Abstract

Pancasila, as the foundation of the state and ideology of the Indonesian nation, plays a crucial role in the formulation of legal policies, including in counter-terrorism efforts. This article discusses how Pancasila values, such as justice, humanity, and unity, are integrated in Indonesia's anti-terrorism legal policy. Pancasila provides a philosophical foundation that ensures the policy is not only effective in maintaining national security, but also respects human rights, prevents discrimination, and strengthens national unity. Thus, the anti-terrorism policy prepared based on Pancasila is expected to realize law enforcement that is just, humanity-based, and supports the integrity of the Indonesian nation. The research method used is the Normative Juridical Approach method, this method focuses on the study of literature and legal regulations, such as the Anti-Terrorism Law in Indonesia. Researchers usually analyze statutory documents, legal theories, and how Pancasila values are applied in existing legal policies. The results of this study reveal that the role of Pancasila in making anti-terrorism legal policy in Indonesia shows that the philosophical idiological values of Pancasila serve as the foundation for the policy).

Abstract

In Indonesia, interfaith marriage is often discussed in society and becomes a problem in legal and social contexts. Indonesia is a country with many different religions, with Pancasila as the country's foundation and values of tolerance and pluralism. However, regulations on interfaith marriage often lead to conflicts between state law and religious rules. The method used in this journal is a statutory approach and a case approach and also uses normative research. Analysis of Religious Marriage Regulations in Indonesia, Challenges in Legal Implementation, Recommendations for Legal Reform. The conclusion of this study shows that the legal regulation of interfaith marriage in Indonesia as stipulated in Law No. 1 of 1974, is still not fully in line with the principles of the constitution and the values of Pancasila which emphasise pluralism and freedom of religion. Simplification of legal procedures: It is recommended that administrative procedures related to interfaith marriage such as marriage registration and family status determination be simplified so that married couples can obtain their citizenship rights without obstacles.

Abstract

This research aims to analyze the role of Pancasila in resolving marriage legal conflicts between Islamic law and national law in Indonesia.The legal context of marriage in Indonesia is often characterized by tension between Islamic law which regulates based on sharia principles and national law regulated in Law Number 1 of 1974 concerning Marriage.Pancasila, as the foundation of the Indonesian state, plays an important role in harmonizing and resolving these conflicts. This research examines how the principles of Pancasila, namely Belief in One God, Just and Civilized Humanity, Indonesian Unity, Democracy Led by Wisdom in Deliberation/Representation, and Social Justice for All Indonesian People can be integrated to resolve marriage legal problems.Through a literature review of books, the latest journals, and expert opinions, this research found that Pancasila can function as an ethical and normative basis for formulating harmonious legal policies.This research recommends the application of Pancasila principles in the legislative process and resolution of marriage legal conflicts to achieve justice and harmony between the various legal systems in force in Indonesia.

Abstract

This study examines the phenomenon of runaway marriages in Indonesia, particularly among communities with strong adherence to traditional customs. Runaway marriages are often seen as a solution for couples who lack family approval or face socio-economic pressures, but they have serious legal implications. Marriages that are not officially registered lack legal standing and negatively impact the legal rights of both the partners and any children born from such unions. Within the framework of Pancasila, runaway marriages conflict with the core values of justice, unity, and respect for the law.The study identifies challenges in enforcing laws related to runaway marriages, including inconsistencies between customary law and state law, inadequate marriage registration in remote areas, and low legal awareness among local communities. The research method involves case analysis, interviews with legal experts and community members, and a review of relevant literature. Recommendations include harmonizing customary law with state law, enhancing legal education, strengthening the role of law enforcement, and utilizing technology in marriage registration systems. These recommendations aim to align marriage practices with Pancasila values and provide fair legal protection for all individuals..

Abstract

Pancasila, as the foundation of the Indonesian state, provides a philosophical and ethical framework for the administration of law and social life in the country. In the context of constitutional law, Pancasila serves as the highest source of law that guides lawmaking and regulatory interpretation. However, the implementation of Pancasila in law is not always in line with the social realities that occur in society, such as the phenomenon of elopement. Kawin lari, which is a marriage performed without going through official procedures or family permission, often reflects the misalignment between social norms, legal practices and socio- economic conditions of society. In Indonesian society, elopement can be considered an act that violates the legal provisions of marriage, which require official registration and consent from the relevant parties. However, in practice, elopement is often caused by factors such as social pressure, economic necessity or gender inequality. This phenomenon suggests an urgent need for harmonization between the principles of Pancasila and the application of constitutional law as well as policy adjustments that are more responsive to the social dynamics of society. This research aims to explore the relationship between Pancasila, constitutional law, and the reality of elopement in Indonesian society by analyzing the various legal and social dimensions of the phenomenon. The results are expected to provide insights into how the country’s fundamental principles can be more effectively integrated in legal practice as well as how legal reform can address existing social challenges.

