Abstract

The application of the death penalty is a subject that triggers complex ethical and moral debates, demanding deep and critical thinking regarding the fairness, effectiveness, and humanity of the legal system in place. This study aims to provide an in-depth understanding of the interpretation and application of the death penalty in the context of Islamic law and consider its compatibility with contemporary ethical norms and human rights principles. Through the library research method, this study integrates and comprehensively analyzes relevant literature to explore various perspectives and sources that have been carefully examined. The findings of this study indicate that the death penalty in the context of Islamic law is not just a simple juridical issue but also requires deep and layered ethical considerations. These considerations must include a thorough understanding of the social and cultural context and readiness to respond to the inevitable dynamics of changing times. It is also important to always respect and uphold the fundamental values of Islam, which include respect for life, fair justice, and broad generosity in maintaining order and security.

Abstract

This study examines the concept of maqasid al-shariah in the context of Islamic economic policy development, emphasizing its understanding, implementation in policy, and evaluation of its impact on society and welfare. The research employs a literature review method, conducting a comprehensive analysis of relevant sources across various disciplines. The findings indicate that maqasid al-shariah serves as a moral compass within Islamic economics, providing a foundation for a just, sustainable, and ethical economy. Its implementation requires the establishment of robust Islamic financial institutions, the regulation of economic activities in accordance with Islamic law, and the preservation of moral values in business practices. The evaluation of its impact underscores the significant role of Islamic economics in safeguarding the core objectives of protecting religion, property, life, intellect, and lineage. This study highlights the ongoing relevance of maqasid al-shariah as a guiding framework for Islamic economic policies, offering a bridge between theoretical principles and practical applications to foster a more just and ethical society.

Abstract

This study provides a richer and more holistic view of how Islamic law and local cultural values can be integrated effectively and harmoniously in regulating the lives of heterogeneous Muslim communities. The research method adopted in this study is library research with an integrative and comprehensive literature analysis approach to identify concepts, theories, techniques, and findings that have been put forward by previous researchers regarding the relationship between Islamic law and local wisdom by looking for patterns, similarities, differences, and trends that emerge from the analyzed literature. The results show that Islamic law, through its flexible conceptual framework, facilitates the integration of local cultural values into legal practice, maintaining its relevance in diverse social and cultural contexts. This integration process not only strengthens local cultural identity in the face of globalization but also supports social harmony by defusing cultural conflicts and strengthening community coherence. Furthermore, it creates an inclusive and fair legal system, recognizing and respecting individual diversity. This integration contributes to knowledge development by demonstrating how laws adaptive to cultural contexts can support sustainability and social justice in heterogeneous societies.

Abstract

This study aims to reveal how the policy-making process carried out by SMPS-IT and SMAS-IT Muslimah Sejati Bekasi, starting from the formulation, and implementation, to policy evaluation, which will end in the value of effectiveness and efficiency as a form of institution existence. This study uses qualitative research through descriptive analysis methods with data collection models using interviews, documentation, observations, and triangulation of sources, techniques, and theories. Through this method, researchers get a finding containing policy cases from two institutions related to the similarities and differences between the formulation process and effectiveness and efficiency. In the formulation process, both have different policies between online and offline, but in the formulation, each has weaknesses consisting of flaws in analysis and alternatives. Meanwhile, in terms of implementation, there are obstacles, individually and institutionally, composed of weak motivation and the disintegration of some teachers and staff. The evaluation has similarities in the implementation system, namely, using a formative, summative model. In terms of effectiveness and efficiency, both achieved the same value. Namely, they were both able to graduate students of 30 Juz Qur'an, while inefficiency there were shortcomings in financing and dependence on electricity in the teaching and learning process.

Abstract

This study reveals the journey of Islamic Law from doctrine to social action that brings change. Using a library research method through a comprehensive literature analysis, this study presents the complex challenges of translating Islamic law principles into concrete actions that expand social justice. The findings of this study identify that the gap between idealism and practice is often a major hurdle in implementing Islamic law. Islamic legal theory offers profound guidance on justice, ethics, and morality, emphasizing values such as social justice, general welfare, and protection of individual rights. However, its implementation often faces obstacles that obscure these noble goals. To achieve true social justice, implementing Islamic law must reflect these core values and not just be empty symbolism. It must be applied, embodying justice, benevolence, and the protection of human rights in everyday life.

