Abstract

Lahirnya Undang-Undang Nomor 4 Tahun 1996 tentang Hak Tanggungan ditujukan untuk menggantikan kedudukan hypotek  dan creditverband serta menjamin adanya kepastian hukum bagi para pihak akan pelunasan utangnya. Namun demikian masih saja pembuatan Akta Kuasa Menjual digunakan sebagai dasar peralihan hak milik atas tanah. Adapun rumusan masalah dalam penelitian ini adalah Bagaimanakah akibat hukum atas dibuatnya akta kuasa menjual yang dibuat dihadapan notaris dalam perjanjian utang piutang dan Bagaimanakah perlindungan hukum para pihak atas dibuatnya akta kuasa menjual tersebut. Adapun teori yang peneliti gunakan adalah Teori Perlindungan Hukum dari Philipus M. Hadjon dan Teori Akibat Hukum dari R. Soeroso. Metode yang digunakan dalam penelitian ini dengan jenis penelitian normatif ysitu penelitian hukum kepustakaan atau data sekunder dengan sumber bahan-bahan hukum primer, sekunder dan tersier. Adapun pendekatan penelitian yang dipergunakan yaitu pendekatan perundang-undangan, pendekatan kasus, pendekatan konseptual, pendekatan analitis dan teknik pengumpulan bahan hukum dilakukan dengan cara mengidentifikasi dan menginventarisasi aturan hukum positif, literatur buku, jurnal dan sumber bahan hukum lainnya. Untuk teknik analisa bahan hukum dilakukan dengan penafsiran gramatikan, penafsiran sistematis. Hasil penelitian ini diperoleh kesimpulan bahwa kuasa menjual  melanggar unsur objektif syarat sah perjanjian Pasal 1320 huruf d KUHPerdata tentang sebab yang halal sehingga berakibat batal demi hukum. Kuasa menjual tidak memberikan perlindungan hukum sama sekali kepada para pihak karena tidak memiliki kekuatan eksekutorial. Perlindungan hukum para pihak telah diatur dengan menggunakan lembaga jaminan sebagaimana Pasal 6, Pasal 14 dan Pasal 20 Undang-Undang Hak Tanggungan. Notaris/PPAT yang terbukti membuatkan kuasa menjual dapat dituntut dengan Pasal 1365 KUHPerdata yaitu Perbuatan Melawan Hukum.

Abstract

In reference to bankruptcy and PKPU, Article 290 of Law No. 37 of 2004 is in conflict with the existence of Supreme Court Circular Letter Number 5 of 2021. This study tackles the problem of putting the stay period in place for the execution of collateral in bankruptcy, which results from the refusal of peace in the form of deferring debt payments. It also looks at the stay period that surrounds collateral execution in bankruptcy and its implications for potential changes to the Bankruptcy Law in the future. The Contractarian Approach Theory serves as the Applied Theory, Bankruptcy Law Theory as the Middle Range Theory, and Legal Certainty Theory as the Grand Theory in this study. It employs a normative juridical research methodology with a statutory approach as its main focus. This method entails looking at and dissecting Law No. 37 of 2004's provisions regarding PKPU and bankruptcy. Secondary data, comprising primary, secondary, and tertiary legal materials, is the type of data utilized. Qualitative juridical analysis is used in the data analysis. According to Since there is no regulation regarding the suspension period for debtors declared bankrupt due to the Panel of Judges' rejection of a postponement of debt payment obligations, the theory of legal certainty has not been satisfied by the provisions regarding the suspension period (stay period) in Article 56, paragraph (1) of Law No. 37 of 2004 concerning Bankruptcy and PKPU

Abstract

Curator in carrying out their duties, namely the settlement/sale of property bankruptcy conducted publicly in accordance with Article 185 UUK PKPU, but if the sale in public is not feasible, then the sale under the hand can be executed with the permission of the supervising judge. Procedures for the sale of bankruptcy property in specify in the legislation and other regulations such as Regulation of the Minister of Finance of the Republic of Indonesia number 213 / PMK.06/2020 about Implementation of the auction which was later amended through the regulation of the Minister of Finance of the Republic Indonesia number 122 of 2023 concerning auction implementation guidelines. One of the rules that changed regarding the sale of collateral objects on behalf of third parties in the process bankruptcy that causes ambiguity in the authority of the curator in carrying out their duties.

