Abstract

Technological developments and digital transformation have had a significant impact on the banking industry sector, triggering the rapid growth of digital banking. This research aims to examine the regulation of digital banking in the era of digital banking transformation by focusing on the comparison between Indonesia and Singapore. This research uses normative juridical research with a statute approach and comparative approach. The results of this research provide in-depth insight into the differences and similarities in regulatory approaches to the level of security, innovation and digital banking penetration between Indonesia and Singapore. The results of this research bring a comprehensive understanding of how the two countries respond to the challenges and opportunities in the era of digital banking transformation which is expected to contribute to the development of digital banking in Indonesia today.

Abstract

Indonesian Migrant Workers refer to any citizen who is currently or has engaged in employment beyond the borders of Indonesia, receiving wages or compensation. The prevalent issue at hand is the rising number of Indonesian Migrant Workers operating illegally, driven by individuals offering unofficial services with enticing proposals to the public. This study employs a normative legal research approach, utilizing secondary data that encompasses primary legal materials such as Law Number 18 of 2017 concerning the Protection of Indonesian Migrant Workers, secondary legal materials including articles, news, and other literature, as well as tertiary legal materials. Indonesia actively takes part in addressing the concerns of Indonesian Migrant Workers by enacting Law Number 18 of 2017 to ensure the fulfillment of their rights and legal protection, including criminal provisions against wrongdoers. Efforts to address this issue involve public awareness campaigns and legal measures against those engaging in criminal activities.

Abstract

This article examines the manifestation of trademarks as collateral to enhance the capacity of Micro, Small, and Medium-sized Enterprises (MSMEs) in Indonesia. The study employs a normative research approach, drawing upon legal sources derived from legislation, relevant legal theories, and concepts. Data is analyzed using a qualitative juridical method and deductive reasoning. The research findings suggest that trademarks should be eligible as collateral since they meet the criteria of intangible movable property that can contribute to the growth and development of SMEs in Indonesia. However, the practical application of trademarks as collateral is hindered by existing regulations and the absence of a specialized intellectual property asset appraisal institution. Such measures are crucial in fostering MSMEs and, ultimately, improving the welfare of the Indonesian society.

Abstract

This research aims to analyze the legal certainty in the protection of intellectual property for Small and Medium-sized Enterprises (SMEs) and to explore the role of higher education institutions in enhancing the effectiveness of intellectual property protection for SMEs. The absence of prior research specifically examining the relationship between these two aspects underscores the novelty of this research within the context of normative law. The research methodology employed is the normative legal research method, relying on the analysis of secondary data involving legal interpretation. The research findings indicate that the intellectual property regulations in Indonesia have provided a fundamental legal certainty for SME actors in their efforts to safeguard creativity and innovation. Higher education institutions, through community engagement activities, play a role in shaping a stronger 'legal culture' to enhance the effectiveness of intellectual property protection for SMEs. Higher education institutions can assist in improving the understanding of SME actors regarding the importance of registration and intellectual property protection.

Abstract

The gig economy has transcended mere trend status, emerging as a resilient force that promotes economies, even in the face of adversities like the COVID-19 pandemic. The gig economy not only impacts employment law but also intersects with regulations governing digital banking. Surprisingly, despite the exponential growth of gig workers in Indonesia, little attention has been given to comprehensively elucidating the legal interplay between employment law and digital banking. Therefore, this research aims to analyze the potential and legal challenges posed by the gig economy's development in the Indonesian economy. This research uses the Global South perspective as the gig economy offers unique challenges to an environment where issues in employment are already a problem. Furthermore, it examines the utilization of digital banking as a mechanism to address the pressing issues faced by gig workers. The potential limitation of this study is the lack of comprehensive data and empirical evidence, which may restrict the depth of analysis and the generalizability of the findings. The rationale of this legal study is to address the lack of comprehensive understanding regarding the legal interplay between employment law and digital banking in the context of the gig economy in Indonesia and bridge the gaps to connect these concepts under the legal context. Employing a normative legal research method with a statutory approach, this study offers a conceptual analysis of these intertwined concepts and their alignment with Indonesia's existing positive laws. The findings reveal significant connections between employment law and digital banking yet highlight the absence of well-defined legal boundaries within Indonesia's legal framework. Consequently, this research catalyses a novel branch of legal development in Indonesia, focusing on the gig economy and its profound implications.Keywords: Digital Banking, Employment Law, Gig Economy.

Abstract

Illegal billboards, which refer to billboards installed without a permit or in violation of applicable regulations, have become a pressing issue in many cities and regions. Its existence can harm the public by disturbing the aesthetics of the urban environment, disrupting traffic safety, and even damaging the natural environment. This research will examine the effectiveness of the Batam City government's policy in overcoming unauthorized advertisements, by considering the perspective of legal effectiveness theory which refers to five main aspects that must be considered, namely in terms of legal factors, law enforcement factors, legal facilities and infrastructure factors, community factors, and cultural factors themselves. This research also uses public policy theory. The method in this research uses empirical research methods with a qualitative approach. The results of this study show that the legal effectiveness of the concept of Batam city government policy against illegal billboards has not been effective, Batam city government policy still has several obstacles including less than optimal sanctions and in terms of law enforcement, there are still many people who are not concerned with the environment. Regarding the solutions applied by the Batam City government in eradicating illegal advertising using the need to make heavier sanctions than just demolition confiscation, for future concepts, the Batam City government plans to realize a new policy concept regarding billboard licensing regulations using an information technology system in the form of a Barcode on each billboard as an effort to tackle illegal billboards in the city of Batam.

