Abstract

Economic and business developments are always accompanied by developments in capital requirements and additional business capital facilities which always require guarantees to maintain the security of the capital provided. business. Pawning is a type of debt and receivable agreement and has been in place since the time of the Prophet. Over time pawnshop institutions were formed to encourage economic survival. This research aims to explain various aspects of sharia pawning starting from the history, legal basis of sharia pawning to the implementation of pawning in both banking and pawnshop institutions in Indonesia. This research is research with a qualitative descriptive approach using documentation studies through references related to sharia pawning in Indonesia. The research results show that sharia pawn operations in Indonesia do not conflict with Islamic sharia (Al-Qur'an, Hadith, Ijma, and DSN Fatwa). Not only that, the principle of pawning is actually in line with maqashid sharia, namely the protection of property, body, mind, offspring and soul. Handling problems at sharia pawnshops by providing several ways to pay off and not adding to the burden of deposits and administration costs. The results of this research provide recommendations that the implementation of sharia pawning can be implemented in the community for the benefit of the people.

Abstract

Indonesia’s mandatory halal certification deadline of 17 October 2026 poses a pressing challenge for Micro, Small, and Medium Enterprises (MSMEs) for Sharia-compliant legal assurance to maintain consumer trust and enhance market competitiveness. This study examines the strategic role of local governments in accelerating halal certification for MSMEs using Siyasah Shar’iyyah approach with the principle of Tasharruf al-imām ‘alā al-Ra‘iyyah manūṭun bi al-Maṣlaḥah. This study used interviews and policy analysis for qualitative analysis. The qualitative multi-case approach examines halal certification acceleration across Madura's four regencies (Bangkalan, Sampang, Pamekasan, and Sumenep) through interviews with key stakeholders, participatory observation, and policy document analysis. The findings demonstrate that local governments are proactively advancing halal certification through targeted approaches. These include deploying Islamic religious counsellors, participating in national certification initiatives, and providing free certification programs to facilitate MSME compliance with halal requirements. Despite proactive efforts, the study identifies three persistent challenges hindering halal certification acceleration, including fragmented coordination between implementing institutions, unequal progress across regions, and insufficient local testing infrastructure, particularly for meat and animal-derived products. To address these systemic barriers, the study proposes mobile halal laboratories to expand testing coverage, digital platforms for accessibility, and Islamic boarding schools for continuous training. The findings bridge critical theory and practice, offering scalable approaches to enhance regulatory compliance and equitable halal certification access for MSMEs.

Abstract

This study aims to critically analyze Ahmed An-Na’im’s thoughts in the renewal of Islamic law, which offers a new perspective on sharia as a dynamic interpretation of sacred texts. The urgency of this study lies in the need to understand the contextual approach to sharia in facing the challenges of modernity, especially in relation to Human Rights (HAM) and constitutionalism. This study uses a qualitative method with a literature study approach, which focuses on An-Na’im’s main works and relevant secondary literature. Data analysis was carried out through the content analysis method to identify patterns, themes, and implications of An-Na’im’s ideas. The results of the study show that An-Na’im defines sharia as an interpretation of texts that are equivalent to Islamic jurisprudence and law, not something sacred and static. His thoughts underline the relevance of sharia to the development of the times through the distinction between universal Makkiyah sharia and contextual Madaniyyah sharia. This idea is influenced by the nasakh theory of his teacher, Mahmoud Muhammad Thaha. However, An-Na’im’s approach has been criticized for being too focused on modern standards such as human rights, giving the impression that Islam needs to adapt to Western values. This study contributes to the discourse on Islamic legal reform by showing how An-Na’im’s approach opens up new interpretative space that remains relevant without ignoring the essence of justice in Islamic teachings

