Abstract

The revitalization of customary law is an effort to integrate traditional values with modernity in sustainable environmental management. Customary law plays a crucial role in maintaining ecosystem balance and ensuring the sustainability of natural resources through principles rooted in local wisdom. However, exploitative economic development and growth-oriented policies often overlook its significance. This study analyzes the challenges, causes, and solutions in revitalizing customary law to create synergy between tradition and modernity. A qualitative approach is employed through in-depth interviews, field observations, and focus group discussions (FGDs) to assess its effectiveness in environmental conservation. The findings indicate that the revitalization of customary law can enhance the effectiveness of natural resource management, strengthen the rights of Indigenous communities, and mitigate conflicts between economic and environmental interests. Integrating customary law into national and international policies, raising public awareness, and fostering cross-sector collaboration are strategic steps to optimize its role in maintaining ecological and economic balance.

Abstract

The revision of Indonesia’s Mineral and Coal Mining Law (Law Number 3 of 2020) has generated significant debate and resistance, especially from 2019 through the initial phases of the COVID-19 pandemic in 2020. Significant concerns encompass heightened corruption risks, compromised environmental protections, dependence on foreign labor, reduced community rights in mining regions, and challenges to democratic and decentralized governance structures. This study rigorously analyses the legal and practical implications of the law, concentrating on its application within the nickel mining industry. This approach employs a juridical-normative framework, integrating literature reviews and observational methods to evaluate recent legal cases and the effects of policy changes. The findings indicate that although the law is designed to simplify licensing procedures and encourage investment, it also presents issues related to diminished regional autonomy, possible environmental harm, and social disparities. The highlighted issues reveal Indonesia’s dependence on extractive industries, which starkly contrasts the global movement towards sustainable practices. The research underscores the necessity for regulatory reforms that harmonize economic development with environmental sustainability and fair resource management, providing critical insights for policymakers, legal professionals, and industry participants.

Abstract

Arabic is a series of operations and processes train students to familiarize themselves to acquire skills / ability to understand everything that is heard, speaking, reading and writing in Arabic. One of proficiency is the skill to read and understand Arabic texts properly. However, in the practical realm is still encountered some problems and issues in this maharoh learning, students are still difficult to read or pronounce the word / phrase and find its meaning. This is because many students do not recognize and pronounce unfamiliar words based wazan (pronunciation rules) and sighot (type of word based dilalahnya). Of this problem researchers provide an alternative solution by presenting a pattern-based learning Arabic morphological analyzer. The objectives of this study were: 1) describe the procedures / technical-based learning Arabic morphology. 2) measure the effectiveness of pattern-based learning Arabic morphological analyzer in increasing reading competence. This study using a pre experimental design with a form of one-shot case Study. And the results of this study concluded that the pattern of learning is quite effective with indicators: 1) students are familiar and easy to pronounce and utter words corresponding wazan / shighot. 2) student easily to memory on vocabulary acquisition; origin of word and its meaning changes. 3) the students more easily and quickly understand a text with the stock of the results of the acquisition of vocabulary and understanding of the meaning of the vocabulary.Keywords: Learning Arabic, Morphology, Reading skill.

Abstract

In the context of the curriculum in Madrasah (Islamic school), the government has determined the concept, implementation, and evaluation of the curriculum in the Decree of the Minister of Religion (KMA) number 183, 184, and 189. It required to formulate an evaluation instrument in the need of curriculum implementation for the process of curriculum implementation evaluation at the practical level in education units. The purpose of this study was to develop an evaluation instrument of curriculum implementation in the form of a curriculum achievement assessment questionnaire. This study used a Research and Development (R&D) with the ADDIE (Analyze, Design, Development, Implementation, and Evaluation) model. In collecting the data, this study used the Dhelpi technique; consultative discussions with experts as validators in the preparation of instruments which included components, aspects, and indicators. FGD (Forum Group Discussion); with Arabic language teachers were applied to analyze the needs related to the development of an evaluation model for curriculum implementation and to formulate aspects of components and indicators of achievement of the Arabic language curriculum. The results showed that the instrument for evaluating curriculum implementation included the formulation of components, aspects, and indicators in the Context, Input, Process, Product, and Outcomes (CIPPO). The components, aspects, and indicators in the CIPPO model were formulated through the conceptual analysis and the contextualization of KMA number 183, 184, 189 and language performance theory as a benchmark and a standard for assessing the achievement of the Islamic high school Arabic curriculum.

