Abstract

This paper aims to discuss the doctrine of res ipsa loquitur as an unlawful act in medical malpractice and its implications on the balance of protection for patients and medical personnel after the enactment of the Health Law. The urgency of this paper lies in examining the applicability of the res ipsa loquitur doctrine in relation to Articles 310 and 440 of the Health Law. The application of the res ipsa loquitur doctrine in proving medical malpractice cases is strategic in determining the existence or absence of unlawful acts due to negligence. The res ipsa loquitur doctrine makes it easier for patients as plaintiffs to prove negligence through a reverse burden of proof mechanism by medical personnel. Although not a formal piece of evidence, the res ipsa loquitur doctrine can be used as a relevant legal basis, especially when supported by medical records, to assess the conformity of medical actions with professional standards and operational procedures. The legal relationship in therapeutic transactions, which is asymmetrical in nature, requires proportional protection, both in relation to the provisions of Article 310 of the Health Law, which encourages non-litigation dispute resolution, and in relation to Article 440, which opens up criminal law channels for serious negligence in medical services. Therefore, the application of the res ipsa loquitur doctrine in criminal law must be strictly limited through a restorative justice approach as a fair alternative with balanced protection interests for patients and medical personnel.

Abstract

Detention under the Indonesian Criminal Procedure Code (KUHAP) is intended to function as a temporary, non-punitive procedural instrument to ensure the proper administration of criminal proceedings. However, the application of detention to individuals with psychotic mental disorders reveals a structural inconsistency between substantive criminal law and criminal procedure, causing detention practices to shift into a form of disguised punishment. This article adopts a normative-analytical approach to assess conceptual gaps within KUHAP, examine the implications of procedural incapacity, and evaluate the urgency of implementing medically rehabilitative detention grounded in international human rights principles. The study analyzes legal literature, national regulations, and forensic perspectives to trace the consequences of conventional detention practices for individuals with psychotic mental disorders. The findings indicate that standard detention not only fails to protect their rights but also heightens psychosocial risks, exacerbates mental conditions, and produces substantive injustice. This research underscores the need to reformulate KUHAP by recognizing procedural incapacity, implementing non-punitive detention based on medical rehabilitation, and integrating the principles of legal utility, substantive justice, and human rights protection. Such an approach is expected to bridge the gap between substantive criminal law and criminal procedure while affirming that the protection of the rights of individuals with psychotic mental disorders is not merely a domestic obligation but also a commitment to international human rights standards.

Abstract

Penelitian ini mengkaji kerangka hukum komparatif terkait perkawinan paksa di Indonesia, Inggris, dan Pakistan, dengan tujuan merumuskan model reformulasi Undang-Undang Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual (UU TPKS) agar lebih efektif dalam melindungi korban. Penelitian ini menggunakan metode penelitian hukum normatif dengan tiga pendekatan utama, yaitu pendekatan perundang-undangan untuk mengkaji aturan hukum yang berlaku, pendekatan konseptual untuk mengidentifikasi perlunya reformasi norma hukum, dan pendekatan komparatif untuk menganalisis persamaan dan perbedaan regulasi di ketiga negara tersebut. Hasil penelitian menunjukkan bahwa Indonesia telah mengkriminalisasi perkawinan paksa sebagai salah satu bentuk kekerasan seksual dengan ancaman hukuman maksimal sembilan tahun penjara, namun belum memiliki mekanisme pencegahan dan pemulihan korban yang komprehensif. Inggris, melalui Forced Marriage Protection Orders (FMPOs) dalam Family Law Act 1996 dan Forced Marriage (Civil Protection) Act 2007, menyajikan model perlindungan preventif yang progresif. Sebaliknya, Pakistan menegaskan larangan tersebut melalui Undang-Undang Pembatasan Pernikahan Anak tahun 1929 dan Undang-Undang Pencegahan Praktik Anti-Perempuan tahun 2011, meskipun implementasinya dibatasi oleh budaya patriarki. Reformulasi Undang-Undang TPKS diperlukan agar lebih preventif, responsif, dan berorientasi pada korban sesuai dengan standar hak asasi manusia internasional.
