Abstract

Perlindungan hukum kepada anak di era digital sangat diperlukan mengingat masyarakat awam tidak begitu mengerti bentuk bentuk perlindungan hukum dan tindakan hukum apa yang dapat dilakukan. Kota Karawang adalah salah satu kota terbesar dan sangat maju di Indonesia banyak anak-anak yang membutuhkan perlindungan hukum karena rentan dengan kekerasan fisik maupun pisikologi. Metode penyuluhan hukum yang dilakukan yaitu penyuluhan dengan diskusi 2 arah dan sosialisasi peraturan terkait perlindungan anak. Dengan dilakukan penyuluhan hukum perlindungan anak, anak-anak di karawang lebih berupaya untuk menyadarkan diri, membuka mata serta hati untuk tidak berdiam diri, dan menolong bila ada kasus kekerasan terhadap anak yang terjadi disekelilingnya.

Abstract

This study examines the legal protection of children born from Toba Batak customary marriages that are not officially registered by the state. In Toba Batak customary law, a marriage is considered valid after all traditional ceremonies have been carried out, so that the child is recognized by the father's clan and social status within the customary community. However, state law requires marriage registration to ensure the certainty of the parents' legal status and the fulfillment of the child's civil rights. The absence of marriage registration has legal consequences in the form of limited recognition of the civil relationship between the child and the father, which impacts identity registration, access to public administration services, and the fulfillment of inheritance rights. This study uses a normative juridical method with analytical descriptive specifications through a review of laws and regulations, legal literature, and court decisions. The results show that preventive legal protection is realized through marriage registration to guarantee the child's right to identity. Meanwhile, repressive legal protection can be achieved through court decisions supported by valid evidence to confirm the child's legal status and ensure the fulfillment of their basic rights.

Abstract

The low mathematical communication skills of students should be the main issue that should be of concern to an educator. Learning should be designed through problems that allow students to be able to do better mathematical communication. This study aims to produce an E-LKPD with a Problem-Based Learning approach based on Jambi culture with valid, practical, and effective quality to improve students' mathematical communication skills. The subject of this research is class VIII MTsSBustanulUlum in even semester 2023/2024. This type of research is Research and Development with the ADDIE model. The results of this study indicate that the quality of E-LKPD developed has valid, practical, and effective categories. The validity can be seen from the results of expert validation in the field of media and learning materials which show that E-LKPD is good and feasible to use, practicality can be seen from the perceptions of students and teachers who give positive responses to the E-LKPD developed and effectiveness can be seen from the increase in students' mathematical communication skills by comparing the pree test and post-test scores with the N-Gain test with an acquisition of 0.50 with a moderate category. Thus to improve students' mathematical communication skills can use E-LKPD with a problem-based learning approach based on the Jambi culture that has been developed.

Abstract

Abstract: The struggle for child custody is one of the problems that arise from divorce. Both parents who are divorced each feel better and are entitled to child custody. The struggle for child custody has indirectly violated the rights of the child so that the need for protection of the rights of the child and the imposition of sanctions on those who do not carry out the judge’s decision and violate the rights of the child. This study aims to determine the legal remedies that can be given to children in order to protect children’s rights after their parents’ divorce and the legal consequences for those who do not have custody who control the child forcibly. The research method used is a normative juridical approach using literature study materials by collecting primary and secondary legal sources, reviewing, and analyzing according to the topics discussed in this study. According to the results of this study, there are children’s rights that must be protected after parental divorce as regulated in the Marriage Law and Child Protection Act, and it is also necessary to pay attention to the best principle for children in all actions related to children. Keywords: Children’s Rights, Legal Protection, Positive Law. Abstrak: Perebutan hak asuh anak merupakan salah satu persoalan yang timbul dari perceraian. Kedua orang tua yang bercerai masing-masing merasa lebih baik dan berhak untuk mendapatkan hak asuh anak.Perebutan hak asuh anak secara tidak langsung telah melanggar hak anak sehingga diperlukannya perlindungan terhadap hak anak dan pemberian sanksi terhadap pihak-pihak yang tidak menjalankan putusan hakim dan melanggar hak anak.Penelitian ini bertujuan untuk mengetahui upaya hukum yang dapat diberikan kepada anak guna melindungi hak-hak anak pasca perceraian orang tuanya dan akibat hukum terhadap pihak yang tidak mendapat hak asuh yang menguasai anak secara paksa. Metode penelitian yang digunakan adalah pendekatan yuridis normatif dengan menggunakan bahan studi kepustakaan dengan cara mengumpulkan sumber hukum primer dan sekunder, mengkaji, dan menganalisa sesuai dengan topik pembahasan dalam penelitian ini. Hasil dari penelitian ini, terdapat hak-hak anak yang harus dilindungi pasca perceraian orang tua sebagaimana diatur dalam UU Perkawinan dan UU Perlindungan Anak, serta perlu diperhatikan pula asas yang terbaik bagi anak dalam segala tindakan terkait anak. Abstract

