Abstract

Saat ini kegiatan ekonomi syariah berkembang pesat di Indonesia. Perkembangan itu diikuti juga dengan Kemajuan pesat teknologi digital di seluruh dunia membawa banyak negara, termasuk Indonesia, ke era teknologi terbarukan atau dikenal sebagai era revolusi industri 4.0. Revolusi Industri (Revin) 4.0 berbasis cyber physical system dengan ciri digitalisasi di segala aspek kehidupan manusia, termasuk pada sektor ekonomi. Perkembangan tersebut diikuti juga dengan sengketa ekonomi syariah, perkembangan sengketa ini menjadi kewenangan pengadilan agama, sehingga fungsi pengadilan agama diperkuat. Penelitian ini merupakan penelitian hukum normatif yang bersifat deskriptif dengan menggunakan pendekatan perundang-undangan dan pendekatan analits. Hasil dari penelitian ini dapat disimpulkan bahwa proses penyelesaian sengketa ekonomi syariah juga didukung dengan regulasi yang mengarah pada proses peradilan yang sederhana, cepat dan biaya ringan, namun selain didukung dengan regulasi juga diperlukan startegi juga untuk meningkatkan kualitas kelembagaan pengadilan agamad dan perlu dilakukan sosialisasi fungsi serta mengubah stigma tentang pengadilan agama.

Abstract

The renewal of marriage legal norms regarding the minimum age limit for marriage with the criteria of "very urgent" has given rise to disparities in the judges' consideration when applying decisions on marriage dispensation cases,  at the same time increasing the number of child marriages in the religious courts. This research discusses two main patterns, i.e.: the application of the "very urgent" criteria in marriage dispensation cases in the Religious Courts and; the relevance of " very urgent"  criteria toward protecting women and children. The theory of the maqāṣid syarī'ah system by Jasser Auda was used as an analytical tool from a contemporary jurisprudential perspective. This research uses a normative juridical approach with data collection techniques using library research. The results of the study show that the form of application of Jasser Auda's maqāṣid syarī'ah system theory in understanding the "very urgent" criteria can at least be analyzed from 4 (four) four conditions that may occur in children whom marriage dispensation is requested,i.e: pregnancy in the child, the potential for free sex, the potential for unregistered marriages, as well as the potential for continuity of education for children who apply for marriage dispensation. These conditions are linear with the six features of Jasser Auda's maqāṣid syarī'ah system,i.e.:   the cognitive nature of the system, wholeness, openness, interrelated hierarchy, multi-dimensionality, and focus on goals.  In addition, the "very urgent" criteria norm is linear with the objectives of regulations regarding child protection and the elimination of domestic violence.

Abstract

Objective –This study aims to determine the appropriate accountability conditions and strategies for increasing the accountability of Muslim religious endowment (waqf) institutions managed by religious organizations in North Sumatra, Indonesia.Design/Methodology –A qualitative descriptive research method is employed to identify strategies for improving the accountability of waqf management based on the results of in-depth interviews with source persons regarding the issue in North Sumatra.Results –Strategies are formulated to increase the accountability of waqf management. These consist of three approaches: synergy between regulators, the Indonesian Waqf Board, and waqf officers (nazirs); the implementation of waqf governance training for nazirs; and the establishment of an Indonesian waqf development master plan.Research limitations/implications – The scope of the research sample is confined to waqf management undertaken by religious organizations in North Sumatra, Indonesia. Further study needs to be conducted which considers other waqf organizations such as mosques, as well as the addition of research samples from other regions for comparison. The implication of this research is the need for additional resources that would be useful for the waqf development strategy in order to improve its accountability.Novelty/Originality – The novelty of this research is the comparison between waqf accountability and the management strategies of Nahdlatul Ulama (NU) and Muhammadiyah in North Sumatra. Previous research only considered accountability from the perspective of nazirs, whereas this study focuses on strategies to increase the accountability of waqf management of the Nahdlatul Ulama and Muhammadiyah Waqf Institutions in North Sumatra from the perspective of nazirs, students and regulators.

