Abstract

This article examines how Islamic family law governance operates within a plural legal system in Aceh, Indonesia, and questions the adequacy of conventional legal pluralism in explaining such practices. While previous studies have recognized the coexistence of state law, Islamic law, and custom, they often remain descriptive and overlook the dynamic interaction between these systems. This study offers a novel contribution by developing the concept of interlegal governance to explain how legal norms intersect and are negotiated in practice, particularly in relation to vulnerable groups. Using a qualitative socio-legal approach based on structured literature synthesis (1994–2025), this article analyzes how legal actors navigate multiple legal forums in resolving family disputes. The findings identify four interlegal patterns: normative harmonization, selective incorporation, jurisdictional bifurcation, and forum navigation. These patterns demonstrate that Islamic family law in Aceh is not governed by a single authority but through dynamic interaction among legal systems. Importantly, the study reveals that interlegality is normatively ambivalent—it can expand access to justice while also reproducing inequalities, particularly affecting women and children. This article argues that understanding Islamic law in plural societies requires moving beyond legal pluralism toward an interlegal perspective that captures both interactions and its implications for justice.

Abstract

The childfree phenomenon has increasingly emerged as part of changing family values in contemporary society, particularly among younger generations who are beginning to reinterpret marriage, reproduction, and family life. The decision not to have children is no longer viewed merely as a biological issue, but is also influenced by economic factors, mental health conditions, family relationship experiences, and changing perceptions of quality of life. In the context of Muslim society in Indonesia, this phenomenon has become a subject of debate because it is closely related to religious values, culture, and the objectives of marriage in Islamic family law. This study aims to analyze the perspectives of women’s Non-Governmental Organizations (NGOs), namely LSM Damar and PKBI Lampung, regarding the childfree phenomenon within the perspective of Islamic family law. This research employs a qualitative approach using a case study method through in-depth interviews and documentation. The findings reveal that LSM Damar and PKBI Lampung perceive childfree as a social phenomenon that should be understood contextually rather than merely as a deviation from family values. LSM Damar emphasizes gender justice and women’s reproductive rights, while PKBI Lampung focuses more on psychological readiness, reproductive health, and family responsibility. From the perspective of Islamic family law, the childfree phenomenon is related to the concepts of hifz al-nasl, family welfare (maslahah), and the importance of mutual consultation in reproductive decision-making within marriage.

Abstract

This research aims to determine the impeachment or dismissal of regional heads in Lampung Province from the perspective of Law and Islamic jurisprudence. This problem is interesting to research. Since this province was founded, at least five regional heads have been dishonorably dismissed for committing Corruption, namely the Regent of South Lampung, the Regent of North Lampung, the Regent of Tanggamus, the Regent of Mesuji and the Regent of Central Lampung. This research uses a library study method, is descriptive-analytical, and uses primary and secondary legal data sources, which are then analyzed using the comparative method. This research concluded that the impeachment of regional heads in Lampung Province was carried out because they violated their oath of office, namely committing Corruption as regulated in Law Number 9 of 2015 concerning Regional Government, which is the second amendment to Law Number 23 of 2014 concerning regional government. Corruption in Indonesia is an extraordinary crime because it has a significant and widespread impact. Instead, the budget for regional development and people's welfare is taken for their interests. In Fiqh Siyasah, this issue is included in siyasah qadhaiyah. Every community must obey the laws and regulations. So, if a regional head violates the Law, he can be dishonorably dismissed for acting wickedly and unjustly. The corrupt behavior of regional heads includes sinful acts and forms of cruelty by leaders toward their people.

Abstract

This research examines the implications of the nyikok tradition in Lampung Pepadun customary society on the fulfillment of children's rights and its relevance to the development of Islamic family law in Indonesia. This type of research is field research, which is conducted in the Lampung Pepadun indigenous community in Lampung Province. This type of research is field research, which is conducted in the Lampung Pepadun Customary Society in Lampung Province. Data sources in this research are primary and secondary data sources. Data analysis in this research uses qualitative methods. Analyzed inductive thinking approach. The results of the study that Nyikok in Lampung Pepadun cultural customs has a good purpose. Based on the Receptio A Contrario analysis, nyikok has compatibility with Islamic law, so that its practice can be applied by the indigenous people of Lampung Pepadun, because it has positive implications in fulfilling children's rights, on the other hand, it is also to protect the inherited property of the deceased father, to continue the breed so that the balance is not broken and to maintain the kinship system that has been established. The nyikok tradition has relevance to Islamic family law in Indonesia, which is relevant to KHI Article 14, Article 2 (1) of Law No. 1 of 1974 concerning Marriage and then the existence of nyikok in the context of child protection and care is relevant to Article 45 of Law No. 1 of 1974 concerning Marriage, that parents have an obligation to maintain and educate children.Keyword: Nyikok; Lampung Pepadun; Children's Rights; Indonesian Family Law.
