Abstract

This study examines the role of Masjid Agung Nur Ala Nur Panyabungan in empowering surrounding street vendors, using the Maqāṣid al-Sharī‘ah Index (MSI) as an analytical framework. The objectives of the research are to assess the conditions, opportunities, and challenges faced by street vendors in this mosque-based economic model, and to explore how Maqāṣid al-Sharī‘ah principles can inform sustainable empowerment strategies. The study employs a qualitative descriptive design, involving in-depth interviews, participatory observation, and document analysis, with participants including mosque administrators, street vendors, and congregants. The results highlight that while the mosque contributes to local economic activity, the empowerment initiatives remain fragmented, with gaps in structured training, financial management expertise, and collaboration with local stakeholders. The MSI findings show that the dimension of "Upholding Justice" scored highest, reflecting the mosque's role in ensuring fair business practices. However, the "Educating Individuals" dimension was weakest, indicating a need for capacity-building programs. The study concludes that for mosques to realize their full potential as centers of economic empowerment, there must be a more strategic approach, including enhanced training, financial transparency, and partnerships with Islamic microfinance institutions.

Abstract

This study analyzes the position of confession as a ground for case termination in KPPU Decision Number 04/KPPU-I/2024 and examines it from the perspective of Ibn Qayyim al-Jauziyah. The background of this research is based on the behavioral change mechanism introduced under KPPU Regulation Number 2 of 2023, which allows the reported party to acknowledge the alleged violation and submit commitments for behavioral improvement, as well as concerns that confession may become a shortcut that weakens the deterrence function and the protection of public interests. This study employs normative juridical research using the statutory approach and the conceptual approach. Legal materials were collected through library research and analyzed qualitatively using deductive reasoning. The findings indicate that confession is not the sole basis for case termination but rather an initial requirement to enter the behavioral change mechanism. The termination of the case in KPPU Decision Number 04/KPPU-I/2024 was carried out after the commitments to behavioral change had been declared fulfilled through a process of supervision and verification in accordance with KPPU Regulation Number 2 of 2023. From the perspective of Ibn Qayyim al-Jauziyah, confession (iqrār) is a highly authoritative form of evidence but cannot stand alone without supporting proof capable of revealing the objective truth. Therefore, the case termination mechanism is fundamentally consistent with the legal thought of Ibn Qayyim al-Jauziyah. However, the effectiveness and legitimacy of case termination ultimately depend on the objectivity and accountability of the verification process regarding the implementation of the behavioral change commitments.

Abstract

Mosques have strategic potential not only as places of worship but also as centres for community economic empowerment. This study aims to analyze the potential, solutions, and strategies for strengthening mosque management in supporting the economic empowerment of surrounding communities through social and cultural approaches. The method used is the Analytic Network Process (ANP), which integrates both qualitative and quantitative approaches, including in-depth interviews, participatory observations, and questionnaires involving religious leaders, cultural experts, mosque administrators, and local business actors. The findings show that the social approach is effective in building trust and community participation, with programs such as charity distribution, healthcare services, economic training, and guidance for converts strengthening solidarity and self-reliance. The cultural approach plays a crucial role in enhancing community identity and acceptance of the mosque. The acculturation of local culture with Islamic values increases the mosque’s relevance in daily life. A successful mosque management model involves visionary leadership, financial transparency, and productive community activities such as cooperatives and MSME bazaars. This study contributes to mosque management by integrating social and cultural approaches through ANP and provides strategic guidance for mosque managers to optimize the mosque’s social, cultural, and economic functions to improve public welfare.

Abstract

This study examines the practice of seller discrimination by the Shopee marketplace, which emerges through algorithmic policies, paid promotional services, and platform features that tend to favor certain sellers. This issue is analyzed based on Law No.?5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition, as well as the principle of justice in Islamic economics, which emphasizes distributive fairness and balance in commercial transactions (muamalah). This research employs a normative juridical with a constitutional and philosophical approach to identify the impact of such approach discrimination on small and medium-sized enterprises (SMEs) that operate as sellers on the Shopee platform. The findings show that the existence of paid promotions, store rankings, and Shopee’s algorithmic recommendations potentially leads to unfair business competition, as these systems prioritize sellers who can afford to pay more for greater visibility. This directly weakens the position of smaller sellers, limits their market access, and creates disparities that contradict the principles of justice in Islamic economics, which call for equal opportunities and fair treatment for all business actors.Therefore, stricter oversight from competition authorities and regulatory evaluation are needed to ensure fair, healthy competition that aligns with both legal norms and Islamic economic values. This research is expected to contribute to strengthening digital business competition policies based on the values of Sharia justice

