Abstract

Pasal 18B ayat (2) UUD NRI 1945 mengatur mengenai penghormatan dan pengakuan atas satuan-satuan masyarakat hukum adat beserta hak-hak tradisionalnya sepanjang keberadaannya masih ada. Salah satu hak masyarakat adat di masyarakat pesisir di Provinsi Lampung ialah hak rumpon sebagai hak ulayat laut. Rumpon laut secara bahasa merupakan jenis alat bantu penangkapan ikan yang dipasang di laut, baik laut dangkal maupun laut dalam. Saat ini eksistensi rumpon laut terancam keberadaannya karena untuk menjaga dan melestarikan sistem pengelolaan perikanan ini tidak didukung oleh tindakan nyata oleh Pemerintah dan masyarakat sekitar pesisir. Tulisan ini melakukan pengkajian atas hak masyarakat hukum atas hak ulayat rumpon di Provinsi Lampung dengan fokus penelitian pada eksistensi hak ulayat laut rumpon pada masyarakat Lampung dan perlindungan konstitusional atas hak ulayat rumpon laut. Metode penelitian yang digunakan yaitu metode socio-legal yang melakukan kajian terhadap aspek hukum dalam ranah das sollen dan das sein.Article 18B paragraph (2) of the 1945 Constitution of the Republic of Indonesia regulates the respect and recognition on customary law community units and their traditional rights as long as they still exist. One of the rights of indigenous peoples in coastal communities in Lampung Province is rumpon’s right as the ulayat right of the sea. Literaly, Rumpon laut is a type of fishing gear installed in the sea, both the shallow and the deep one. Currently the existence of rumpon laut is threatened because the maintenance is not supported by concrete actions by the Government and coastal communities. This paper conducts an assessment of the community’s right on customary rights of rumpon laut in Lampung Province. This paper focuses on the existence of the ulayat right of rumpon laut in Lampung and the constitutional protection of the ulayat right of rumpon laut. The research method used is a sociolegal method that studies the legal aspects in the realm of das sollen and das sein.

Abstract

Genetically Modified foods are now being widely consumed. In 2011, more than 90% of corns and soybeans in the US are genetically modified. Research shows in America the people suffering from allergies are increasing. Some people connected the allergies with the widely consumed genetically modified foods. But other researchers show that genetically modified food bring no harms to human. In fact, genetically modified foods are cheaper and will be a great tool to fight against poverty and hunger. But in countries like Italy, Austria, and the Netherlands, they have fully banned genetically modified organisms, making them the GMO’s free Country. In the survey conducted, most consumers are not educated enough about GMO. They also concern about the impact of genetically modified food on human health, environmental and animal health.

Abstract

Indonesia is an archipelagic country, consisting 17,508 big and small islands. People need  for land is increasing in big cities, and also those in small islands. The one and only way for people in small islands meet the need for land is by exploiting coastal areas and beaches to be a place of residence and place of business. Coastal and costal areas should be protected by spatial planning systems and managed wisely by local governments. Any development activities and utilization of coastal areas shall be subject to the provisions of the written positive law. Communities should also understand   that development and community activities can impact on the availability of fish and the presence of coral reefs, mangrove forests or seagrass beds whose existence can affect the livelihoods of local communities. The research method used is empirical. It is necessary to prevent the utilization of coastal border space for purposes other than public purposes. The beach is owned by everyone, therefore it must be prevented exclusive use for personal interest by making a fence or building directly on the beach.Keyword: beach, coastal, small islands

Abstract

The growth of the elderly population in Indonesia is greatly increasing. Maintain the survival of parents, and prevent the occurrence of danger, risks, and violations of human rights of parents is important. The issue discussed in this article is how the legal protection of the elderly who experienced psychological and financial violence. The research method used is socio-legal research. The results show that legal protection against the elderly has not been well implemented. Article 321 of the Civil Code provides for mutual obligations between parents and children. Article 9 of the Law on the Elimination of Domestic Violence regulates the scope of households and the prohibition of neglecting a person within the scope of the household. Article 8 of Law Number 13 Year 1998 on Elderly Welfare affirms that government, community and family are responsible for the improvement of elderly welfare. Implementation of Article 46 regarding the responsibility of the child to the elderly parent has not been effective. This can be seen of how many people who do not know the existence and content of the relevant provisions, many people neglecting their obligation ignoring their elderly parents. Legal protection of the elderly, which covers the recognition of the rights of the elderly, the protection of their interests and intentions, is not written in detail because the various provisions of how the Law are summarized. Sociologically, these provisions often escape the attention of the public, although the rules of non-law provide a special affirmation that supports the rule of law. Keywords: Legal protection, elderly parents, psychology, finance violances.

