Abstract

Fenomena hukum terhadap Anggota Koperasi Simpan Pinjam tersebut dinyatakan pailit sebagai perangkat Organisasi dari suatu badan hukum koperasi, Anggota bertanggung jawab atas perbuatannya jika terjadi resiko kerugian pada Koperasi tersebut. Rumusan Masalah dalam penelitian ini adalah Bagaimana Perlindungan Hukum Terhadap Anggota Terkait Koperasi Simpan Pinjam Yang Dinyatakan Pailit? Dan Bagaimana? Akibat Hukum Terhadap Koperasi Simpan Pinjam Yang Dinyatakan Pailit? Teori yang digunakan adalah Teori Akibat Hukum dari Soeroso dan Teori Perlindungan Hukum dari Satjipto Rahardjo. Metode yang digunakan dalam penelitian ini dengan jenis penelitian yuridis normatif yaitu penelitian hukum kepustakaan atau data sekunder dengan sumber bahan-bahan hukum primer, sekunder dan tersier. Adapun pendekatan penelitian yang dipergunakan pendekatan perundang-undangan, pendekatan konseptual, pendekatan analitis, pendekatan kasus dan teknik pengumpulan bahan hukum dilakukan dengan cara mengidentifikasi dan menginventarisasi aturan hukum positif, literatur buku, jurnal dan sumber bahan hukum lainnya. Untuk teknik analisa bahan hukum dilakukan dengan penafsiran hukum gramatikal, sistematis dan metode konstruksi hukum. Dari hasil penelitian dapat disimpulkan bahwa a) Akibat hukum terhadap Koperasi Simpan Pinjam Yang Dinyatakan Pailit Sangatlah penting Akibat dari Kepailitan tersebut tidak hanya dirasakan oleh Debitor saja akan tetapi Kreditor juga sebagai pihak yang dirugikan, Koperasi yang telah diputuskan pernyataan pailitnya oleh Pengadilan Niaga, maka haruslah melakukan pemberesan atau penyelesain pembubaran melalui Tim Penyelesaian, b) harus adanya Perlindungan Hukum terkait Anggota apabila Koperasi simpan Pinjam di Nyatakan Pailit dan Saran dari penulis perlunya penyempurnaan Undang-Undang Pengkoperasian dan Undang-Undang Kepailitan  khusunya mengenai hak dan kewajiban anggota koperasi simpan pinjam yang turut di berikan tangggujawab dalam koperasi simpan pinjam yang dinyatakan pailit dan saran untuk mengatur secara jelas dalam Undang-Undang Pengkoperasian.

Abstract

Adopted children are often a complex subject in the inheritance law system, because of their position between two families, namely the biological family and the adoptive family. This research will examine the legal framework governing the inheritance rights of adopted children, evaluate conflicts that may arise between civil law and social practice, and offer legal solutions or recommendations that can balance the interests involved. This research uses a qualitative approach with descriptive methods. The research results show that adoption has a major impact on the position of adopted children's inheritance rights in civil law. Although the adoption process through the courts can provide stronger legal certainty regarding the inheritance rights of adopted children, there are variations in local legal provisions that influence the recognition and allocation of inheritance rights of adopted children. The importance of a clear and official legal process in regulating the status of adopted children is emphasized to ensure legal certainty and protection of their inheritance rights. Apart from that, gifts and wills also play an important role in the distribution of inheritance, but the calculation of legitimacy must be taken into account to ensure fairness in inheritance allocation. Thus, protection of the inheritance rights of adopted children needs to be strengthened by considering various legal aspects related to the inheritance process, to maintain justice, sustainability and peace in inherited families.