Abstract

There are still cases of hospital accreditation manipulation, highlighting the importance of the existence of independent institutions as assessors of government hospital accreditation. Therefore, two research questions arise: the regulation of independent institutions as assessors of government hospital accreditation and the administrative legal accountability of independent institutions as assessors of government hospital accreditation. This study is a normative legal research employing several approaches, including legislative approach, conceptual approach, and comparative approach. The results show that the authorization given to independent institutions in accrediting hospitals is regulated by Law Number 17 of 2023 concerning Health, aiming to create consistency, harmony, systematicity, and synchronicity in efforts to improve the quality of health services. These provisions are reinforced by regulations such as the Hospital Law, Minister of Health Regulation Number 12 of 2020, and Minister of Health Decree Number HK.01.07/MENKES/406/2020 jo. Minister of Health Decree Number HK.01.07/MENKES/6604/2021, and Minister of Health Decree Number HK.01.07/MENKES/1128/2022, demonstrating the accountability, consistency, and systematic nature of the legal basis needed. The administrative legal accountability of independent institutions as assessors of government hospital accreditation has administrative legal consequences, namely the revocation of the Minister of Health's decree that approves their status as hospital accreditation providers.

Abstract

This paper aims to strengthen the opinion or concept of the validity of a law relating to triple talaq out of court with the perspective of Islamic law and positive law. This paper is the result of qualitative research on a number of data sources (works); books and articles discussing and/or research results regarding the legal validity of triple talaq outside the religious courts. To see the role and/or function of writing, Teubner's theory of legal certainty is used, the law that can satisfy all parties is responsive law and responsive law is only born if there is democratization of legislation. Without democracy (community participation) in the legislative process the result will never give birth to an independent law. The interests of the community are neglected because the law is independent because its meanings refer to itself (justice, certainty, benefit). Law Number 1 of 1974, the pronouncement of divorce must be done in front of the court, otherwise the divorce is not recognized by state law. And the husband and wife are still bound by state law even though according to Islamic law they are no longer husband and wife.

Abstract

Tujuan dari penelitian ini adalah untuk menjelaskan kebijakan pembangunan infrastruktur jalan di Desa Kemiri Kecamatan Panti. Lokasi dalam penelitian ini adalah Desa Kemiri, Kecamatan Panti, Kabupaten Jember. Penelitian ini menggunakan pendekatan deskriptif kualitatif. Jenis dan sumber data dalam penelitian ini ada dua, yaitu data primer dan data sekunder. Pengumpulan data dilakukan melalui observasi, wawancara dan dokumentasi. Analisis data meliputi pengumpulan data, kondensasi data, penyajian data dan penarikan kesimpulan. Temuan penting dalam penelitian ini adalah adanya ketimpangan pembangunan infrastruktur jalan antar dusun di Desa Kemiri, terdapat dua dusun di Desa Kemiri yang belum memiliki infrastruktur jalan yang memadai seperti jalan aspal yang rusak, pembangunan jalan paving yang belum merata, dan jalan tanah yang becek ketika hujan. Hasil penelitian ini menunjukkan bahwa keberhasilan implementasi kebijakan pembangunan infrastruktur jalan di Desa Kemiri dipengaruhi oleh empat faktor, yaitu penyampaian komunikasi, kejelasan dan konsistensi komunikasi yang baik, adanya sumber daya yang memadai, adanya disposisi yang memiliki komitmen dan tanggungjawab serta struktur birokrasi yang jelas dan terkoordinasi

Abstract

Islamic religious education is one of the important sectors in the development of a community with character and noble values. The KUA Talang Ubi, as a religious institution, plays an active role in providing Islamic education services, including pre-marriage counseling and family education for a harmonious family life (sakinah). This study aims to analyze the implementation of service marketing management elements at KUA Talang Ubi, focusing on product, place, process, promotion, and physical evidence. Using a descriptive qualitative approach, this research identifies the successes and challenges in managing Islamic education services. The findings indicate that although the marketing management implementation is running well, there are still challenges such as the lack of adoption of the SIMKAH technology by the community and inconsistent implementation of standard operating procedures (SOP). This article offers recommendations in the form of intensive training for the community, improved communication quality, and staff training.

