Abstract

This study addresses the legal uncertainty surrounding the term limits of legislative members in Indonesia, encompassing the House of Representatives (DPR), Regional Representative Council (DPD), and Regional People's Representative Councils (DPRD). The core problem lies in existing laws, such as Law No. 17 of 2014 on MD3 and Law No. 8 of 2012 on Elections, which specify a five-year term but lack explicit limitations on re-election periods. This regulatory vacuum enables incumbents to hold office indefinitely, leading to significant implications for democratic quality. The research aims to analyze the legal and socio-political consequences of this unlimited tenure, including the stagnation of democratic circulation, the proliferation of political dynasties, increased risks of corruption, and declining public trust. It employs a normative-legal methodology, scrutinizing primary legal materials, academic journals, and survey data to evaluate the existing framework. Findings reveal that the absence of term limits undermines equal political opportunities, fosters political dynasties, and correlates with a high incidence of corruption cases among legislative members. Comparative analysis with other countries, such as Venezuela and the Philippines which impose strict term limits, highlights the necessity for reform. The study concludes that amending the 1945 Constitution and revising the MD3 Law and Election Law to include clear term limitations is crucial. These legislative reconstructions are essential to foster leadership regeneration, enhance accountability, and ensure a healthy, responsive constitutional democracy in Indonesia.

Abstract

This study examines the implementation of local retribution collection at the Sport Center Manunggal Jati in Semarang City from the perspective of positive law and the principles of good governance. The main issue addressed is the extent to which the regulation and implementation of user service retribution in this sector align with the general principles of good administration. The research adopts a normative juridical method with a descriptive-analytical approach. Data were obtained through literature studies on statutory regulations, local government documents, and previous research findings. The results reveal that the legal framework for retribution collection is well-established, both at the national and regional levels, including Law Number 1 of 2022, Government Regulation Number 35 of 2023, Semarang Regional Regulation Number 7 of 2018, and Mayor Regulation Number 6 of 2020. However, implementation still faces challenges such as limited public outreach, suboptimal administrative systems, and insufficient supervision. Nevertheless, the retribution collection at Sport Center Manunggal Jati reflects the principles of legal certainty, utility, impartiality, non-abuse of power, and public interest. The study concludes that strengthening management systems, conducting regular regulatory evaluations, and applying digital technology are essential to improve the efficiency and accountability of retribution administration.

Abstract

Penelitian ini bertujuan untuk menganalisis tanggung jawab Dinas Pemberdayaan Perempuan dan Perlindungan Anak (DP3A) dalam implementasi kebijakan Kota Layak Anak (KLA) di Kota Semarang. Fokus utama penelitian adalah sejauh mana DP3A melaksanakan tanggung jawabnya dalam mengelola dan mengawasi program perlindungan anak yang sejalan dengan prinsip-prinsip KLA. Metode yang digunakan adalah pendekatan normatif, yaitu dengan menelaah peraturan perundang-undangan yang relevan, serta mengumpulkan data melalui studi dokumen, laporan tahunan DP3A, dan kajian dari penelitian terdahulu. Hasil penelitian menunjukkan bahwa DP3A memiliki peran sentral dalam merumuskan kebijakan, mengoordinasikan pelaksanaan program, serta mendorong partisipasi masyarakat dalam mewujudkan Kota Layak Anak. Namun demikian, implementasi kebijakan ini masih menghadapi beberapa tantangan, antara lain keterbatasan sumber daya manusia dan anggaran, sertal emahnya koordinasi antarinstansi yang terlibat. Oleh karena itu, penelitian ini menyimpulkan bahwa diperlukan peningkatan kapasitas kelembagaan DP3A, perbaikan sistem koordinasi lintas sektor, sertap elibatan aktif masyarakat agar kebijakan Kota Layak Anak di Kota Semarang dapat berjalan dengan optimal dan berkelanjutan.

Abstract

Live shopping is an innovative form of digital marketing that combines real-time interaction with the convenience of online shopping. This study aims to explore the communication strategies used by presenters to trigger purchasing transactions on the TikTok Live Shopping platform. Using a qualitative approach and respondent perception analysis, the findings reveal that product knowledge, direct interaction, and delivery style significantly influence consumer buying interest. Presenters who can convey information persuasively, create interactive engagement, and effectively utilize platform features have a greater potential to boost conversion rates. Facial expressions, body gestures, and vocal tone also serve as crucial nonverbal elements that affect emotional responses from viewers. Additionally, promotions, discounts, and detailed product presentations are the main attractions that draw audience attention during live sessions. TikTok, as an entertainment-based platform, allows for more expressive and personal communication strategies. Therefore, the success of live shopping on TikTok highly depends on the presenter’s ability to build dynamic two-way communication. This study concludes that presenter communication strategies are central to creating an effective digital shopping experience. The findings contribute significantly to the development of live streaming-based marketing strategies in the digital economy era.

