Abstract

Startups play an important role in the digital economy by bringing innovation and growth. Intellectual property can be in the form of copyrights, patents, trade secrets and trademarks owned by a startup business. However, the protection of intellectual property, especially copyrights and trade secrets, still faces major challenges. This article examines the legal lacuna in intellectual property protection, particularly regarding the relationship between startups and freelancers who often contribute valuable ideas and works. Using Philipus M. Hadjon's theory of legal protection and Gustav Radbruch's theory of legal certainty, this article highlights the need for stricter regulation to address the legal vacuum. Reforms are needed to improve trade secret protection and ensure better legal certainty. The conclusion suggests that strengthening intellectual property regulations will support the sustainability and competitiveness of startups, as well as protect their innovative assets in a competitive digital environment.

Abstract

Trademark protection is important because of its role in representing a brand’s integrity. The effort to protect trademark rights is therefore essential in ensuring that the brand’s integrity does not suffer any erosion, even if it means going for a lawsuit. This research is conducted to analyze the challenges in pursuing a lawsuit to protect trademark rights, particularly in proving what constitutes a well-known trademark. This research utilized the normative legal research method to analyze the existing positive law in Indonesia, particularly regarding the protection of trademarks. The conceptual analysis supported by the normative research method used in this research found that most of the literature favors the effort to protect trademarks, as it covers a significant portion of a brand’s strategy and perception in the public eye. However, the case study found that the reality of this pathway can be difficult, where there is a possibility that a decision can be made not based on a sound ratio decidendi, or even the lack thereof.

Abstract

Carbon emissions play an important role in the acceleration of climate change, which threatens the livelihoods of many people around the world. Electronic vehicles (EVs) serve as a solution to this problem by reducing the amount of pollution and enabling the use of renewable energy as a source. This research analyzes the incentives provided by countries that are trying to reduce their carbon emissions with EVs, namely Indonesia and Malaysia. The analysis is supported by a comparative legal research method and statutory approach. This research finds that Malaysia’s framework of incentives is superior to that of Indonesia’s, as incentives provided by Indonesia do not address the issue of carbon emissions entirely and are buried within a very fragmented legal framework. The research proposes a number of changes that need to be made in Indonesia to support the EV industry in all of the aspects that are relevant to its development, such as R&D, human resources, consumer support, and financial support for manufacturers.

Abstract

The rapid development of artificial intelligence (AI) presents complex challenges in legal theory, particularly regarding the question of AI as a legal subject. As AI becomes increasingly capable of creative work and decision-making, the question arises whether it should be recognized legally as an entity in its own right. This study explores the legal implications of recognizing AI as a legal subject through the lens of Immanuel Kant's philosophy, particularly focusing on human dignity. Kant argues that human dignity is intrinsic, grounded in the capacity for rational thought and moral responsibility, a characteristic AI lacks. Thus, recognizing AI as a legal subject risks undermining human dignity by equating human beings with entities that do not possess autonomy or ethical awareness. The study examines the current legal framework in Indonesia, highlighting the lack of clear regulation for AI, and explores the philosophical, ethical, and practical considerations involved in the legal treatment of AI. It argues that AI should be treated as a tool, not a legal subject, ensuring that human dignity remains the cornerstone of the legal system. The paper concludes by advocating for a fragmented, sector-specific approach to AI regulation in Indonesia, ensuring more focused oversight while protecting human dignity.

Abstract

Introduction: Freedom of expression in the digital era without any restrictions indirectly triggers the spread of fake news. The freedom to spread news or broadcasts often transcends legal, cultural and religious boundaries. Therefore, fake news is used as a tool to attack honor and bring down the good name of a person or group.Purposes of the Research: This research aims to analyze criminal and civil law regulations related to the spread of fake news in the digital era in Indonesia.Methods of the Research: Through normative legal research methods, this study examines various relevant regulations, including the Criminal Code, Civil Code, and Electronic Information and Transaction Law.Results Main Findings of the Research: The results of the study show that both criminal and civil laws already have mechanisms to overcome the spread of fake news. In the criminal realm, sanctions are given to perpetrators who spread fake news with a wide impact, such as inciting riots or violating human rights. Related articles in the Criminal Code and the Electronic Information and Transaction Law, such as Article 160 of the Criminal Code and Article 28 paragraph (3) jo. Article 45A paragraph (3) of the Electronic Information and Transaction Law, provides a strong legal basis. Meanwhile, civil law allows aggrieved individuals to claim compensation through the concept of unlawful acts in the Civil Code. A comparison between criminal and civil law shows that these two systems are complementary: criminal law focuses on providing a deterrent effect and protecting the public interest, while civil law places more emphasis on the recovery of individual losses. While existing regulations are adequate to deal with the spread of fake news, increased legal awareness in the community, stronger law enforcement, and more effective prevention mechanisms are needed to deal with the challenges in this digital age.