Abstract

Abstrak Pesatnya perkembangan teknologi informasi telah mendorong pertumbuhan e-commerce secara signifikan di Indonesia. Di balik kemudahan akses dan persaingan harga yang ditawarkan, terdapat praktik yang berpotensi merusak tatanan persaingan usaha, salah satunya adalah predatory pricing. Praktik ini dilakukan dengan menetapkan harga sangat rendah bahkan di bawah biaya produksi untuk menyingkirkan pesaing dari pasar, yang pada akhirnya menciptakan dominasi pelaku usaha tertentu dan merugikan konsumen serta pelaku usaha kecil dalam jangka panjang. Meskipun Indonesia telah memiliki dasar hukum melalui Undang-Undang Nomor 5 Tahun 1999, implementasi penegakan hukum terhadap praktik ini masih menghadapi tantangan, terutama dalam konteks digital. Makalah ini bertujuan untuk mengkaji secara yuridis praktik predatory pricing dalam e-commerce sebagai bentuk persaingan usaha tidak sehat, menganalisis dampaknya terhadap pelaku usaha kecil dan konsumen, serta menelaah peran hukum persaingan usaha dalam menanggulangi persoalan tersebut. Kajian ini diharapkan dapat memberikan kontribusi bagi penguatan regulasi dan penegakan hukum di era ekonomi digital.Kata Kunci: predatory pricing, persaingan usaha tidak sehat, e-commerce, hukum persaingan usaha, KPPU.

Abstract

Abstrak Pencabutan hak politik sebagai pidana tambahan merupakan instrumen hukum yang digunakan untuk memberikan efek jera terhadap pelaku tindak pidana yang menyalahgunakan jabatan publik, terutama dalam kasus korupsi. Dalam sistem hukum Indonesia, ketentuan mengenai pencabutan hak politik diatur secara normatif dalam KUHP dan Undang-Undang Pemberantasan Tindak Pidana Korupsi, serta diperkuat oleh Putusan Mahkamah Konstitusi. Meskipun demikian, penerapannya di pengadilan masih bersifat fakultatif dan belum memiliki indikator hukum yang jelas. Penelitian ini menggunakan pendekatan normatif dengan menelaah peraturan perundang-undangan, putusan pengadilan, serta doktrin hukum pidana untuk mengkaji legitimasi, batasan, dan dinamika penerapan pidana tambahan tersebut. Hasil penelitian menunjukkan bahwa pencabutan hak politik merupakan bentuk pembatasan hak asasi manusia yang sah, sepanjang diterapkan secara proporsional dan adil. Oleh karena itu, diperlukan pedoman yudisial yang lebih terstruktur untuk memastikan konsistensi penerapan pidana tambahan ini demi menjaga integritas sistem hukum dan perlindungan hak konstitusional.Kata kunci: pencabutan hak politik, pidana tambahan, tindak pidana korupsi, hak asasi manusia, keadilan. AbstractThe revocation of political rights as an additional criminal sanction is a legal instrument used to deter offenders who abuse public office, particularly in corruption cases. In Indonesia's legal system, the provision for revoking political rights is normatively regulated in the Criminal Code and the Law on the Eradication of Corruption, and is reinforced by the Constitutional Court's decisions. However, its implementation in court remains facultative and lacks clear legal indicators. This study adopts a normative legal approach by examining statutory regulations, court decisions, and criminal law doctrines to analyze the legitimacy, limitations, and practical dynamics of such additional punishment. The findings show that revoking political rights constitutes a legitimate restriction of human rights, provided it is applied proportionally and fairly. Therefore, a more structured judicial guideline is needed to ensure the consistent application of this additional sanction in order to uphold the integrity of the legal system and protect constitutional rights.Keywords: revocation of political rights, additional punishment, corruption, human rights, justice.

