Abstract

As the only province in Indonesia implementing Islamic Sharia law, Aceh has a rich historical and cultural context rooted in Islamic traditions. In the modern era, understanding how Sharia law interacts with diverse community demands is crucial. This study examines the actualization of diyah (compensation) in Aceh's Qānūn Jināyah (Crimes) using a sociological approach to Islamic law. The qualitative research method employed involves descriptive data collection. The findings reveal that the diyah law in Aceh’s Qānūn Jināyah illustrates the intricate interaction between social, cultural, legal, and religious aspects in the application and acceptance of Islamic law. Diyah serves not only as a formal legal instrument for justice but also as a reflection of the strong cultural values, religious traditions, and social norms within Acehnese society. Through sociological analysis, the study highlights how the mechanism for implementing diyah in the Qānūn Jināyah embodies the integration of Islamic law with the socio-cultural values of Acehnese society, offering insights into how Sharia law adapts to contemporary social challenges and changes.

Abstract

Every work of innovation is a valuable intellectual property that should be protected by the state, according to Law No. 24 of 2014. However, Intellectual Property Rights are not adhered to by the public as there is much piracy. This is evident in the proliferation of websites providing pirated music, photocopies of books, and uploading songs that are sung again without permission from the creator. This necessitates a study related to the protection of Intellectual Property Rights (IPR) from the perspective of Islamic law. Building on the theory of maqasid sharia, the study shows that Islamic law views copyright as protected property because it is haq al-ibtikar containing the creator's exclusive, economic, and moral rights. From a fiqh perspective, the solution should be based on moral and economic demands. Therefore, it is necessary to strictly enforce the law against violations of Intellectual Property Rights because it is based on the appreciation and protection of creative rights, which signify professionalism.

Abstract

This paper examines divorce lawsuits caused by domestic violence committed by husbands against wives, focusing on the rights of women as victims. In such cases, wives can file for divorce and demand compensation for the physical and psychological harm they have suffered. The study employs a qualitative approach with an analytical descriptive method, using the library method to gather and analyze both primary and secondary literature, including legal documents, laws, scientific articles, and case reports. The research aims to identify patterns, challenges, and solutions related to legal protection for victims of domestic violence in divorce proceedings. The findings reveal that while there are legal provisions for compensation, significant challenges remain, such as social stigma, economic dependence, and limited access to legal resources, which complicate women's ability to claim their rights. Additionally, societal attitudes and gaps in law enforcement further hinder the realization of justice for victims. The study concludes that public awareness campaigns and stronger advocacy are essential to empowering women and ensuring their rights are protected throughout the divorce process. It also emphasizes the need for stricter law enforcement to hold perpetrators accountable and provide justice for victims. This research contributes to improving legal and social frameworks for the protection of women facing domestic violence.

Abstract

The witness is the person or party who hear and know themselves what the testimony. However, there are also witnesses called testimonium de auditu namely hearing the testimony of others, meaning that the information obtained from another person or not known directly. This testimony is called the Shahadah according fiqh al Istifāḍah and some are calling it the bi al-Shahada al-Tasâmu'i. Theoretically, testimonium de auditu be a problem as opposed to the actual meaning of the witness. Therefore in practice, especially among the jurists' disagreement occurs. Departing from this disagreement, the problems discussed in the testimony of the strength of the testimony of two perspectives: in civil law and jurisprudence. From this exploratory study found that testimonium de auditu can not be used as direct evidence in the trial, but a testimony de auditu can be constructed by a judge as an allegation by a judge. While Shahada al Istifāḍah in Islamic civil law has the power and strength are perfect even on specific issues such as ownership and determination of offspring. Even the jurists' further states that the strength of this testimonium stronger testimony of two witnesses who qualify formal and material requirements. Abstract

The idea of daman towards both criminal and justice victims, from early time, has been mentioned in the nash of both Al-Quran and Al-Hadith. From the nash, Ulemas have formulated various fiqh forms concerning daman (compensation). In fact, from early time the Islamic Jurists have not applied the terms masuliyah madaniyah for justice responsibility, and masuliyah al ina'iyah for criminal one. However, several thinkers of classical Islamic law mainly al-Qurafi and al- `Iz Ibn Abdi Salam have introduced the term al-jawabir for justice conpensation (read: daman) and al-zawajir for criminal compensation (read: 'uqubah diyat, arus, etc.). Although in its development, up to recent time, Islamic Jurists often use the term masuliyah that is because of the Western work influences. Daman could occur because of deviation on akad (agreement) namely daman al-aqdi, and could happen because of violation namely daman `udwan. In determining the compensation, the esential elements are darar or lost on the victims. Darar could occur on physical, material or things and service aspects; and it could also be on moral and emotional destruction or called darar adabi including name-reputation damage. The standard for the compensation either on quality or quantity must be similar to darar suffered by the victims. Although in certain cases, the multiplying compensation may happen based on the victims' condition. Keywords: Compensation Theory, Islamic Law, Law perspectives