Abstract

Child custody disputes following divorce often become complex legal and emotional battles, especially when religious and customary laws intersect. In many Muslim-majority societies, Islamic law (Sharia) and customary law (adat) both influence custody decisions, sometimes complementing each other but often conflicting in practice. Islamic law prioritizes the child’s welfare while emphasizing maternal custody during early childhood (hadanah) and paternal guardianship (wilayah) in later years. However, customary law, deeply rooted in local traditions, can override or modify these principles based on community norms, family ties, and social status. This study explores the legal and cultural dimensions of child custody disputes in divorce cases, analyzing the extent to which Islamic law and customary law shape judicial decisions and parental rights. While Islamic law prescribes clear guidelines, its application varies across jurisdictions, influenced by local customs and judicial interpretations. In many cases, customary norms challenge Islamic legal principles, leading to inconsistencies and gendered biases that may disadvantage mothers or overlook the best interests of the child. As globalization and legal reforms push for greater adherence to human rights and child protection standards, the tension between religious and customary laws raises critical questions about the future of custody rulings. This paper examines landmark cases, legal frameworks, and the evolving role of Islamic and customary laws in shaping custody outcomes. By comparing these perspectives, it seeks to highlight the need for harmonized legal solutions that prioritize the child’s well-being while respecting cultural and religious traditions.

Pendekatan yang digunakan dalam penelitian ini adalah yuridis normatif,dengan menelaah berbagai peraturan perundang-undangan, dokumen hukum daerah, sertaliteratur akademik dalam ranah hukum administrasi negara. UU No. 23 Tahun 2014 dan UUNo. 10 Tahun 2009 secara jelas memberi wewenang kepada pemerintah daerah untukmengatur dan mengawasi kegiatan kepariwisataan, termasuk konser musik. Namun, DinasKebudayaan dan Pariwisata Kota Semarang belum memiliki perangkat kelembagaan danperaturan pelaksana yang memadai untuk melaksanakan kewenangan tersebut secara penuhdan akuntabel.Kata Kunci: Hukum Negara, Pengawasan Konser, Dinas Budaya dan Pariwisata

Abstract

Dengan melakukan penerbitan NIB, para pelaku usaha dapat memperoleh banyak manfaat, yakni kepastian dan perlindungan dalam berusaha, pendampingan pengembangan usaha, kemudahan akses pembiayaan ke lembaga keuangan bank dan non-bank, dan kemudahan dalam pemberdayaan dari pemerintah. Namun, terjadi perbedaan signifikan antara jumlah orang berusaha sendiri dengan jumlah penerbitan NIB akibat rendahnya penerbitan NIB yang menyebabkan pelayanan perizinan tidak merata dirasakan oleh seluruh masyarakat Kabupaten Tuban dikarenakan para pelaku usaha yang minim literasi digital dan wilayahnya sangat jauh dari pusat kota Tuban. Tujuan penelitian ini adalah untuk menganalisis adanya optimalisasi dari DPMPTSP Tuban dalam meningkatkan penerbitan NIB dan menganalisis hambatan dalam optimalisasi tersebut. Metode penelitian yang digunakan adalah menggunakan teori kebijakan publik dari Harold D. Lasswell diselaraskan dengan pendekatan penelitian kualitatif dengan jenis penelitian yuridis empiris yang berasal dari data primer berupa data hasil wawancara dan data sekunder berupa studi kepustakaan dan studi dokumen. Hasil penelitian menunjukkan bahwa DPMPTSP Tuban berhasil meningkatkan penerbitan NIB secara signifikan setiap tahunnya sejak program Jempol Lari, Roadshow Pelayanan Publik, dan sosialisasi pelayanan perizinan kepada para pelaku usaha yang bertempat tinggal jauh dari pusat kota Tuban yang ingin melakukan legalisasi usaha sehingga dapat terpenuhinya Good Governance oleh DPMPTSP Tuban.

Abstract

The television industry faces significant challenges due to digital disruption, particularly the increasingly widespread penetration of artificial intelligence (AI) technology. AI has the potential to optimize production, distribution, and audience preference analysis, but its implementation faces the complexities of unstructured social systems. This study aims to explore the systemic application of AI using a Soft Systems Methodology (SSM) approach to identify, analyze, and optimize its use in the television industry. The research method used was qualitative with a case study design at a national television station. The SSM process was carried out through seven stages, starting from exploring the problem situation, compiling rich pictures, analyzing CATWOE, and formulating and evaluating corrective actions. Data were collected through literature review, participant observation, and internal document analysis. The results show that SSM is effective in identifying strategic areas for AI optimization, particularly in audience segmentation, content automation, and broadcast management. The resulting framework is flexible, participatory, and responsive to the social dynamics of media organizations. The impact of this research is a contribution to the development of media information systems and technology, as well as expanding the scope of soft methodologies in responding to the challenges of digital transformation in an adaptive and sustainable manner.

Abstract

This study examines the limitations and mechanisms of the application of criminal sanctions against taxpayers who violate tax provisions in Indonesia, and evaluates the application of the ultimum remedium principle as the principle of "criminal sanctions as a last resort." Using a qualitative legal-normative approach with a descriptive-analytical method, data was collected through a documentation study of primary sources (Law 7/2021 in conjunction with Law 6/2023 concerning KUP, KUHAP, KUHP) and secondary sources (scientific journals 2020–2025, textbooks, DGT guidelines). Normative-dogmatic analysis reveals that the KUP Law explicitly separates administrative and criminal sanctions without setting a minimum loss threshold for criminal prosecution, so that tax officials tend to use criminal sanctions only for high-value cases. The legal-theoretical study explains that the ultimum remedium principle is accommodated through provisions such as Article 8 paragraph (3) and Article 44B of the KUP Law, but in practice it still encounters inconsistencies and broad discretion. Synthesis of findings indicates the need for quantitative guidelines for loss thresholds, reintegration of the “first-time offender” protocol, and harmonization of the Criminal Procedure Code with the principle of criminal subsidiarity. These recommendations are expected to strengthen the implementation of the ultimum remedium principle, ensuring that criminal sanctions are truly the last resort in enforcing fair and proportional tax law.
