Abstract

The issue of climate change necessitates active state participation inmitigating greenhouse gas (GHG) emissions through the adoption ofequitable and sustainable policies. This study seeks to examine thenature of state responsibility in climate change mitigation inIndonesia, with a particular focus on the implementation of CarbonEconomic Value (NEK) as delineated in Presidential Regulation No.98 of 2021. This research constitutes a prescriptive normative legalstudy, employing a legislative approach. The findings indicate thatthe regulatory framework for Carbon Economic Value (NEK)provides a foundational structure for NEK as an environmentaleconomic instrument to facilitate the attainment of NationallyDetermined Contributions (NDCs) through various mechanisms.Nonetheless, this framework exhibits several deficiencies, includingthe legal status of carbon units, the mechanism for stateaccountability, and inadequate protection for indigenous peoplesand local communities. Consequently, the researchers advocate forthe government to fortify the legal foundation of NEC by formulatingmore detailed and integrated technical regulations and, in the longterm, to consider the development of specific legislation on carboneconomic value. These measures are anticipated to enhance theefficacy of NEC, ensure legal certainty, and achieve ecological justicefor both present and future generations.

Abstract

The relationship between traditional Islamic jurisprudence (fiqh) and modern international human rights norms has long been characterized by debate and tension. Islamic law is commonly perceived as divinely grounded and normatively authoritative, whereas human rights frameworks are often viewed as secular, universal, and rooted in modern legal philosophy. This perceived dichotomy has contributed to the widespread assumption that Sharī‘a and human rights are inherently incompatible, particularly in sensitive areas such as gender equality, freedom of religion, and minority rights. Reassessing this tension is especially important for Muslim-majority societies that must reconcile religious legitimacy with global human rights obligations. This study explores the potential for harmonizing classical Islamic jurisprudence with contemporary human rights norms by identifying shared values, points of divergence, and feasible pathways for integration. Using a qualitative normative legal approach, the research employs doctrinal analysis of primary Islamic legal sources alongside international human rights instruments, supported by comparative analysis of key rights, including the protection of life, religious freedom, and gender equality. Interpretative analysis is applied to examine how classical and contemporary Islamic scholars conceptualize human rights within the Sharī‘a framework. The findings reveal substantial convergence between Islamic law and human rights norms, particularly in their shared emphasis on human dignity, justice, equality, and social welfare. While interpretative tensions persist, they are largely shaped by contextual and institutional factors rather than by the core ethical objectives of Islamic law. Integrative approaches grounded in ijtihad, maṣlaḥa, and maqāṣid al-sharī‘a offer constructive pathways for harmonization.

Abstract

Penelitian ini bertujuan untuk meninjau atribusi konsep diri pada anak putus sekolah di SMK Negeri 1 Paguyaman Pantai. Fokus utama penelitian adalah memahami bagaimana siswa yang tidak melanjutkan pendidikan membentuk persepsi terhadap dirinya sendiri serta mengidentifikasi faktor-faktor yang memengaruhi keputusan mereka untuk berhenti sekolah. Hasil penelitian menunjukkan bahwa terdapat dua kategori konsep diri yang dialami oleh siswa putus sekolah, yaitu konsep diri negatif dan konsep diri positif. Siswa dengan konsep diri negatif cenderung merasa rendah diri, pesimis terhadap masa depan, dan menganggap dirinya gagal. Sementara itu, sebagian siswa tetap memiliki konsep diri positif, percaya diri, dan yakin bisa meraih kesuksesan melalui jalur nonformal seperti bekerja atau berwirausaha. Faktor utama penyebab putus sekolah adalah kondisi ekonomi keluarga yang terbatas serta pengaruh pergaulan bebas. Selain itu, penelitian ini menemukan bahwa upaya yang dilakukan oleh pihak sekolah dalam menangani kasus siswa putus sekolah masih terbatas, yaitu dengan melakukan kunjungan ke rumah dan berkomunikasi langsung dengan orang tua siswa. Temuan ini menunjukkan pentingnya pendekatan yang lebih komprehensif dan berkelanjutan dari berbagai pihak untuk membentuk konsep diri yang positif serta menekan angka putus sekolah.

