Abstract

Waste management issues in Batam City have become a critical environmental concern amid rapid population growth and intensive industrial activities. Although the Batam City Government has enacted Regional Regulation Number 11 of 2013 on Waste Management as a legal framework, its implementation in practice continues to face significant challenges. This study aims to analyse the effectiveness of the regulation and its legal implementation during the period 2024–2025, as well as to identify the inhibiting factors affecting its enforcement. The research employs an empirical legal method using statutory and sociological approaches, supported by interviews with officials from the Environmental Agency and officers at the Telaga Punggur Final Disposal Site (TPA). The findings indicate that the effectiveness of the regulation remains low due to weak law enforcement, limited infrastructure and facilities such as waste collection fleets and heavy equipment and low public awareness regarding waste segregation and management. Based on Soerjono Soekanto’s theory of legal effectiveness, these constraints are closely related to law enforcement actors, supporting facilities, and the legal culture of the community. This study recommends strengthening regulatory enforcement, upgrading waste management facilities, enhancing public education, and fostering synergy among government, communities, and the private sector to achieve an effective and sustainable waste management system in Batam City.

Abstract

Pemenuhan hak bekerja bagi warga negara merupakan aspek penting dalam upaya mengentaskan kemiskinan. Penelitian ini membandingkan kebijakan serta pelaksanaan pemenuhan hak bekerja di Indonesia dan Malaysia untuk melihat seberapa efektif strategi yang digunakan dalam menurunkan angka kemiskinan. Metode yang digunakan adalah pendekatan kualitatif melalui studi perbandingan kebijakan ketenagakerjaan, regulasi, dan program sosial yang diterapkan di kedua negara. Hasil penelitian menunjukkan bahwa Malaysia memiliki sistem ketenagakerjaan yang lebih tertata, termasuk perlindungan sosial bagi pekerja, program pelatihan keterampilan, dan investasi sektor industri yang lebih terarah. Di sisi lain, Indonesia masih menghadapi tantangan berupa regulasi ketenagakerjaan yang rumit, tingginya tingkat pekerjaan informal, serta keterbatasan akses terhadap pelatihan kerja. Berdasarkan temuan tersebut, penelitian ini merekomendasikan perlunya peningkatan sinergi antara pemerintah, sektor swasta, dan lembaga pelatihan untuk memperkuat sistem ketenagakerjaan di Indonesia, sehingga akses terhadap pekerjaan yang layak dan berkelanjutan dapat ditingkatkan sebagai langkah strategis dalam mengentaskan kemiskinan.

Abstract

Kebocoran data pribadi oleh entitas korporasi digital di Indonesia terus meningkat. Mekanisme pertanggungjawaban pidana korporasi belum berjalan efektif sehingga menimbulkan kekhawatiran terhadap perlindungan hak privasi warga negara di era digital. Penelitian ini bertujuan menganalisis pengaturan dan penerapan pertanggungjawaban pidana korporasi terhadap kebocoran data pribadi di Indonesia serta membandingkannya dengan praktik di Uni Eropa dan Amerika Serikat. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perbandingan hukum dan studi kasus. Data diperoleh melalui studi kepustakaan terhadap peraturan perundang-undangan, putusan hukum, dan dokumen terkait yang dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa di Uni Eropa, korporasi dapat dimintai pertanggungjawaban pidana maupun administratif melalui General Data Protection Regulation, dengan sanksi administratif sebesar 10–20 juta Euro atau 2–4% dari omzet global, sementara penentuan sanksi pidana diatur oleh negara anggota. Di Amerika Serikat, korporasi dapat dimintai pertanggungjawaban pidana berdasarkan Federal Trade Commission Act dan aturan pidana federal, yang memberikan dasar hukum kuat untuk menindak perusahaan yang lalai melindungi data pribadi. Sebaliknya, di Indonesia, meskipun telah memiliki Undang-Undang Perlindungan Data Pribadi dan KUHP baru, mekanisme pertanggungjawaban pidana korporasi belum efektif karena ketiadaan lembaga pengawas independen dan penegakannya cenderung simbolik. Kondisi ini menegaskan urgensi penguatan mekanisme pertanggungjawaban pidana korporasi serta pembentukan otoritas pengawas independen guna memperkuat perlindungan data pribadi di Indonesia.

