Abstract

ABSTRACT Purpose of the study: This article analyzes the tension between freedom of expression and political stability in the context of the Indonesian Constitutional Court’s Decisions No. 90/PUU-XXI/2023, 78/PUU-XXI/2023, 7/PUU-VII/2009, and 50/PUU-VI/2008 on the Dissemination of Information Via Social Media, which are deemed to potentially inducing commotion. Methodology: This article used legal research methods using the statutory, conceptual, and case approaches. The legal materials were examined through a prescriptive analysis to identify new normative constructions related to the cyber commotions, as interpreted in the Constitutional Court decision. Results: The article's main findings show that the Court tends to acknowledge the dangers of vague and ambiguous-norms and relates this issue to the principle of legality, legal certainty, and the permissible limitations of rights under the International Covenant on Civil and Political Rights. The Court underscores the importance of normative clarity to ensure that such provisions do not become repressive instruments against political expression or criticism in digital spaces. In an era where public discourse largely takes place in the digital-space, criminalization based solely on the potential for commotion, without objective criteria, may hinder citizens’ participation in democracy. Results: This article recommends reformulating the norms by employing a more contextual, human rights-based approach to prevent the misuse of law that suppresses freedom of expression. A proportional balance between freedom of expression and political stability can be achieved within Indonesia’s legal system. The scholarly contribution of this research will greatly assist researchers in understanding the meaning of the freedom of expression on social media and will support stronger law enforcement. Novelty/Originality of this Study: The Constitutional Court's Decision on the Judicial Review of Articles 28(3) and 4A(3) of Law 1/2024 emphasizes the need of exercising prudence while balancing the protection of freedom of expression with measures to maintain public order. Keywords: Constitutional Court; Decision; Cyber; Commotion.   ABSTRAK Tujuan penelitian: Artikel ini menganalisis ketegangan antara kebebasan berekspresi dan stabilitas politik dalam konteks putusan Mahkamah Konstitusi Indonesia Nomor 90/PUU-XXI/2023, Nomor 78/PUU-XXI/2023, Nomor 7/PUU-VII/2009, dan Nomor 50/PUU-VI/2008 tentang penyebaran informasi melalui media sosial yang dianggap berpotensi menimbulkan keresahan. Metodologi: Artikel ini menggunakan metode penelitian hukum dengan pendekatan undang-undang, konseptual dan kasus. Bahan hukum dianalisis menggunakan analisis preskriptif untuk menemukan norma baru terkait dengan keresahan siber yang telah ditafsirkan dalam Keputusan Mahkamah Konstitusi. Hasil: Temuan utama artikel ini menunjukkan bahwa Mahkamah cenderung mengakui bahaya norma yang samar dan multitafsir, serta mengaitkan masalah ini dengan asas legalitas, kepastian hukum, dan pembatasan hak yang diperbolehkan berdasarkan Kovenan Internasional tentang Hak Sipil dan Politik (ICCPR). Mahkamah menggarisbawahi pentingnya kejelasan norma agar ketentuan tersebut tidak menjadi alat represif terhadap ekspresi politik atau kritik di ruang digital. Di era di mana wacana publik sebagian besar terjadi di ruang digital, kriminalisasi yang semata-mata didasarkan pada potensi kerusuhan, tanpa kriteria yang objektif, dapat menghambat partisipasi warga negara dalam demokrasi. Kegunaan penelitian ini: Artikel ini merekomendasikan perumusan ulang norma menggunakan pendekatan yang lebih kontekstual dan berbasis hak asasi manusia untuk mencegah penyalahgunaan hukum yang menekan kebebasan berbicara. Keseimbangan proporsional antara kebebasan berekspresi dan stabilitas politik dapat dicapai dalam sistem hukum Indonesia. Kontribusi keilmuan dari penelitian ini akan sangat membantu para peneliti dan akademisi dalam memahami makna kebebasan berekspresi di sosial media dan akan membantu penegakan hukum yang kuat. Kebaruan/Keaslian Kajian: Putusan Mahkamah Konstitusi tentang pengujian Pasal 28 ayat (3) dan Pasal 45A ayat (3) UU No. 1 Tahun 2024 menegaskan perlunya kehati-hatian dalam menyeimbangkan upaya perlindungan kebebasan menyampaikan pendapat dengan upaya menjaga ketertiban umum. Abstract

