Abstract

When talking about polygamy, it is often seen from the existence and perspective of meeting the biological needs of men. Polygamy is seen as a form of unequal relationship in marriage, so the losers are women. Polygamy always creates a negative perception even though many polygamists are still carried out illegally. Regarding the problem of polygamy, it is necessary to conduct a review that looks at the benefits to produce a comprehensive study. So, in this case, the issue of polygamy is studied through an examination of hifdz al-nasl, which is one of the concepts of maqashid al-shari'ah. At the same time, library research is this type of research with the nature of a descriptive-analytical study that systematically describes the facts found accurately and carefully through a review of hifdz al-nasl. This research concludes that polygamy is a wisdom given by Allah to humans and does not violate the purpose of maqashid al-shari'ah to continue protecting offspring (hifdz al-nasl) while still producing because a man will still be able to produce even though they are old. Meanwhile, women are limited by menopause so that when that period has arrived, the female reproductive organs can no longer function generally for fertilization.

Abstract

This study examines the concept of children's rights in Islam, focusing on two key dimensions, namely gender equality and youth justice. This study uses library research methods by conducting a comprehensive literature analysis to compile and analyze written sources related to children's rights in Islam, gender equality, and justice of the younger generation. Through this approach, the study aims to gain a deeper understanding of the issues. The study results show that Islam has great potential in shaping a more just, inclusive, and sustainable society by applying the principles of children's rights, gender equality, and youth justice. It offers an optimistic view that religious values can be a significant cornerstone in building a better society. Islamic teachings emphasize the importance of providing quality education, protection from exploitation, and meeting children's basic needs as an integral part of the principles of justice in this religion. This includes the economic, social, and moral rights that must be fulfilled to build a brighter future for future generations.

Abstract

This study aims to understand the role of Islamic law in empowering youth and its impact on protecting children's rights in a social context by analyzing the challenges and opportunities that exist in defending children's rights within the framework of Islamic law. The literature study method is used by collecting information from relevant sources such as books, journals, and related documents. The results show that Islamic law provides a robust framework for each child to contribute to society through values such as Justice, balance, and social responsibility. Implementing children's rights in Islamic law creates holistic growth and positive social change. Educational institutions, families, communities, and the state are essential in upholding the child's rights. Despite challenges such as diverse interpretations, gender imbalances, and social problems, opportunities lie in the flexibility of Islamic law and the involvement of activists and civic organizations. By optimally utilizing the role of Islamic law, involving all parties, and overcoming existing challenges, there can be sustainable social transformation and fulfillment of children's rights within the framework of Islamic law.

Abstract

This study devels into the transformational efforts of Agus Moh Najib, a prolific Muslim intellectual and professor of ushul fiqh at UIN Sunan Kalijaga Yogyakarta, in revitalizing and reforming the conceptual framework of ushul fiqh, which is the cornerstone of Islamic law in response to the complex challenges of modernity. The research conducted is a type of qualitative research with a descriptive-analytical review of various sources of literature that is equipped with a philosophical study through the data analysis method used is content analysis. The findings of this study highlight the ongoing process of redesigning ushul fiqh initiated by Agus Moh Najib is directed to bring closer and interconnect between Islamic law and legal science in general. He also sits the position of Islamic law in proportion between the sacred dimension and the profane dimension. Redesign of ushul fiqh as the foundation for jurisprudence and Islamic law is an urgent step to be done because the changing conditions and situations, time and place as a result of these factors, have invited a variety of serious problems related to jurisprudence and Islamic law. In contrast, the method of ijtihad developed by reformers of legal thinkers in answering various issues of modern times has not been satisfactory.[Penelitian ini mengupas upaya transformasional Agus Moh Najib, seorang intelektual muslim yang produktif dan guru besar ushul fiqh di UIN Sunan Kalijaga Yogyakarta, dalam merevitalisasi dan mereformasi kerangka konseptual ushul fiqh, yang merupakan landasan hukum dalam Islam guna menjawab berbagai tantangan modernitas yang begitu kompleks. Penelitian yang dilakukan adalah jenis penelitian kualitatif dengan tinjauan deskriptif analitik terhadap berbagai sumber pustaka yang dilengkapi dengan kajian filosofis melalui metode analisis data yang digunakan adalah content analysis. Temuan penelitian ini menyoroti proses konsep redesain ushul fiqh yang digagas oleh Agus Moh Najib diarahkan untuk mendekatkan dan menginterkoneksikan antara hukum Islam dan keilmuan hukum pada umumnya. Dia juga mendudukkan posisi hukum Islam secara proporsional antara dimensi sakral dan dimensi profan. Redesain ushul fiqh sebagai fondasi bagi fiqh dan hukum Islam merupakan langkah yang urgen untuk dilakukan sebab terjadinya perubahan kondisi dan situasi, waktu dan tempat sebagai akibat dari faktor-faktor tersebut, telah mengundang berbagai masalah serius berkaitan dengan fiqh dan hukum Islam. Sedangkan metode ijtihad yang dikembangkan para pembaharu pemikir hukum dalam menjawab berbagai problematika zaman modern saat ini belum juga memuaskan.]

