Abstract

This article discusses the legal issue of protecting the rights of children who are victims of incest rape after abortion in the law enforcement process. The crimes that occur should be resolved by the criminal justice system. In fact, child victims of incest rape have not received protection at every stage of the examination, from the investigation, prosecution to court decision. The importance of protecting child victims can be seen as a form of protection by the state in the form of administering justice. Apart from the completeness of statutory regulations regarding the protection of child victims, (the Witness and Victim Protection Agency), law enforcement officials, related government agencies and other relevant parties, the function of the judiciary plays an important role. This article aims first, to analyze the regulations regarding forms of protection for victims of incest rape in the criminal justice system. Second, it aims to analyze the enforcement of legal protection for child victims of incest rape in the judicial system. The method used in this article is a normative juridical research type using a statutory approach, conceptual approach and case approach. Analysis of legal materials, namely legal materials and literature that have been collected through systematic methods and then analyzed by inventorying, systematizing and interpreting all legal regulations and concepts according to the problems discussed. Substantially, from a regulatory perspective, a lot has been regulated regarding legal protection for child victims of incest, but in law enforcement it has not been able to provide protection, because the regulations for victim protection are still partially regulated. Studies of court decisions have not been able to accommodate the values of legal efficacy and the value of legal justice in providing legal protection to child victims of incest rape, especially in the criminal justice system. This study is important to carry out so that in the future there will be legal harmonization regarding legal protection for child victims of incest in the future.

Abstract

ABSTRACT The purpose of the study was to know and analyze the accountability of the Deepfake Porn-based Crime with this goal, the problems discussed are: 1) How is the accountability of Deepfake Porn-based AI in laws and regulations? 2) How is the urgency of legal updates against DeepFake Porn AI crime? With the formulation of the problem. The results showed that: 1) Criminal liability against the perpetrators of Deepfake Porn's crime was subject to punishment of Law, and the Pornography Law due to the void of legal norms that regulate the Deepfake Porn based AI 2) Criminal policy updates against Deepfake Porn Crime AI Very Important Porn Given the absence of regulations that regulate this digital problem with specific, effective and efficient recommendations given: 1) Indonesia must start modernize the rules so that they do not miss the development of technology, resulting in emptiness of law. 2) It is important for reformulation of rules regarding Porn Deepfake which there are no regulations yet in order to more optimally provide legal certainty in law enforcement to perpetrators of criminal acts and more effective protection for victims. ABSTRAK Tujuan penelitian adalah mengetahui dan menganalisis pertanggungjawaban tindak pidana deepfake porn berbasis AI. Dengan Tujuan tersebut maka masalah yang dibahas adalah: 1) Bagaimana pertanggungjawaban tindak pidana deepfake porn berbasis AI dalam peraturan perundang-undangan? 2)Bagaimana urgensi pembaruan hukum terhadap tindak pidana deepfake porn AI? Dengan perumusan masalah tersebut maka metode penelitian yang digunakan adalah penelitian yuridis normatif dengan pendekatan perundang-undangan (statue approach), pendekatan konseptual (conceptual approach) dan pendekatan kasus (case approach. Hasil penelitian menunjukan bahwa: 1) Pertanggungjawaban pidana terhadap pelaku tindak pidana deepfake porn terdapat kekaburan norma hukum yang mengatur tentang deepfake porn berbasis AI 2) pembaruan kebijakan pidana terhadap tindak pidana deepfake porn berbasis AI sangat penting mengingat tidak adanya regulasi yang mengatur dengan spesifik. Rekomendasi diberikan: 1) Indonesia harus mulai memodernisasi aturan sehingga tidak ketinggalan dengan perkembangan teknologi, sehingga menghasilkan kekaburan hukum. 2) Penting untuk reformulasi aturan mengenai deepfake porn yang belum ada regulasinya agar lebih optimal memberikan kepastian hukum dalam penegakan hukum kepada pelaku tindak pidana serta perlindungan kepada korban yang lebih efektif.

