Abstract

This study examines the legal protection afforded to good-faith housing buyers when objects of a Binding Sale and Purchase Agreement (PPJB) are included in a developer's bankruptcy estate, focusing on Supreme Court Decision No. 24 K/Pdt.Sus-Pailit/2025. The research employs a normative juridical method, using statutory, conceptual, and case approaches to analyze bankruptcy law, consumer protection norms, PPJB regulations, and judicial reasoning. The study finds that although the PPJB in the case was privately executed and did not comply with the formal requirements of Ministerial Regulation ATR/BPN No. 16 of 2021, the Supreme Court affirmed that buyers who had fully paid and taken possession before bankruptcy qualify as good-faith third parties entitled to protection. The Court emphasized the asset separation principle, holding that only assets legally owned by the debtor at the time of bankruptcy may form part of the bankruptcy estate, thereby limiting the universality principle and prioritizing substantive justice. By annulling the curator’s action, the decision strengthens consumer protection in developer bankruptcy cases. This study concludes that buyers require both preventive and repressive legal protection, and that PPJBs should be executed as authentic deeds with a power of sale clause to prevent future disputes.

Abstract

Abstract Excessive consumption of trans fats can increase LDL and triglyceride levels and decrease HDL levels. Therefore, an instrument is needed to protect consumers when consuming processed foods by including information about trans fat content on processed food packaging. The main topic of this research examines the regulations regarding the inclusion of trans fat information on processed food packaging in Indonesia and Singapore and the government's responsibility to consumers to provide accurate information. The research methods applied are the normative juridical method with a legislative approach, a comparative approach, and a case approach. Library research was applied as a data collection technique. This study shows that regulations regarding the inclusion of trans fat information in Indonesia and Singapore already exist, but there are several differences regarding the limits of trans fat content that can be contained in food and provisions regarding sanctions. Therefore, Indonesia can immediately create regulations regarding sanctions for violations of the inclusion of trans fat information on processed food packaging and consider the implementation of front-of-pack labeling. Keywords : Trans fat, Indonesia, Singapore.

Abstract

Abstract  This study aims to analyze corporate responsibility in ensuring the compliance of the pharmaceutical industry with regulations governing the use of laboratory animals in Indonesia, emphasizing aspects of legal, ethical, and technical adherence to animal welfare principles. This study adopts normative juridical research method employing both statuory and conceptual approaches. The data were gathered through library research, comprising primary legal materials for instance like laws and regulations, additionally secondary legal materials including books, journal articles, as well as online references. The findings indicate that although Indonesia has established several regulations such as Law No. 18 of 2009 jo. No. 41 of 2014, Government Regulation No. 95 of 2012, Minister of Health Regulation No. 75 of 2020, and BPOM Regulations No. 10 of 2022 and No. 20 of 2023, their implementation within the pharmaceutical industry remains suboptimal due to weak enforcement and monitoring mechanisms. Therefore, the establishment of an integrated compliance system combined with ethical and technical oversight is essential to ensure that the use of laboratory animals is conducted transparently, responsibly, and in accordance with the 3R and 5F principles. Keywords: laboratory animals, legal compliance, animal welfare.

Abstract

 AbstractProtection of industrial designs for food packaging is vital to preserve originality and legal certainty. In Indonesia, substantive examination remains reactive triggered only by third-party objections during the publication period creating potential uncertainty, as seen in the red ginger drink packaging dispute between PT Aneka Boga Citra and PT Total Asri Sumber Alam. In contrast, Japan applies a full examination from the outset to assess novelty and originality. Using a normative juridical method (comparative approach and case studies), this study finds that full examination effectively strengthens protection and prevents disputes. This research recommends that Indonesia must  adopt a Hybrid Substantive Examination Model combining rigorous expert review with AI technology. Keywords : Industrial Design, substantive examination, comparative law.

