Abstract

Law 37 of 2004 states that the debt to the creditor PT has been determined. Bangun Investa Graha can be billed on time, but PT. PPJB is terminated unilaterally and in bad faith by Bangun Investa Graha, which frequently ignores calls from creditors. In accordance with normative legal principles, this study employs qualitative research methods. In this approach, the author employs a normative juridical strategy. It is possible to draw the conclusion based on the findings of the research that has been discussed that Law Number 37 of 2004 Concerning Bankruptcy and Postponement of Debt Payment Obligations (PKPU) does not have any legal function against concurrent creditors who are not guaranteed. When a debtor has debts that are greater than his assets, the responsibilities of the debtor and his directors are not taken into account in the Panel of Judges' decision in this case. Due to the fact that the debtor's assets will not be distributed appropriately if the debtor is declared bankrupt by the court, concurrent creditors will suffer greater losses. The Panel of Judges considered the decision in Renvoi's cassation without understanding why the cassation was rejected—whether the debtor's condition was insufficient to pay creditors or the debtor did not want to pay concurrent creditors.Keywords: Debts, Debtors, Creditors, Losses

Abstract

In the increasingly fierce business competition, the outsourcing system is felt to be more effective for the company. On the other hand, the outsourcing system opens opportunities for employers to carry out Termination of Employment (PHK) actions easily. In the outsourcing system, there are weaknesses, there is no guarantee of continuity of work for workers. Law Number 6 of 2023 of Job Creation has regulated legal protection for outsourcing workers against arbitrary actions by employers in carrying out layoffs, through the principle of Transfer of Undertakings Protection of Employment (TUPE). But in practice, the TUPE principle is still not running effectively. The purpose of this research is to find out and understand the principles of the employment relationship between outsourced workers and employers so that unfair layoffs do not occur and legal protection for outsourced workers from employers' arbitrariness in implementing layoffs. This study uses a normative juridical approach. It is necessary to develop regulations regarding outsourcing in which legal protection for workers is further enhanced, determine sanctions and law enforcement for those who commit violations, and carry out more intensive supervision of the implementation of outsourcing. Keywords: Legal protection, outsourcing, continuity of work

Abstract

This research investigates the implementation of smart contracts in the Indonesian property sector, examining the legal opportunities and challenges involved. Blockchain technology offers high transparency, efficiency, and security in property transactions, but faces regulatory and infrastructural hurdles. The aim of this research is to explore the related legal dynamics, identify socio-economic impacts, and offer sustainable solutions. The research method employed is a qualitative legal approach to gather and analyze data. The findings indicate that although blockchain can expedite transaction processes and enhance transparency, the legal validity of smart contracts and consumer protection remain major issues. Regulatory updates and increased awareness of data security are necessary to optimize the adoption of this technology in Indonesia.Keywords: Blockchain., Property law., Regulation., Smart contracts., Transparency

Abstract

The state holds constitutional responsibility in the field of labor by providing legal protection to ensure legal certainty for individuals involved, particularly in the context of employing foreign labor. However, such protection applies only to foreign workers who meet the legal standing requirements in Indonesia. This research addresses the case of unilateral termination of employment against Stephane Baudoin by PT Origin Resort Lombok. Utilizing a normative juridical method, the findings indicate Baudoin's entitlement to legal recourse due to fulfilling the criteria of legal standing in labor matters. The appellate decision of the Supreme Court confirms PT Origin Resort Lombok's violation of the Job Creation Law. This study aims to contribute to the literature on the protection of foreign workers, focusing on industrial relations disputes and legal safeguards. Keywords: Foreign Workers, Industrial Relations Disputes, Legal Protection

Abstract

This research highlights the legal complexity related to the division of joint assets in marriage, both in the context of monogamy and polygamy, with a focus on the provisions of Article 35 paragraph 1 of Law No. 1 of 1974 and Article 65 paragraph (1) point (b) of Law No. 16 2019. Through a normative juridical approach and analytical descriptive methods, this research examines how assets obtained during marriage are recognized as joint assets without considering individual contributions, as well as the implications of the division of assets in polygamous marriages where each wife is entitled to a fair share according to Islamic law. Abstract

Every criminal act cannot be separated from a series of causes and effects. Legal events that conflict with statutory regulations always cause harm to other people. Criminal accountability is intended to determine the condition of a perpetrator of a criminal act, whether or not the perpetrator can be punished for the criminal act he committed, in this case namely the crime of embezzlement as regulated in Article 372 of the Criminal Code. The issues raised are  What is the criminal responsibility for the perpetrator of the criminal act of embezzling a rental car belonging to Wulan Rent Car and what criminal sanctions are applied to the perpetrator of the criminal act of embezzling a rental car belonging to Wulan Rent Car. The research method used is qualitative using an empirical juridical approach because it examines actual legal events directly. Criminal responsibility is fundamental for compensating for losses incurred by victims of criminal acts of embezzlement, namely by being accountable before the law by bearing the legal consequences that they must undergo because this is within the authority of law enforcement officials and compensating for losses suffered by victims of criminal acts of embezzlement. victims of criminal acts worth of lost objects. determined. Abstract

To encourage economic development, technological progress, local government, state formation, administrative responsibility, and the safe and effective transportation of people and goods across the country, the federal government must fulfill its commitment to a highly developed transportation infrastructure. The purpose of this is to learn about incidents involving vehicles and seek efforts from law enforcement and the public to reduce the number of traffic accidents. Empirical Juridical Methodology is used in this research process and research specifications use analytical descriptive. The results of the research from the first problem formulation are, as a preventive measure, increasing supervision of road traffic and transportation such as facilities and infrastructure, infrastructure, and vehicle safety on the road and secondly, based on the law, criminal accidents are an incident caused by unintentional, negligent and careless driving by a perpetrator. The author concludes that in efforts to enforce traffic laws, there needs to be awareness and an important role for the government, as well as law enforcers, to participate in encouraging the public to be more aware when driving and pay attention to whether vehicles are suitable for use or not. For perpetrators of traffic accident offenses there are sanctions that apply through Article 310, but in general in traffic accident cases the Restorative Justice method is often used because the incident is an Ordinary Offense. Keywords: Transportation; Traffic; Road Transport; Security.
