Abstract

This study aims to analyze the process of examining the content of pornography on 2 streamer hosts of the Dream Live application based on Law No. 14 of 2008 concerning Pornography. The research method used is a qualitative approach with a case study of 2 streamer hosts. Data were collected through interviews, observation, and document study. The results show that the examination of pornography content on the Dream Live application is carried out by internal parties using filter technology and a moderation team. However, there are shortcomings in the examination process, such as the lack of thorough examination and inadequate sanctions against streamer hosts who violate the rules. In addition, active government intervention is still needed to oversee and tighten supervision of streaming applications. Therefore, it is recommended to improve the effectiveness of examining pornography content by strengthening the surveillance system, improving the quality of filters and moderation teams, and enforcing strict sanctions against streamer hosts who violate the rules. Abstract

Saat mengambil keputusan, hakim kerap berpijak pada konsep Nebis In Idem dikarenakan kasus asas ini menjadi penentu suatu kasus dapat diadili kembali atau tidak. Gugatan timbal balik antara Ms Glow dan Ps Glow menjadi salah satu kasus yang berkaitan dengan asas ini karena diduga mengajukan kasus yang sama. Metodologi penelitian hukum normatif menjadi metode pada penelitian ini, dengan tujuan untuk menemukan dan mengembangkan argumentasi hukum melalui analisis materi pelajaran dan pemeriksaan prinsip-prinsip yang berlaku maupun asas hukum. Hasil penelitian ini adalah kasus sengketa merk dagang antara MS Glow dan PS glow tidak termasuk dalam kategori nebis in idem dikarenakan pada saat gugatan diajukan oleh tergugat kepada PN Niaga Surabaya, PN Niaga Medan masih memeriksa perkara dan belum mengeluarkan putusan. Berdasarkan penjabaran di atas peneliti berpendapat bahwa praktik peradilan pada kasus ini sama dengan UU dan peraturan lokal, dan federal, termasuk Pasal 1917 Kitab UU Hukum Perdata. Hakim sudah membuktikan dalam memeriksa perkara dan mengatur jalannya peradilan, Hakim tidak sewenang-wenang dengan aturan yang ada.

Abstract

Now, the world is undergoing a transformation known as the industrial revolution and resulting in a creative economy, which affects technological progress based on the principle of human creativity. In this case, intellectual property rights have an important role to provide protection to their citizens for the results they obtain and avoid intellectual property rights infringement. However, in practice, several problems arise with legal policies on intellectual property rights in the Indonesian state. In Indonesia, the protection of intellectual property rights can realize a sense of security, legal certainty and psychological effects, increasing the creator's spirit to continue to innovate.

Abstract

Similarity in bottle designs between various companies is one of the new issues that has emerged as the eco-bottle sector in Indonesia has grown. Inadequate legal protection has been provided to the owners of the eco-botol industrial design, which ought to be fiercely safeguarded, and there are no legislation that specifically address design imitation and false representation. This essay employs a comparative approach; specifically, the author contrasts Indonesia's industrial design rights laws with those in the United States, which have proven effective in protecting industrial design rights holders. Because of the importance of this comparison, industrial design rights holders should consider it before Indonesia's industrial design rights laws are finalized.

Abstract

Diversi ialah sebuah sistem penanganan di luar proses sistem peradilan secara formal karena adanya kasus pidana dengan pelaku anak yang berada di bawah umur. Penyelesaian melalui diversi diperuntukkan bagi anak berkonflik dengan hukum. Metode penelitian penulisan jurnal ini menggunakan teoritis normatif. Oleh sebab itu menurut Pasal 108 Undang-Undang Republik Indonesia Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak, sistem diversi digunakan untuk alasan menjauhkan serta memisahkan pelaku anak dibawah umur dari penyelesaian melalui sistem peradilan formal agar tidak terjadi diskriminasi kepada pelaku anak pelanggar hukum. Melalui upaya pencegahan berupa diversi tidak memberikan efek jera sehingga pelaku kejahatan di bawah umur menganggap remeh adanya upaya diversi tersebut. Upaya agar korban anak terlindungi dari anak yang melakukan perbuatan melawan hukum atau pelaku adalah secara maksimal tidak memberikan diversi kepada anak yang kembali melakukan kejahatannya setelah adanya putusan hakim.