Abstract

Hukum Islam mempunyai Karekter yang berbeda dengan Hukum adat ataupun hukum lain pada umumnya. Hukum islam mempuyai Karakter khusus yaitu tetap dalam bidang Ibadah dan Elastis dalam bidang hukum Muamalah. Penelitian ini dilakukan untuk menganalisis secara mendalam hukum Islam dengan melihat karakter khusus yang dimilikinya. Penelitian ini menggunakan pendekatan kualitatif dengan metode penelitian hukum normatif. Hasil dari penelitian ini menunjukkan bahwa dalam hal ibadah, hukum islam bersifat tetap sejak zaman Nabi sampai sekarang seperti hukum ibadah sholat lima waktu, sedangkan dalam hal hukum muamalah dimana hukum ini terkait dengan hubungan manusia dengan manusia terus mengalami perubahan sesuai dengan situasi dan kondisi dimana masyarakat muslim itu hidup. Oleh karena itu, dalam hal hukum Islam karakter yang dimilikinya sangat unik dan tidak pernah habisnya untuk terus kemudian dikaji dan dipelajari

Abstract

This study aims to evaluate the influence of a contextual approach on improving santri's kitab kuning literacy and to formulate an adaptive model at Al-Hikam Islamic Boarding School Burneh Bangkalan. This research used a qualitative research with classroom action research (CAR). The data of this study is the improvement of literacy of Kitab Kuning for Santri at Al-Hikam Islamic Boarding School Burneh Bangkalan. The data of this study got from observations, in-depth interviews, and documentation of learning practices with beginner santri of Madrasah Diniyah Takmiliyah (MDT) at Al-Hikam. This research used Miles and Huberman's interactive mode to analysis data. The findings indicate that the adoption of the innovative "Al-Miftah Lil Ulum" method successfully addressed the ineffectiveness of the traditional sorogan method, significantly improving santri's morphological and syntactic analysis skills in a short period. The learning materials, structured in the form of nadzam, colored tables, and structured exercises, proved capable of bridging santri's cognitive gap towards classical texts. The implementation of this method had a significant impact on santri's ability to read and comprehend Fathul Qarib within a relatively short timeframe. This research found that challenges exist in the learning process, such as heterogeneity of abilities and the need to adjust the study duration to two years; these were addressed through class separation and strengthening meaning comprehension practices. The results of this study imply that the integration of contextual methods can bridge the gap between classical Islamic intellectual heritage and contemporary educational challenges, affirming the crucial role of innovation for pesantren's relevance in responding to 21st-century learning needs.

Abstract

This article aims to analyze and compare the concept of rights that provide guarantees from the perspectives of positive law and Islamic law, as well as to examine the potential for integrating both within the framework of a plural national legal system. The methodology used is qualitative library research with a normative approach, utilizing primary sources such as statutory regulations and classical and contemporary Islamic jurisprudence literature, along with secondary sources including scholarly journals and books published within the last ten years. The results of the study indicate that both legal systems equally recognize the importance of guarantee rights as instruments of justice and legal certainty, albeit through different approaches: positive law emphasizes juridical-administrative aspects, while Islamic law highlights moral values and social responsibility. Although there is potential for harmonious integration, implementation still faces structural and cultural challenges, thereby necessitating institutional reform and capacity building within society to realize a fair and adaptive legal system in the context of national legal pluralism.

Abstract

Ideally, the publicity principle in security law functions as a transparency instrument to provide legal certainty and maximum protection for creditors over secured objects. However, in practice, this principle often faces distortions, particularly in fiduciary guarantees that are not registered, leading to legal uncertainty and weakening the creditor’s position in the event of a dispute. This study aims to critically examine the effectiveness of the publicity principle in protecting creditors’ interests within Indonesia’s security law framework. The research method employed is a literature study with a qualitative-descriptive approach, relying on primary sources such as legislation and secondary sources including legal literature. The findings indicate that the implementation of the publicity principle has not been fully effective in ensuring legal certainty for creditors, primarily due to weak enforcement of registration obligations and the absence of strict sanctions for violations. Therefore, a reformulation of the legal protection mechanism is necessary to better respond to creditors' interests.

