Abstract

This study aims to analyze the challenges and potentials in harmonizing Islamic law and human rights to achieve universal justice. The research method used is library research with a descriptive-analytical approach. Literature analysis was conducted to understand Islamic law and human rights concepts and principles, as well as the challenges and opportunities associated with harmonizing the two. The results show that harmonizing Islamic law and human rights can contribute significantly to achieving universal justice. This harmonization requires an awareness of the importance of protecting individual rights and universal justice and recognizing internationally recognized human rights principles. In Indonesia, a country with a majority Muslim population, harmonization between Islamic law and human rights must be done by considering the high religious and cultural diversity. There needs to be contextualization efforts with national legal systems and policies that support protecting individual rights fairly and inclusively. The role of state institutions, such as courts, legislatures, and law enforcement agencies, is also essential in encouraging the implementation of harmonization in line with the principles of universal justice.

Abstract

This study aims to reveal the failure of the state to use its authority to ensure the fulfilment of religious freedom for all its citizens maximally and adequately because, in practice, the state sometimes takes refuge behind the slogan of neutrality when it sees the majority group committing violent practices against minority groups. This study uses a discourse analysis method with a phenomenological approach to understanding the meaning of various events and human interactions. Meanwhile, the data was collected through literature study, media study, and observation using content analysis and discourse analysis methods in processing the data. Then this research results in the finding that opening the state accommodation gap to the demands of the majority religious group will provide space for them to take advantage of the similarities in their religious ideology with state actors and then attempt to dictate state policy. The inability of the state to be neutral in solving the problems of its people, at the same time, has given rise to the impression that a handful of certain social classes have controlled the state. Even this research results also show that tendencies of intolerance and discrimination arise in the community.

Abstract

This study aims to examine the relevance of humanist da'wah in the Islamic context as a solution to strengthen equality and human rights in the religious context. This study uses literature study research methods with an integrative literature analysis approach to obtain a comprehensive understanding. The results of this study stated that humanist da'wah in Islam has significant relevance in strengthening equality and human rights. Humanist da'wah, focusing on human values, justice, and compassion, opens the door to applying the principles of gender equality and human rights in the Islamic context. The role of humanist da'wah in promoting gender equality and human rights is recognized as a driving force for positive social change. However, there are still some challenges, including cultural and social issues that still support gender inequality and human rights violations, as well as technological and environmental challenges. However, there are still many important opportunities to strengthen equality and human rights, such as the role of social media and inclusive education in strengthening equality and promoting human rights awareness. Abstrak Kajian ini bertujuan untuk mengkaji relevansi dakwah humanis dalam konteks Islam sebagai solusi untuk memperkuat kesetaraan dan hak asasi manusia dalam konteks agama tersebut. Kajian ini menggunakan metode penelitian studi pustaka dengan pendekatan analisis literatur secara integratif yang bertujuan untuk mendapatkan pemahaman yang komprehensif. Hasil kajian ini menyatakan bahwa dakwah humanis dalam Islam memiliki relevansi yang signifikan dalam memperkuat kesetaraan dan hak asasi manusia. Dakwah humanis, dengan fokus pada nilai-nilai kemanusiaan, keadilan, dan kasih sayang, membuka pintu bagi penerapan prinsip-prinsip kesetaraan gender dan hak asasi manusia dalam konteks Islam. Peran dakwah humanis dalam mendorong kesetaraan gender dan hak asasi manusia diakui sebagai motor penggerak perubahan sosial positif. Namun, masih terdapat beberapa tantangan, termasuk isu-isu budaya dan sosial yang masih mendukung ketidaksetaraan gender dan pelanggaran hak asasi manusia, serta tantangan teknologi dan lingkungan. Meskipun begitu, masih ada banyak peluang penting dalam upaya memperkuat kesetaraan dan hak asasi manusia, seperti peran media sosial dan pendidikan yang inklusif dalam memperkuat kesetaraan dan mempromosikan kesadaran akan hak asasi manusia.

Abstract

Handling corruption cases is not always consistent in emphasizing the element of intention/intentionally. Theoretically, the concept of deliberation has been put forward by some experts. However, in the realm of implementation the theoretical studies of those experts become contradictory. This is because there is no certainty of indicators of intent. Deliberation in this research is viewed from criminal law and psychology. The method used in this research is Forum Group Discussion (FGD). Then also is performed professional judgment by legal practitioners and academics. The results show that law enforcers have a common perception in viewing the deliberate in cases of corruption. Law enforcers in understanding the Articles use the theory of science and the theory of Possibility in Certainty. It is deliberate behavior when viewed from psychology produces a construct that can be measured using the science theory.

Abstract

This study investigates the significance of feminism in promoting gender reform in the context of progressive Islam, using library research with a holistic literature analysis. Through careful review and comprehensive synthesis of related literature, the study aims to understand the evolution of the concept of feminism in progressive Islam as well as its impact on gender reform efforts. The results confirm that gender equality in progressive Islam can strengthen the feminist movement by providing a solid foundation for inclusive social change. The positive impact of the feminist movement in this context is evident through the changes that have taken place, especially in the empowerment of women and the increase in public awareness of gender issues. However, challenges, including resistance from conservative groups and solid social norms, suggest that gender reform is a long journey that requires sustained commitment and solid cooperation from various parties. In addition, the importance of the role of youth, inclusive education, supportive legal and policy changes, and active community participation are critical factors in achieving greater gender equality in a diverse Muslim community.

