Abstract

The principle of ultimum remedium in environmental criminal law is a principle that places criminal sanctions as the last resort after administrative and civil sanctions are no longer effective. This principle aims to ensure that environmental law enforcement proceeds proportionally and not repressively. However, in practice in Indonesia, the application of the ultimum remedium principle often creates a dilemma between environmental protection and economic development interests. Many environmental violations such as forest fires, river pollution, and illegal mining activities are resolved only through administrative measures without criminal sanctions, even though the resulting damage is highly significant. This study employs a normative juridical method with statutory, conceptual, and case approaches to analyze the extent to which the implementation of the ultimum remedium principle can uphold ecological justice. The research findings show that the application of this principle in Indonesia tends to be weak, as many environmental violations are not prosecuted criminally under the pretext of efficiency and economic stability. In fact, environmental criminal law plays a crucial role as a deterrent instrument against environmental crimes. Therefore, environmental law reform in Indonesia needs to be directed toward strengthening criminal law enforcement against offenders—especially corporations responsible for large-scale environmental damage.

Abstract

This research, entitled “A Juridical Analysis of Village Fund Corruption Crimes (A Case Study at the Simalungun District Prosecutor’s Office),” is motivated by the increasing number of cases involving the misuse of village funds that have caused state financial losses and eroded public trust in village governments. The study aims to analyze how the law is applied in cases of village fund corruption handled by the Simalungun District Prosecutor’s Office, to identify the obstacles encountered by prosecutors in handling such cases, and to evaluate the effectiveness of law enforcement in eradicating corruption involving village funds. The research adopts a normative juridical method using statutory, conceptual, and case approaches, focusing on the Kardianto case handled by the Simalungun District Prosecutor’s Office. The data sources consist of primary legal materials, such as legislation and indictment documents; secondary legal materials, including books, journals, and previous research; and tertiary legal materials, such as legal dictionaries and encyclopedias. The findings reveal that the application of law in cases of village fund corruption has been carried out in accordance with Law No. 31 of 1999 in conjunction with Law No. 20 of 2001 on the Eradication of Corruption Crimes and Law No. 6 of 2014 on Villages. However, the effectiveness of law enforcement remains hindered by overlapping regulations, limited human resources, weak inter-agency coordination, and low levels of legal awareness among the community. Nevertheless, the Simalungun District Prosecutor’s Office has demonstrated progressive measures through the implementation of the Jaksa Garda Desa (Village Guardian Prosecutor) program and the digitalization of public-fund monitoring. The study concludes that law enforcement against village fund corruption in the jurisdiction of the Simalungun District Prosecutor’s Office has been relatively effective in its repressive aspects but needs strengthening in preventive and participatory dimensions. Institutional reform, capacity building for law enforcement officers, and active community participation are essential to establishing transparent, accountable, and corruption-free village governance.

Abstract

The mass media plays a strategic role in overseeing government operations and informing the public, particularly in the context of uncovering corruption cases. This study aims to analyze the media's role in uncovering and shaping public opinion regarding corruption cases in Indonesia. Through a qualitative approach using case studies of several media reports related to major corruption cases, it was found that the media acts as a social watchdog, a driver of public opinion, and a catalyst for law enforcement action. However, the media also faces challenges such as interference from political interests and limited access to information. The study's findings indicate that the existence of free and independent media is crucial for strengthening transparency and public accountability. Therefore, strengthening journalistic professionalism and ethics is key to increasing the effectiveness of the media's role in eradicating corruption.

Abstract

This research examines the optimization of natural and artificial lighting in the ABG Computer Laboratory using Dialux simulation. The study aims to evaluate daylight performance based on window configuration, investigate the causes of deviation between simulation results and on-site illuminance measurements, and develop an artificial lighting layout that fulfills visual comfort standards for computer-based learning spaces. The initial daylight simulation revealed that 59.8% of the total floor area achieved illumination levels of ≥300 lux; however, field measurements showed substantially lower illuminance due to shading from dense vegetation in front of the façade, leading to uneven light distribution across the room. The artificial lighting simulation using 50W 6500K LED luminaires successfully provided uniform illuminance of ≥500 lux throughout the working plane. These findings confirm that a hybrid lighting system—integrating optimized daylight and artificial lighting—is the most reliable and energy-efficient solution for computer-oriented educational environments.

Abstract

Thermal comfort is a fundamental parameter in architectural performance, especially in tropical climate regions. This study presents a thermal evaluation an outdoor open courtyard in the Faculty of Engineering, Universitas Negeri Gorontalo. Field measurements were conducted for 60 minutes using air temperature, black-globe radiation temperature, relative humidity, and wind speed as primary indicators. Results show that the courtyard exceeded comfort tolerance: average temperature reached 46 , global radiation >47 , humidity ranged from 32–48 %, and wind speed was near stagnant. The analysis reveals that direct solar exposure, heat-retentive paving, and blocked cross-ventilation due to building mass arrangement are the main contributors to outdoor thermal stress.

Abstract

The phenomenon  of child grooming that develops through digital media is a form of modern sexual violence that poses a serious threat to children as a vulnerable group. This practice is carried out by the perpetrator establishing communication, building closeness, and psychological manipulation of children for the purpose of sexual exploitation. This research aims to examine the criminal act of child grooming as a form of digital sexual violence and analyze the legal accountability of perpetrators according to laws and regulations in Indonesia. The research method used is normative juridical research with a legislative and conceptual approach. The results of the study show that the crime of child grooming has been regulated in Law Number 17 of 2016 concerning Child Protection and Law Number 12 of 2022 concerning the Crime of Sexual Violence. Both regulations affirm that perpetrators can be sentenced to criminal sanctions, either in the form of imprisonment or additional penalties, taking into account the aspect of child protection as a victim. Thus, the accountability of child grooming  perpetrators not only emphasizes on the criminal aspect, but also on the prevention and recovery of victims.