Abstract

The paradigm of boundary management of Indonesia Timor Leste region in Atambua Bobonalo has the implementation to the boundary region condition which is relatively isolated and left behind from the economic aspect, defense aspect and national security aspect as well as the legal aspect. It is also required the welfare approach besides the security approach and also the boundary management system which is well and professionally organized. The boundary region needs more attention from the govemment for that side defense and security is very dependent. Infrastructure in Timor Leste boundary development shall be adequate in the context of defense and security such as the weapon system supply, infrastructure and suprastructure boundary development, recognition/protection of indigenous people rights regulations, the drafting and stipulating the cross-boundary regulations as well as the rule of law supremacy and the improvement of the professionalism of govemment officials. All in all, we need to maintain the nationalism to the society at the boundary region, and the implementation of policy pattern approach which would not leave the local wisdom behind.

Abstract

Since act number 5 of 1960 concerning basic regulations on agrarian principles on 24th of September 1960, it was a historic day for Indonesia. Because, that was the unification day of the land law, by revoked the land legal dualism in Indonesia for the sake to create a legal protection and also giving the legal certainty to the holders of the land rights. Likewise the act number 19 of the basic regulations on agrarian principles have instruct to held a land registration then published a land rights certificate as a proof of land ownership. It is a vigorous but not the absolute proof of land ownership, because of the impact of publication system that held in land registration in Indonesia, the land rights certificate can be canceled by a person who feels that he has rights of the land concerned. That makes the purpose of the basic agrarian principles, may not be effective due to the process of law in Indonesia concerning that basic regulations on agrarian principles concerning that it has been 58 years since the day it published.

Abstract

One of the famous indigenous peoples who participate in national development is the Baduy Tribe. The commercial appeal of the Baduy tribe lies in the cultural values and local wisdom that they continue to maintain. However, there are challenges for creative economy actors from the Baduy customary law community, especially in harmonizing applicable customary law and other laws that regulate the industry. The establishment of regulations related to this is deemed very necessary and important, one of which is to provide legal protection for creative business actors who have created original works known as intellectual property. This research examines the form of legal protection for creative economy business actors of the Baduy Customary Law Community and what factors are the obstacles in efforts to protect the law against creative economy business actors of the Baduy Customary Law Community. This research is descriptive and normative legal research using a qualitative approach. The government's form of legal protection is by imposing IPR, Creative Economy Law 24/2019, Law 28/2014 concerning Copyright, and Law 20/2016 concerning Marks and Geographical Indications. The legal protection sought by the law against the creative actors of the Baduy Indigenous Law Community is preventive in nature, namely through the registration process by applying information technology, while the lives of the Baduy people tend to severely limit the use of modern technology. The pattern of the Baduy community which is religiously magical and cosmic is the main obstacle where people live with an ascetic value system that is at odds with the values adopted by modern society.Salah satu masyarakat hukum adat yang tersohor dan turut serta dalam pembangunan nasional adalah Suku Baduy. Daya tarik komersial Suku Baduy terletak pada nilai budaya dan kearifan lokal yang terus dipertahankan oleh mereka. Namun ada tantangan tersendiri bagi pelaku ekonomi kreatif dari kalangan masyarakat hukum adat Baduy, terutama dalam menyelaraskan hukum adat yang berlaku dan hukum lainnya yang mengatur industri tersebut. Pembentukan aturan terkait hal itu dirasa sangat perlu dan penting, salah satunya untuk memberi perlindungan hukum terhadap pelaku usaha kreatif yang telah menciptakan karya orisinil yang dikenal sebagai kekayaaan intelektual. Penelitian mengkaji tentang wujud perlindungan hukum terhadap pelaku usaha ekonomi kreatif Masyarakat Hukum Adat Baduy dan faktor-faktor apa saja yang menjadi kendala dalam upaya perlindungan hukum terhadap pelaku usaha ekonomi kreatif Masyarakat Hukum Adat Baduy. Penelitian ini merupakan penelitian hukum normatif yang bersifat deskriptif dengan menggunakan pendekatan kualitatif. Wujud perlindungan hukum pemerintah yaitu dengan memberlakukan HKI, UU Ekraf 24/2019, UU 28/2014 tentang Hak Cipta dan UU 20/2016 tentang Merek dan Indikasi Geografis. Perlindungan hukum yang diupayakan oleh undang-undang terhadap para pelaku ekraf Masyarakat Hukum Adat Baduy bersifat preventif yaitu melalui proses pendaftaran yang dengan menerapkan teknologi informasi, sementara kehidupan orang Baduy cenderung sangat membatasi pemanfaatan teknologi modern. Corak masyarakat Baduy yang religio magis cosmic adalah kendala utama dimana masyarakat hidup dengan sistem nilai asketis yang berseberangan dengan nilai yang dianut oleh masyarakat modern.