Abstract

This study aims to analyze the financing restructuring regulations in the Musyarakah Mutanaqisah (MMQ) contract based on Financial Services Authority Regulation Number 2/POJK.03/2022, and examine the legal considerations of the panel of judges in the Medan Religious Court Decision Number 1224/Pdt.G/2024/PA.Mdn and the Demak Religious Court Decision Number 4/Pdt.G.S/2024/PA.Dmk reviewed from the perspective of the DSN-MUI Fatwa Number 89/XII/2013 concerning Sharia Financing Restructuring. This study uses a normative juridical method with a statutory approach, a case approach, and a conceptual approach. The results show that POJK Number 2/POJK.03/2022 provides a normative framework for Islamic banks to restructure problematic financing through rescheduling, reconditioning, and restructuring mechanisms while still observing the principles of prudence and sharia compliance. In the Demak Religious Court Decision, the panel of judges considered that the bank had attempted restructuring through an addendum to the agreement as a form of rescheduling, so that the legal considerations used were in line with the principles of the DSN-MUI Fatwa Number 89/XII/2013. On the other hand, in the Medan Religious Court Decision, the customer's restructuring request was not used as a basis for consideration, and the panel of judges based their decision more on the Mortgage Law without referring to the DSN-MUI fatwa. This study concludes that there are differences in the judges' paradigms in interpreting sharia financing restructuring, which has implications for the non-uniform application of sharia principles in resolving sharia economic disputes within the Religious Court environment.

Abstract

Penelitian ini mengkaji fenomena perbedaan tarif perahu yang diterapkan oleh para pelaku usaha lokal terhadap wisatawan di kawasan wisata alam Kecamatan Batang Lubu Sutam, Kabupaten Padang Lawas. Fokus penelitian diarahkan pada praktik penentuan harga yang mengindikasikan adanya unsur diskriminasi dalam pelayanan wisata air di daerah tersebut.. Tujuan penelitian ini adalah untuk menganalisis praktik diskriminasi harga dari perspektif hukum positif di Indonesia serta pemikiran Ibnu Taimiyyah. Penelitian ini menggunakan metode yuridis empiris dengan pendekatan lapangan berupa observasi dan wawancara terhadap wisatawan yang ada di lokasi wisata. Hasil penelitian menunjukkan bahwa diskriminasi harga terjadi secara langsung dengan membedakan tarif antara wisatawan lokal dan luar daerah, terutama berdasarkan bahasa dan asal pengunjung. Hal ini bertentangan dengan Undang-Undang Nomor 5 Tahun 1999 tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat. Praktik ini dalam perspektif Ibnu Taimiyyah, termasuk bentuk kezaliman dan tadlis (penipuan) yang merugikan konsumen. Faktor penyebab diskriminasi harga antara lain adalah ketidaktahuan wisatawan mengenai tarif dan tidak adanya transparansi harga dari penjual.

Abstract

This study seeks to investigate and analyze the factors that influence Generation Z’s use of fintech lending (paylater) in Jakarta, West Java, East Java, Central Java, and North Sumatra. This study employs a descriptive quantitative methodology and questionnaire distribution. The study employed purposive sampling. This study included 200 Generation Z respondents who have utilized fintech lending (paylater) as respondents. The method of data analysis employs Partial Least Square-Structural Equation Modeling (PLS-SEM) and SmartPLS version 3.2.9 software. The variables performance expectation, social influence, hedonic motivation, and habit have a positive and significant effect on behavioral intention, whereas effort expectation, facilitating conditions, and price value do not. In addition to testing the UTAUT 2 model, this research was conducted on Generation Z, where few research results are discussing the use of fintech lending (paylater). Generation Z is the generation that currently dominates the population in Indonesia and will be the next generation of Indonesians; therefore, it is essential to determine what factors play a role in encouraging the use of fintech lending (paylater) among Generation Z.AbstrakPenelitian ini tujuannya guna menyelidiki serta menganalisis faktor-faktor yang pengaruhi pemakaian fintech lending (paylater) generasi Z di Jakarta, Jawa Barat, Jawa Timur, Jawa Tengah, dan Sumatera Utara. Penelitian ini menggunakan metodologi kuantitatif deskriptif dan penyebaran kuesioner. Penelitian ini menggunakan purposive sampling. Penelitian ini melibatkan 200 responden generasi Z yang telah memanfaatkan fintech lending (paylater) sebagai responden. Metode analisis data memakai perangkat lunak PLS-SEM dan SmartPLS versi 3.2.9. Variabel ekspektasi kinerja, pengaruh sosial, motivasi hedonis, serta kebiasaan berpengaruh positif juga signifikan pada niat berperilaku, sedangkan ekspektasi upaya, kondisi fasilitasi, dan nilai harga tidak. Selain menguji model UTAUT 2, penelitian ini dilakukan pada generasi Z, dimana hasil penelitian yang membahas tentang penggunaan fintech lending (paylater) masih sedikit. Generasi Z merupakan generasi yang sekarang mendominasi jumlah penduduk di Indonesia dan akan menjadi generasi penerus bangsa Indonesia; Maka dari itu, penting agar tau faktor apa saja yang berperan untuk mendorong penggunaan fintech lending (paylater) di kalangan generasi Z.