Abstract

This article's objective is to review and discuss the legal guidelines of Indonesia's Master Plan for Industrial Development for the Use of Potential Forestry Industry Resources. The normative methods of legal research that were used to write this article. Forests are important natural resources that provide many ecological, economic and social benefits. Paper is just one of many products and services for which the forestry industry provides raw materials, wood, furniture and building materials. The industry is subject to various laws and regulations governing the management, harvesting and utilization of forest resources. This paper provides an overview of industrial law in the forestry industry, covering key laws and regulations, their impact on the industry, and the legal framework. Industry forest law refers to the legal framework governing the management and utilization of forests for industrial purposes. It includes regulations on logging, reforestation, forest conservation, and the protection of indigenous communities. The aim is to balance the economic benefits of industrial forestry with the need to ensure sustainable forest management and protect the environment.

Abstract

The focus of this research is the factors that might be considered by judges when granting criminal sanction relief to a Justice Collaborator. Second, how does the application of Justice Collaborator affect criminal cases in Indonesia and what are the impacts. In this study, the approach method used is normative juridical research method. The results of the study show that there are several regulations in Indonesia that regulate Justice Collaborators in the criminal justice system, but they have not been regulated in detail in the Criminal Procedure Code. Justice Collaborators have an important existence and urgency in the criminal justice system, especially in the stages of investigation, examination, prosecution and execution of decisions.

Abstract

Abstrak Pancasila sebagai dasar negara Indonesia memiliki peran yang krusial dalam mewujudkan keadilan sosial, terutama di tengah perkembangan era digital yang pesat. Dalam konteks ini, sila kelima Pancasila, "Keadilan Sosial bagi Seluruh Rakyat Indonesia," menjadi landasan untuk memastikan bahwa setiap individu memiliki akses yang adil terhadap sumber daya dan peluang dalam masyarakat digital. Artikel ini membahas bagaimana nilai-nilai Pancasila dapat diterapkan untuk mengatasi tantangan kesenjangan digital, mempromosikan partisipasi ekonomi yang inklusif, serta menjaga etika dan moralitas dalam interaksi sosial di dunia maya. Dengan memanfaatkan teknologi secara bijaksana dan adil, serta mengedepankan prinsipprinsip kemanusiaan dan keadilan sosial, Indonesia dapat menghadapi tantangan global sambil tetap mempertahankan jati diri sebagai bangsa yang berlandaskan pada nilai-nilai luhur Pancasila. Abstract

The election of the President and Vice President serves as a fundamental pillar of democracy and a crucial moment in the democratic process in Indonesia. However, in recent decades, the hegemony of oligarchs has posed a significant threat to the fairness and integrity of the electoral system. Oligarchs, wielding substantial power and influence, frequently manipulate the electoral process for personal and group interests, often resorting to criminal activities such as bribery, political intimidation, and the misuse of state resources. These actions undermine the legitimacy of elections and erode public trust in the democratic process. This research seeks to analyze the methods employed by oligarchs in the presidential election as criminal acts that damage the integrity of the electoral process in Indonesia. Using a normative legal approach, this research examines various written sources, including books, journals, and empirical data from past elections. The findings reveal a consistent pattern of legal violations by oligarchs that significantly compromise the electoral process. Based on these findings, the research recommends reforms aimed at strengthening the enforcement of criminal laws related to elections and enhancing the capacity of electoral oversight institutions to prevent oligarchic interference. These reforms are crucial for preserving an inclusive and fair democracy in Indonesia.

Abstract

The values contained in Pancasila have always been fixed, which has shifted only to individuals who practice the principles of Pancasila has begun to fade due to the evolution of the times. Generation Z witnessed the loss of Pancasila values, nationalism and patriotism in them because they were too affected by the advancement of science and technology, the wave of globalization, and unlimited interaction. For this reason, it is necessary to apply Pancasila to change this behavior. In this study, qualitative analysis or approach is applied, namely research methods whose theories or discussions are obtained from various sources such as books, journals, articles, and others. emphasizing the observation of phenomena and deepening the substance of the meaning of the phenomenon. This study was carried out to increase the spirit of nationalism so that this generation does not care about the values contained in Pancasila. Therefore, the values contained in Pancasila must always be applied in daily activities.
