Abstract

This research addresses the legal issues surrounding the dissemination of false news, particularly in the case of Decision Number 686/Pid.Sus/2021/PN JKT, which involves the spread of fabricated content on social media. The purpose of this study is to analyze judicial considerations in the legal handling of fake news and its implications on public order. The research employs a normative legal method, using secondary data from the court's decision and analyzing it through document analysis with a case-based and conceptual approach. The results highlight the court's focus on the intentionality of the defendants, their awareness of the false nature of the content, and the potential risks of public unrest. The study concludes that while media freedom is constitutionally protected, it must be exercised responsibly, especially in the digital age, to prevent harm to public order and societal harmony. This case underscores the need for greater media accountability and the balance between freedom of expression and public safety.

Abstract

Data protection is one of the most important aspects of the digital economy, with its legal implications extending across digital landscapes. The failure to protect data in data breaches can threaten the interests of owners and expose them to various risks. Legal compliance regarding how owners are notified of data breaches is important to prevent this, necessitating deep legal discourse and analysis. Using a comparative legal research method with a statutory approach, this study dissects norms within Indonesia and South Korea’s legal systems to analyze their differences in legal compliance regarding this issue. The findings of this study highlight the discrepancies in legal frameworks between Indonesia and South Korea. It particularly notes Indonesia's lack of a governing body for data breach notifications and the absence of comprehensive privacy impact assessments or cybersecurity compliance. Ultimately, the study underscores the need for Indonesia to develop a normative model for data protection to address its significant regulatory gaps—contrasting with South Korea's more robust legal mechanisms and the GDPR's systematic oversight.KEYWORDS: Data Breach, Data Breach Notification, Data Protection.

Abstract

Bangsa Indonesia saat ini berada dalam krisis penegakan hukum. Dalam praktiknya, aparat penegak hukum cenderung mengabaikan hingga menganut ketidakpedulian terhadap keadilan hukum yang  menimbulkan penurunan kepercayaan masyarakat terhadap aparat penegak hukum. Adapun kelompok yang paling rentan mengalami ketidakadilan akibat krisis penegakan hukum adalah masyarakat penyandang disabilitas. Pada dasarnya ketidaksempurnaan itu tidak boleh menjadi penyebab hilangnya harkat dan martabat masyarakat penyandang disabilitas. Adapun terdapat urgensi penelitian ini yakni dikarenakan adanya terdapat krisis penegakan hukum sehinggadalam mencegah terjadinya pengabaian hak yang mengarah kepada diskriminatif bagi masyarakat penyandang disabilitas didalam praktik penegakan hukum diperlukan pembahasan mengenai pemanfaatan Artificial Intelligence (AI) bagi  masyarakat penyandang disabilitas menjadi hal yang penting dan aktual untuk dilakukan pengkajian lebih lanjut. Penelitian ini berfokus kepada pemanfaatan Artificial Intelligence (AI) sebagai alat bantu pemberian bantuan hukum bagi masyarakat penyandang disabilitas agar tercapainya penegakan hukum yang memenuhi nilai keadilan, nilai kepastian dan nilai kemanfaatan. Spesifikasi dalam penelitian ini menggunakan jenis metode penelitian yuridis normatif dengan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Data yang dianalisis yakni data sekunder yang diperoleh secara tidak langsung melalui teknik studi kepustakaan.

Abstract

The integration of Artificial Intelligence (AI) into scientific advancements has become a crucial part of daily life for many people. In the creative industry, AI has the potential to not only enhance the level of creativity, but also productivity. The legal implications of this development must be carefully analyzed for the development of the creative industry, to establish a legal position on where AI stands in the increasingly competitive market, especially when Intellectual Property Right (IPR) as a key factor is taken into account. This research examines the need for a legal framework for AI. It was conducted through the lens of intellectual property law, to determine its place within existing IPR regimes using the comparative legal method. The results conceptually justify the urgency to regulate AI, and highlights the taxonomy dilemma of AI-generated works within the current dynamics of the creative industry, indicating a taxonomy dilemma. Further analysis also indicates that while there’s a decent urgency to address all of the normative issues that exist within Indonesia’s IPR legal framework, it’s imperative that Indonesia prioritizes the development of the copyright and patent regimes, which are closely related to the nature of AI-generated works.

