketa di sektor sewa kapal.]

Abstract

Smart Contracts offer significant potential for contractual processes in Indonesia, much like their utilization in the United States under the prevailing regulations of both countries, including the Electronic Information and Transactions Law Number 11 of 2008, the Civil Code, the Uniform Electronic Transaction Act, the Electronic Signatures in Global and National Commerce Act, the Blockchain Technology Act, as well as Arizona House Bill 2417 and Nevada Senate Bill No. 398. This study aims to pragmatically analyze the legal perspective regarding the legal capacity to facilitate the use of Smart Contracts as a form of blockchain technology, using the legal framework of the United States as a comparative basis. The research employs a comparative legal research method with a legislative approach. The analysis reveals the inadequacy of the legal framework in Indonesia, despite recent revisions, which still exhibit numerous shortcomings in facilitating the utilization of Smart Contracts. Suggestions for regulatory aspects are proposed to support comprehensive legal development, as an effort to adapt to the evolving times. Smart Contract menawarkan potensi pemanfaatan yang baik dalam proses berkontrak di Indonesia, sebagaimana yang telah mulai dimanfaatkan di Amerika Serikat melalui peraturan perundag-undangan yang berlaku di kedua belah negara, yaitu Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik, Kitab Undang-Undang Hukum Perdata, Uniform Electronic Transaction Act, Electronic Signatures in Global and National Commerce Act, Blockchain Technology Act, dan Arizona House Bill 2417, Nevada Senate Bill No. 398. Penelitian ini bertujuan untuk menganalisis secara pragmatisme dalam perspektif hukum perihal kecakapan hukum untuk memfasilitasi pemanfaatan Smart Contract sebagai bentuk teknologi blockchain, dengan menggunakan kerangka hukum Amerika Serikat sebagai bahan komparasi. Penelitian ini menggunakan metode penelitian komparatif dengan pendekatan perundang-undangan. Analisis menemukan adanya ketidakcakapan kerangka hukum di Indonesia, meskipun telah didukung dengan revisi pengaturan terbaru, yang nyatanya masih memiliki banyak kekurangan dalam kecakapan untuk memfasilitasi pemanfaatan Smart Contract. Usulan aspek pengaturan diusulkan oleh pengaturan ini untuk mendukung perkembangan hukum yang komprehensif, sebagai upaya beradaptasi terhadap perkembangan zaman

Abstract

As a country blessed with abundant cultural elements, Indonesia holds the potential to harness traditional knowledge for the betterment of its people's lives. Unfortunately, this concept is often forgotten within Indonesian society and faces various challenges that jeopardize cultural heritage. Hence, the objective of this study is to analyze the significance of traditional knowledge and the legal hurdles that arise in regulating this concept within Indonesia's intellectual property rights framework. The findings of this normative legal research demonstrate that traditional knowledge holds great importance for Indonesian society, particularly amidst the accelerating impacts of globalization, which pose a threat to cultural heritage. Taking a legislative approach, there is an urgent need for a normative framework to protect traditional knowledge as a communal intellectual asset in order to realize the implicit recognition reflected in the constitution, the 1945 Constitution.

Abstract

Legal protection for banking institutions in Small and Medium Enterprise (SME) Credit Agreements is a fundamental issue in maintaining the financial system’s stability and promoting economic growth. This research analyzes the legal framework and legal certainty of protection for banks in SME Credit Agreements in Indonesia. This normative legal research uses a statute approach, with primary data sources in the form of relevant legislation and secondary data sources in business law literature. The results show that the juridical basis of protection for banks consists of preventive regulations (prudential principles, credit agreements, collateral, FSA supervision) and repressive regulations (credit restructuring, collateral execution, dispute resolution). Although this legal framework is comprehensive, its implementation faces significant challenges, such as inconsistent law enforcement, legal loopholes in collateral regulations, and the complexity of the judicial process. To improve legal certainty, regulatory reform, capacity building of law enforcement officials, information technology adoption, and supervision strengthening are recommended. Thus, this research contributes to strengthening legal protection for banking institutions, which will support the creation of a healthy and sustainable credit ecosystem for SMEs.

Abstract

This research aims to explore and analyze the regulations and implementation of the Free Trade Zone (FTZ) policy in the context of improving the economy in Batam City, Indonesia. This research uses non-doctrinal or empirical research. The applied problem approach involves three main approaches: a statutory approach, a conceptual approach, and a sociological or empirical approach. The data analysis technique used is qualitative analysis with a deductive data presentation pattern. Researchers will explore the regulations related to FTZs in Batam City and analyze the economic implications of these policies. Research findings show that in 2022 after the publication of PP No. 41 of 2021 has had an impact on improving the economy in Batam, including increasing export and import transactions so that Batam City's trade balance recorded a surplus of USD 2,262.24 million. Increase in the number of industrial and investment areas. It is hoped that the analysis of these findings will provide better insight into the contribution of FTZ policies to economic development at the local level

Abstract

Corporations inevitably violate human rights in a variety of ways. As corporations evolved into massive multinational businesses, corporate violence—which is a legacy of colonialism and corporate power—continues to exist today. Corporate players maintain their freedom in pursuing their objectives using convoluted and obscure multinational organizations and supply networks, through the utilization of corporate law principles like the veil of corporate ownership, and also through other practices like tax evasion and lobbying of political bodies. The objective of this article is to explore the legal aspects of the problem of corporate violence, and suggesting reforms to ensure justice for the affected parties. This article uses the doctrinal research method along with the comparative method, focusing on both primary and secondary data. This article makes the case that the issue stems from the structural and systemic flaws in the framework of international law as well as in corporate laws that continually preserve corporate institutions in frustrating the advancement of the cause for human rights.  To effectively enhance the corporate and human rights environment, a framework of hard law, soft law, and non-law reforms and actions is needed.

Abstract

In 2020, Law Number 11 of 2020 concerning Job Creation has been enacted. With this, it also changes the legislation regarding employment, including Government Regulation Number 35 of 2021. The purpose of this research is to find out the implementation of Government Regulation Number 35 of 2021 concerning PKWT, Outsourcing, WKWI, and PHK after the Constitutional Court Decision on Providing Compensation for PKWT Workers and providing solutions in accordance with the laws and regulations and facts found in the field in order to overcome the obstacles that occur. This research uses the Empirical/Sociological type of legal research because the data to be used is mainly data obtained directly which is primary data. Compensation is the right of workers who are bound by a Fixed-Term Employment Agreement (PKWT), so employers are obliged to provide the rights of PKWT workers at the end of the working period in accordance with the employment agreement. If the employer does not pay compensation rights, administrative sanctions will be imposed in accordance with applicable regulations.
