Abstract

This study, entitled Implementation of Sale and Purchase of Uncertified Land in Grobogan Regency, this study aims to determine the Implementation of Land Sale and Purchase in Indonesia According to the applicable Positive Law, and find out the legal consequences of the implementation of buying and selling land without certificates in Grobogan Regency and find out how the stages of buying and selling uncertified land can be carried out. This study aims to determine the implementation of land sale and purchase in Indonesia according to the applicable positive law, and to analyze and understand the legal consequences of the implementation of land sale and purchase without certificates in Grobogan Regency. The research method uses a sociological juridical approach. Research specifications using descriptive analysis, data sources used primary data and secondary data, primary data collection methods using conservation and interviews, secondary data collection methods using literature studies and document studies and data analysis methods using qualitative analysis methods. Based on the results of the study, it can be concluded that the sale and purchase of land according to positive law in Indonesia must be made by and before the authorized Land Deed Making Officer (PPAT) as evidenced by the Sale and Purchase Deed. Legal consequences of the implementation of the sale and purchase of land without a certificate in Grobogan Regency In buying and selling land without a certificate, it is very possible that there are legal consequences caused, namely the absence of transfer of land rights and uncertainty of the transfer of land rights, as well as the lack of guaranteed legal certainty and legal protection.

Abstract

Some large companies with good capital and capabilities will also provide good services and administrative systems. Maybe it will be different if the company is still relatively small and within the scope of a relatively small company running its company only with original or perfunctory capital, which makes the company not have employees who have sufficient competence in managing the company. This study aims to determine the provisions in the cooperation agreement letter between CV Hot pepper Creative and SMK National Health Analyst Surakarta and whether it is by the legal regulations of the agreement. The author uses legal (doctrinal) research methods carried out by searching library materials. The author’s research type in this study is normative legal research. The data types used are primary legal materials consisting of legal regulations, secondary legal materials derived from books, research journals, and other research, and tertiary materials derived from Indonesian and legal dictionaries. The results of the research obtained that the contract agreement carried out between Hot pepper and SMK Analis was by the legal terms of the agreement Article 1320 KUHPerdata. The contractual agreement is by the principle of freedom of contract Article 1324 KUHPerdata that there is no coercion either by physical violence or intimidation so that the person is forced to agree to the agreement.

Abstract

Mediation is a process that the parties must go through during the process of resolving a divorce case before the parties proceed with the case to the trial table. The parties must go through this mediation stage first. So, in an effort to increase the success of mediation, the Supreme Court implemented Supreme Court Regulation no. 1 of 2016 which contains related Mediation Procedures in Court. The research method that the author uses is a quantitative research method. By using data sources consisting of primary data, secondary data in the form of primary, secondary and tertiary legal materials, the primary data used in this research is data obtained directly from the field. The aim of this research is to understand the effectiveness of mediation in resolving divorce cases, and as evaluation material it is necessary to find out what can be supporting and inhibiting factors for the success of mediation. The results of research at the Boyolali Religious Court that mediation in resolving divorce cases has been effective is proven by the success rate of mediation in resolving divorce cases increasing in 2022 and 2024. However, there are still many factors that hinder the success of mediation, such as the strong desire of the parties to divorce, besides that there are also supporting factors in the form of family support for the parties to reconcile. Mediation in Divorce Cases at the Boyolali Religious Court has succeeded in reducing the divorce rate by 39.35% in 2024.

Abstract

In this modern era, many technologies have emerged and help human life, one of which is Artificial Intelligence (AI), but despite the many benefits it brings, it turns out that AI also brings anxiety, especially in the field of Intellectual Property Rights (IPR), which Many AI creations are considered to have the potential to commit violations, especially in the field of copyright, such as forgery of works of art or theft of works of art. Apart from that, AI creation itself invites other problems regarding whether it can be legally protected or not, because one of the problems that exists in the use of AI is that the data used in its development uses existing creations, unless the copyright protection period has expired, then the creation is still subject to copyright protection. So that the legality of the AI creation itself is still questionable. Therefore, by using the normative method by collecting data related to relevant rules and opinions of experts, from these data, researchers try to analyze using descriptive analytical methods that connect the object under study with existing regulatory provisions and with literature studies, it is hoped that this article can answer the problem of the legality of AI creations, especially in the frame of Intellectual Property Rights in Indonesia. According to the Indonesian Copyright Law (UUHC), works created by Artificial Intelligence cannot be said to be works of creation that can be protected. However, legal violations that occur due to the use of AI can be held accountable by the AI service provider. To avoid the many violations that will occur in the future due to the continued development of this technology, the Indonesian government must make clearer and firmer regulations in regulating technological developments that are occurring rapidly and widely in Indonesia.

Abstract

This research discusses the fundamental differences between the European Union's Digital Services Act (DSA) and the Electronic Information and Transaction Law No 1 of 2024 in the context of child protection. The European Union's Digital Services Act regulates online platforms with a holistic and comprehensive approach, while the Electronic Information and Transaction Law No. 1 of 2024 focuses more on the Indonesian context. This research uses a qualitative method with a normative juridical approach. The normative juridical approach is an approach that is carried out based on the main material by examining laws and regulations, theories, concepts, legal principles related to differences in regulatory approaches, implementation, and their impact on child protection on the TikTok platform with descriptive-analysis. The difference between this article and previous research lies in the comparative study of data review. The objectives of this study are (1) to examine the fundamental differences between the European Union's Digital Services Act and the Electronic Information and Transaction Law No. 1 of 2024 in the context of child protection, (2) to describe the impact of these regulations on TikTok's policies and practices in protecting children from the risks that may arise on the platform. The results of this study are that the European Union's Digital Services Act regulates online platforms with a holistic and comprehensive approach, while the Electronic Information and Transaction Law No. 1 of 2024 focuses more on the Indonesian context. The differences between the two include the definition of child protection, platform obligations, complaint mechanisms, sanctions, and content monitoring approaches. However, both aim to protect children from risks in the digital environment. The impact of both regulations on TikTok's policies and practices includes increased platform obligations and responsibilities, transparency, stricter content monitoring, implementation of effective complaint mechanisms, and closer cooperation with government and relevant agencies.

