Abstract

Introduction to the Problem: The implementation of digital zakat has become a popular trend for zakat practices in Indonesia, allowing the muzakki to make their payments swiftly and easily online. However, there are several challenges faced in the adoption of digital zakat in Indonesia, including concerns on the security of personal data and financial transactions. The potentials for hacking or misuse of muzakki's personal data may hinder the development of digital zakat.Purpose/Study Objective: This paper examines the legal protection of the personal data of zakat payers who use digital platforms as the means for distributing their zakat.Design/Methodology/Approach: The method used in this study is qualitative through normative legal research. The data obtained is analyzed with conceptual approach to formulate specific regulations governing digital zakat platform in detail.Findings: The existence of digital zakat is considered a technological innovation that has increased the accessibility of zakat for the people, thereby improving the welfare of those underprivileged. However, confusion and uncertainty regarding the rules and procedures of digital zakat remain in Indonesia. Digitising zakat brings along its own risks and challenges, including the potential for the misuse of funds, data security issues, and the lack of monitoring and accountability. To ensure the appropriate use of zakat funds in accordance with Islamic law and the relevant regulations, both the zakat institutions and the government must strengthen their supervisory and control over the collection and distribution of zakat through digital platforms. Additionally, it is important to note that not all levels of society in Indonesia have access to digital technology. A significant portion of the population, particularly those in remote areas, may not be able to fully participate in digital zakat practices due to lack of internet access or other necessary equipment.Paper Type: Research Article

Abstract

Pemanfaatan cabai rawit dalam pembuatan sambal sagela organik bertujuan untuk meningkatkan nilai tambah produk pertanian serta pendapatan petani. Cabai rawit merupakan salah satu komoditas pertanian yang melimpah, namun sering mengalami fluktuasi harga yang tidak stabil. Melalui pengolahan menjadi sambal sagela organik, cabai rawit dapat diolah menjadi produk bernilai ekonomi lebih tinggi, yang memiliki daya tahan lama dan pasar yang lebih luas. Penelitian ini menggunakan metode deskriptif dengan pendekatan kualitatif, melibatkan petani cabai rawit di Gorontalo sebagai subjek utama. Hasil penelitian menunjukkan bahwa pembuatan sambal sagela organik memberikan peningkatan pendapatan sebesar 20-30% dibandingkan dengan penjualan cabai rawit segar. Selain itu, proses pengolahan organik yang ramah lingkungan juga memberikan dampak positif terhadap keberlanjutan lingkungan dan kesehatan konsumen. Oleh karena itu, pengembangan produk turunan berbasis cabai rawit, seperti sambal sagela organik, merupakan solusi inovatif untuk meningkatkan kesejahteraan petani dan memperkuat perekonomian lokal.

Abstract

This research aims to determine the judge's considerations in carrying out his juridical function to adjudicate cases, whether they align with legal principles governing marriage and protecting children's rights, and how social stigma influences the judge's decision-making process in many instances.  Interviews were conducted directly to create effective and efficient discussions to collect the primary data. In addition, data was obtained through literature and research studies, including regulations, documents, and related books.  This paper examines a case study concerning a judge's decision to grant dispensation to a married couple not yet of legal age due to a request for parental guardianship submitted to the Gorontalo Religious Court in decision Number 10/Pdt.P/2021/PA. The findings show that the convergence of various legal aspects, cultural values, and social norms can influence judges' considerations in determining child marriage dispensations. The issue of child marriage in Indonesia is complex and needs serious attention. A legal framework must support objective legal principles, take into account the needs and interests of all parties, and overcome social stigma against child marriage.

Abstract

Domestic violence (KDRT) is a human rights violation that has a serious impact on victims, especially women and children. Although it has been regulated in Law Number 23 of 2004 concerning the Elimination of Domestic Violence, the implementation of law enforcement in various regions still faces various challenges. This study aims to analyze the form of law enforcement for domestic violence cases in the jurisdiction of the Gorontalo Police, as well as identify the inhibiting and supporting factors in the law enforcement process. The research method used is empirical juridical, with a qualitative approach involving interviews with law enforcement officials, victims, and accompanying institutions. The results of the study show that although the Gorontalo Police have tried to handle domestic violence cases seriously, there are still obstacles such as lack of reports from victims, patriarchal culture, limited resources, and lack of public understanding of victims' rights. This study recommends increasing the capacity of law enforcement officials, cross-sectoral cooperation, and legal education to the public to realize more effective protection for victims of domestic violence.

Abstract

Understanding and anticipating money laundering risks remains a formidable challenge for financial authorities, primarily because Suspicious Transaction Reports (STRs) function as lagging indicators rather than real-time proxies for illicit activities. This disconnect necessitates the development of early warning indicators (EWIs) capable of signaling latent risks as institutional reporting behaviors unfold. This study investigates whether fluctuations in currency circulation provide predictive signals for STR volumes in subsequent periods. Drawing on cash-based money laundering theory and acknowledging detection lags inherent in compliance processes, this study argued that currency fluctuations encapsulate information regarding latent suspicious activities that manifest only after a temporal delay. Methodologically, the study employs a panel count model utilizing fixed-effects negative binomial regressions alongside extensive robustness checks, including hurdle and zero-inflated specifications, on monthly panel data from 34 Indonesian provinces spanning 2022 to 2024. The empirical analysis reveals that cash inflows and outflows significantly predict STR volumes with a lead time of two to three months. Conversely, the circulation of counterfeit currency shows no significant correlation. These findings suggest that physical currency circulation can serve as a robust EWI for monitoring financial crime risks, specifically to inform supervisory prioritization, compliance resource allocation, and macro-financial oversight in cash-dependent economies.