Abstract

Fulfilling justice for trafficking victims is not enough to be imprisoned alone but must come to the recovery of the suffering losses of trafficking victims. In Law Number 21 of 2007 concerning the Eradication of Trafficking in Persons, it stipulates the rights that can be given to victims, one of which is the right to restitution that must be given by traffickers as compensation to victims, in this case based on District Court Decision Number: 109 / Pid.Sus / 2022 / PN Tp, the defendant was convicted in accordance with the second alternative charge JPU Article 81 Jo Article 69 of Law of the Republic of Indonesia Number 18 of 2017 concerning the Protection of Migrant Workers as amended by Law of the Republic of Indonesia Number 11 of 2020 concerning Job Creation Jo Article 55 paragraph (1) to – 1 of the Penal Code with a prison sentence of 10 (ten) years and a fine of IDR 1,000,000,000 (one billion rupiah). The method used in this study is normative-empirical legal research by examining actual actions in the form of legal documents (judges' decisions) which are then adjusted to applicable rules and regulations, information collected through online literature searches, books, and related regulations. In this legal research, legal approaches, conceptual approaches, and case approaches will be used, along with specific research needs. In this study, primary and secondary legal materials were used. The legal material analyzed is presented methodically, logically, and reasonably. Based on the findings of the study, it can be concluded that the conviction in the judgment number 109/Pid.Sus/2022/PN Tp by being convicted of legally and convincingly violating the articles contained in the PMI Law, justice for victims is not fulfilled where  the type of crime is a criminal offense that is not included in the provisions of article 2 paragraph (1) letter a of Perma Number 1 of 2022.

Abstract

Kemajuan teknologi mendorong industri keuangan digital terus mengalami perkembangan yang semakin pesat dan salah satunya adalah financial fechnology (fintech). Indonesia belum memiliki regulasi yang spesifik, menjadikan Indonesia masih lemah secara pondasi hukum dalam mewujudkan suatu kemajuan dalam industri keuangan. Penelitian ini bertujuan untuk memahami dan menganalisa kondisi pengaturan fintech khususnya di Indonesia dan Singapura. Metode penelitian yang digunakan adalah hukum normatif dengan menggunakan data yang diperoleh melalui studi kepustakaan. Hasil penelitian ini menunjukan perkembangan industri fintech Indonesia yang tergolong maju, dapat terus dikembangkan dengan menelaah perkembangan industri  fintech yang ada di Singapura. Hukum fintech Indonesia dan Singapura masih bertumpu pada beberapa aturan yang dikeluarkan Otoritas Jasa Keuangan (OJK) di Indonesia dan Monetary Authority of Singapore  (MAS) di Singapura. Inilah yang masih menjadi titik lemah kedua bangsa ini. Peran hukum yang masih terkesan lemah menjadikan suatu celah besar yang harus segera diperbaiki dalam arus perkembangan industri fintech. Industri Fintech yang melibatkan masyarakat secara luas dan mengandung nominal uang yang sangat banyak, perlunya suatu hadirnyahukum yang dapat menjamin perlindungan kepentingan para stakeholders.

Abstract

The entire responsibility for all children in Indonesia lies with the government, and it extends to all children in Indonesia, not only those who are Indonesian nationals but also includes children who are refugees from foreign countries. One of the fundamental rights regulated by the laws and the Convention on the Rights of the Child ratified by Indonesia is the right to receive appropriate education (formal, non-formal, and informal education). This research aims to analyze the implementation of formal education fulfillment for refugee children in Batam City, especially those accommodated at Hotel Kolekta. Therefore, the research questions are as follows: 1) How effective is the fulfillment of the right to formal education for refugee children in Batam City? 2) What challenges do refugee children in Batam City face in obtaining the right to formal education? 3) What are the solutions for the fulfillment of the right to formal education for refugee children in Batam City? This research utilizes the empirical legal research method with a sociological approach, and it is analyzed qualitatively using the Effectiveness of Law Theory by Soerjono Soekanto as an analytical tool. The research findings indicate that the five factors in the theory are not yet effective due to legal factors related to specific technical implementation regulations for the fulfillment of the right to formal education for refugee children being absent. The ineffectiveness of law enforcement is due to the weak coordination among relevant parties, especially the Education Agency of Batam City, UNHCR, IOM, and schools in Batam. The facility factor is also ineffective due to the limited facilities in enhancing the Indonesian language skills of refugee children, resulting in a low interest in attending school and continuing formal education (Community Factor). Different cultures influence the social interaction of refugee children with the community of Batam City (Cultural Factor), causing a slow improvement in Indonesian language proficiency, which is the language of instruction in formal education in Batam City.

Abstract

Maltreatment of children, a persistent issue in Indonesia, including Batam City, often manifests through physical, emotional, or sexual abuse in households, schools, and public spaces. Such crimes cause profound psychological and physical harm, highlighting the urgent need for effective solutions. This study explores the application of restorative justice in handling child maltreatment cases in Batam City, emphasizing its future-oriented accountability, discussion-based negotiation, and healing-focused approach. Employing an empirical legal and social methodology, the research incorporates primary data through in-depth interviews with stakeholders, including prosecutors, police, victims, and relevant agencies, and secondary data from legal documents, books, and scientific publications. Findings reveal that while Batam’s law enforcement supports restorative justice, challenges and differing perspectives persist. This research contributes by proposing restorative justice as a progressive strategy to address child maltreatment, aiming for long-term benefits for victims, perpetrators, and society.
