Abstract

The implementation of Islamic law in Indonesia is still in a phase of gaps and contradictions. In line with developing a national legal system, it is expected to uphold the rule of law based on justice and truth from prevailing values, culture, and community beliefs. In order to answer the related issues, this study applied a library research model based on relevant library materials in the form of books, journals, or related articles. The results of this study showed that the position of Islamic law in the legal system in Indonesia was equal to Western law and customary law as a source of national law formation. Islamic law as a legal order guided by the majority of the Indonesian Muslim society had lived and existed in the legal system of state administration through sharia-based legislation (Islamic law). However, it was undeniable that the implementation of Islamic law and the presence of sharia-based laws experienced a dilemma internally and externally, influenced by epistemological, methodological, and socio-cultural aspects of politics. In addition, the efforts to develop and foster national law integrated a legal system that was harmoniously structured and followed the needs and developments of community culture. Moreover, it provided a great opportunity to consciously place Islamic law into a complete source of national law shaded by The Five Principles and the 1945 Constitution without causing contradictory and problematic assumptions by relying on the principles of forming the people in perfect and unanimous unity. Finally, it took the middle way, could develop and move, and had the life force in forming itself according to the development and or progress of the times.

Abstract

The existence of judges has been positioned as a fundamental and influential instrument for law enforcement in Indonesia. The role of judges in examining, adjudicating and even deciding cases actually relies on ethics and morality which have been fully outlined by the Law and other derivative regulations. This study aims to unravel the ethical ideals of judges from a juridical perspective, the reality of ethical problems of judges and strategies to strengthen judges in Indonesia. This type of research uses library research or library research through a review of relevant library materials. The results of the study show that the scope of judge ethics includes personality ethics, ethics in carrying out their duties, ethics for colleagues or fellow judges and ethics towards society or seekers of justice which as a whole are intended as a means of progress and personality formation, as a means of social control, and as a guarantee increase in the morality of judges. Despite the fact, the ethics and morality of judges are faced with problems stemming from the weaknesses in the personality of judges internally and the tension and ineffectiveness of the supervisory system externally. Therefore, the realization of a strong oversight policy by involving the Supreme Court as internal oversight and the Judicial Commission as external oversight is a strategic answer to overcoming the decline in the integrity and morality of judges, and is supported by constructive efforts such as strengthening the essential performance of the Honorary Panel of Judges in examining and deciding alleged violations of the code of ethics, stimulated the performance of the liaison team and judge supervisory assistants, strengthened strict sanctions in line with reward and punishment policies and built responsive legal values and culture.

Abstract

This study aims to analyze the correlation between the death penalty for murder, narcotics, and corruption (a legal approach to jinayah, qishash, hudud, and ta'zir), and aims to look more deeply into the implementation of punishments that use a legal basis or arguments that are general in nature and specific argument. This research uses descriptive qualitative. Data were collected through interviews, observation, and documentation. This study uses data analysis techniques, which consist of stages of data collection, data reduction, data presentation, and drawing conclusions. The results of the study show that legal settlements from the Juridical-Empirical study include makers, dealers, sellers and buyers as well as users, as well as victims of the same status before the law, because they both violate the law, they must be sentenced to death, in the context of crimes against the loss of human life. , in this case the similarity of the punishment of Qishash with the Criminal Code is the same, as in the case of intentional murder that is not condoned by the victim's family. Therefore, the death penalty of Qishash only applies if the intentional killing that is not condoned by the victim's family, as well as corruption of humanitarian funds can be punished by death

Abstract

This study aims to describe maqashid al-Syariah in terms of the philosophical aspects of maqashid al-Syariah, the relevance of maqashid al-Syariah with contemporary ijtihad. This research uses descriptive qualitative. Data were collected through interviews, observation, and documentation. This study uses data analysis techniques, which consist of stages of data collection, data reduction, data presentation, and drawing conclusions. The results of the research on the relevance of maqashid al-Shariah with contemporary ijtihad show the philosophy of maqashid al-Syariah. Contemporary ijtihad also tries to see significant changes in Islamic law from time to time, namely changes from the family aspect, women's aspect, and worship aspect. In an effort to develop Islamic legal thought, especially in providing understanding and clarity on various contemporary legal issues, mujtahids need to know the purpose of Islamic law. In addition, the purpose of the law needs to be known in order to identify whether a legal provision can still be applied to a particular case or because of changes in social structure, the law can no longer be maintained. Thus, knowledge of Maqāṣid al-Shari'ah is the key to the success of the mujtahid in his ijtihad.

