Abstract

Many workers in Indonesia experience violations of legal protection of their rights and obligations, caused by their ignorance of employment contracts and the rights and obligations inherent in the workforce. This issue is the basis for this study, which aims to analyze employment contracts in the context of labor law, focusing on the legal protection of workers' rights and obligations. This study uses a qualitative method with a descriptive approach. The results of the study show that labor law is always related to the protection of workers' rights and obligations. In employment law, an employment contract is understood as a written agreement between an employee and an employer that regulates various aspects of the employment relationship between the two. This contract serves as a legal basis that protects the rights and obligations of each party. Legal protection itself is an effort to protect the dignity and human rights (HAM) owned by legal subjects, in accordance with applicable legal regulations, either in the form of policies or regulations aimed at safeguarding these interests from threats. The rights and obligations between parties are interrelated, where the rights of one party become an obligation for the other.

Abstract

This article aims to analyze legal regulations related to informal sector workers, especially casual workers, as well as derivative regulations that are relevant to their protection. This research uses a normative research method with a descriptive approach. The research results show that although Law Number 13 of 2003 concerning Employment provides a legal basis for the protection of informal workers, its implementation is still limited and faces many challenges, especially in terms of access to social security and legal protection. Current protections include the right to a living wage, fair treatment, and access to social security programs. Therefore, further efforts are needed to improve legal protection for freelance workers in Indonesia, in order to create a safer and fairer work environment and support the sustainability of the freelance work sector which is growing rapidly in the digital era.

Abstract

This study aims to discuss the importance of understanding rights and obligations in employment relations in Indonesia. Employers are expected to protect workers' interests through counseling, coaching, and ensuring work safety, while workers must also understand their obligations. Although there are laws regulating workers' rights, such as Law Number 13 of 2003, there are still obstacles in its implementation, including culture and lack of awareness. Real action is needed from the government to strengthen regulation and supervision. Suggestions provided include increasing socialization of rights and obligations, improving regulations, and social security for workers, especially in the informal sector, to create fair and sustainable employment relations. Effective legal protection is needed to create social justice and ensure workers' rights are respected.

Abstract

Introduction: Obesity is a health problem experienced by workers in the manufacturing industry. The incidence of obesity is caused by various factors, including lack of knowledge. This study aims to analyze the factors associated with knowledge about obesity among workers. Methods: This study an analytical observational design with a cross-sectional approach conducted at PT XYZ in Surabaya City, East Java Province. The population of this study consisted of 145 workers in the manufacturing sector from various work units. The sample size consisted of 119 people. The independent variables were age, sex, work tenure, work unit, education level, and access to information about obesity. Meanwhile, the dependent variable was knowledge level. The statistical test used was the contingency coefficient test. Results: The results showed that most workers were over the age of 35 years (89.9%), males (67.2%), worked in a production work unit (60.5%), had worked for more than 20 years (78.2%), had a high school degree (54.6%), had good knowledge (55.5%), and did not have access to information about obesity (55%). A relationship was found between work tenure (p = 0.001), education level (p = 0.002) and access to information (p = 0.004) with knowledge level of the workers about obesity. Meanwhile, age (p = 0.437), sex (p = 0.643), and work unit (p = 0.335) had no significant relationship with knowledge level of the workers about obesity. Conclusion: A relationship was found between work tenure, education level, and access to information with knowledge level about obesity.

Abstract

Tax revenue is the main source of state revenue, but disputes often arise related to the application of Double Taxation Avoidance Agreements (DTAs). These disputes generally revolve around the fulfillment of administrative requirements, especially the inclusion of a Domicile Certificate (SKD). This research aims to analyze the application of material and formal legal principles in two Tax Court decisions, namely PUT-001293.35/2020/PP/MXVIIIA Year 2022 and PUT-004868.13/2021/PP/MXIIIB Year 2022, as well as the implications for legal certainty and taxpayer protection. The research uses normative juridical method with statutory, case, and conceptual approaches. Data is obtained from literature studies in the form of laws and regulations and legal doctrines. The results show that decisions that prioritize material legal principles provide substantive justice but have the potential to weaken the application of tax regulations. Conversely, decisions that prioritize formal legal principles provide legal certainty by emphasizing the importance of fulfilling administrative requirements. The conclusion of this research emphasizes the need for a balance between substantive justice and legal certainty in the application of P3B. Implementing regulations, such as PER-25/PJ/2018, are important instruments to ensure P3B is used appropriately and prevent misuse, thus supporting the optimization of tax revenue