Abstract

The rapid proliferation of online gambling in Indonesia has prompted the Ministry of Communication and Informatics to implement large-scale algorithmic blocking measures, creating a critical tension between cybersecurity enforcement and citizen data protection. This study investigates the unintended consequences of these automated blocking mechanisms on government digital infrastructure that hosts personal data. Using normative legal research methodology with a conceptual approach grounded in Gustav Radbruch's legal philosophy which emphasizes. The research analyzes primary legal materials, including the Electronic Information and Transactions Law and implementing regulations, supplemented by secondary data from policy documents and case studies of breached government websites. Results demonstrate that while algorithmic blocking has successfully reduced gambling site accessibility by over 80%, it has simultaneously compromised data security indiscriminately blocking compromised government portals without adequate due process mechanisms. The absence of transparent algorithmic criteria in the TRUST+Positif system and the lack of procedural safeguards have created legal uncertainty and disproportionate impacts on public service delivery. The study concludes that Indonesia's current approach prioritizes technical utility over justice and legal certainty, necessitating regulatory reforms that balance cybersecurity objectives with constitutional privacy protections through precision-based blocking, algorithmic transparency requirements, and independent oversight mechanisms to ensure digital governance that respects fundamental rights while effectively combating online gambling.

Abstract

Domestic violence remains a pervasive social and legal issue in Indonesia, particularly in Batam City, despite existing legal frameworks. This study aims to analyze the effectiveness of resolving domestic violence cases through restorative justice at the Batam City Prosecutor’s Office and to identify factors influencing its implementation. Employing an empirical legal research method with a juridical-sociological approach, data were collected through interviews, observations, and document analysis. The results reveal that while restorative justice provides a humane and efficient alternative to conventional prosecution—prioritizing victim recovery, offender accountability, and the restoration of social harmony—its application faces challenges. These include limited regulatory authority, punitive mindsets among law enforcement, and low public awareness. However, supporting factors such as an established legal basis, positive prosecutorial attitudes, and community involvement contribute to its success. The study concludes that restorative justice is a viable, progressive approach to addressing domestic violence cases. Sustainable implementation requires regulatory refinement, professional training, and cultural shifts toward restorative principles.

Abstract

Environmental governance in Southeast Asia continues to face serious challenges due to climate change, pollution, and the persistent tension between centralized authority and local autonomy. This study addresses the legal problem of whether decentralization frameworks in Indonesia, Thailand, and the Philippines adequately support environmental governance and the protection of the right to a healthy environment. The study aims to comparatively assess the normative structure of decentralization and environmental regulation in those three jurisdictions and to identify the legal implications of centralized tendencies within their governance systems. This research employs a doctrinal legal research method with a comparative approach, relying on primary legal sources and relevant secondary materials. The findings show that all three countries formally recognize local governmental roles in environmental management, yet substantial centralized control remains dominant. Indonesia and Thailand exhibit stronger top-down regulatory structures that constrain local autonomy, while the Philippines offers a relatively more participatory and comprehensive framework, though it remains highly fragmented. The study concludes that decentralization in ASEAN environmental governance has not yet fully ensured effective legal protection of the right to a healthy environment.

Abstract

The central legal problem of this study lies in the normative inadequacy and weak enforcement construction of the right to be forgotten within the personal data protection regimes of Indonesia and Thailand amid escalating data breaches in Southeast Asia. This research aims to analyze and compare the normative framework governing the right to be forgotten in Indonesia and Thailand with selected global benchmarks, namely the European Union, South Korea, and the United States, in order to formulate ideal legal constructs adaptable to Southeast Asian contexts. This study employs a normative legal research method supported by a comparative legal approach, examining statutory regulations and secondary legal materials from Indonesia, Thailand, the EU (GDPR), South Korea (PIPA), and the United States (CCPA). The findings reveal that although Indonesia’s Personal Data Protection Law and Thailand’s Personal Data Protection Act formally recognize deletion rights, both frameworks remain incomplete due to limited procedural clarity, weak dispute resolution mechanisms, insufficient third-party deletion obligations, and ambiguous safeguards against re-identification risks. In contrast, the EU’s GDPR mandates third-party takedown obligations and imposes severe financial sanctions, South Korea’s PIPA provides strict deletion duties combined with criminal penalties, and the CCPA establishes structured compliance and notification mechanisms. Consequently, strengthening enforcement pathways, clarifying procedural guarantees, and integrating stricter controller obligations are essential for Indonesia and Thailand to ensure effective realization of the right to be forgotten in rapidly expanding digital societies.