Abstract

This research aims to analyse the implementation of parate execution in the legal system of property security in Indonesia, especially in relation to the protection of third-party rights. Although parate execution is a creditor's right that is legally regulated in legislation, its practice often raises issues of justice, legal certainty, and legal expediency. Third parties, such as heirs or auction buyers, often suffer losses because their rights are not properly considered or protected. This research uses a normative juridical approach by analysing parate execution cases involving conflicts between creditors, debtors, and third parties. The results show that there is injustice in the implementation of parate execution when the rights of third parties are ignored, as well as legal uncertainty due to inconsistent procedures and rules for execution. In addition, the current legal system has not been able to create optimal legal benefits, as third parties often do not receive adequate protection. Based on these findings, the study recommends clearer regulatory reforms and transparent procedures to protect the rights of third parties. This reform is needed to ensure that the implementation of parate execution is fair, provides legal certainty, and produces equitable benefits for all parties involved.

Abstract

This study investigates the effectiveness of mediation as a mechanism for resolving business disputes in Indonesia, focusing on its procedural efficiency and impact on the relationships between disputing parties. Employing a qualitative research approach with descriptive normative analysis, the research highlights the legal foundations of mediation established by laws such as Law No. 30 of 1999 and Supreme Court Regulation No. 1 of 2016, which mandate mediation prior to litigation. The findings reveal that while mediation presents significant benefits, including faster resolution times and cost savings, its effectiveness is contingent on several factors: public awareness, the quality of mediators, and the parties' willingness to engage collaboratively. The study emphasizes the importance of confidentiality, neutrality, and mutual interest as key principles in ensuring a fair mediation process. Despite the challenges faced, such as a preference for litigation and uncertainties regarding the enforcement of mediated agreements, the research indicates that mediation has the potential to enhance business relationships and streamline dispute resolution processes. The insights gleaned from this study not only contribute to the understanding of mediation within the Indonesian legal context but also offer valuable lessons for other jurisdictions aiming to develop their alternative dispute resolution frameworks.

Abstract

This study aims to determine the extent of the influence of Bankruptcy law consisting of Bankruptcy statements and Suspension of Debt Payment Obligations (PKPU), as one of the legal instruments in the settlement of problem loans in Indonesia consisting of management, peace, and/or settlement/sale of debtor assets carried out by the Curator in the bankruptcy process, or the Administrator in the PKPU process. The Bankruptcy declaration mechanism is based on a court decision which results in the execution having the same legal force as a court decision in general, so that the execution of bankrupt debtor assets must be carried out through public sales/auctions so that transparent, accountable, and accountable sales can be carried out. Meanwhile, the PKPU mechanism is intended to achieve peace so that debtors' debts and problematic credits can be restructured to creditors and so that the debtor's business can run again. Bankruptcy legal instruments are now a trend in resolving debt disputes or bad credit that is most in demand because of its faster resolution, considering that Bankruptcy law has a fast-dimensional legal system (speedy trial), so that the rights of creditors and debtors can be more guaranteed based on applicable law. Both through the Bankruptcy declaration mechanism and PKPU, both are intended to protect the interests of debtors and creditors.

Abstract

In the reality that occurs in society which has become a customary law where it starts from the element of mutual trust and then agrees on the price and object, then the parties continue the sale and purchase agreement by buying and selling under the hand with receipts. So there was a levering of the transfer of ownership of the ship to the buyer. Related to Article 5 letter a of the Regulation of the Minister of Transportation of the Republic of Indonesia Number PM 39 of 2017 concerning Registration and Nationality of Ships requires ships that are registered for ownership in Indonesia, namely ships with size 7 (Gross Tonnage). The method used in this study is normative juridical research, namely normative juridical research is an approach using a set of laws and regulations and other legal materials. The research approach used is to review laws and regulations as the main point of analysis in reviewing and discussing legal issues. From the results of the research, it is obtained that in order to avoid a dichotomy between government regulations that regulate a transfer of rights and notary deeds and the reality in the field, it is necessary that imperative provisions regarding the transfer of rights to ships with a weight of more than 7 gross tonnage are clearly regulated in the provisions that are included in the hierarchy of laws and regulations as per Law of the Republic of Indonesia Number 12 Year 2011 concerning the Formation of Laws and Regulations.