Abstract

This study analyzes unfair business competition practices in the telecommunications sector in Indonesia, which analyzes in more depth the case study of blocking carried out by PT Telekomunikasi Selular and PT Telekomunikasi Indonesia under the auspices of the Telkom Group against the Over The Top (OTT) service Netflix. The author uses a normative method with a case and legislative approach, this study found that the unilateral blocking carried out by the Telkom Group has fulfilled the elements of discrimination regulated in Article 19 letter (d) of Law Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition because the Telkom Group only blocked Netflix, while other OTT services that have done the same thing were not subjected to the same blocking, in this case the Telkom Group's policy as a dominant business actor in the telecommunications sector also has a negative impact on consumer internet access. However, despite the discovery of discriminatory acts that are strong indications, the KPPU decision in Case No. 08 / KPPU-I / 2020 stated that the Telkom Group was not indicated in unfair business competition practices, this indicates a legal weakness. This legal weakness is caused by the non-implementation of the Network Neutrality principle in regulations governing the flow of telecommunications services and the limitations of business competition test indicators that cannot analyze the long-term impact (Network Effects) in the digital telecommunications market. Therefore, this study concludes that regulators must harmonize by improving regulations on cooperation between telecommunications services and OTT services through fair and transparent Business to Business principles, as well as adding long-term impact (Network Effects) test criteria to the KPPU Commission Regulation to ensure healthy competition in the future.

Abstract

This study investigates the dynamics of U.S.–China security rivalry in the South China Sea through a neo-realist perspective using a systematic literature review of recent scholarly work. The findings show that strategic competition between Washington and Beijing is driven primarily by structural pressures of the international system rather than ideological disputes or policy miscalculations. China’s naval modernization, A2/AD capabilities, and island militarization reflect long-term hegemonic aspirations to dominate the regional maritime order, while the United States maintains its Indo-Pacific military posture and expands alliance networks to preserve maritime primacy. International institutions and diplomatic mechanisms have failed to mitigate tensions because both powers prioritize national interests above legal norms and cooperative regimes. The rivalry has widened military coalitions, weakened ASEAN strategic autonomy, and entrenched bipolarity across the Indo-Pacific, indicating that conflict escalation is linked to the distribution of power under anarchy rather than contingent diplomacy. This review concludes that without a fundamental shift in structural power, the South China Sea will remain a focal arena of long-term security competition between the United States and China

Abstract

  This article examines the philosophical significance of Balinese customary law and the Tri Hita Karana principle as a normative foundation for the development of sustainability-oriented law in Indonesia. Using a normative juridical method with statutory and conceptual approaches, the research analyzes legal doctrines, regulatory frameworks, and scholarly discourse to evaluate how Tri Hita Karana contributes to legal philosophy and legal policy. The findings show that Balinese customary law institutionalizes sustainability through spiritual, social, and ecological harmony, demonstrated in resource governance, dispute resolution, family law, economic institutions, and tourism regulation. The study identifies the potential of Tri Hita Karana to shape a national sustainability legal framework through cultural-philosophical integration, strengthening community-based legal institutions, and harmonizing legislation with ethical responsibility to nature and culture. The article concludes that Tri Hita Karana offers a culturally grounded philosophical paradigm capable of enriching national legal development for environmental, social, and cultural sustainability

Abstract

This study aims to analyze the state’s responsibility in protecting consumers of imported halal products and to examine the implications of Indonesia–United States trade negotiations for the implementation of the Halal Product Assurance Law (UU JPH) within a standards-based global trade landscape. It employs a normative legal research method using statutory, conceptual, and comparative approaches. The analysis evaluates national regulations alongside the principles of non-discrimination and equivalence under the WTO regime to determine the limits of trade compromise. The findings indicate that mandatory halal certification constitutes a constitutional mandate that cannot be substantively negotiated. Recognition of foreign halal certificates may only be granted through a strict, transparent, and proportional equivalence assessment to ensure an equivalent level of protection for Muslim consumers. Trade negotiations do not eliminate regulatory sovereignty; rather, they require the design of recognition mechanisms that preserve the integrity of the national halal assurance system and remain consistent with international trade law.

Abstract

This study examines the legal certainty of using cryptocurrency as an investment instrument in companies in Indonesia. Although cryptocurrency is not recognized as a legal means of payment, it has been acknowledged as a tradable commodity in futures exchanges. This research utilizes a normative legal approach to analyze existing regulations, challenges encountered, and legal protections available for investors. The findings indicate that despite significant profit potential, investors still face high risks due to price volatility, insufficient legal protections, and cybersecurity threats. It is crucial for the government to formulate more comprehensive and supportive regulations to protect investors and prevent misuse and illegal practices. Additionally, an extensive educational program is needed to enhance public understanding of the risks and benefits of investing in cryptocurrency. With adequate regulation and improved public awareness, cryptocurrency is expected to contribute positively to Indonesia’s digital economic growth. This study aims to contribute to the development of policies and regulations related to cryptocurrency in Indonesia and to encourage greater public participation in this investment ecosystem.
