Village-Owned Enterprises (BUM Desa) are legal entities that aim to manage and develop the potential of village resources as well as to improve the quality of life of village communities and strengthen village capabilities. However, its progress is certainly not easy, one of which is BUM Amartha Patas Village which has stopped operating after a three-year hiatus. Basically, BUM Desa cannot be dissolved and simply stops operating because this could give rise to other legal consequences. The management's responsibilities remain even though BUM Desa has been on hiatus for three years. This research is juridical-normative legal research aimed at finding and formulating legal arguments. This research has the characteristic of studying the object of legal research in terms of legal principles. The research results show that the responsibility of the BUM Desa management does not end with the cessation of business activities. They must complete all ongoing activities, settle the assets and obligations of BUM Desa, as well as protect community assets and settle debts. Cessation of business activities does not erase the legal status of BUM Desa as a legal entity. The dissolution of BUM Desa is defined as the cessation of business activities, with assets and liabilities remaining and must be handled legally.

State-Owned Enterprises (BUMN) are one of the actors in economic activities in the national economy which have an important role in realizing the welfare and prosperity of society. In the case of bankruptcy and postponement of debt payment obligations applications, the Prosecutor's Office has the authority to file a bankruptcy application against the debtor on the basis of public interest. On the other hand, the Prosecutor's Office can also act as a state attorney who has the authority to represent the state or state agency in a case. From the research results, it can be concluded that the authority of the State Attorney to represent the state/state agencies in commercial cases is different from civil cases in general as regulated by Law No. 37 of 2004 concerning Bankruptcy and postponement of debt payment obligations.

Mediation serves as a crucial mechanism in resolving breach of contract disputes by providing an alternative to litigation that emphasizes collaboration and mutual agreement. This study investigates the role and effectiveness of mediation in addressing disputes arising from contractual non-performance. Employing a qualitative approach, the research examines case studies and legal frameworks governing mediation in contract disputes. The findings reveal that mediation offers several advantages over litigation, including reduced costs, faster resolution times, and the preservation of business relationships. These benefits make mediation a preferred choice, especially for parties seeking to maintain ongoing partnerships. The study also highlights the role of mediators as impartial facilitators who guide parties toward creative and mutually beneficial solutions. Mediators assist in clarifying issues, addressing misunderstandings, and fostering open communication, which are essential in resolving complex contractual disputes. However, the success of mediation is contingent upon the willingness of both parties to engage in the process and their commitment to finding a resolution. This paper underscores the significance of promoting mediation as a primary dispute resolution method in breach of contract cases. It advocates for strengthening legal frameworks and increasing public awareness to enhance its accessibility and effectiveness. By doing so, mediation can be further integrated into the legal landscape, offering an efficient and harmonious approach to resolving disputes while alleviating the burden on courts.

Pemerintah Indonesia selaku pemilik saham dari Badan Usaha Milik Negara memiliki hak memberikan penugasan kepada Badan Usaha Milik Negara untuk melakukan fungsi kemanfaatan umum atau Public Service Obligation (PSO). Fungsi kemanfaatan umum tersebut adalah salah satu wujud pelaksanaan dari tanggung jawab pemerintah untuk memenuhi hajat hidup orang banyak sebagaimana diamanatkan di dalam Undang-Undang Dasar 1945. Fokus dari pembahasan pada artikel ini adalah bagaimana tinjauan tanggung jawab direksi Perseroan atas penugasan yang diberikan oleh pemerintah kepada badan usaha milik negara. Penulis berpendapat bahwa dalam hal terjadi kerugian kepada badan usaha milik negara akibat pelaksanaan penugasan dari pemerintah, maka tanggung jawab yang dititikberatkan kepada kepada direksi Perseroan atas kerugian badan usaha milik negara tidak sesuai dengan Pasal 28 D Undang-Undang Dasar Tahun 1945 yang mengatur adanya jaminan, perlindungan dan kepastian hukum yang adil. Batasan tanggung jawab pemerintah sebagai pemegang saham dari badan usaha milik negara yaitu hanya sebesar modal yang disetor dan hanya bertanggung jawab atas kompensasi finansial atas penugasan yang diberikan tidak mencerminkan suatu rasa keadilan sebagaimana pernyataan pada Pasal 28 D Undang-Undang Dasar 1945. Kata kunci: Kewajiban Pelayanan Publik; penugasan; Kerugian Badan Usaha Milik Negara; Tanggung Jawab Direksi.

Adanya keterkaitan antara praktik jabatan rangkap dengan penetapan harga dijelaskan dalam Peraturan KPPU No. 4 Tahun 2011 tentang Pedoman Penetapan Harga bahwa perilaku penetapan harga sebagaimana diatur dalam Pasal 5 UU No.5/1999 akan menjadi lebih mudah dilakukan apabila terdapat jabatan rangkap pada perusahaan yang saling bersaing. Persoalan ini dapat mempengaruhi secara negatif iklim persaingan usaha dan memiliki dampak serius bagi realitas dunia usaha di Indonesia. Walaupun terdapat aturan hukum yang melarang jabatan rangkap, nyatanya praktik jabatan rangkap masih sering terjadi khususnya jabatan rangkap oleh direksi badan usaha milik negara yang seharusnya berperan menyelenggarakan kemanfaatan umum dan kesejahteraan masyarakat. Berdasarkan penelitian ini ditemukan bahwa telah terjadi ketidakpastian hukum terkait jabatan rangkap direksi BUMN, yang mana dalam peraturan menteri BUMN No.3/2015 memperbolehkan seorang direksi BUMN merangkap jabatan namun hal ini bertentangan dengan peraturan diatasnya yang melarang praktik tersebut. Dengan demikian telah terjadi inkonsistensi norma antara Undang-Undang dengan peraturan pelaksananya yang melanggar ketentuan hierarki yang lebih tinggi. Implikasi dari adanya praktik jabatan rangkap Direksi BUMN ini berpotensi menimbulkan persaingan usaha tidak sehat karena penetapan harga tiket pesawat bukan bersumber dari pertimbangan nilai keekonomisan tetapi adanya kepentingan yang sama dari organ Persero.