Abstract

Artificial Intelligence (AI) has emerged as a pivotal technology significantly impacting various sectors, including education. In the context of learning, AI holds the potential to improve personalization, automate assessments, and enhance learning analytics. However, in Islamic education, AI's implementation must align with the values of Islamic educational management and supervision. This study analyzes the application of AI in Indonesia's teaching and learning process while evaluating its benefits, challenges, and relevance to Islamic educational supervision. Using a literature review methodology, this study explores the role of AI in enhancing educational quality, particularly through personalized learning and administrative efficiency. Findings indicate that AI can assist supervisors in monitoring educational processes to ensure they are in line with Islamic values, such as justice, transparency, and character building. However, challenges such as technological infrastructure, digital literacy, data privacy, and algorithm bias remain significant. The study concludes that collaboration between the government, educational institutions, and supervisors is essential to develop infrastructure, train educators, and create policies that protect student privacy and uphold Islamic values. Future research should delve deeper into how Islamic educational supervision can optimize AI implementation in diverse educational settings.

Abstract

This paper examines divorce lawsuits caused by domestic violence committed by husbands against wives, focusing on the rights of women as victims. In such cases, wives can file for divorce and demand compensation for the physical and psychological harm they have suffered. The study employs a qualitative approach with an analytical descriptive method, using the library method to gather and analyze both primary and secondary literature, including legal documents, laws, scientific articles, and case reports. The research aims to identify patterns, challenges, and solutions related to legal protection for victims of domestic violence in divorce proceedings. The findings reveal that while there are legal provisions for compensation, significant challenges remain, such as social stigma, economic dependence, and limited access to legal resources, which complicate women's ability to claim their rights. Additionally, societal attitudes and gaps in law enforcement further hinder the realization of justice for victims. The study concludes that public awareness campaigns and stronger advocacy are essential to empowering women and ensuring their rights are protected throughout the divorce process. It also emphasizes the need for stricter law enforcement to hold perpetrators accountable and provide justice for victims. This research contributes to improving legal and social frameworks for the protection of women facing domestic violence.

Abstract

This study aims to analyze the effect of CARTER dimensions consisting of tangible, assurance, reliability, tangible, empathy and responsiveness on customer satisfaction at Bank Syariah Mandiri in Medan City. electronic word of mouth. Respondents in this study were customers of Bank Syariah Mandiri in Medan City who were Muslim and used Mobile Banking. A total of 300 questionnaires were distributed, there were 220 questionnaires that met the criteria. So that the data can be processed as many as 220 samples. The analysis technique uses Structural Equation Modeling with AMOS.The results show that the Compliance dimension has a positive and significant effect on customer satisfaction at Bank Syariah Mandiri in Medan City, the assurance dimension has a significant positive effect on customer satisfaction at Bank Syariah Mandiri in Medan City, the reliability dimension has a positive direction but does not significantly affect customer satisfaction at Bank Syariah Mandiri in Medan. Medan City, the tangible dimension is the largest dimension that has a positive and significant effect on customer satisfaction of Bank Syariah Mandiri in the City, the dimension of empathy has a positive and significant effect on customer satisfaction of Bank Syariah Mandiri in the City, the dimension of responsiveness has a positive and significant effect on customer satisfaction of Bank Syariah Mandiri in Medan city. The variable of customer satisfaction has a positive and significant effect on electronic word of mouth on Bank Syariah Mandiri customers in Medan City. The Sobel test conducted shows that customer satisfaction has a significant effect as a mediator between the tangible, assurance, tangible, empathy and responsiveness dimensions and Electronic Word of Mouth.