Abstract

The International Maritime Organization (IMO) held a conference from 9 to 13 December 2002 in London, resulting in an amendment to the international convention on safety of life at sea or Safety of Life at Sea (SOLAS) 1974. This research aims to analyze the effectiveness of implementing SOLAS 1974, analyzing obstacles, and providing solutions in dealing with obstacles in the implementation of SOLAS 1974 at the Public Port in Batam City. The research objects are SCN Batam Public Harbor, BP Batam and 99 Batu Ampar Harbor. The research results were analyzed using the theory of legal effectiveness according to Soerjono Soekanto which consists of five factors, namely the legal factor itself, law enforcement factors, facilities and infrastructure factors, community factors and cultural factors which are the results of the research. From this research it can be concluded that at the SCN Public Port the facilities and infrastructure factors were found to be less effective and other factors were effective, whereas at the BP Batam and 99 Batu Ampar Ports each factor was found to be effective. The obstacle experienced by the SCN Batam Public Port in implementing SOLAS 1974 was support from the Company itself, namely the provision of facilities and infrastructure for. Meanwhile, the obstacle experienced by the BP Batam and 99 Batu Ampar Public Ports in implementing the results of the researchers' field observations was the lack of firmness in law enforcement in the field

Abstract

Electricity is a primary necessity in today's world, and it has an impact on a country's economic growth. PT PLN Batam, as a subsidiary of PT PLN (Persero), is not only a provider of electricity but also must prioritize the quality of service to consumers. However, in practice, there are consumers who experience an increase in electricity bills compared to the previous month, and they do not receive a clear and proper explanation from PT PLN Batam regarding their electricity usage. The purpose of this research is to analyze the form of legal protection for consumers against electricity bills without usage in Batam and to evaluate the effectiveness of legal protection for consumers against such bills in Batam. The research method used in this study is empirical legal research, as it is conducted through field studies by observing the implementation of applicable regulations in the community. The results of this research show that legal protection for consumers against electricity bills without usage in Batam is still weak due to the low legal awareness from both PT PLN Batam and consumers, as well as the lack of clarity in the Electricity Law regarding the steps consumers can take. The effectiveness of legal protection is also hampered by the use of difficult-to-understand language in SPJBTL, the low legal awareness of the public, and the lack of legal literacy regarding consumer rights and obligations. This leads to difficulties for consumers in resolving issues related to electricity bills that do not match their actual usage

Abstract

Although Indonesia possesses significant potential for solar energy, it remains behind Vietnam, highlighting the critical need for policy and investment reforms to meet the increasing demand for renewable energy. This study aims to explores the normative issues within the Indonesian legal framework for investment and benchmarks it against Vietnam’s to assess the legal gap that may have hindered Indonesia’s progress in supporting solar technology investments. This study adopts a normative-empirical approach by integrating normative legal analysis of regulatory frameworks with the presentation and examination of empirical data. The empirical dimension of this research incorporates analysis of implementation outcomes, including renewable energy capacity data, carbon footprint measurements, and regulatory effectiveness indicators. The results of this study highlights normative inadequacies from Indonesia, with the lack of foundational normative support, followed by the lack of support in the form of complimentary regulations. Vietnam, on the other hand, has a significantly more developed framework to support investments in solar technology, serving as comparative evidence of the stark contrast between the country’s success and Indonesia’s ongoing challenges.

Abstract

Introduction: Indonesia and Malaysia are countries with fairly good economic levels in the ASEAN. Economic growth in the business world also has an influence on contract law because the phenomenon that occurs is the use of standard agreement models in the business world to make business processes more effective and efficient.Purposes of the Research: The aim of this research is to analyze the differences in contract law in Indonesia and Malaysia, also describe the phenomenon of standard agreement practices that occur in Indonesia and Malaysia, and analyze the validity of standard agreements that apply in Indonesia and Malaysia.Methods of the Research: The research method used is normative juridical. The type of study used is through literature study. The type of data used is secondary data consisting of primary legal materials, namely the Civil Code, the Malaysian Contracts Act 1950, the 1957 Sale of Goods Deed.Results Main Findings of the Research: The research results show that Indonesia and Malaysia are countries that have implemented standard agreement. These two countries also have a legal basis that allows standard agreements to come into force on the condition that there must be clauses that emphasize the rights and obligations of the parties to achieve justice.

Abstract

Kualitas informasi yang diberikan oleh penyedia Kredit Pemilikan Rumah (KPR) erat kaitannya dalam pemenuhan hak konsumen, serta berakibat dampaknya terhadap pemahaman dan keputusan konsumen KPR. Masalah ketidakjelasan informasi terkait suku bunga, biaya tambahan, dan syarat kredit, yang sering menyebabkan kesalahpahaman dan konflik antara Bank dengan Konsumen KPR. Penelitian bertujuan untuk mengidentifikasi kualitas informasi KPR yang disampaikan dan menganalisis pengaruhnya terhadap pemahaman dan keputusan konsumen KPR di Kota Batam. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan analisis bahan hukum sekunder, seperti peraturan perundang-undangan, didukung pendekatan empiris dari data primer yang langsung diperoleh dari sebaran kuesioner kepada 59 Responden (konsumen KPR di Kota Batam). Hasil penelitian menunjukkan bahwa meskipun sebagian besar konsumen merasa informasi cukup jelas, namun aspek transparansi terkait biaya tambahan dan risiko masih memerlukan perbaikan. Transparansi informasi berkontribusi positif terhadap kepercayaan dan keputusan konsumen, dengan diperlukan edukasi lebih lanjut dan pengawasan regulator untuk meningkatkan perlindungan konsumen. Penelitian ini menegaskan pentingnya penyampaian informasi yang akurat dan transparan sebagai bentuk tanggung jawab hukum penyedia KPR, sesuai dengan Undang-Undang Perlindungan Konsumen.
