Abstract

With the rapid development of technology, it is now easier for people to communicate and find information, one of which is through social media. Social media has various types, advantages and disadvantages. The use of social media is not limited to a person's status, such as age, gender, religion or profession. Currently, many judges use social media to communicate, seek information and interact with the public. However, the use of social media by judges can affect public trust in the judiciary. In several countries, there are already rules and ways for judges to use social media properly and correctly. However, in Indonesia, the Code of Ethics and Code of Conduct for Judges (KEPPH) which has been in effect since 2009 does not regulate the use of social media by judges. Therefore, this research aims to assist the Supreme Court and the Judicial Commission in creating regulations or guidelines regarding the use of social media by judges, as well as assisting judges in using social media without violating the judge's professional code of ethics.

Abstract

Judges who act as executors and spearheads of justice and interact with the public are expected to have high professionalism in considering and making legal decisions in a case. In carrying out their duties, a judge is required to comply with the applicable code of ethics. When a judge violates the professional code of ethics, he will be given sanctions according to the violation he has committed. The case of violating the code of ethics that recently occurred was the case regarding Anwar Usman as Chairman of the Constitutional Court who was proven to have violated the professional code of ethics for judges in relation to Decision Number 90/PUU-XXI/2023. The aim of this research is to find out the accountability of a judge who has violated the professional code of ethics and to know the role of the Honorary Council of the Constitutional Court in handling cases of violations of the code of ethics committed by constitutional judges. This research uses a normative juridical method by referring to legal norms contained in statutory regulations as well as legal norms that exist in society. An approach that refers to applicable laws and regulations including principles, principles and doctrine. Judges who violate the code of ethics can impose three types of sanctions taking into account the background, level of seriousness and consequences of the violation. The Honorary Council of the Constitutional Court is an instrument formed by the Constitutional Court with the aim of maintaining and upholding honor, nobility and dignity. The authority possessed by the Honorary Council of the Constitutional Court includes maintaining the dignity and honor of the Constitutional Court, examining and deciding on allegations of violations of the code of ethics and behavior of constitutional judges. The trial led by Jimly Asshiddiqie as Chair of the Honorary Council of the Constitutional Court (MKMK) through the Decision of the Honorary Council of the Constitutional Court Number 02/MKMK/L/11/2923 stated that Anwar Usman in this case had been proven to have violated the code of professional ethics and behavior of judges. For this reason, Anwar Usman was dismissed from his position as Chairman of the Constitutional Court.

Abstract

Ethics is a value that must be understood and owned by everyone, with ethics, life together can be arranged as we expect. However, in practice, law enforcement in Indonesia still finds problems that distance the law from its main goal of providing justice, certainty, and benefits for the community. This study raises issues related to the relationship between judicial independence and integrity with the enforcement of legal professional ethics, as well as factors that can affect the independence and integrity of the judiciary in court processes. The methods used in this study are normative juridical and literature research, both of which are secondary data collection methods. Then, it can be concluded that judges who uphold the independence and integrity of their judiciary, can show the meaning of legal professional ethics. The relationship between the independence and integrity of the judiciary and the ethics of the legal profession is very close, because independence and integrity are the main conditions for the realization of the rule of law, and are guarantees for the upholding of law and justice.

Abstract

In applying these principles, the participation and function of law enforcement is essential as a defence of justice especially in the awareness of the fundamental rights of the people in the legal context. In practice, however, the law enforcement agencies that are supposed to enforce such legal norms are often unable to avoid unethical practices. The CPC specifically investigates the elite of power involved in corruption crimes carrying out a noble mission to adapt to the realities of public life. Therefore, this study aims to further evaluate the extent to which the authority recipient can play their role by applying the principles in the Code of Ethics of the CPC profession to the legal objectives and code of ethics of a profession that is justice. The method used is qualitative research method of library research or known as library study. This research found that, from the moral code of ethics perspective, some failures in the implementation of professional standards were also seen in cases that occurred in the CPC. Abstract

Ethics is an assessment of whether someone's behavior or actions are right or wrong. Meanwhile, morality is the rightness or wrongness of human behavior. Ethics are ideas and ideals about the motives for moral action or behavior. As the author, I took the title: "The Urgency of Implementing Professional Ethics in Law Enforcement Efforts in Indonesia". We have great hope as writers that by writing this, we can provide benefits and knowledge to readers in accordance with its objectives. This research uses a normative juridical approach, namely by inventorying, studying and analyzing and understanding law as a set of regulations or positive norms in the legislative system that regulates human life. Professional ethics is an ethical attitude that is an integral part of facing life as a professional. Only professionals can or know better whether their behavior in carrying out their professional duties is in accordance with the ethical requirements of their profession.

Abstract

Captive marriage, which involves the forced taking of women without their consent, goes against the principles enshrined in the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW) and the Universal Declaration of Human Rights (UDHR). Although Indonesian law prohibits kidnapping and forced marriage, cultural acceptance of these practices on Sumba makes it difficult to enforce the law. This study underscores the need for increased law enforcement, comprehensive public education, robust support services for victims, policy reform, and active engagement with traditional institutions. Such steps are critical to protecting women's rights and aligning domestic practices with international human rights standards.