  This article discusses cross-culture integration between Javanese and Chinese communities in Malang City, East Java, Indonesia. How social capital can construct personal and social backgrounds with very different backgrounds can shape cross-cultural integration between the two ethnicities. The research was conducted using a qualitative approach, with a descriptive type. The research subjects were Javanese and Chinese people in Malang City, East Java. Data collection was carried out by observation, interviews, documents, and focus group discussions (FGD). The results of the study show that: social capital (trust, values/norms and networks) is strength, the basic foundation in realizing cross-cultural integration between ethnic Chinese-Javanese and can maintain harmonious relations and avoid conflicts. The strength of social capital can be identified through the elements inherent in the social structure of the community, such as: trust, values, and networks. The implementation of the strength of social capital as an adhesive, as well as a bridge/liaison in interaction gave birth to cultural acculturation as a form of cross-cultural integration of ethnic Chinese and Javanese in Malang City. The recommendations in this study are: (1) The model found in cross-culture integration based on social capital in the Chinese-Javanese community in Malang City can be used as a model in understanding cross-cultural differences between the two ethnicities but can live side by side with each other, (2) Improving values/norms of togetherness between the two ethnicities, through strengthening "shared identity" as citizens of Malang City, (3) Forming and developing networks in the economic, social, cultural and defense fields continuously and sustainably. Based on the results of this study, it can be recommended that to anticipate the disintegration of the nation, it is necessary to strengthen social capital from various ethnic groups in various fields of life.

Abstract

The study develops a constitutional design to regulate the number of presidential and vice-presidential candidates following the Constitutional Court’s annulment of the presidential threshold. It observes that the absence of a model framework from the Court creates a regulatory vacuum that may expose the presidential election to political fragmentation, heightened polarization, and procedural inefficiencies. To address this issue, the research aims to construct a constitutional framework capable of enhancing electoral stability while sustaining democratic competitiveness. The study employs a normative juridical method supported by statutory analysis, case studies, and comparative assessment to identify feasible regulatory alternatives. The analysis demonstrates that the most effective approach to limiting the number of candidates is to regulate the number of political parties eligible to participate in general elections, given their role as the primary gatekeepers of nomination. The findings propose several regulatory instruments, including a moratorium on the establishment of new political parties, stricter requirements for party formation, enhanced eligibility criteria for electoral participation, a minimum age requirement for political parties, a maximum threshold for the number of qualified parties, and the disqualification of previously registered parties that fail to meet revised standards. The study concludes that these mechanisms collectively form a coherent constitutional strategy for maintaining a manageable number of presidential candidates and ensuring the continuity, integrity, and effective governance of the electoral process.

Abstract

Many cases occur in Indonesia that show children and women have become victims of violence, one of which is domestic violence. There are many cases in the community of children and women who experience physical, psychological, sexual violence and neglect in the family, especially in the household. This community services uses FGD method to strengthen the children's and women's forum. The findings of this community services found that change is a must, so that in this case the government needs to make efforts to educate the public to be more open and able to take care of themselves to avoid becoming victims of violence, especially in the household. This community services take place in Dadaprejo, Batu, Esat Java. As a result, the Women and Children Forum is an important tool to be carried out as a means of communication that is implemented to prevent women and women from becoming victims of violence.

Abstract

This paper aims to scrutinise the Malaysian juvenile justice system and the negative consequences of the lack of pre-trial alternative measures in dealing with children. Juvenile delinquency is a social problem that has attracted numerous discussions from different quarters. One of the primary issues in this area is how to respond to complex, multifaceted problems involving children in conflict with the law. Through doctrinal analysis and comparative frameworks with international standards and legal practice in England and New Zealand, this study highlights the positive impact of diversionary approaches on recidivism, rehabilitation, and restorative justice. Malaysia’s heavy reliance on formal adjudication is inconsistent with several international standards. This paper advocates amending the Child Act 2001 and the Criminal Procedure Code to implement pre-trial diversion, with police and prosecutorial discretion to encourage restorative justice alternatives in minor and non-violent cases. This change would align Malaysia’s system with international norms, improve children's rights, and advance the justice system toward greater rehabilitation and restoration.

Abstract

This study examines forestry regulation from the perspective of ecological justice by analysing the relationship between state control, environmental protection, and the rights of indigenous peoples. The research employs a normative legal research method based on secondary data comprising primary and secondary legal materials. The approaches adopted include statutory, conceptual, and comparative approaches to assess forestry governance in Indonesia and to compare it with Canada. The findings indicate that, at the normative level, forestry regulations have accommodated the principles of sustainability and social justice; however, their implementation continues to face challenges, including centralised authority, tenure conflicts, and environmental degradation. The comparative analysis demonstrates the importance of integrating ecosystem protection, recognising the rights of indigenous peoples, and ensuring public participation. Accordingly, the reconstruction of forestry regulation is required to strengthen participation, to reaffirm the meaning of state control as a public mandate, and to enhance enforcement mechanisms grounded in environmental restoration for the benefit of intergenerational sustainability.