Abstract

The reform of Indonesia’s national criminal law through the enactment of Law Number 1 of 2023 concerning the Criminal Code (KUHP) introduces significant changes in the regulation of criminal offenses, particularly within the domain of morality-related crimes. One of the most notable developments is the reclassification of certain offenses into complaint-based crimes, which were previously treated as ordinary offenses. This policy shift is grounded in the intention to better respect individual privacy, human dignity, and the autonomy of victims in deciding whether a case should proceed through legal channels. At the same time, it reflects the state’s effort to limit excessive intervention in the private sphere of citizens. Nevertheless, the implementation of complaint-based offenses in morality-related crimes presents a number of challenges. In practice, this mechanism may hinder victims’ access to justice due to various factors, including social pressure, stigma, unequal power relations, and economic dependence on the perpetrator. This study aims to comprehensively examine the concept of complaint-based offenses in morality crimes under the new Criminal Code and to analyze its implications for victim protection. This research employs a normative legal method using both statutory and conceptual approaches, supported by primary and secondary legal materials. The findings indicate that while complaint-based offenses provide victims with greater control over legal proceedings, they also pose risks of injustice, particularly for vulnerable groups such as women. Therefore, strengthening legal policies, improving victim assistance mechanisms, and adopting a more victim-oriented approach are essential to achieving substantive justice.

Abstract

Kegiatan pengabdian kepada masyarakat berjudul “Meningkatkan Kepedulian dan Kesehatan Masyarakat melalui Layanan Khitanan Massal dan Pemeriksaan Kesehatan Lansia di SDN 8 Telaga Desa Doluhupa Kabupaten Gorontalo” dilaksanakan sebagai upaya meningkatkan akses pelayanan kesehatan bagi masyarakat, khususnya anak usia sekolah dasar dan kelompok lanjut usia. Kegiatan ini dilatarbelakangi oleh masih adanya keterbatasan masyarakat dalam memperoleh pelayanan kesehatan yang terjangkau, rendahnya kesadaran pemeriksaan kesehatan berkala, serta kebutuhan layanan khitan yang aman dan sesuai standar medis. Metode pelaksanaan kegiatan menggunakan pendekatan pelayanan langsung yang dikombinasikan dengan edukasi kesehatan. Tahapan kegiatan meliputi persiapan, identifikasi mitra dan lokasi, survei pendahuluan, penyusunan materi edukasi, koordinasi dengan pihak sekolah, pembentukan tim fasilitator, pelaksanaan layanan, monitoring, evaluasi, dan pelaporan. Kegiatan dilaksanakan di SDN 8 Telaga, Desa Doluhupa, Kabupaten Gorontalo, dengan melibatkan mahasiswa, tenaga kesehatan, pihak sekolah, dan masyarakat. Peserta kegiatan terdiri atas 50 anak yang mengikuti khitanan massal dan 120 lansia yang mengikuti pemeriksaan kesehatan. Hasil kegiatan menunjukkan bahwa layanan khitanan massal berjalan dengan baik, aman, dan mendapat dukungan positif dari masyarakat. Pemeriksaan kesehatan lansia membantu peserta mengetahui kondisi kesehatannya, terutama terkait risiko penyakit tidak menular seperti hipertensi dan peningkatan kadar gula darah. Selain itu, edukasi kesehatan yang diberikan mampu meningkatkan pemahaman masyarakat mengenai pentingnya pola hidup sehat dan pemeriksaan kesehatan rutin. Kegiatan ini menunjukkan bahwa kolaborasi antara mahasiswa, tenaga kesehatan, sekolah, dan masyarakat dapat menjadi strategi efektif dalam meningkatkan kepedulian sosial serta derajat kesehatan masyarakat secara berkelanjutan.

Abstract

The increasing use of motorcycles among minors is a concerning phenomenon because it is not balanced by legal awareness and traffic safety. This study aims to analyze law enforcement against children as underage motorcyclists and identify the factors that influence it in the Bolaang Mongondow Selatan Regency Police area. The method used is qualitative research with a descriptive approach, through data collection techniques such as interviews, observation, and documentation. The results of the study indicate that law enforcement is carried out through three main approaches: preventive, repressive, and coordinative. The preventive approach is realized through socialization and patrols, the repressive approach through warnings, tickets, and summoning parents, while the coordinative approach through cooperation with schools, parents, and local governments. However, the effectiveness of law enforcement is still influenced by factors such as a suboptimal legal structure, low public awareness, and strong socio-cultural influences that are permissive towards violations. The conclusion of this study confirms that law enforcement has been carried out systematically, but requires strengthening synergy between the authorities, the community, and the social environment to improve legal compliance and traffic safety in a sustainable manner.