Abstract

Commercial property disputes between creditors and debtors are on the rise, particularly in industrial cities such as Batam. Creditors frequently encounter significant challenges, including the risk of default, third-party claims, and obstacles in executing collateral—largely driven by regulatory uncertainty and weak law enforcement. This study aims to examine the legal protection available to creditors in commercial property disputes, with a focus on District Court Decision No. 158/Pdt.G/Plw/Gs/2022/PN Btm. Utilizing a normative juridical approach, the research highlights a clear disconnect between existing legal provisions and their practical implementation in safeguarding creditor rights. Key barriers faced by creditors include prolonged execution processes, lack of transparency in credit agreements, and insufficient financial literacy among debtors. [Semakin meningkat, terutama di kota industri seperti Batam. Kreditur sering menghadapi risiko wanprestasi, klaim pihak ketiga, dan hambatan eksekusi jaminan yang disebabkan oleh ketidakpastian regulasi serta lemahnya penegakan hukum. Penelitian ini bertujuan untuk menganalisis perlindungan hukum bagi kreditur dalam sengketa properti komersial berdasarkan Putusan Pengadilan Negeri Batam No. 158/Pdt.G/Plw/Gs/2022/PN Btm. Metode penelitian yang digunakan adalah pendekatan yuridis normatif. Hasil penelitian menunjukkan bahwa terdapat kesenjangan antara ketentuan hukum yang ada dengan implementasi perlindungan kreditur di lapangan. Hambatan utama yang dihadapi kreditur meliputi proses eksekusi yang berlarut-larut, kurangnya transparansi dalam perjanjian kredit, serta minimnya edukasi bagi debitur].

Abstract

Introduction to the Problem: Unfair competition threatens economic growth and is harder to detect in the digital era. For Indonesia and Thailand, growing digital economies depend on fair online marketplaces, yet these platforms face risks like price manipulation and visibility bias. Addressing these issues is crucial to unlocking their global trade potential. Purpose/Study Objectives: The purpose of this research is to analyze the normative potentials and challenges in enforcing antitrust laws in Indonesian and Thai online marketplaces, particularly in addressing antitrust challenges that are unique to the digital environment. Design/Methodology/Approach: This research utilizes normative legal research method and a comparative legal approach to examine the frameworks for protecting against unfair competition in online marketplaces in Indonesia and Thailand. Findings: Findings of this study highlight that the existing antitrust laws in Indonesia and Thailand are not equipped to address the unique challenges of digital markets, such as algorithm-driven price fixing, product visibility manipulation, and data monopoly. The study proposes a legal framework model focusing on enhancing algorithmic transparency, ensuring search neutrality, establishing robust market monitoring, and integrating data governance with antitrust measures. This model aims to bolster fair competition and consumer protection, positioning both nations to leverage their digital economy potentials effectively. Paper Type: Research Article

Abstract

Technological developments have an impact on the financial sector. One of the innovations that has occurred in the financial industry is regarding online loans. The regulations that apply in Indonesia relating to online loans are only regulated by financial services authority regulations and Bank Indonesia regulations. Meanwhile, online lending practices give rise to various legal issues that can no longer be resolved solely through these regulations. The research aims to analyze the urgency of establishing legislation regarding online loans. The research method used in this research is normative juridical in answering the problem formulation; a juridical and theoretical basis was used, namely the Legal Protection Theory. The research results show that the formation of a special law regarding online loans is very critical because of the widespread practice of online loans carried out by illegal institutions, which causes the rights and obligations between loan givers and recipients to be unbalanced, such as determining very high loan interest with short repayment periods, as well as personal data leaks and various other cases and other cases. Therefore, it is hoped that the establishment of this unique law can provide external legal protection.