Abstract

Mining activities in Pohuwato Regency generate economic benefits while simultaneously giving rise to legal issues, particularly concerning land acquisition carried out through tali asih mechanisms. This practice often places local mining communities in a legally vulnerable position due to unequal power relations with mining companies and the absence of clear legal regulation. This study aims to analyze the legal standing of local mining communities in land acquisition practices conducted through tali asih mechanisms and to formulate forms of civil law protection that are fair, proportional, and grounded in social justice. This research employs a normative–empirical legal method with statutory, conceptual, and sociological approaches. Data were obtained through library research on legal regulations and doctrines, as well as empirical data collected through interviews and field observations. The findings indicate that tali asih practices have not fully complied with the principles of freedom of contract, good faith, and equality of the parties, resulting in the protection of the civil rights of local mining communities being largely formal rather than substantive. Furthermore, normative gaps and the weak role of the state in providing preventive protection exacerbate the legal vulnerability of affected communities. This study concludes that strengthening regulatory frameworks and adopting a legal protection approach oriented toward social justice are necessary to ensure that mining-related land acquisition not only provides legal certainty but also guarantees the protection of rights and the sustainability of the livelihoods of local mining communities.

Abstract

Perkembangan ilmu pengetahuan dan teknologi yang pesat telah mengubah sistem penegakan hukum lalu lintas di Indonesia, termasuk di Provinsi Gorontalo. Metode tilang konvensional seringkali dianggap tidak efektif karena proses yang panjang, keterbatasan personel, dan rentan terhadap pungli. Untuk mengatasi permasalahan tersebut, sistem Penegakan Electronic Traffic Law Enforcement (ETLE) diperkenalkan sebagai inovasi teknologi yang bertujuan untuk memperkuat transparansi, efisiensi, dan akuntabilitas dalam penegakan hukum lalu lintas. Penelitian ini bertujuan untuk menganalisis implementasi ETLE di Provinsi Gorontalo dan mengidentifikasi kendala yang menghambat optimalisasi pelaksanaannya. Dengan menggunakan pendekatan empiris kualitatif yang didukung oleh analisis perundang-undangan, konseptual, dan studi kasus, penelitian ini mengumpulkan data primer melalui wawancara dan observasi di Direktorat Lalu Lintas Kepolisian Daerah Gorontalo, dilengkapi dengan data sekunder dari peraturan perundang-undangan dan literatur. Temuan penelitian menunjukkan bahwa ETLE telah berkontribusi dalam mengurangi pelanggaran lalu lintas dan meningkatkan kepatuhan masyarakat, sebagaimana tercermin dari penurunan pelanggaran yang tercatat secara signifikan dari tahun 2022 ke tahun 2024. Sistem ini juga telah meminimalkan interaksi langsung antara petugas dan pengguna jalan, sehingga mengurangi potensi praktik ilegal. Namun, masih terdapat beberapa tantangan, termasuk keterbatasan infrastruktur teknologi, data kepemilikan kendaraan yang tidak lengkap, rendahnya kesadaran masyarakat, dan tingginya biaya denda yang dianggap memberatkan oleh sebagian pengguna jalan. Kendala-kendala ini membutuhkan perbaikan infrastruktur, edukasi publik yang berkelanjutan, dan penguatan kebijakan untuk memastikan ETLE berfungsi secara efektif dan adil. Secara keseluruhan, ETLE merupakan langkah penting menuju modernisasi penegakan hukum lalu lintas dan mendorong budaya berkendara yang aman dan tertib di Provinsi Gorontalo.

Abstract

This study aims to (1) determine how law enforcement efforts are implemented against the theft of four-wheeled and two-wheeled vehicles in Gorontalo City, and (2) analyze the factors influencing the number of vehicle theft cases, specifically in 2024, which experienced the highest increase in such cases compared to the previous year. It employs an empirical legal study methodology, involving observations at the Gorontalo City Resort Police and the Gorontalo District Court. Data collection is through interviews with investigators from the Gorontalo City Resort Police and junior legal clerks, who served as participants in the study. The findings reveal that law enforcement efforts against vehicle theft in Gorontalo City have been carried out under legal provisions and the Criminal Code. However, several factors have contributed to the increase in vehicle theft cases over three years, particularly in 2024. Economic factors seem to drive individuals to engage in vehicle theft. Additionally, environmental factors, technological developments, and certain legal aspects indicate that current law enforcement measures have not yet deterred offenders effectively. This study recommends enhancing cooperation between the community and law enforcement agencies to improve oversight of vehicle theft in Gorontalo City. Furthermore, legal counseling is necessary to educate the public on the importance of avoiding involvement in vehicle theft cases