Abstract

Law violations committed by law enforcers cannot be separated from the paradigm and legal teaching system applied by law faculties that produce law graduates. This paper discusses the adab paradigm in law teaching in law faculties in Indonesia. The method used in this paper is qualitative by describing the data obtained through interviews, observations, and readings of the existing literature. The study results indicate that the teaching of law in Indonesia is positivistic. The education of law is more about teaching the law that applies in a country that is contained in the legislation and its derivatives. This can be seen from the structure of the course and the content of the course syllabus where there are only six (6) courses that are directly related to etiquette. The factors that influence the shift in valuesin the teaching of law include educators and the learning system. While the model of inculcating values for law students can be done by inculcating character at the beginning of the lecture, exploring and elaborating on philosophy and legal principles in each course, incorporating ethical valuesin each course, drawing grades through cases (Project Base), inculcating values through ideal legal figures, creating separate courses related to etiquette, and incorporating customary valuesinto courses. Of the seven models above, incorporating ethical values in each course is the most ideal model to be applied

Abstract

ABSTRACT: The purpose of this study was to determine how consumer preferences for mineral products in Binjai City, North Sumatra, are influenced by green products, green brand images, and green advertising. Quantitative analysis used responses obtained from a random stratified sample. The low R Square of 29.4% was due to momentum, which resulted in bias in purchase preferences during the data analysis process. The study findings showed that green products were positively and significantly related to the intention to purchase mineral products, green illustrations were positively and significantly related to the intention to purchase mineral products, and green advertising was positively and significantly related to the intention to purchase mineral products. In addition to using green products, green brand images, and green advertising, green marketing should always be carried out. Abstract

This study aims to analyze unilateral control of partnership cooperation from the perspective of business competition law and the principle of benefit (istislah), as well as to review the competence of the authority of the KPPU decision Number 02/KPPU-K/2023 in providing protection to small businesses, namely plasma farmers. This study uses a normative legal research method with a judicial case approach, which examines laws and regulations related to business partnerships and KPPU decisions as the main material for analysis. The data used comes from legal documents, partnership agreements, laws and regulations, and KPPU decisions, which then this analysis technique is normative juridical. The results of the study show that PT Hardaya Inti Plantations was proven to have violated Article 35 paragraph (1) of Law Number 20 of 2008, because it unilaterally controlled small businesses (farmer cooperatives), did not provide transparent financial accountability reports, and set the purchase price of fresh fruit bunches not in accordance with government regulations. This has implications for financial losses for plasma farmers, who are burdened with debt without a clear payment mechanism for losses in unilateral control of large businesses that monopolize the partnership system. In terms of perspective, this practice is contrary to the principles of justice and welfare, because it harms the weaker party in the partnership. As a suggestion, it is necessary to strengthen regulations and supervision from the KPPU, including the application of stricter sanctions against large business actors who abuse partnerships. In addition, transparency in partnership agreements must be clarified through more detailed regulations, as well as legal assistance for plasma farmers so that they have a stronger bargaining position in partnership agreements.   Abstrak Penelitian ini bertujuan untuk menganalisis penguasaan sepihak kerja sama kemitraan dalam perspektif hukum persaingan usaha dan prinsip kemaslahatan (istislah),serta meninjau kopetensi kewenangan putusan KPPU Nomor 02/KPPU-K/2023 dalam memberikan perlindungan kepada usaha kecil yakni petani plasma.Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan yudisial case kasus (case approach), yang mengkaji peraturan perundang-undangan terkait kemitraan usaha serta putusan KPPU sebagai bahan utama analisis. Data yang digunakan berasal dari dokumen hukum, perjanjian kemitraan, peraturan perundang-undangan, serta putusan KPPU, yang kemudian teknik analisa ini bersifat yuridis normatif.Hasil penelitian menunjukkan bahwa PT Hardaya Inti Plantations terbukti melanggar Pasal 35 ayat (1) UU Nomor 20 Tahun 2008, karena menguasai usaha kecil (koperasi tani) secara sepihak, tidak memberikan laporan pertanggungjawaban keuangan yang transparan, serta menetapkan harga pembelian tandan buah segar tidak sesuai dengan ketentuan pemerintah. Hal ini berimplikasi pada kerugian finansial bagi petani plasma, yang terbebani utang tanpa kejelasan mekanisme pembayaran atas dari kerugian dalam penguasaan sepihak dari pada usaha besar yang memonopili sistem kemitraan. Dalam perspektif istislah, praktik ini bertentangan dengan prinsip keadilan dan kemaslahatan, karena merugikan pihak yang lebih lemah dalam kemitraan.Sebagai saran, diperlukan penguatan regulasi dan pengawasan dari KPPU, termasuk penerapan sanksi yang lebih tegas terhadap pelaku usaha besar yang menyalahgunakan kemitraan. Selain itu, transparansi dalam perjanjian kemitraan harus diperjelas melalui regulasi yang lebih detail, serta pendampingan hukum bagi petani plasma agar mereka memiliki posisi tawar yang lebih kuat dalam perjanjian kemitraan.