Abstract

Penelitian ini mengkaji konsep kerugian non-material dalam hukum Islam. Secara normatif, penelitian ini mengulas bagaimana kompensasi untuk tindakan plagiarisme ditinjau dari perspektif hukum Islam. Jenis penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan kualitatif, yang dianalisis secara mendalam untuk memahami konteks dan makna dari norma-norma hukum yang berlaku. Hasil penelitian menunjukkan bahwa hukum Islam menghormati hak-hak pribadi, termasuk hak kekayaan intelektual. Ketika seseorang menjiplak karya orang lain tanpa izin atau tanpa memberikan pengakuan, hal ini dianggap sebagai pelanggaran terhadap hak-hak pribadi penulis atau pencipta asli. Dalam konteks ini, plagiat bisa dianggap sebagai bentuk pencurian, karena mengambil sesuatu ide atau karya yang bukan miliknya.

Abstract

The research was conducted at Kopassus Park with the aim of determining Parking Characteristics, including Parking Accumulation, Vehicle Parking Volume, Parking Index, Turn Over, Parking Headway, and Parking Space Requirements. The survey was conducted for a duration of seven days. The data obtained consisted of vehicle entry and exit data for both cars and motorcycles. The research results showed that the maximum parking index for cars on June 18, 2023, was 56%, indicating that the demand for car parking space did not exceed the available parking capacity. Similarly, for motorcycles, the maximum parking index on June 23, 2023, was 28.3%, indicating that the demand for motorcycle parking space did not exceed the available capacity. The minimum headway for cars occurred on June 18, 2023, between 2:00 PM and 3:00 PM, with a value of 3 minutes per vehicle, while the minimum headway for motorcycles occurred on June 18, 2023, between 12:00 PM and 1:00 PM, with a value of 3.75 minutes per vehicle. The largest parking space requirement for cars on June 18, 2023, was 161 square meters, with the parking area for cars at Kopassus Park totaling 569.49 square meters, still able to accommodate vehicles during peak hours. The maximum parking space requirement for motorcycles on June 19, 2023, was 34.5 square meters, with the parking area for motorcycles at Kopassus Park totaling 121.20 square meters.

Karir politik Syekh Zainuddin Abdul Majid bermula ketika menjabat sebagai Konsulat Nahdlatul Ulama Sunda Kecil pada tahun 1950. tahun 1952 menjadi ketua badan penasehat partai masyumi pulau Lombok.

Abstract

This research explores the will for student character building in "Serat Darmariwayat" by Paku Alam III, a historical figure in Indonesia. In this study, Serat Darmariwayat is designated as the main source to understand the values and teachings left by Paku Alam III regarding character building. It highlights the importance of literature, goodwill, education, self-control, and ethics in shaping a person rooted in local wisdom values. This research presents an in-depth look at how traditional values and literature become the foundation of student character building. This research is library research which specifically focuses on Serat Darmariwayat, a literary work produced by Paku Alam III. it can be assumed that the approach adopted is comprehensive, centered on individual development rooted in cultural, moral and intellectual values. The implications of this will for modern education are significant. The importance of literary appreciation, educational awareness, self-control, and cultural understanding can be applied in today's educational curricula and practices. Although integration challenges may arise, collaborative efforts between educational institutions, local communities and parents can overcome these barriers. This research provides a solid foundation for understanding how traditional values can be a valuable guide in shaping student character in the modern era.

Abstract

Rokok merupakan salah satu faktor risiko utama dari beberapa penyakit kronis yang dapat mengakibatkan kematian. Hal ini   menunjukkan bahwa rokok merupakan masalah besar bagi   kesehatan masyarakat. Selain dari segi kesehatan, rokok juga  mempengaruhi kepribadian perokok itu sendiri. Biasanya remaja  usia SMA sudah mengenal rokok. Pengabdian ini bertujuan untuk melaksanakan pendidikan kesehatan menggunakan video animasi tentang bahaya merokok pada remaja. Pengabdian kepada masyarakat dengan sasaran siswa sekolah menengah atas tentang edukasi bahaya merokok pada remaja berbasis video animasi dapat meningkatkan pengetahuan mahasiswa. Penyuluhan ini dilaksanakan di SMAN 01 Muaro Jambi oleh tim pengabdi dari Poltekkes Kemenkes Jambi. Selama melakukan penyuluhan siswa sangat antusias dalam mendengarkan pemateri, untuk itu diharapkan kegiatan ini digalakkan khususnya di dunia Pendidikan.