Abstract

This research explains the conformity of polygamy practices in Indonesia with Pancasila values and national law, with the aim of assessing how far polygamy is in accordance with the state’s basic principles and applicable legal regulations. This research approach uses qualitative methods by studying cases and analyzing documents. Data was collected through interviews with key informants, observations of court cases, and analysis of legal documents and academic literature. Research findings show that although polygamy is regulated by Law no. 1 of 1974 concerning Marriage, practices are often inconsistent with Pancasila values, especially in terms of social justice and gender equality. Weak legal implementation and inadequate protection of the rights of first wives and children contribute to exacerbating injustice. This research recommends legal reform, strengthening supervision, and protecting women’s rights to increase compatibility between the practice of polygamy and the basic principles of state and national law.

Abstract

Dual nationality is a growing phenomenon in the era of globalization, but it presents various challenges from both Islamic law and international law perspectives. In Islamic law, dual nationality is not explicity addressed; however, principles such as the unity of the ummah (community) and obligations toward the state can create dilemmas concerning dual obligations, such as taxes or military service. Islam teaches compliance with laws that do not contradict Sharia, but dual nationality can lead to conflicts between duties toward the state and religious obligations. Meanwhile, in international law, dual nationality often raises issues related to state sovereignty, dual obligations, and legal conflicts between countries. Countries that permit dual nationality face difficulties in terms of diplomatic protection and the regulation of individual rights. Possible solutions include international negotiations, the adoption of more flexible dual nationality policies, and increasing legal awareness for individuals involved. This paper aims to explore the challenges faced by individuals with dual nationality in the context of Islamic law and propose pratical solutions to address these issues.

Abstract

The role of marriage guardians is discussed in the context of Islamic law, Pancasila and the Indonesian constitution, as well as challenges and solutions in their implementation. The marriage guardian has a central function in Islamic law as the party responsible for witnessing and ratifying the marriage contract. This research explores how the role of marriage guardian is integrated with Pancasila values ​​which emphasize justice and equality, and how this is in line with provisions. The research method used in this research is a qualitative descriptive research method, taking the research location at the Polokarto District Religious Affairs Office. The population and sampling method used was purposive sampling while the respondents were heads and employees at the KUA office and husband and wife couples. The types and sources of data used are primary and secondary data. The data collection technique uses interviews and literature study, while the data analysis technique is interactive analysis. The results of the research show that according to Islamic law the role of the guardian in marriage is very important because all marriages carried out must be with the permission and blessing of the marriage guardian, especially the guardian of the lineage, namely the father, because the marriage is based on the teachings of the Islamic religion. Marriage without the guardian's permission is invalid. This is emphasized in Article 19 KHI. Having a marriage guardian in marriage can play a role in protecting women from possible harm in their marriage household, and by first fulfilling the conditions and pillars of marriage and what is no less important is having permission and blessing from the marriage guardian, especially the father before the marriage. carried out will have an influence on psychological aspects for the continuity and peace of the married household of the daughter.

Abstract

The application of Pancasila in handling criminal acts of terrorism plays a crucial role in efforts to maintain the security and welfare of Indonesian society. This article aims to analyze the application of Pancasila values in countering terrorism. Through a comprehensive literature study approach, this article assesses the extent to which Pancasila values have been applied to counter terrorism crimes, including how the basic principles of Pancasila such as humanity, social justice, and unity are applied in countering terrorism. With in-depth analysis, this article finds that the values of Pancasila have not been fully implemented in counterterrorism. Through this study, it is hoped that a more effective and integrated solution can be found in fighting terrorism while still upholding the values of Pancasila as a guideline.

Abstract

Corruption is a problem that threatens the social, economic, and political foundations of Indonesia. This study analyzes the role of Pancasila as the legal foundation for anti-corruption efforts. As the state ideology, Pancasila contains moral, ethical, justice, and humanitarian values that are relevant to strengthening the fight against corruption. This qualitative research employs literature analysis, case studies, and interviews. The findings reveal that the five principles of Pancasila—Belief in One Almighty God, Just and Civilized Humanity, Unity of Indonesia, Democracy Guided by the Inner Wisdom of Deliberation and Representation, and Social Justice for All Indonesians—can serve as moral and ethical grounds for developing anti-corruption policies and regulations. The study highlights the importance of applying Pancasila values in education, public policy, and law enforcement to build a strong anti-corruption culture. With this holistic approach, Indonesia is expected to combat corruption both repressively and preventively, achieving justice and social welfare.