Abstract

The development of deepfake artificial intelligence technology poses new challenges for Indonesian criminal law because it can be used to digitally manipulate a person’s face, voice, and identity. This study aims to analyze the modus operandi of deepfake AI technology abuse as well as the legal liability of perpetrators in digital fraud crimes. This study employs a normative legal research method using a statutory approach, a case-based approach, and a conceptual approach. The results indicate that the modus operandi of deepfake misuse involves the dissemination of AI-generated manipulative videos featuring President Prabowo Subianto, purporting to offer financial assistance to the public, accompanied by a WhatsApp number to direct victims to communicate with the perpetrator and transfer funds. Legal liability in this case arises because the perpetrator’s actions satisfy the elements of a criminal offense: there is intent, the perpetrator possesses the capacity to be held accountable, and no justifying or exculpatory grounds are found. This criminal liability is based on Article 51(1) in conjunction with Article 35 of the ITE Law and Article 378 of the Criminal Code, while the PDP Law is used as a supporting normative instrument in addressing the misuse of digital identities in the form of faces and voices. This study underscores the importance of strengthening regulations, digital evidence, and harmonizing legal frameworks regarding the misuse of deepfake technology.

Abstract

This study aims to understand the concept of judicial pardon in the national Criminal Code, as well as to examine the comparative application of judicial pardon between Indonesia and the Netherlands. This research uses a normative legal research method, applying the statute approach, conceptual approach, comparative approach, and historical approach. Based on the research conducted, the findings are as follows: 1) In the existing legal system, the concept of judicial pardon is not yet recognized or implemented in Indonesia. The mechanism for granting pardon falls under the authority of the executive, namely the President, through the provision of clemency, amnesty, and abolition. Although judicial institutions, such as the Supreme Court, are involved in the consideration process, the final decision remains in the hands of the President. Therefore, it does not reflect the essential characteristic of judicial pardon, which originates from the judiciary itself. 2) The Dutch legal system has implemented the concept of judicial pardon, allowing active involvement of judicial institutions in the pardon-granting process. Although pardons are formally issued by the King, the decisions are based on strong judicial and administrative considerations.

Abstract

The implementation of Regional Election oversight through the SIWASLIH application in Batam City continues to face operational constraints, barriers to digital adaptation, and limited supporting facilities for Polling Station Supervisors. This empirical legal research aims to evaluate the effectiveness of Polling Station Supervisor recruitment, analyze the determinants of recruitment dysfunction, and formulate optimization strategies based on digital literacy competence. Using a socio-legal approach, data were collected through in-depth interviews with seven informants and analyzed through a synthesis of legal system theory and legal effectiveness theory. The findings show that the ineffective use of SIWASLIH is caused by the absence of technical recruitment norms that explicitly assess the digital literacy competence of Polling Station Supervisors. Article 27 of Law Number 8 of 2015 provides the normative basis for the duties, authorities, and reporting obligations of Polling Station Supervisors. However, the implementation of these obligations through SIWASLIH has not been supported by adequate digital selection instruments under Bawaslu Regulation Number 19 of 2017 or Decree of the Chairperson of Bawaslu Number 301/HK.01.01/K1/09/2024. The absence of these technical indicators causes recruitment to rely on administrative assessment and general interviews. This study recommends revising technical recruitment instruments, affirming digital literacy indicators in Bawaslu regulations, developing SIWASLIH with offline functionality, providing practice-based technical training, and establishing a task force for technological assistance.