Abstract

This study aims to determine the professionalism of female judges in the Sungguminasa religious court as a requirement for female judges in implementing decisions with the values of responsibility as a fair court. This research is a qualitative study with a socio-legal research approach. The main data source of this research is interviews with female judges.Furthermore, data collection in this study uses observation, interviews and documentation.Meanwhile, data processing and analysis techniques are carried out through three stages, namely data reduction, data presentation and conclusion drawing.The results showed that the professionalism of female judges will show how the quality of decisions, so that female judges in the Sungguminasa religious court must be intellectual, experienced, responsible for legal and moral aspects and driven by the effectiveness of the caseload. Although female judges at the Sungguminasa religious court have good competence in terms of education, the lack of appealed decisions and their average experience of 15 years. However, it was found that there are several problems of female judges in maintaining their professionalism, including ineffective communication between judges and litigants, the existence of female judges' decisions that correlate with the woman solidarity, especially polygamy cases, there is still no time discipline, the imbalance in the ratio of the number of judges to the caseload will affect performance productivity because with the frequency of too many cases that must be tried by judges, it will affect the cognitive and emotional aspects of judges and support for increasing the professional capacity of judges has not been maximized. Moreover, in the age of technology, where judges must have competence in the IT field, it can be seen from the lack of opportunities to attend training or technical guidance. Moreover, in the age of technology, judges must have competence in IT. So it is necessary to attend training, especially senior judges.

Abstract

Maqashid al-Syariah is known as a method of Islamic law philosophy. It put a reason to explore the inner meaning of the text by connecting reality that appeared arround it. Meanwhile, the method of decision law is one way to find and act the law among the people. Maqashid syariah and method of decision law has corelation to fulfill the ideal meaning of law in the text and in other way, maqashid syariah purposes to realize the maslahat for peoples.

Abstract

This article describes the issue of codification of Islamic law in the development of modern legal theory. From the assessment results obtained by understanding some of the literature that was essentially the codification of Islamic law is the codification of the rules of fiqh and usul fiqh rules and the development of theories of Islamic law that is based on Islamic law epistimologi. Therefore, the pattern includes the codification of Islamic law; codification of the rules of fiqh which includes three phases, namely the development of a period of growth and formation, the development and codification and the maturity and refinement. While codification of usul al-fiqh includes not only the rules of jurisprudence but also related to the struggle of who the originator of usul al-fiqh as a mode of philosophical thought in epistimologi Islamic law. Birth of legal theories under Islamic law epistimologi Why refer to the style of traditional and rational thinking in Islamic law underlies epistimologi birth maqasid al-Shari'ah theory developed by Islamic jurists before the era and the era of al-Syātibi maqashid theory after al- Syātibi.

Abstract

Conflict and tension is by Noel James Coulson in Islamic jurisprudence that the law of God is always confronted with the process of human intellectual activity that tries to transform the law of God. Law is a system of commandments determined divinity. Rejecting the principle is basically leaving the faith in Islam. While the transformation of man-made law take its own shape in the system of rights and obligations. The validity of the theory is not appropriate because Coulson puts clerical dissent as a form of conflict and contradiction in the law of Islam, although in epistimologi Islamic law that is intended to understand and find the law is not to define or create it. Abstract

This article studies the development of philosophical thought in Islamic jurisprudence. This study aims at tracing the origin and transformation of philosophical thought in Islamic world, and the influence of philosophical thought in the development of Islamic social law. This article demonstrates that the philosophical thought in Islamic law finds its fundamental bases in the Qur’an and hadits. These fundamental bases have then been developed by Islamic scholars in the philosophy of Islamic law.

Abstract

Abstract: Janin or fetus is one of the real problem in Islamic law since long time ago till today. There are many problems that caused janin or fetus aborsed by mothers and the most important of this problems is the unpragnancy. Islamic law stressed that janin or fetus must be respected by all humans so that Islamic law encouranges mothers and father to protect the janin or fetus in their mother’s uterus. That why, janin or fetus actually has life and has potentially to grow up in many cells to be human.