Abstract

AbstrakHak Cipta Lagu atau Musik dapat menjadi Jaminan Fidusia sebagaimana diatur dalam ketentuan Undang-Undang Nomor 42 Tahun 1999 tentang Jaminan Fidusia, akan tetapi pada penerapannya belum ada hak cipta lagu atau musik yang menjadi Jaminan, sehingga Penolakan oleh Bank atas proses pinjaman yang berasal dari Jaminan Hak Cipta lagu dan musik sebagai objek Jaminan Fidusia sebagaimana diatur dalam Undang-Undang Nomor 10 Tahun 1998 tentang Perbankan. Masalahnya Hak Cipta Lagu atau Musik tidak dapat dijadikan objek Jaminan Utama terhadap Bank menimbulkan kepastian hukum sebagaimana diatur dalam aturan Undang-Undang Nomor 7 Tahun 1992 dengan Peraturan Bank Indonesia (PBI) Nomor 14/15/PBI/2012. Metode yang digunakan dalam penelitian ini adalah Yuridis Normatif yang didukung dengan pendekatan Analytical Approach, Statute approach dan Case Approach, dengan bersumber bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier, Teknik pengumpulan bahan hukum diperoleh melalui studi kepustakaan serta interpretasi hasil wawancara yang kemudian penulis analisis dengan cara penafsiran analogi. Hasil penelitian ini menunjukkan bahwa penolakan pengajuan pinjaman oleh Bank berawal dari objek jaminan hak cipta lagu atau musik yang tidak dapat dijaminkan kepada Bank dan hak cipta lagu atau musik jika dijaminkan hanya sebatas objek jaminan tambahan, Keseragaman penolakan pinjaman oleh Bank-Bank dalam proses pengajuan musisi untuk menjaminkan hak cipta lagu dan musik dapat dimungkinkan pelaksanaannya dengan berpedoman pada ketentuan Peraturan Bank Indonesia (PBI) Nomor 14/15/PBI/2012 yang mengatur secara limitative tentang benda-benda bergerak yang dapat dijadikan Jaminan Fidusia. Namun UUHC tidak memberikan batasan kriteria Seni hak cipta lagu atau musik hanya sebatas hak ekslusif sebagaimana diatur dalam ketentuan pasal 12 ayat 1 Undang-Undang Nomor 28 Tahun 2014 pada poin 4 telah menimbulkan ketidakpastian hukum, oleh karena itu perlu dilakukan penerapan Hukum Progresif menurut Satjipto Rahardjo (2010) terhadap UUHC agar dapat memberikan pengaturan yang lebih jelas, tegas dan specifik.Kata Kunci: Lagu atau musik, Objek Jaminan dan Jaminan fidusia AbstractThe Copyright of songs or music can be a fiduciary guarantee as regulated in the provisions of Law Number 42 of 1999 concerning Fiduciary Guarantees, and but in its application there is no copyright of songs or music that becomes collateral, so that the Bank's Rejection of the loan process originating from the guarantee Copyright of songs and music as objects of Fiduciary Guarantee as regulated in Law Number 10 of 1998 concerning Banking. The was problem is that Song or Music Copyright cannot be used as the object of the Main Guarantee against the Bank, giving rise to legal certainty as regulated in Law Number 7 of 1992 with Bank Indonesia Regulation (PBI) Number 14/15/PBI/2012. The method used in this research is normative juridical which is supported by the analytical approach, statute approach and case approach, sourced from primary legal materials, secondary legal materials and tertiary legal materials. the writer analyzes by interpreting the analogy. The are an results of this study indicate that the rejection of loan applications by the Bank originates from the object of guaranteeing the copyright of songs or music that cannot be guaranteed to the Bank and the copyright of songs or music if guaranteed is only limited to the object of additional guarantees. to guarantee the copyright of songs and music, it is possible to implement it by referring to the provisions of Bank Indonesia Regulation (PBI) Number 14/15/PBI/2012 which regulates in a limitative manner regarding movable objects that can be used as Fiduciary Guarantees. However, UUHC does not limit the criteria for art, song or music copyright, only to the extent of exclusive rights as regulated in the provisions of Article 12 paragraph 1 of Law Number 28 of 2014 at point 4 which has created legal uncertainty, therefore it is necessary to implement Progressive Law according to Satjipto Rahardjo (2010) on UUHC in order to provide clearer, firmer and specific regulations.Keywords: Song or music, Object of Guarantee and Fiduciary Guarantee

Abstract

This study examines the juridical implications of the Fixed-Time Work Agreement (PKWT) on the welfare of workers in Indonesia. The regulations regulated in Law Number 13 of 2003 concerning Manpower show that there is an imbalance in legal protection between PKWT workers and workers with Indefinite Time Work Agreements (PKWTT). In many cases, PKWT causes job uncertainty, low sense of security, and lack of access to basic workers' rights. This study uses a normative approach with a qualitative analysis of regulations and their implementation. The main findings show that the implementation of PKWT has not fully met the principles of justice and welfare, so it is necessary to revise regulations and policies to protect workers

Abstract

This research focuses on the rights of taxpayers in the cancellation of Tax Assessment Letter (SKP). In Indonesia, taxpayers have the right to apply for cancellation of an SKP that is deemed erroneous. However, some rights such as access to information, the right to clarity of process, and the right to object are often hampered by complex administrative mechanisms. This research aims to identify taxpayers' rights in the context of SKP cancellation and evaluate whether these rights are adequately fulfilled. The results show that there is a gap between regulation and implementation, making it difficult for taxpayers to obtain their rights effectively.