Abstract

Corporate Social Responsibility (CSR) is a vital component of modern corporate governance, particularly in environmentally and socially sensitive sectors such as plantations. In Indonesia, although the legal framework for CSR is established through Company Law and sectoral regulations, its implementation often lacks strategic depth and sustainability. This study investigates the legal and empirical challenges of CSR practices within the non-palm plantation sector, focusing on how companies translate normative CSR obligations into effective, community-centered programs. The research aims to evaluate the effectiveness of CSR as a tool for sustainable development, identify gaps between regulatory expectations and field practices, and propose recommendations for optimization. Using an empirical juridical method, this study combines qualitative interviews with legal analysis of CSR frameworks to assess social and environmental outcomes of CSR programs. Findings reveal that CSR is frequently treated as a compliance obligation, with many initiatives lacking integration into long-term business strategy. Programs are often symbolic, with limited tangible benefits for local communities due to weak regulatory coordination, inadequate stakeholder engagement, and ineffective monitoring. The study concludes that CSR in the plantation sector requires a transformative shift—from superficial compliance to strategic sustainability. Integrating CSR into business core values, supported by clear legal standards, inclusive stakeholder collaboration, and transparent reporting, is essential to enhance its real-world impact. This research offers a model for evaluating CSR effectiveness and contributes to the broader discourse on legal reform and sustainable corporate governance in Indonesia’s agribusiness sector.

Abstract

The use of internet services has become widespread and has become an integral part of daily life for millions of individuals around the world. However, in accessing and using internet services, consumers often face various risks and challenges, such as privacy violations, online fraud, or non-compliance with promises made by service providers. Apart from that, a high security system also increases public confidence in comprehensive data security protection. Legal protection aims to integrate and coordinate various interests in society because in one movement of interests, protection of certain interests. In implementing personal protection in electronic systems, it must be based on the principle of respect for personal data as privacy and every owner of personal data has the right to data in the electronic system. Therefore, legal protection of consumers regarding the use of internet services is becoming increasingly important. This research actualizes the protection of consumer personal data in the context of internet service use. We analyze relevant legal and regulatory developments, both at national and international levels, that play a role in protecting consumer rights and interests in the digital ecosystem.

Abstract

Currently, there is a regulatory conflict regarding Kampung Tua (Traditional Villages) in Batam, where there is an overlap between Presidential Decree No. 41/1973, which grants Management Rights of all land in Batam Island to the Batam Authority, and Batam City Regional Regulation No. 2/2004 on Spatial Planning that includes the definition of traditional villages. To resolve this conflict, it is recommended that the Batam City Government and BP Batam implement Romli Atmasasmita's Integrative Law Theory and propose alternatives by designating Kampung Tua as a cultural heritage area with tourism potential development, not solely focusing on industrial areas, thus requiring an effective Kampung Tua Policy Model to reduce prolonged conflicts. Methodology: This research employs a qualitative descriptive method with primary data collection through observations in9 districts and 18 sub-districts in Kampung Tua Batam. Data analysis was conducted descriptively-qualitatively using Batam City Regional Regulation No. 2/2004 as secondary data, supported by Good Governance theory and other relevant legal materials. Conclusion: The research findings indicate that there is complexity and regulatory overlap concerning Kampung Tua in Batam between Presidential Decree No. 41/1973 and indigenous community protection regulations, leading to legal uncertainty and prolonged conflicts. To address this, a comprehensive approach is needed through the implementation of Integrative Law Theory, establishment of cultural heritage status, and implementation of Administrative Policy Theory, considering aspects of law, law enforcement, infrastructure, community, and culture to achieve a balance between legal certainty, community welfare, and cultural preservation.