Abstract

Language planning policy is essential for language preservation, yet research rarely addresses vernacular or local languages specifically. This study examines how vernacular language planning policies can contribute to the preservation and revitalization of local languages, focusing on the case of Aceh, a province in Indonesia with a rich variety of local languages requiring preservation efforts. The study’s primary goal is to identify an effective framework for vernacular language planning in Aceh that can serve as a practical reference for language policymakers, planners, and researchers in Indonesia and beyond. Utilizing a systematic review method, this research analyzes literature on language vitality, endangerment, revitalization, and planning policy. Key findings reveal a newly developed vernacular language planning framework tailored to the current vitality status of Acehnese languages, offering a suitable model for their preservation and revitalization. This framework has the potential to serve as a foundational tool for efforts to sustain and revive Acehnese and other vernacular languages more broadly.

Abstract

This research aims to determine the causes of violations committed by prisoners in detention centers and what the legal consequences are for prisoners who commit violations in detention centers. This research uses a normative-empirical research type. The results of this research show that the cause of criminal violations in detention is mostly due to overcapacity in the Pinrang class IIB state detention center and also because of feelings of resentment that have not been resolved previously outside detention and when they are reunited, these feelings of resentment reappear which cause emotions towards These prisoners also lack awareness for these prisoners, and as for the legal consequences for prisoners who commit criminal offenses in class IIB Pinrang state detention centers, these prisoners receive different sanctions according to the criminal offenses they have committed, which are categorized into three levels, namely moderate. For light, light, and heavy sentences, the prisoner is given a warning not to commit the same offense and the prisoner makes an oral or written statement not to repeat the act, then the medium sentence is given a sanction where the prisoner is put in a red cell or cell. exile for 6 (six) days and deprived of his rights for a while, such as not having visits from his family finally, this punishment is serious, this punishment is included in serious offenses where the prisoner will be put in solitary confinement for 6 (six) times 2 (two), and have their rights removed, such as not having visits from their family and their remission period could be revoked.

Abstract

A hoax is an attempt to trick or mislead readers or listeners into believing anything when the person who created of the hoax news is aware that the news is false. Hoaxes can be identified in a variety of ways, one of which is to evaluate an argument using linguistics, a discourse analysis. The purpose of this research is to examine the linguistic features of Putri Candrawati hoax news, to investigate the realizations in linguistic features of Putri Candrawati hoax news, and to examine the reason of linguistic features of Putri Candrawati hoax news. The data of this research was taken from Putri Candrawati (PC) statement in TV One’s YouTube Channel. The data were analysed by using Lakoff (2004) Women’s Speech theory, ten linguistic features of women's speech are as follows: hypercorrect grammar, extremely polite forms, emphatic stress, avoidance of harsh swear words, lexical hedges or filler, tag questions, increasing intonation on declarative, empty adjective, exact colour terms, intensifier, and hypercorrect grammar. The findings of this research that there were eight out of ten characteristics of women's speech in the linguistic features of Putri Candrawati hoax news. It was found that the most dominant feature used is intensifier (31 utterances), empty adjectives (28 utterances), lexical hedges or filler (20 utterances), hypercorrect grammar (11 utterances), super polite forms (11 utterances), emphatic stress (5 utterances), avoidance of harsh swear words (4 utterances), tag question (4 utterances).  Two characteristics are absent in the interim, exact colour terms and rising declarative intonation.

Abstract

The determination of village boundaries is a crucial aspect of village governance to ensure legal certainty, administrative order, and the prevention of conflicts between villages. However, in practice, boundary disputes still frequently occur, as experienced by Gampong Meurandeh Dayah, Langsa Lama District, Langsa City, following the regional expansion in 2010. The lack of clear administrative boundaries has led to various issues, including land ownership disputes, difficulties in resource management, and obstacles to public service delivery. This study employs an empirical legal method with a sociological approach. Data were collected through field observations, interviews with village officials, and an analysis of relevant regulations, such as Law No. 6 of 2014 on Villages and Minister of Home Affairs Regulation No. 45 of 2016. The findings indicate that efforts to resolve the dispute have been undertaken, including field inspections and the creation of a territorial map, but these have not yet resulted in final legal certainty. A multi-faceted approach is required, involving administrative measures through boundary remapping, legal measures through binding village regulations, and social measures through mediation and customary deliberation. These steps are expected to resolve the boundary dispute fairly and sustainably.