Abstract

This paper discusses the implementation of Islamic family law in Indonesia's marriage law regarding the right to choose a partner for women with the main problem explaining how the interrelationships of the values ​​of Islamic family law are absorbed in Indonesian laws. Utilizing a literature study whose primary data sources come from books, journals and statutes, this research finds that Indonesia, as a country known for its Muslim majority and having many ethnicities and cultures, also adopts the principles of equality in Islam implemented in Marriage Law No. 1 of 1974 is included in the realm of choosing a mate for women. As stipulated in UUP No. 1 of 1974 concerning the conditions for marriage regulated in Article 6 Paragraph 1, namely that there must be the consent of the bride, meaning that the woman is willing to be married by a man who wants to marry her without any coercion. What is contained in Article 6 Paragraph 1 UUP No. 1 of 1974 is in line with the mission of Islam, namely the principle of equality for women. This aims to build a happy and eternal household and of course in line with human rights.

Abstract

This study aims to understand the role of Islamic law in empowering youth and its impact on protecting children's rights in a social context by analyzing the challenges and opportunities that exist in defending children's rights within the framework of Islamic law. The literature study method is used by collecting information from relevant sources such as books, journals, and related documents. The results show that Islamic law provides a robust framework for each child to contribute to society through values such as Justice, balance, and social responsibility. Implementing children's rights in Islamic law creates holistic growth and positive social change. Educational institutions, families, communities, and the state are essential in upholding the child's rights. Despite challenges such as diverse interpretations, gender imbalances, and social problems, opportunities lie in the flexibility of Islamic law and the involvement of activists and civic organizations. By optimally utilizing the role of Islamic law, involving all parties, and overcoming existing challenges, there can be sustainable social transformation and fulfillment of children's rights within the framework of Islamic law.

Abstract

The main objective of this study is to deepen the understanding of how Islamic values can be integrated into the modern economic system, thereby creating a more inclusive, just, and welfare-oriented economic model. This study uses library research to access and analyze various sources of information relevant to an integrative literature analysis. The results of the study confirm that economic secularization. However, it has dominated the global system with a paradigm of materialism and individualism, simultaneously opening opportunities for Islamic economics to offer transformational solutions that are more ethical, inclusive, and sustainable. By reconstructing the Sharia-based paradigm, integrating the values of justice and solidarity into modern economic practices, and strengthening Islamic economic institutions through innovation and professionalism, this system can go beyond simply being an alternative to capitalism and socialism. Islamic economics has excellent potential to create a global economic order oriented towards human welfare and make it relevant in the modern era and as a universal solution that addresses the world's pressing needs.

Abstract

This study reveals how Islamic law and human rights can be a voice of justice in challenging situations, offering exciting and relevant answers for a harmonious future of peace. The research method applied in this study is designed in an integrative and comprehensive manner to explore the relationship between the two in the context of conflict separatism. The study results show that Islamic law and human rights have similar perspectives in respecting religious plurality, avoiding discrimination, and prioritizing peace in dealing with conflict separatism. Both emphasize the importance of understanding the root causes of conflict and seeking comprehensive and sustainable solutions to achieve reconciliation and just peace. In separatism conflicts, Islamic law and human rights also emphasize the importance of social justice, solidarity, education, and accountability as integral parts of conflict management. Both perspectives view that efforts to achieve peace and reconciliation must involve all elements of society, including religious leaders, community leaders, and community organizations, in mediating and promoting peace values.  In addition, the harmony between Islamic law and human rights emphasizes the importance of understanding human rights as a universal value that must be upheld by all people, not only in the context of separatism conflicts but also in broader social and political life.

Abstract

Para ulama klasik dalam memberikan penafsiran terhadap teks nash dengan sangat tendesius dan berorienstasi patriarkhis (patriarchalism theological oriented). Hasil dari penafsiran tersebut, terkadang ditafsirkan yang disesuaikan dengan selera orang yang menafsirkannya dan juga tidak lepas dari kepentingan. Pada artikel ini bertujuan untuk mengungkap secara metodologis atas reinterpretasi terhadap teks nash tentang kedudukan perempuan yang dilakukan oleh KH. Husein Muhammad. Jadi fokus kajian pada artikel ini terdapat pada bagaimana cara penafsiran KH. Husein Muhammad terhadap teks nash yang berhubungan dengan perempuan sebab KH. Husein Muhammad mencoba melakukan reinterpretasi terhadap teks nash tersebut dengan pandangan yang baru melalui pemikiran yang lebih progresif dan peka terhadap berbagai persoalan perempuan dalam kesetaraan gender. Jenis penelitian kepustakaan (library research) dalam pengumpulan data adalah jenis penelitian pada artikel ini melalui pendekatan kualitatif dengan metode deskripptif-analitis dan content analysis yang didukung melalui interaksi antara konsep dan penafsiran dengan analisis data model Milles dan Huberma. Maka dari itu, artikel ini menghasilkan kesimpulan bahwa analisis yang dilakukan oleh KH. Husein Muhammad merupakan sebuah hasil prestasi intelektual yang cerdas dan sebagai bentuk pengamalan terhadap nilai-nilai dalam ajaran Islam sebagai agama yang ramah terhadap perempuan.