Abstract

Child marriage is a controversial issue in many countries, including Indonesia, due to its negative impact on girls. Indonesian law regulates the minimum age for marriage, but there are still gaps in its implementation. This issue also relates to social, economic, and health impacts, such as reproductive health risks and limited access to education. This research aims to review the implementation of child marriage policies, policy orientations, and their impact on the understanding and implementation of maslahah mursalah values. This study uses normative legal research methods to examine the issue of child marriage based on the normative aspects present in applicable legislation. The results of the research indicate that the implementation of child marriage policies based on maslahah mursalah in Indonesia should be holistic, considering social, cultural, religious, and legal aspects. This policy should prioritize the common welfare and protection of children's rights, with an emphasis on education, legal protection, reproductive health, and reducing social stigma. The importance of collaboration between the government, NGOs, religious leaders, and the community in designing and implementing this policy is emphasized. Regular evaluations need to be conducted to ensure the effectiveness of the policy in achieving the goals of child protection and public welfare. Additionally, consideration should be given to the cultural and religious diversity in Indonesia while adhering to international commitments supporting the prohibition of child marriage.

Abstract

This study describes an in-depth analysis of the concept of justice in Islamic law and Western law by relying on literature studies involving comparative and integrative literature analysis. This approach was chosen to obtain comprehensive results in the comparative understanding of the concept of justice in Islamic law and Western law. The study results stated that justice in Islamic law has deep roots in religious teachings and is often closely related to religious values. In contrast, Western law tends to be more secular based on legal principles that arise from historical developments and philosophical thought. In comparison, there are similarities in the humanitarian principles underlying the laws of War, Peace, human rights, and individual protection. However, differences in legal sources, basic principles, and implementation create different frameworks for achieving justice. In an age of increasingly connected globalization, this better understanding of differences and similarities can potentially promote cross-cultural dialogue, international cooperation, and joint efforts in achieving justice and peace worldwide.

Abstract

This article aims to deepen the construction of general election regulations related to representation and identity politics. This research is non-doctrinal with a normative approach, using documentation studies and libraries as data sources. Research findings suggest that the electoral arrangement designs the holding of elections as a tool for preserving national identity and national interests. Although the Electoral Act does not accommodate political representation of a distinctly religious nature, its implementation involves special regulations, such as Special Autonomy for Papua Province, the Government of Aceh, and the Yogyakarta Special Territory Privileges. This regulation gives room for politics of representation based on patriotism, culture, and religion. Furthermore, the Election Act prohibits some campaign actions that could create political nuances of identity. This article is expected to contribute to a further understanding the political dynamics of representation and identity in the context of the Electoral Law in Indonesia.Artikel ini bertujuan untuk mendalami konstruksi pengaturan mengenai pemilihan umum terkait politik representasi dan politik identitas. Penelitian ini bersifat non-doktrinal dengan pendekatan normatif, menggunakan studi dokumentasi dan kepustakaan sebagai sumber data. Temuan penelitian menunjukkan bahwa pengaturan tentang Pemilu merancang penyelenggaraan pemilu sebagai alat untuk menjaga identitas nasional dan kepentingan nasional. Meskipun Undang-Undang Pemilu tidak mengakomodasi politik representasi yang bersifat kedaerahan, kesukuan, dan agama, implementasinya melibatkan regulasi khusus, seperti Otonomi Khusus Bagi Provinsi Papua, Pemerintahan Aceh, dan Keistimewaan Daerah Istimewa Yogyakarta. Regulasi khusus ini memberikan ruang untuk politik representasi berdasarkan kedaerahan, budaya, dan agama. Lebih lanjut, Undang-Undang Pemilu juga melarang sejumlah tindakan kampanye yang berpotensi menciptakan nuansa politik identitas. Artikel ini diharapkan dapat memberikan kontribusi pada pemahaman lebih lanjut tentang dinamika politik representasi dan identitas dalam konteks Undang-Undang Pemilu di Indonesia.

Abstract

This study comprehensively explores using artificial intelligence (AI) to discover Islamic law. This study relies on literature study with literature analysis conducted in an integrative and comprehensive manner. The results of this study indicate that the use of artificial intelligence in the discovery of Islamic law provides deep and efficient analytical capabilities, enabling the identification of Islamic legal trends, agreements, and differences between schools. However, challenges arise regarding transparency, bias, and the role of humans in the decision-making process. To combat this, solid ethical guidelines and strict regulations are needed. Artificial intelligence also influences the development of Islamic law by assisting in adaptation to the modern context, bridging the gap between Islamic law and technology, and facilitating a more inclusive and global understanding of Islamic law. In this context, collaboration between Islamic jurists, computer scientists, and religious communities is critical to harnessing artificial intelligence's full potential in supporting relevant and responsive Islamic law in changing times.

Abstract

This intersectional study investigates the harmonisation of Islamic law and human rights in the context of empowering Muslim women through Islamic economics. This study applies an intersectional approach in carrying out the library research method with literature analysis carried out integratively and comprehensively to explore and review various literature sources relevant to the research topic, including journal articles, books, research reports, policy documents, and other related sources of information. The results show that harmonisation between Islamic law and human rights in empowering Muslim women through Islamic economics significantly impacts achieving gender equality and supporting sustainable development. The complexity of Muslim women's identities influenced by factors such as religion, gender, and social class demands a holistic and integrated policy approach in the economy. While the Islamic economy offers great potential to enhance the role of women as agents of change and key drivers of economic development, the incompatibility between Islamic law and human rights conventions and issues of gender inequality points to the need for more inclusive legal and policy reforms. Identifying and recognising these challenges underscores the importance of adopting a comprehensive and coordinated approach. Specific measures that need to be strengthened include inter-agency cooperation, legal and policy reforms to support better gender equality, capacity building of women in the Islamic economic sector, and raising public awareness on the importance of women's empowerment. As such, this study enriches the academic literature and offers practical guidance for policymakers, stakeholders in the Islamic economy, and the general public in advocating and implementing effective and sustainable women's empowerment.