Abstract

The integration of customary law within the framework of the new Criminal Code (KUHP) places normative pluralism as a strategic issue for national law reform. This article aims to evaluate the extent to which recognition of customary norms is in line with the principles of restorative justice proposed in the new Criminal Code and to identify implementing barriers at the level of legislation, judicial practice, and indigenous communities. The research approach is juridical-normative, combining doctrinal studies, analysis of legislative texts, and reviews of decisions and related policies. The results of the analysis show that although the new Criminal Code framework opens up the possibility of recognizing customary norms through alternative solutions, there is an unclear recognition criteria, procedural inconsistencies, and the risk of subordination of customary norms by state rules. Furthermore, limited institutional capacity and disparities in access to legal representation hinder the realization of participatory restorative justice principles. In conclusion, effective integration requires clear normative differentiations, participatory verification mechanisms, and strengthening the capacity of judicial institutions and indigenous communities. Legal implications include the need for technical amendments and implementation guidelines to ensure harmonization between legal pluralism and restorative justice goals. Practical recommendations include customary verification standards, training of cultural mediators, and independent monitoring mechanisms to assess compliance with restorative justice principles.

Abstract

Abstrak Eksistensi formulasi tindak pidana informasi dan transaksi elektronik di Indonesia yang diatur dalam Undang-Undang Republik Indonesia Nomor 11 Tahun 2008 Tentang Informasi Dan Transaksi Elektronik, Undang-Undang Republik Indonesia Nomor 19 Tahun 2016 Tentang Perubahan Atas Undang-Undang Republik Indonesia Nomor 11 Tahun 2008 Tentang Informasi Dan Transaksi Elektronik, dan Undang-Undang Republik Indonesia Nomor 1 Tahun 2024 Tentang Perubahan Kedua Atas Undang-Undang Republik Indonesia Nomor 11 Tahun 2008 Tentang Informasi Dan Transaksi Elektronik, telah sering dilakukan judicial review kepada Mahkamah Konstitusi. Dominasi pokok perkara judicial review adalah tentang kebebasan berpendapat seperti pasal pencemaran nama baik dan ujaran kebencian. Padahal, kebebasan berpendapat merupakan salah satu hak paling mendasar dalam kehidupan bernegara yang secara konstitusional diakui eksistensinya. Abstract

Upaya pembaharuan hukum pidana terus dilakukan tidak hanya terhadap hukum pidana materil akan tetapi juga terhadap hukum pidana formil, pembaharuan dimaksudkan agar terhadap perkara pidana dapat diselesaiakan secara efektif dan efisien, khusus terhadap pembaharuan hukum pidana formil dalam hal memangkas proses beracara yang lama dan bertele-tele sehingga terjadi penumpukan perkara di pengadilan sehingga diperlukan solusi dalam mengatasi hal tersebut salah satunya dengan menyadur penyelesaian perkara pidana melalui plea bargaining. Untuk itulah peneliti tertarik melakukan penelitian dengan judul prinsip plea bargaining dalam penyelesaian perkara pidana secara cepat, sederhana dan biaya ringan dalam pembaharuan hukum acara pidana. Penelitian ini merupakan penelitian yuridis normatif dengan pendekatan, perundang-undangan, pendekatan konsep dan pendekatan kasus. Selanjutnya dianalisis melalui tahapan interprestasi, penilaian, penelitian, dan evaluasi. Dan terakhir disimpulkan dalam bentuk perskriptif. Dari hasil penelitian diketahui bahwa pada dasarnya prinsip plea bargaining dapat diterapkan di dalam system peradilan Pidana Indonesia hal ini sesuai dengan asas peradilan pidana yang sederhana, cepat dan biaya ringan. Di dalam RKUHAP pengadopsian plea bargaining pengakuan bersalah melalui jalus khusus yang dilaksanakan secara terbatas.

Abstract

Penggunaan metode pembelajaran yang sesuai menjadi salah satu faktor tercapainya tujuan pembelajaran. Salah satu metode yang dapat digunakan untuk meningkatkan keterampilan proses sains siswa yaitu metode praktikum. Keterampilan proses sains dibutuhkan untuk memperoleh, mengembangkan serta menerapkan konsep, hukum dan prinsip yang ada pada sains. Metode praktikum mendorong siswa untuk memahami materi bukan hanya pada teori tetapi juga meningkatkan kemampuan proses, kemampuan menganalisis, serta kemampuan siswa dalam menyimpulkan. Jenis penelitian ini adalah penelitian eksperimen dengan desain penelitian one group pretes-posttest. Berdasarkan hasil observasi didapatkan presentase keterampilan proses sains siswa pada setiap indikator, yaitu mengamati 51,56%, mengklasifikasi 45,31%, mengkomunikasikan 43,75%, menarik kesimpulan 48,44%, dan memprediksi 45,31%. Pada saat menggunakan metode praktikum terdapat peningkatan keterampilan proses sains yaitu mengamati 64,06%, mengklasifikasi 59,38%, melakukan percobaan 73,44%, mengkomunikasikan 54,69%, menarik kesimpulan 53,13%, dan memprediksi 60,94%. Metode praktikum terbukti mampu meningkatkan hasil belajar siswa yaitu dengan perolehan N-gain 0,31 .