Abstract

Village development is an important part of national development that emphasizes community participation and collaboration between local institutions. In this context, participatory village development requires synergy between the village government and community elements, including Karang Taruna as a youth organization that has a strategic role in supporting the implementation of development programs. However, in practice, the involvement of Karang Taruna in several villages is not fully optimal, thus affecting the effectiveness of village development. This study aims to analyze the challenges of cooperation between village heads and Karang Taruna, identify the cooperation models applied, and explain the development of synergy between the two in the implementation of village development with collaborative, participatory governance to realize sustainable development and community empowerment, especially the younger generation in the Botumito sub-district. This study uses a descriptive approach using qualitative research types that only describe the meaning of data or phenomena that can be captured by the researcher, by showing the evidence. This study uses data collection techniques in the form of interviews, observation, and documentation. In-depth interviews were conducted with competent sources in their fields, including village heads, BPD, Karang Taruna, and community leaders. To validate the research data, triangulation techniques were used, with qualitative data analysis. The results showed that the main challenges to collaboration lie in communication, the division of roles and authority, and resource support. Two models of collaboration were identified: a more effective and participatory partnership (coordination) model in Potanga and Tapadaa Villages, and a top-down instructive (hierarchical) model in Tutulo and Hutamonu Villages. The development of synergy indicates that villages with open communication and a clear division of roles have more inclusive, participatory, and sustainable development.

Abstract

Drug abuse in Indonesia, particularly in Gorontalo Province, has reached a critical point that threatens the younger generation and requires a comprehensive evaluation of existing recovery policies. This study aims to analyze the implementation of legal rehabilitation efforts in minimizing the rate of drug abuse and to evaluate the policies of the National Narcotics Agency (BNN) of Gorontalo Province as both preventive and curative measures. The method used is a descriptive qualitative approach with the CIPP (Context, Input, Process, Product) evaluation model, in which data were collected through in-depth interviews, observations, and documentation studies, and then analyzed inductively. The results show that rehabilitation efforts have successfully recovered 727 drug users during the 2021–2024 period. However, their effectiveness is still constrained by the limited number of addiction counselors, inadequate inpatient facilities, and the high level of social stigma within the community. These findings conclude that although rehabilitation policies at BNNP Gorontalo are aligned with the principles of restorative justice, strengthening is still needed in terms of human resources and public education to eliminate social resistance. The implications of this study emphasize the importance of a more integrative policy transformation between law enforcement and sociological support. This research serves as a basis for recommendations to local governments in optimizing narcotics eradication strategies through the enhancement of more humane and accessible rehabilitation facilities.

Abstract

Traffic is an important aspect of people's lives related to daily mobility, but the increasing level of violations indicates low compliance with the law, especially in Buol Regency. This study aims to analyze the role of the Buol Police Traffic Unit in enforcing the law against traffic violations and identify the factors that influence it. The method used is empirical legal research with a qualitative approach through observation, interviews, and documentation techniques. The results of the study indicate that the Buol Police Traffic Unit has implemented law enforcement through three main approaches, namely preventive, repressive, and curative, but its effectiveness has not been optimal. This is caused by various obstacles, such as low public legal awareness, lack of consistency and firmness of officers, and low levels of public trust. In addition, traffic violations are influenced by internal factors such as low discipline and knowledge of road users, as well as external factors such as infrastructure conditions, weak supervision, suboptimal administrative services, and a permissive community culture. In conclusion, traffic law enforcement in the Buol Police area needs to be carried out in a more comprehensive, consistent, educational, and sustainable manner to be able to increase public compliance and realize optimal traffic order and safety.

Abstract

Early marriage remains a widespread social phenomenon in Indonesia, including in Paleleh District, Buol Regency, despite the increase in the minimum age regulation through Law No. 16 of 2019. This study aims to conduct a comprehensive legal critique of the effectiveness of government policies in reducing early marriage rates and identify obstacles encountered in the field. The method used is a descriptive qualitative approach, where data is collected through observation, documentation studies, and in-depth interviews with informants from government elements and early marriage perpetrators, which are then analyzed using the theory of legal effectiveness. The results of the study indicate that the policy has not been substantially effective because the number of underage marriages remains fluctuating and high, triggered by the exploitation of marriage dispensation loopholes and the practice of unregistered marriages. In addition, it was found that cultural factors of "shame" (sirri), economic pressure, and lack of data synchronization between agencies are the main obstacles to the success of the regulation. This study concludes that positive law does not automatically change social behavior without the support of the community's legal culture, so that policy transformation that integrates sociological approaches and community-based education is needed. These findings are important as a basis for recommendations for local governments to develop child protection strategies that are more humane and address the roots of socio-cultural problems.