Abstract

One type of gender-based violence is sexual violence. Instances of sexual violence manifest in diverse spheres of existence, encompassing both private and communal spheres. The perpetrators escaped pun- ishment. However, the victims were not provided with adequate assistance. This study seeks to offer a comprehensive analysis of the implementation of restorative justice, specifically focusing on its positive impact on the physical and psychological rehabilitation of victims of sexual violence. This study employs normative legal research methodology, focusing on statutory regulations and utilizing a conceptual approach. Various sources such as statutory regulations, journals, books, reports, and similar references are consulted. This study finds that achieving justice for survivors of sexual abuse is contingent upon the involvement of knowledgeable and trained individuals who possess expertise in the power dynamics and control mechanisms inherent in sexual violence, as well as a profound comprehension of the effects of trauma. In addition to that, the following factors must take precedence when implementing restora- tive justice for victims of sexual violence: Ensuring the protection of the victim, preventing the offender from manipulating the process, ensuring the victim is not under any pressure, avoiding conflicts of loy- alties, providing services that benefit the public, and maintaining a balance of power. [Kasus kekerasan seksual sudah menjadi salah satu bentuk kekerasan berbasis gender yang sangat sering menimpa kaum perempuan. Kasus kekerasan seksual terjadi di berbagai lini kehidupan, baik ranah domestik maupun ranah publik. Acapkali pelaku yang seharusnya dijerat hukum dan korban yang harusnya mendapat pelayanan tidak terlaksana dengan baik. Penelitian ini bertujuan untuk memberikan gambaran penerapan restorative justice yang pro terhadap pemulihan fisik dan psikol- ogis korban penyintas kekerasan seksual. Penelitian ini menyimpulkan bahwa keadilan terhadap korban penyintas kekerasan seksual dapat diterapkan jika berbagai pihak yang menangani adalah tenaga ahli yang telah ditraining terkait dinamika kekuasaan dan mekanisme kontrol yang terlibat dalam kekerasan seksual, serta pemahaman mendalam tentang dampak trauma. Selain itu, aspek- aspek berikut harus menjadi prioritas ketika menerapkan keadilan restoratif bagi korban kekerasan seksual: Menjamin keselamatan korban, menjamin pelaku tidak memanipulasi proses, korban tidak dalam tekanan, tidak adanya konflik kesetiaan, ketersediaan pelayanan terhadap kepentingan publik, dan keseimbangan kekuasaan.]

Abstract

The convergence of customary norms with Islamic legal norms gives rise to a new legal entity, including philosophical meanings. However, it is often seen as problematic and potentially conflicting with Islamic legal principles. This article seeks to explore the symbolic meanings and reasons for the persistence of the kebon odeq in the marriage customs of the Sasak community in Pengadang Village, Central Lombok. Utilizing an anthropological approach with symbolic anthropology theory popularized by Victor Turner and conducting in-depth interviews with five key informants, this article reveals that within the kebon odeq, the Sasak community in Pengadang assigns significant symbolic meanings to various elements. The components of kebon odeq enhance a sense of unity and cultural values as a form of respect for ancestral customs. Symbolically, it emphasizes the correlation of its symbolic meaning with cultural values, marriage, and social aspects of society. In Islamic law, this tradition holds symbolic meanings related to the values of Islamic marriage, especially commitment and maintaining sustainability. The intersection of philosophical meanings between custom and Islamic law is a significant motivation for the extent to which kebon odeq is preserved and developed by the Sasak Muslim community.