The Constitutional Court Decision Number 83/PUU-XXII/2024 concerning Article 251 of the Indonesian Commercial Code (KUHD) represents a pivotal moment in strengthening legal protection for policyholders within insurance contracts in Indonesia. Prior to this ruling, Article 251 KUHD authorized insurers to unilaterally revoke insurance policies upon discovering discrepancies in the information provided by policyholders, including unintentional errors. Such a provision created an imbalance in the legal position between insurer and insured, and often led to injustice in insurance practices. Through this decision, the Constitutional Court annulled the aforementioned provision, emphasizing the importance of applying the principles of justice and proportionality in contractual relationships. This study aims to examine the implementation of the principle of justice in insurance contracts following the Court's ruling. The analysis focuses on both juridical and practical impacts on the process of forming and executing insurance agreements. This research employs a normative juridical method, with statutory, conceptual, and case study approaches. The findings indicate that the revocation of Article 251 KUHD has shifted the burden of disclosure, placing greater emphasis on fairness in evaluating the balance of rights and obligations between the parties. The principle of justice now plays a central role, replacing the insurer's previous unilateral dominance. This condition necessitates adaptation from both the insurance industry and regulatory authorities in formulating technical policies that prioritize consumer protection and contractual equity.

This study aims to analyze the legal consequences of non-registration or late registration of receivables owned by creditors in the bankruptcy process. Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations (PKPU) stipulates that in bankruptcy proceedings, the fulfillment of rights over the bankrupt estate can only be obtained if the creditor registers their receivables for verification. However, there are no specific provisions that explicitly regulate the legal consequences of receivables that are not registered at all or those registered late and thus cannot be verified. This legal uncertainty creates problems in practice, particularly regarding legal protection for creditors and legal certainty in the resolution of bankruptcy cases. Using a normative juridical approach and analyzing relevant legislation and court decisions, this research finds that creditors who fail to register their receivables or register them late lose their rights to receive payments from the bankrupt estate. In other words, receivables that are not verified—either due to non-registration or late registration—are not recognized in the bankruptcy process. This conclusion highlights the importance of creditors understanding the procedures for registering receivables in bankruptcy in order to protect their rights. The study also recommends that existing legal regulations provide clearer guidance regarding the consequences of delayed or unregistered receivables to ensure legal certainty and fair protection for all parties involved in bankruptcy proceedings.

Era Globalisasi yang ditandai dengan meningkatnya perkembanganteknologi komunikasi dan informasi, telah memberikan pengaruh positifpada seluruh aktivitas manusia, tidak terkecuali di sektorperekonomian. Salah satu pengaruh teknologi komunikasi daninformasi di sektor perekonomian adalah mulai dipergunakannyaelectronic commerce. Sekalipun banyak keuntungan yang diperolehmelalui electronic commerce, khususnya ditinjau dari aspek jarak, danwaktu, namun tidak berarti e. commerce bebas dari terjadinya risikorisiko yang dapat merugikan para pihak, utamanya pihak konsumen,sehingga diperlukan adanya suatu sistem keamanan yang baik. Sistempengamanan transaksi yang banyak dipakai adalah teknologikriptografi (cryptography) dan Secure Electronic Transction (SET).Namun sistem keamanan ini pun tidak luput dari kelemahan, karenamasih dimungkinkan seseorang menembus sistem tersebut. Jika pihakpihak dalam e-commerce bermaksud mengurangi risiko akibatmasuknya pihak lain ke dalam sistem jaringan keamanan, mereka harusmencari cara untuk mengatasinya. Hasil penelitian menunjukkan bahwaperjanjian asuransi dapat digunakan untuk mengurangi risiko yangdapat terjadi akibat masuknya pihak lain ke dalam sistem keamanan e.commerce, sepanjang perjanjian tersebut tidak menyalahi prinsipprinsip asuransi sebagaimana diatur dalam Kitab Undang-UndangHukum Dagang. Mengingat perjanjian asuransi yang dibuat termasukgolongan asuransi kerugian maka pembuktiannya dapat mengacukepada ketentuan Pasal 257 dan 258 Kitab Undang-Undang Hukumdagang.

This research aims to understand the practice of fare determination through a bidding system on online transportation applications based on Competition Law in Indonesia and to examine the supervision of fare determination actions through a bidding system on online transportation applications based on the applicable laws and regulations. This research employs a normative juridical analysis with a descriptive-analytical method by explaining the practice of fare determination using a bidding system and subsequently analyzing it using existing legal theories and norms. The results of this research indicate that the fare determination actions taken by online transportation business operators using a bidding system potentially violate the provisions of Article 20 of the Business Competition Law regarding the prohibition of predatory pricing and the Decree of the Minister of Transportation Number KP 667 in conjunction with the Decree of the Minister of Transportation Number KP 1001 concerning the Guidelines for Calculating Service Costs for Motorcycles Used with Applications, as well as the Minister of Transportation Regulation Number 12 of 2019 on the Protection of Safety for Motorcycle Users Used for Community Interests. Supervision of the actions of online transportation business operators in setting prices using a bidding system is conducted by two institutions, namely KPPU (Commission for the Supervision of Business Competition) and the Ministry of Transportation, both preventively and repressively.