Abstract

This study analyzes the application of restorative justice to aggravated theft crimes at the East Medan Police Sector between January 2022 and June 2025. The approach used is a normative-empirical study with a juridical-sociological framework. The normative aspect examines Article 363 of the Criminal Code, Law Number 2 of 2002, Police Regulation Number 8 of 2021, Attorney General Regulation Number 15 of 2020, and Supreme Court Regulation Number 1 of 2024. The empirical aspect captures practices at the East Medan Police Sector through case data, interviews with investigators, victims, and perpetrators, as well as administrative documentation. The caseload under Article 363 has been relatively stable at 28 to 46 reports per quarter, with motorcycle theft accounting for 57 to 64 percent. Restorative justice facilitation is selectively implemented in 4 to 8 cases per quarter, with a success rate of 60 to 75 percent, and a resolution time of 18 to 21 days, faster than the typical 40-day transfer of files. Key criteria include voluntary consent from the parties, non-recidivists, restitution of losses, and a lack of public unrest. Cases involving violence, serious threats, or those that disrupt public security are not transferred to restorative justice and remain in litigation. Findings indicate that this restorative justice mechanism is effective for certain cases, consistent with the principle of ultimum remedium, reduces the burden of the judicial process, and increases party satisfaction. However, obstacles arise from differing perceptions among law enforcement officials, concerns about the deterrent effect, and inconsistent post-mediation monitoring. The study recommends strengthening SOPs based on eligibility indicators, mediation training for investigators, formal coordination with prosecutors and courts, involvement of community leaders, and post-settlement monitoring by Bhabinkamtibmas to prevent recurrence and maintain accountability.

Abstract

The principle of proportionality is an important principle in criminal law that serves to ensure a balance between the severity of the crime and the punishment imposed. In crimes of assault in Indonesia, the application of the principle of proportionality is crucial because variations in the form of assault often lead to differences in the level of culpability of the perpetrator and the impact on the victim. This study aims to analyze the application of the principle of proportionality in criminal justice practice, particularly in relation to judges' decisions in assault cases. The method used is a normative juridical approach by examining the provisions of the Criminal Code (KUHP), legal doctrine, and relevant court decisions. The results of the analysis indicate that the application of the principle of proportionality still faces several obstacles, such as disparities in decisions, judges' subjectivity in assessing mitigating and aggravating circumstances, and limited binding sentencing guidelines. Nevertheless, the principle of proportionality remains an important foundation in realizing substantive justice, by considering aspects of victim rights protection, crime prevention, and social reintegration for perpetrators. In conclusion, the application of the principle of proportionality in criminal acts of assault in Indonesia requires consistent application by judges, clearer sentencing guidelines, and strengthening the role of progressive law to achieve a balance between individual and societal interests.

Abstract

Regarding the criminal act of fraud in the recruitment of civil servants involving corrupt civil servants, the author believes that Article 378 of the Criminal Code should be maximally applied to the defendant. This crime not only constitutes an individual offense but also undermines public trust, meritocracy, and good governance principles, causing both personal and institutional harm. Hence, the sentence of 1 year and 8 months imposed on Suwari Bin Sukadar by the Mojokerto District Court (Register Number 182/Pid.B/2024/Pn Mjk) seems too light and may not effectively deter potential offenders.

Abstract

Penilaian kinerja merupakan praktik penting dalam manajemen sumber daya manusia yang berperan strategis dalam meningkatkan kinerja karyawan, terutama di sektor kesehatan yang menuntut kualitas pelayanan tinggi seperti di Kabupaten Paser, Kalimantan Timur. Penelitian ini bertujuan untuk menganalisis hubungan antara penilaian kinerja—meliputi perencanaan, metode, tujuan, dan umpan balik—dengan kinerja tenaga kesehatan dan staf administrasi di fasilitas layanan kesehatan daerah tersebut. Metode penelitian yang digunakan adalah deskriptif kuantitatif dengan populasi 1.200 karyawan dan sampel 300 responden yang dipilih secara proporsional berstrata; data dikumpulkan melalui kuesioner dan dianalisis menggunakan statistik deskriptif dan inferensial dengan software SPSS. Hasil penelitian menunjukkan bahwa seluruh dimensi penilaian kinerja memiliki hubungan positif dan signifikan terhadap kinerja karyawan, dengan umpan balik sebagai faktor yang memberikan pengaruh paling besar (r = 0,768, p < 0,01). Temuan ini konsisten dengan teori motivasi dan manajemen hasil yang menekankan pentingnya keterlibatan aktif dan transparansi dalam evaluasi kinerja. Kesimpulannya, sistem penilaian kinerja yang dirancang secara objektif, transparan, dan partisipatif dapat meningkatkan produktivitas dan mutu pelayanan kesehatan di Kabupaten Paser. Penelitian merekomendasikan penguatan perencanaan, penerapan metode evaluasi yang terukur, penetapan tujuan yang jelas, serta pengelolaan umpan balik yang sistematis agar implementasi penilaian kinerja lebih efektif dan berkelanjutan.