Abstract

This study provides a comprehensive legal analysis of the regulatory framework governing cash waqf-based real estate development projects in Indonesia. It critically examines the integration of Sharia principles with contemporary Indonesian business law, focusing on the legal challenges and opportunities that arise from this intersection. The research employs a normative legal approach, analyzing statutory provisions, recent jurisprudence from 2022-2024, and relevant fatwas from the National Sharia Council (DSN-MUI). Key findings reveal significant regulatory gaps, including overlapping institutional authorities, weak enforcement mechanisms, and a lack of harmonization between Law No. 4 of 2004 on Waqf and Law No. 2 of 2008 on Islamic Banking. The study further explores the role of innovative financial instruments, such as Cash Waqf-Linked Sukuk (CWLS), and the impact of recent OJK regulations on the participation of Islamic banks in waqf-based projects. By offering a detailed analysis of these legal dynamics, the research proposes a multi-faceted strategy to enhance legal certainty, strengthen governance, and unlock the full potential of cash waqf for sustainable and inclusive real estate development in Indonesia. The paper concludes with actionable recommendations for policymakers, regulators, and practitioners to foster a more robust and Sharia-compliant ecosystem for waqf financing.

Abstract

The Constitutional Court of the Republic of Indonesia, through Decision Number 23/PUU-XIX/2021, opened the possibility for debtors to file a cassation appeal against Postponement of Debt Payment Obligation (PKPU) decisions submitted by creditors when the debtor’s proposed settlement plan has been rejected. This ruling serves as a constitutional correction to Article 235(1) and Article 293(1) of Law No. 37 of 2004, which previously denied debtors any legal remedies. However, the practical implementation within the Commercial Court remains inconsistent with the Constitutional Court’s mandate. Administrative mechanisms of the Supreme Court, including SEMA No. 1 of 2022 and Decree No. 109/2020, have yet to be aligned with this decision, resulting in debtor cassation petitions being rejected on formal grounds, as seen in several PKPU cases. This research employs a normative legal research method, utilizing statutory, case-based, historical, and analytical approaches. The study examines primary, secondary, and tertiary legal materials through qualitative juridical analysis to assess the implications of the Constitutional Court’s ruling and the form of legal certainty that should be afforded to debtors. The findings indicate that Decision 23/PUU-XIX/2021 normatively grants debtors a constitutional right to seek cassation. Nevertheless, inconsistencies in the Supreme Court’s procedural regulations have generated significant legal uncertainty for debtors. When viewed through the lens of the rule of law and legal certainty theories, such conditions contradict the principles of justice, clarity, and protection of legal subjects. Therefore, regulatory harmonization, procedural reform, and administrative adjustments at the Commercial Court level are required to ensure the effective implementation of the Constitutional Court’s decision and to guarantee genuine legal certainty for debtors

Abstract

The principle of ultimum remedium in tax criminal law is designed as thefinal boundary of law enforcement, to be used only when administrativemeasures are no longer effective. However, in the practice of handlingcorporate tax crimes in Indonesia, this principle is often disregarded,resulting in punishment becoming the first step rather than the last resort.This study aims to analyze the effectiveness of ultimum remedium as amechanism for state loss recovery and to assess the extent to which itsimplementation reflects the principles of justice and fiscal efficiency.Additionally, this study examines the relevance of this principle from anIslamic law perspective, particularly in relation to the concept ofrestorative justice and the state's role in realizing public welfare(maslahah). Using a normative juridical approach supported byempirical data from court decisions and interviews, this study finds thatthe ultimum remedium principle has not been consistently applied andtends to have no significant impact on state financial recovery. From anIslamic law standpoint, these findings reinforce the argument that asystem prioritizing the restoration of state rights (the rights of Baitul Mal)should take precedence over physical sanctions, in accordance with thespirit of justice oriented toward public benefit. As a novel contribution,this study proposes a restorative fiscal justice approach model thatpositions ultimum remedium as an active strategy for recovering losses,not merely as a principle of criminal limitation. These findings areexpected to strengthen the direction of economic criminal law reformtoward a system that is more proportional, efficient, and adaptive to stateneeds, while aligning with ethical and religious values.