Abstract

Juvenile delinquency is a problem. Children who receive insufficient attention tend to commit criminal acts, ranging from theft to serious violence, which harm both themselves and society. Indonesia’s juvenile justice system emphasizes protection and rehabilitation, particularly for children under 14 who can only be subjected to non-penal measures, while children aged 14–17 undergo diversion processes and juvenile court proceedings. Nevertheless, serious crimes create tension between child protection and the demands for justice for victims. Sentencing of children must consider age, the severity of the offense, and ethical legal principles, including preventive, retributive, and reformative objectives. This study employs normative legal research using statutory and case approaches to analyze the implications of a child’s age on the type and form of sanctions. The results highlight that age significantly influences sanction application, ensuring justice while encouraging children to improve themselves and develop optimally.

Abstract

Corruption in Indonesia has transformed into an extraordinary crime that systemically destroys the state's economic structure. Despite a high rate of law enforcement actions, the level of asset recovery remains very low compared to the total state financial losses incurred. This research aims to analyze the urgency of updating the legal framework regarding asset confiscation in corruption cases in Indonesia. The method used is normative juridical research with statutory and conceptual approaches. The findings indicate that the current asset confiscation regulation, which relies on the Criminal Procedure Code (KUHAP), focuses solely on evidentiary purposes (corpus delicti) and requires an in personam claim, making it inadequate for the optimal recovery of state losses. Furthermore, there is a disharmony of norms between the KUHAP, the Anti-Corruption Law, and bankruptcy law, which frequently hinders the asset execution process. Therefore, legal reformulation through the adoption of the Non-Conviction Based (NCB) Asset Forfeiture principle is an absolute necessity. This concept allows for asset confiscation without waiting for a criminal conviction against the perpetrator and is proven to be in line with international standards such as UNCAC and FATF. This research concludes that the enactment of the Asset Confiscation Bill is highly urgent and must be accompanied by institutional legal harmonization and mechanisms to protect the civil rights of good-faith third parties.

Abstract

Corruption is an extraordinary crime that causes significant losses to the state, both materially and immaterially, which has a broad impact on the economic, social and political stability of a country. As the main victim in corruption crimes, the state bears the burden of recovering the losses incurred. The concept of bargaining for punishment offers an alternative approach in corruption law enforcement by allowing the perpetrator to reduce the sentence through the return of state losses. This research aims to analyze the application of the concept of bargaining for punishment in the context of Indonesian criminal law, especially in realizing justice and benefits for the state as a victim. The method used is Normative Juridical legal research, this research discusses the relevance of bargaining for punishment in bridging the interests of the state for the recovery of losses with the principles of criminal justice. The results show that the application of this concept can accelerate the case settlement process, reduce the burden on the justice system, and maximize the return of lost state assets. However, the application of bargaining for punishment must be closely monitored so as not to harm the principle of justice, especially in dealing with perpetrators with a significant level of guilt. Bargaining for punishment has the potential to become a strategic mechanism in eradicating corruption in Indonesia, provided that it is applied proportionally by considering aspects of justice, expediency, and legal certainty. This research recommends strengthening regulations and guidelines for the implementation of bargaining for punishment to ensure optimal recovery for the state as victims of corruption crimes

Abstract

The development of information technology has provided new challenges in the fight against corruption, especially in terms of technology-based crimes that are difficult to detect. This research aims to analyze the application of the concept of bargaining for punishment in handling digital corruption cases and evaluate the challenges and benefits arising from its application. The method used in this research is a literature study and analysis of applicable legal concepts in the context of technology-based crimes. The results show that the application of this mechanism can accelerate the process of disclosing corruption cases involving technology, by offering incentives to reduce sentences to defendants who are willing to cooperate. However, the application of this concept also faces a number of challenges, such as the potential for abuse of the justice system, the complexity of obtaining valid evidence, and the need for regulatory updates and capacity building of law enforcement agencies. Overall, while bargaining for punishment offers great potential to accelerate the disclosure and recovery of state losses, its success relies heavily on the integrity of the legal system and strict oversight.
