Abstract

Regulation of sanctions for criminal acts of human trafficking in Indonesia is specifically regulated based on Article 1 number 1 of the Law on the Eradication of Criminal Acts of Trafficking in Persons which defines human trafficking as various acts of surveillance, transportation, harboring, sending, transmitting or receiving a person in various ways for the purpose of exploitation, including sexual exploitation, with laws that cause dilemmas, especially regarding prospective Indonesian workers who are vulnerable to becoming victims of human trafficking. The research method used in this research is normative juridical using a statutory regulation approach and a context approach in answering problems. The results of the research show that the application of sanctions for criminal acts of trafficking in persons as regulated in Article 2 paragraph (1) of the Law on the Eradication of Criminal Acts of Trafficking in Persons against perpetrators who exploit victims, fraud in aggravation, sanctions are also applied to state administrators, corporations and their administrators, groups organized criminal acts of human trafficking. Legal uncertainty in the application of sanctions for criminal acts of human trafficking is a serious problem that can disrupt eradication and law enforcement. This primarily relates to legal provisions governing the crime of trafficking in persons, which is very important for effective law enforcement. This uncertainty is found in two main regulations: the Law on the Eradication of the Crime of Human Trafficking and the Law on the Protection of Indonesian Migrant Workers.

Abstract

This study discusses the policy of Guideline Number 18 of 2021 concerning the settlement of drug abuse cases through rehabilitation with a restorative justice approach as an implementation of the dominus litis principle by the Indonesian Attorney General's Office. The implementation of the drug abuse rehabilitation policy by the Indonesian Attorney General's Office based on the dominus litis principle is regulated in the Attorney General's Guideline Number 18 of 2021. This policy addresses the number of drug convicts that exceed capacity with a restorative justice approach. The dominus litis principle gives prosecutors great authority in controlling the legal process, including the decision to continue or stop prosecution based on sufficient evidence. In addition, this principle allows for the termination of prosecution if the perpetrator's actions are not considered a crime. This policy gives prosecutors the authority to determine legal settlements with rehabilitation, prioritizing the recovery of perpetrators and positive impacts on society. Rehabilitation focuses on changing the behavior of perpetrators through programs that help them overcome drug addiction and improve their social skills. In addition to providing legal protection and the rights of perpetrators, this approach also emphasizes the principle of fast, simple, and low-cost justice, and avoids complicated and expensive legal processes. The principle of restorative justice in this policy aims to improve the negative impacts of drug abuse, by emphasizing the physical, mental, social, and emotional recovery of perpetrators, so that they can return to being productive members of society.

Abstract

The marital rape case is the one sexual violence case based on unequal relations between husband dan wife. In Indonesia, positive law doesn’t differentiate imprisonment or fines between sexual violence perpetrated by another person and sexual violence perpetrated by a partner in marriage. This article was written using feminist legal theory and human rights which describes the position of women in the eyes of the law and the fulfillment of the rights of wives as victims of marital rape. This study uses a juridical-normative method which aims to explain the criminal burden of rape cases based on a human rights perspective. Conclusion in this study is that cases of marital rape that occurred against wives are a form of violation of human rights in which criminal sanctions are needed to distinguish cases of sexual violence committed by other people from cases of sexual violence committed by partners in marriage.Keywords: Criminal Prosecution, Human Rights, Marital Rape.

Abstract

The global COVID-19 pandemic has disrupted the health sector, forcing countries to transform their health. In Indonesia, the response to this crisis was the issuance of a new health law, namely Law No. 17 of 2023. One of the updates is the provision that provides legal protection for medical personnel, namely in the process of criminal investigations against medical personnel, investigators must first request a recommendation from the authorized panel in disciplinary examinations, in this case, referring to the previous law, the Indonesian Medical Discipline Honorary Council (MKDKI). The recommendation determines whether the investigation can be continued or not based on the implementation of the professional practice of medical personnel, whether or not it is in accordance with professional standards, service standards, and standard operating procedures. The request for a recommendation from the panel must be received by the investigator no later than 14 days, and if it is more than that, the panel is considered to have approved the investigation of medical personnel. This is a polemic because for crucial decisions, namely assessing whether or not there is a violation of standards, only 14 days are given, while in reality the examination takes months. Finally, the research is presented to measure the legal certainty of the complaint examination procedure within the MKDKI, the legal certainty of the panel's recommendations regarding the continuation of the investigation process, and to reformulate provisions that are not yet fair in the process.

Abstract

Euthanasia remains a contentious issue in Indonesia, where it is currently prohibited by law, creating significant challenges in balancing human rights, legal standards, and medical ethics. This research explores the legal framework, human rights considerations, and medical perspectives surrounding euthanasia in Indonesia, with a comparative analysis of practices in the Netherlands. Employing a normative legal research methodology, it utilizes legislative analysis, case studies, and comparative approaches to examine the regulatory gaps and societal implications of euthanasia in Indonesia. The findings reveal that while active euthanasia is explicitly criminalized under Indonesian law, passive euthanasia occurs discreetly within society, reflecting a legal and ethical gray area. Comparatively, the Netherlands' regulated approach provides valuable insights into balancing patient autonomy and societal ethics. This study concludes that Indonesia could benefit from legalizing passive euthanasia under stringent conditions, aligned with human rights principles and cultural values. This legalization would require robust regulatory frameworks, including judicial oversight and ethical guidelines, to ensure accountability and safeguard vulnerable groups. The findings underscore the urgency of harmonizing legal, human rights, and medical perspectives to address this complex issue while respecting Indonesia's unique socio-cultural context.