Abstract

Child custody disputes following divorce often become complex legal and emotional battles, especially when religious and customary laws intersect. In many Muslim-majority societies, Islamic law (Sharia) and customary law (adat) both influence custody decisions, sometimes complementing each other but often conflicting in practice. Islamic law prioritizes the child’s welfare while emphasizing maternal custody during early childhood (hadanah) and paternal guardianship (wilayah) in later years. However, customary law, deeply rooted in local traditions, can override or modify these principles based on community norms, family ties, and social status. This study explores the legal and cultural dimensions of child custody disputes in divorce cases, analyzing the extent to which Islamic law and customary law shape judicial decisions and parental rights. While Islamic law prescribes clear guidelines, its application varies across jurisdictions, influenced by local customs and judicial interpretations. In many cases, customary norms challenge Islamic legal principles, leading to inconsistencies and gendered biases that may disadvantage mothers or overlook the best interests of the child. As globalization and legal reforms push for greater adherence to human rights and child protection standards, the tension between religious and customary laws raises critical questions about the future of custody rulings. This paper examines landmark cases, legal frameworks, and the evolving role of Islamic and customary laws in shaping custody outcomes. By comparing these perspectives, it seeks to highlight the need for harmonized legal solutions that prioritize the child’s well-being while respecting cultural and religious traditions.

Abstract

Lignocellulose materials, such as bamboo, rattan, and wood, have been largely used for furniture and crafts. On the other hand, the utilization of lignocellulose-like materials, which have a similar texture and appearance to those from nature, has been increasing recently due to their superior durability. This research aimed to identify the lignocellulose-like material using spectroscopy analysis, such as Raman and Near Infrared (NIR) which is well-known as a non-destructive, quick, and accurate approach for material identification. We investigated 4 types of lignocellulose-like materials that were provided by Dewan Serat Indonesia (The Indonesian Fiber Council) from an industry that produces them. The NIR analysis was performed at wavenumbers 10,000-4,000 cm-1. The natural lignocellulose (bamboo and wood) and the polymers (polyethylene and polyproline) were used as standards. Raman analysis was further employed to identify the composition of selected lignocellulose-like materials by comparing their spectra with the library software. The results showed that the original NIR spectra of lignocellulose-like and those natural materials were different, indicating that the NIR analysis can differentiate those materials. The NIR spectra of lignocellulose-like materials were similar to those of polyethylene spectra. Those lignocellulose-like were also identified as polyethylene due to the similarity of the Raman spectra and their library spectra.

Abstract

Background: Continuous noise exposure can cause an increase in blood pressure and work-related stress in the rotary production area of PT APB Manufacturing Industry in East Java Province, Indonesia. Purpose: This research aims to analyze the effect of noise intensity on blood pressure before and after work among employees in the rotary production area of the manufacturing industry in East Java Province, Indonesia. Method: This research employed an analytic observational study with a cross-sectional design. The sample, obtained through cluster random sampling, consisted of 49 people. Data were collected by measuring noise intensity and monitoring blood pressure before and after work. A Paired Sample T-test was conducted to assess differences in workers' blood pressure before and after exposure to noise. Result: Significant differences were observed in both systolic (p-value = 0.000) and diastolic (p-value = 0.010) blood pressure before and after work. Conclusion: Increased blood pressure appears to be linked to noise levels in the workplace exceeding the threshold value. Consequently, there is a need for control efforts to overcome this issue.

Abstract

The law of regional autonomy is a branch of law that regulates regional authority in managing its own government affairs based on the principle of decentralization. In the Indonesian constitutional system, regional autonomy aims to enhance government effectiveness, accelerate development, and provide quality services to the community by considering regional characteristics and needs. The main legal basis for regional autonomy in Indonesia is outlined in Articles 18, 18A, and 18B of the 1945 Constitution, as well as Law Number 23 of 2014 concerning Regional Government. Key concepts in regional autonomy law include the division of authority between central and regional governments, financial relationships between the two, and principles of supervision and accountability in local governance. However, regional autonomy faces challenges such as corruption at the regional level and imbalances in the implementation of central policies. Therefore, strengthening regulations and supervisory mechanisms is crucial to ensure that regional autonomy laws align with the principles of democracy, government effectiveness, and community welfare.

Abstract

Introduction: Occupational health must be considered in the workplace. Cases of overweight and obesity among workers in the manufacturing sector have increased. This study analyzes the relationship between physical workload and personal factors related to nutritional status among manufacturing workers. Methods: This study used an observational analytic study with a cross-sectional design. The variables of this study were physical workload, nutritional status, and personal factors such as gender, educational level, exercise habits, and smoking habits. The sample in this study was 239 workers in the manufacturing industry, and it was obtained using random sampling techniques. Data were analyzed using the Spearman correlation and coefficient contingency test. Result: More than half of the total cases of overweight and obesity occur in manufacturing workers who have a low physical workload. More than half of the respondents are female, do not have a high school education, and have never exercised. Most do not have a smoking habit. The results showed that physical workload (p=0.001), exercise habits (p=0.001), gender (p=0,004), and educational level (p=0.037) were related to nutritional status. In contrast, manufacturing workers' smoking habits were not associated with nutritional status (p>0.05). Conclusion: Physical workload, exercise habits, gender, and educational level have a relationship with nutritional status among workers, it is recommended that workers must increase their exercise routine such as implementing scheduled sports shifts for workers and providing sports facilities in companies so the case of being obesity can be decreased.