Abstract

Technology is developing so rapidly that it knows no boundaries. Blockchain smart contracts are one of the real proofs of technological development. This innovation was born out of the urgent need for faster, more convenient, and efficient digital transactions. Its existence is an extension of conventional agreements that have legal validity when the provisions as stated in Article 1243 of the Civil Code are fulfilled. This normatif juridical research is compiled using a statutory approach and the data is obtained from literature studies. Sources of data obtained from primary legal materials in the form of laws and secondary legal materials from literacy that have relevance to the issues raised are then processed with descriptive analysis methods. The objectives are to: 1) Know the legal aspects contained in the use of Blockchain smart contract technology; and 2) Knowing the legal settlement of disputes arising in the use of Blockchain smart contracts. The results of the study indicate that a Blockchain smart contract can be considered a valid agreement if it fulfills the 4 (four) elements of a conventional agreement along with other additional provisions. Its utilization in the cyber world creates friction with international law, so that the implementation, legal protection, and disputes that arise must also pay attention to the provisions of international law. This shows that the Blockchain smart contract is an innovation that provides convenience for the community which also requires more attention, especially its legal status in Indonesia.

Abstract

This research discusses criminal law enforcement against current information technology in overcoming cyber crime, and to find out legal liability related to cases of company data leakage in Indonesia. This research uses a normative approach. This research uses main data and additional data. The data collection technique in this research uses literature study, while the analysis technique used in this research uses qualitative analysis. The results of this study are in the form of criminal law enforcement policies against current information technology in overcoming cyber crime, in overcoming cyber crime regulated in Law No. 19 of 2016 concerning Amendments to Law No. 11 of 2008 concerning Electronic Information and Transactions Article 27 to Article 31. Then legal liability related to cases of corporate data leaks in Indonesia, regulated in the Personal Data Protection Law which regulates data protection.

Abstract

Intellectual Property Rights (IPR) are exclusive rights granted to individuals or groups for their creative works that benefit society. They protect interests, financial rights, and prevent infringement. This research aims to find out how the regulations in Indonesia and its benefits in the registration of Intellectual Property Rights, especially Patent Rights. This research uses normative juridical research to analyze legal issues using various legal materials. It focuses on positivistic views, principles, doctrine, discovery, systematics, harmonization, comparative studies, and history. The approach includes statutory and conceptual analysis, grammatical and systematic interpretation. Copyright protection in science, art and literature often coincides with creation, where the creator does not register the work. Indonesian copyright law uses principles such as lex posterior derogat legi priori. Islamic jurisprudence emphasizes intellectual property rights and the prohibition of unlawful consumption, the researcher draws from a concept namely Maqashid As-Sharia. The Maqashid as-Sharia approach, which focuses on the benefit of protecting the mind and property, can be used to study intellectual property rights in Islamic law. In this case, it is expected that the creators can register their creations for the sake of the formation of benefits.

Abstract

In accordance with Law No. 35 Article 76 I of 2014 on child protection, this study investigates the impact of child exploitation on the mental and emotional health of children in Surakarta. This study shows that child exploitation adversely affects children's mental and emotional health. That many of them experience anxiety, depression, sleep disorders, and also experience high psychological burden, which causes emotional disorders such as anger, frustration, and deep sadness. In addition, this study found that Law No. 35 Article 76 I of 2014 provides significant protection for child victims of exploitation in Surakarta. The law also regulates the sanctions given to the perpetrators of child exploitation. This study aims to review and analyze how much child exploitation in Surakarta and what are the factors that cause child exploitation that affect the mental and emotional health of children. Data analysis is conducted using empirical methods to explore cases of experience and concrete facts by means of observation and interviews. The results of this study suggest that communities and government agencies should be more aware of combating child exploitation. To prevent children from exploitation that harms their mental and emotional health, strict education and socialization should be conducted.

Abstract

The primary objective of this study is to scrutinize and evaluate the process of transferring ownership rights to land lacking certification and its associated legal implications, while also assessing the proactive measures taken by National Land Agency Grobogan Regency in addressing instances of uncertified land transactions. Employing an empirical juridical research approach, which entails analyzing real world social issues to acquire pertinent knowledge for resolution, this study seeks to gain insights into the subject matter. Findings from the research indicate that the transfer of ownership rights to uncertified land in Grobogan Regency can occur through both formal and informal channels. These factors are influenced, among other things, by incomplete land documentation, the high cost of sale and purchase deeds, the still strong legal culture of local communities, and the low level of legal knowledge of local communities to carry out effective sales and purchases in accordance with government regulations. The legal consequence of owning uncertified land in the Globogan Regency area is that it is detrimental to the party holding the rights to the land because there is no guarantee of legal certainty. National Land Agency Grobogan Regency's approach to addressing instances of land transactions lacking certificates involves implementing a free land registration program, also known as Complete Systematic Land Registration (PTSL) by the National Land Agency. This initiative aims to streamline the registration process, particularly for rural communities, thereby ensuring legal certainty and protecting community land rights. Embracing principles such as simplicity, affordability, efficiency, safety, fairness, equity, transparency, and accountability, the program aims to facilitate accessible and fair land registration procedures.