Abstract

ABSTRAK Pertanggungjawaban suatu badan hukum atau korporasi yang beranjak dalam bidang lingkungan dalam pekerjaannya , maka pada hakikatnya patut jelas dalam penelusuran dari segi dokumen AMDAL, izin (lisensi) dan klasifikasi peran pekerjaan pada beberapa jabatan yang termuat pada badan hukum (korporasi) yang berkepentingan maka model penataan bisa diperhatikan adanya sanksi  dengan pendekatan penal, Undang-Undang No 32 Tahun 2009 terkait Perlindungan dan Pengelolaan Lingkungan Hidup telah menyebutkan bahwasannya korporasi terkait serupa salah satu subjek hukum yang bisa dimintai pertanggung jawaban pidana. Permasalahan pada penelitian ini yakni bagaimana korporasi dalam pertanggungjawaban pidana akibat  pencemaran dan/atau perusakan tindakan lingkungan tersebut berlangsung karena terencana atau kelalaian dan solusi menanggulangi tindak pidana yang dijalankan korporasi. Metode Penelitian library research atau studi Pustaka mencakup pengumpulan dokumen hukum guna mendukung analisis dan penyelesaian berbagai isu aktual. Itulah sebabnya, pertanggungjawaban korporasi dalam tindak pidana lingkungan hidup terhadap tanah longsor dalam penambangan pasir di kawasan Pronojiwo  yang dikaji menggunakan mekanisme penal serta bagaimana solusi korporasi dalam pertanggungjawaban atas rusaknya lingkungan.Kata Kunci: Pertanggungjawaban, korporasi,tanah longsor

Abstract

Uncertainty with regard to the proper implementation of Article 44 of the Criminal Code is to be discussed.  In legal practice, the existence of mental disorder in those who are accused of murder or homicide will be made dependent on the decision of psychiatrist (authorized to conduct forensic psychology or psychiatry). In the case that such mental disorder is determined to be existing during a pre-trial hearing, the court is under no obligation to order cessation of the criminal proceeding. It is noted that in a number of cases the decision to terminate investigation or cease court proceeding falls completely under the Judge discretionary power.  The author’s recommendation is that a reformulation of Art. 44 of the Criminal Code is in order.

Abstract

The court does not always demand or require visum et repertum when examining homicide cases.  Forensic autopsy may not be required at all by the criminal court when deciding that the accused is guilty of homicide as charged. The verdict may be reached based on other evidence. The author, using a juridical normative approach, concludes that the absence or presence of a visum et repertum does influence the judge’ consideration and matters to the final verdict. Considering that, regardless of the surviving family’s consent, in cases of unnatural death, forensic autopsy and the making of a visum et repertum should be mandatory.

Abstract

Domestic psychic violence can be experienced by everyone, including children, wives, husbands, and others. As a material offense on domestic psychic violence, the elements resulting from psychological trauma must be proven. Therefore, the intervention of forensic psychologists and forensic psychiatrists is very important in cases of domestic psychic violence. The differences in the competence of psychologists and psychiatrists as well as the prospective roles of both professions in proving cases are the focus of the problems being studied. A normative legal research method with descriptive qualitative data analysis was employed in this research. The results showed that the existence of forensic psychologists and forensic psychiatrists is very important for finding material truths that can be scientifically tested in cases of domestic psychic violence. As evidence for letters and/or expert reports, the assessment results of forensic psychologists and forensic psychiatrists have accurate evidentiary value in forming a judge's conviction. This paper ends with a recommendation that as a form of protection for domestic violence victims, the role of psychologists and/or psychiatrists should be optimized, both in the pre-adjudication, and adjudication phases. In addition, considering the balanced position between psychologists and psychiatrists in law enforcement, this should not create jealousy and unhealthy competition between the two professions.

Abstract

The dynamics of genital reconstruction create disparities in the rights of transsexual individuals to form families and the legitimacy of marriage in Indonesia for transsexual individuals who lack clarity under the Marriage Law. The methodology employed is normative legal research, analyzing applicable regulations and religious perspectives. The discussion encompasses an explanation of the position of transsexual individuals following gender reassignment surgery, which impacts the legitimacy of marriage for transsexual individuals who have undergone genital reconstruction, in accordance with religious law and the Marriage Law, as well as the legal implications of the marriages conducted. The analysis indicates that the six officially recognized religions in Indonesia tend to reject the legitimacy of transsexual marriages, viewing them as same-sex unions that violate religious norms. The legal implications for transsexual individuals vary: for those without medical indications, marriages are considered same-sex; whereas for those who undergo surgery to affirm their gender, marriages may be deemed valid. The conclusion reveals a dissonance between legal frameworks and social norms, as well as challenges faced by transsexual individuals in accessing equal marriage rights.