The principle of the best interest of the child constitutes a central normative foundation for post-divorce child custody protection within Islamic family law. Although this principle is widely recognised in statutory regulations and judicial practice, its application and juridical consequences vary considerably across legal systems. This study examines the regulation and application of the best interest of the child principle in Islamic family law in Indonesia and Malaysia, with particular attention to the legal implications arising from differences in their normative and procedural designs. Employing a normative legal research method with comparative and doctrinal approaches, the study analyses legislation, the Compilation of Islamic Law, judicial decisions, and relevant scholarly literature on Islamic family law and child protection in both jurisdictions. The analytical framework draws upon the concepts of ḥaḍānah and maqāṣid al-sharīʿah to assess the relationship between custody determination and the execution of court decisions. The findings demonstrate that both Indonesia and Malaysia formally recognise the best interest of the child as the guiding principle in determining child custody under Islamic family law. However, divergent normative and procedural configurations produce distinct juridical outcomes. In Indonesia, child custody protection predominantly operates as custody protection as declarative justice, where judicial decisions establish legal entitlements without being supported by effective enforcement mechanisms. In contrast, Malaysia’s Islamic family law system reflects a model of custody protection as enforceable justice, integrating custody determinations with enforcement measures and legal sanctions for non-compliance. These findings underscore that child protection in Islamic family law is shaped not merely by normative recognition, but by the extent to which legal systems connect custody determinations with enforceable institutional mechanisms.

Abstract

Brand is a sign in the form of pictures, names, words of letters, numbers, arrangement of colors, or combinations of those elements which have distinguishthing power and are used in goods or service trade activities. The terms in the brand, especially regarding the protection of famous brands, can actually be applied in the case of domain names. "There is a provision in the TRIPs that governs the issue of protection of this famous brand, and the public becomes bound by the provision because it has been ratified". The meaning is Article 16 (3) TRIPs (Trade Related Aspect of Intellectual Property Rights). Article 16 (3) states that Article 6 bis of the Paris Convention on Protection of Industrial Property Rights shall apply, mutatis mutandis to goods and services which are not similar to goods and services to which a trademark has been registered.

Abstract

Changes in the legal construction begin with a paradigmatic shift in the relationship between the consumer and businesses, as reflected in the preference of let the producer aware principle in favor of letting the buyer aware principle. This study aims to find out the implication of the let the producer aware principle for goods and services, and its development in consumer protection law in Indonesia and to find out the legal system of Indonesia adopts the let the producer aware principle in order to protect Indonesian consumers. The research method applied in this study is normative juridical approach. The data obtained from the study of literature which is used as secondary data. Furthermore, interviews were conducted to obtain primary data, and then the data were analyzed by juridical qualitative method. As a result of analysis, it shows that firstly: the implementation of let the producer aware principle in Indonesia has not been properly conducted because of the common perception that consumers’ opinion is less valuable than producers’. Secondly, the adoption of the let the producer aware principle for consumer protection by Indonesian Legal policy is shown by Law Number 8 Year 1999 about Consumer Protection (Indonesian Consumer Protection Act), which is based on the principle of fault liability, utilizing reversed burden of proof. This way, both parties are protected, because it proportionally distributes the liability to each party. In conclusion, both producers and consumers are equally protected on condition that they can provide evidence of the losses obtained.

Abstract

Female civil servants are absolutely prohibited from becoming second/third/fourth wives as regulated in Government Regulation Number 45 of 1990 concerning Marriage and Divorce Permits for Civil Servants, with the threat of sanctions for those who violate. Problems occur if the judge grants the request for polygamy with the prospective second wife's position as a civil servant with one of the judge's considerations which is not in accordance with the Legislative Regulations, namely ordering the prospective second wife to attach a Certificate of Giving Permission from Her Superior, as in the Decision of the Demak Religious Court Number 539/Pdt. G/2019/PA.Dmk. This research aims to determine the validity of the Certificate of Giving Permission from the Superior submitted by the prospective second wife in the decision in terms of the relevant Legislation. The approach method used in this research is normative juridical with research specifications, namely analytical descriptive, meaning that the events being researched are described using primary, secondary and tertiary legal materials. This research uses qualitative juridical analysis methods to produce descriptive data. The results obtained from this research are that the validity of the Certificate of Granting Superior Permission submitted by the prospective second wife should not have perfect legal force and can be canceled because it does not comply with the provisions in Article 4 paragraph (2) of Government Regulation Number 45 of 1990 concerning Marriage Permits and Divorce for Civil Servants.

Abstract

The adoption of children of different religions in Indonesia has been normatively regulated under positive law; however, in judicial practice, discrepancies in court determinations are still found in cases involving similar legal facts. This is evident in the Determination of the Gianyar District Court Number 76/Pdt.P/2025/PN Gin and the Determination of the Banyumas District Court Number 9/Pdt.P/2018/PN Bms, where judges rendered differing decisions regarding applications for interfaith adoption. In one determination, the application was granted by taking into account customary law and the best interests of the child, whereas in the other determination, the application was rejected by emphasizing the requirement of religious conformity under positive law. This study aims to analyze the judges’ legal reasoning as well as the factors contributing to the disparity in determinations of interfaith adoption from the perspective of legal certainty theory. The research employs a normative legal method with statutory, case, and conceptual approaches. Legal materials are collected through library research and analyzed qualitatively. The results indicate that the disparity in determinations is caused by differences in judicial interpretation of the requirement of religious conformity, the application of the principle of the best interests of the child, and the influence of legal pluralism in judicial practice.