Abstract

Transformasi sistem gadai ke dalam platform digital merupakan bagian dari inovasi keuangan yang bertujuan untuk meningkatkan aksesibilitas dan efisiensi layanan gadai bagi masyarakat. Penelitian ini bertujuan untuk menganalisis perubahan dalam sistem gadai tradisional menuju layanan berbasis digital, serta mengidentifikasi prospek dan tantangan regulasi dalam implementasi E-Gadai di Indonesia. Metode yang digunakan adalah kajian pustakan, dengan menelaah berbagai literatur akademik, regulasi, serta penelitian sebelumnya yang membahas peran teknologi finansial (FinTech) dalam industri gadai. Hasil penelitian menunjukkan bahwa digitalisasi gadai, melalui layanan Pegadaian Digital Service (PDS), telah memberikan manfaat signifikan, seperti kemudahan akses transaksi, peningkatan efisiensi waktu, serta transparansi dalam layanan keuangan. Namun, implementasi e-gadai juga menghadapi sejumlah tantangan, termasuk kesenjangan literasi digital, risiko keamanan siber, serta kekosongan regulasi yang belum sepenuhnya mengakomodasi perkembangan teknologi keuangan. Selain itu, masih maraknya praktik gadai ilegal menjadi tantangan tersendiri dalam memastikan perlindungan konsumen dan stabilitas industri gadai di Indonesia..

Abstract

Test of English as a Foreign Language (TOEFL) is a mandatory English proficiency test for university students as a measure of foreign language proficiency. However, a common problem is students’ unpreparedness for the test due to a lack of understanding of tips and tricks for answering TOEFL questions correctly. This community service activity was designed using a Participatory Action Research (PAR) approach. The purpose of this community service activity was to provide tips and tricks for answering TOEFL questions to the Islamic Economics student association at the Faculty of Islamic Studies, Trunojoyo University. A total of 50 participants participated in this community service activity. This community service activity was designed using a training method that focused on the problems faced by the participants regarding TOEFL test-solving strategies, so that they would be better prepared when taking the test at a language center or TOEFL test provider. This community service activity focused on three stages: preparation; training; and evaluation. The results of this community service activity had a positive impact on literacy skills related to TOEFL question-solving strategies. The results of the questionnaire given showed that students had a good understanding of the strategies and methods for solving TOEFL test questions so that they were better prepared to face TOEFL questions when they took the TOEFL test.

Abstract

This article discusses the reconstruction and reorientation of polygamy regulations in the Compilation of Islamic Law (KHI), specifically Articles 55–59, through the philosophical framework of maqāṣid al-usrah developed by Jamāluddīn ‘Aṭiyyah. This research is crucial given that the KHI, having been in force for over 30 years, requires a new reading (the expedient of re-interpretation) to preserve the values of maqāṣid in facing contemporary social dynamics. This qualitative study, utilizing a library research method and content analysis, aims to explore the maqāṣid values and evaluate their alignment with Indonesia’s positive legal norms. The analysis results indicate that the KHI implicitly integrates three core dimensions of ‘Aṭiyyah’s maqāṣid al-usrah, namely taḥqīq al-sakīnah wa al-mawaddah wa al-raḥmah, tanẓīm al-’alāqah bayn al-jinsayn, and tanẓīm al-jānib al-mālī li al-usrah, primarily through the key requirement of acting justly (Article 55 Paragraph 2) and the necessity of obtaining permission from the Religious Court (Article 56). ‘Aṭiyyah’s concept, which demands psychological and emotional justice (al-’adālah al-nāfsi-yah wa al-wijdāni-yah), provides a strong foundation for reorienting the interpretation, shifting the focus from formal procedure to the substance of the objective. The article recommends adding ethical and social clauses (such as psychological assessment) and explicitly integrating the maqāṣid al-usrah principles into the KHI, so that Islamic family law can serve as a contextual, humanistic, and solution-oriented guide in realizing substantive justice and protecting family sakīnah.