Abstract

This study analyzes Masnun Tahir’s thoughts on Nationalist fiqh as a solution to the challenges of pluralism, intolerance, and radicalism in Indonesia. Masnun Tahir proposes a paradigm of Nationalist fiqh that integrates Islamic values with the multicultural context of Indonesian nationhood. The study employs Jurgen Habermas’s Critical Hermeneutics theory as an analytical framework to explore the transformative dimensions of this thought, encompassing interfaith dialogue, education, and the strategic role of religious scholars (ulama) in fostering social harmony. Using a library research methodology and textual analysis, this research examines Masnun Tahir’s works and the relevance of his ideas in the social context. The findings indicate that Masnun Tahir’s Nationalist fiqh offers a comprehensive approach that balances Islamic teachings with national values, positioning pluralism as a strength to enhance unity. This paradigm encourages the application of contextual Islamic law that respects local values and aligns with societal needs. Interfaith dialogue emerges as a central pillar of this paradigm, functioning as a tool to strengthen social integration and minimize conflicts arising from differences in belief. Education based on Nationalist fiqh is also identified as a key element in shaping a tolerant and patriotic generation. The analysis reveals that the paradigm of Nationalist fiqh is not merely normative but also transformative, providing practical solutions to the challenges of intolerance and radicalism. However, its implementation faces obstacles, including social resistance and the need for cross-sectoral support. With inclusive and sustainable strategies, Nationalist fiqh holds significant potential as an instrument for inclusive social transformation in Indonesia. This study contributes to the enrichment of theoretical discourse and offers a new perspective on bridging religion and nationhood in the Indonesian context.

Abstract

This study aims to develop strategies for family economic empowerment in Gangga II Village by integrating the perspective of Maqashid Shariah to enhance material, spiritual, and social well-being. Gangga II Village possesses significant economic potential in the fisheries and agribusiness sectors but faces considerable challenges, including limited infrastructure, low access to skills education, and dependency on the fisheries sector. Using a qualitative approach, this study analyzes local economic potential and empowerment strategies based on skills training, financial literacy, and strengthening community collaboration through women’s groups (PKK) and village-owned enterprises (BumDes). In the framework of Maqashid Shariah, economic empowerment not only aims for material well-being but also seeks to balance worldly and spiritual aspects and reinforce social solidarity within families and communities. These findings are expected to contribute to the development of empowerment concepts grounded in Islamic values and enrich international literature on the application of Maqashid Shariah in village community economic empowerment. This research offers a more holistic empowerment concept to sustainably improve village community economies, particularly in Gangga II Village.

Abstract

This study aims to identify the factors that influence the successful adoption of green economy technology, analyze its impact on business sustainability, and examine the role of family values in supporting this transformation. The library research method is used in this study, as it allows for an in-depth exploration of various existing theories, concepts, and empirical findings, to build a strong argumentative basis and produce a comprehensive synthesis of different perspectives. The results confirm that the green economy is a strategic imperative that requires family businesses to transform the traditional paradigm towards progressive long-term sustainability. The next generation, with their global vision and innovation courage, are the key actors in introducing green technologies, creating eco-friendly products, and integrating sustainability values into the core of family businesses. While there is often tension with the older, more conservative generation, cross-generational collaboration offers opportunities to create synergies between legacy stability and future innovation. If managed appropriately, family businesses will not only survive the dynamics of the modern economy but also lead the transformation towards a green economy that is equitable, inclusive, and has a positive impact on the environment and global society

Abstract

The background of this study is rooted in the significance of human rights as a universal principle, which often faces challenges when applied within the context of Islamic law. The main issue is the incompatibility between some practices of Islamic law and the principles of human rights, which raises the question of how these two legal systems can interact without compromising their fundamental values. This study aims to explore the relationship between Islamic law and human rights, understand the challenges arising from differences in interpretation and implementation, and offer solutions to bridge these differences. This study uses a qualitative method combining text analysis, literature, and secondary data better to understand the concept of human rights in Islam and identify areas of potential conflict. The results show that the relationship between Islamic law and human rights is complex, where potential conflicts and convergence efforts coexist. Despite potential conflicts, the values of justice, equality, and human dignity in Islam align with Human Rights principles. However, differences in interpretation and implementation of the law can be a significant source of tension. This study highlights the importance of an approach rooted in cross-cultural and religious dialogue, as well as respect for diversity, to achieve a more harmonious convergence between Islamic law and universal human rights.
