Abstract

Indonesia modern civil law development lasted to align with community life progress. In 1998 made bankruptcy laws reform of colonial legacy, which was revised in 2004 by Law No. 37. Additionally, the bankruptcy law instruments sourced on the Civil Code and some other provisions. After the court decision on bankruptcy declaration, bankruptcy process was arrangement and distribution of wealth the debtor’s bankrupt (boedel bankruptcy) by curator. So far, the difficulty legal curator instrument cared and settled bankruptcy estate. The prioritization of splitting on the preference and separatist creditor. This research was classified as a normative legal research. Basically, the research based on secondary data. The research conclusion, first, completion of settlement the boedel bankruptcy arranged which reflected in a series of activities that sequence according to the stages and institutionally involve the creditor committee, curator, and the supervisory judge; second, the principles of justice that could be applied in determining the division of boedel bankruptcy to creditors, particularly the preferred and separatist creditors, namely the principle of pari passu and pro rata, the principle of balance, the principle of proportional, and the principles of fairness; third, instruments of Indonesia bankruptcy law consists of elements of civil law (Civil Code), bankruptcy law and suspension of debt payments (Act No. 37 of 2004), a variety of laws and regulations under the law, occasionally based on the policy elements. Abstract

Feature of corporation as activities-oriented for profit can lead to potential violations law or corporate crime. The criminal action corporations can arised because the impact of corporate activities arising from business contracts, product quality problems, failure of information technology systems and negligence of the administrative requirements for business licensing compliance. In other words, the legal entity of crime was often referred as corporate crime as violations committed by businesses to profit more quickly and maintains the company's reputation. The study concluded, first, the political dimension of the criminal law on corporation has general nature, that political criminal law founded in Criminal Code Bill which are oriented to the development of law by placing the corporation as a criminal, and need a codification law of Corporation. Second, The political criminal law also has special nature, which is found in 16 laws examined, in the contexts of criminal responsibility concepts and application of pattern of criminalas well as models of criminal sanctions can be imposed on perpetrators of criminal acts of the corporation.Keywords: Corporate crime of law politics, legal standing, subject crime of law.

Abstract

The basic problems judgments simple, fast and low cost also upon the Supreme Court, where various rules, whether in the form of the Supreme Court rules or circular Letter of the Supreme Court was issued in order to accelerate the examination process until the escaping minutasi decision so that the person can immediately determine further steps, including by utilizing technology to speed up the process. But until this time, in the jurisdiction of the criminal justice not mistakes to make small summary court and not teradopsi in total on the basis of restorative justice. Although there is a process of checking with the event quickly in KUHAP only against criminal acts of light and the matter in a traffic accident (laka necessarily) and adopted the basis of restorative justice on the legislation that are custom without connecting with KUHAP. The basis of the judiciary is simple, fast and low cost in the jurisdiction of the practice of the law appears in the form of a distorted, where often a suspects/Defendants start since the jurisdiction of the pre-adjudikasi offered not to use mentoring from the power of the Law with the reasons will be changed the article will tangled by so that the requirement will be more lightly.

This situation, economists call an oligopoly. An oligopoly has few sellers, with interdependent pricing decisions among the larger firms iin the industry (Nafziger, 1997). Abstract

This study explores the dynamic of early-age marriage and implementing social protection concepts for households’ women victims in Gorontalo. This research uses qualitative method with explorative-inductive approaches. We were collected data by interviews, observation, and documentation. Resulting studies that early-age marriage cases in Gorontalo effected by low education, patriarchy system, domestic violence, divorced, and multi-dimensional poverty. For that, this study recommended that social control be worked fine, where the role of parent’, education, and community—create a social safety net for getting better—this role of parents and educational institutions in implementing the protection concept as a social policy reformulation material.Studi ini mengeksplorasi dinamika pernikahan dini dan skema perlindungan sosial yang tepat bagi perempuan korban kekerasan dalam ruamh tangga di Gorontalo. Penelitian ini menggunakan metode kualitatif dengan pendekatan eksploratif-induktif. Data dikumpulkan dengan wawancara, observasi, dan dokumentasi. Hasil studi menunjukkan bahwa kasus pernikahan dini di Gorontalo disebabkan oleh rendahnya tingkat pendidikan, budaya patriarkhi, kekerasan dalam rumah tangga, perceraian, dan kemiskinan multidimensi. Untuk itu, studi ini merekomendasikan agar kontrol sosial dapat berfungsi dengan baik—peran orang tua, sekolah, dan komunitas—agar social safety net berjalan dengan baik. Peran ini tercermin dalam konsep perlindungan sebagai bahan untuk reformulasi kebijakan sosial.

Abstract

The GMS allows owners residing abroad to join via teleconference with other shareholders. In accordance with Article 76 jo 77 of the Company Law, the GMS may be conducted in person or via electronic media. The most crucial aspect of the GMS is that all participants can see, hear, and participate directly. Nevertheless, the authenticity of a notarial act must be preserved. The notion of Cyber Notary continues to violate Article 1 point 7 and Article 16 paragraph (1) letter m of the UUJN. This study employs normative legal research in an effort to gather the pertinent information regarding the issue. The data should be utilized in conjunction with secondary and tertiary items. In addition, primary data is utilized to support secondary data-based legal documents. Using the method of normative legal analysis, the data were analyzed. The results of the study indicate that the GMS held via video conference can be considered an authentic deed if it applies the legal principle of lex specialis derogate lex generalis, where lex the general is Article 16 paragraph (1) letter m of the Notary Position Act and lex the specialist is Article 77 paragraph (1) in conjunction with the Explanation of Article 77 paragraph (4) of the Limited Liability Company Law.Keywords: GMS; Cyber Notary; Teleconferencing AbstrakPara pemegang saham yang berada diluar negeri dapat mengikuti RUPS menggunakan media telekonferensi dengan pemegang saham lainnya. RUPS menurut Pasal 76 jo 77 UUPT dapat dilakukan secara tatap muka ataupun melalui media elektronik. Hal terpenting bahwa semua peserta RUPS dapat melihat, mendengar, dan berpartisipasi secara langsung dalam RUPS. Namun demikian, sifat autentik dari suatu akta Notaris tetap harus dijaga. Konsep Cyber Notary masih bertentangan dengan Pasal 1 angka 7 UUJN dan Pasal 16 ayat (1) huruf m. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif yang dilakukan sebagai upaya untuk mendapatkan data yang diperlukan sehubungan dengan permasalahan. Data yang akan digunakan dengan data sekunder dan bahan tertier. Disamping itu juga digunakan data primer sebagai pendukung bahan hukum data sekunder. Untuk analisis data dilakukan dengan metode analisis yuridis normatif. Dari hasil penelitian dapat diperoleh bahwa RUPS yaang dilaksanakan melalui video konferensi dapat disebut sebagai akta autentik jika menggunakan asas perundang-undangan lex specialis derogate lex generalis dimana yang menjadi lex generalis adalah Pasal 16 ayat (1) huruf m Undang-Undang Jabatan Notaris, sedangkan lex specialis-nya adalah Pasal 77 ayat (1) jo Penjelasan Pasal 77 ayat (4) Undang-Undang Perseroan Terbatas.Kata Kunci: RUPS; Cyber Notary; Telekonferensi

Abstract

The legal bond between employees and the self-employed begins with the making of a good activity agreement made by recording or by means of words. The contract which is charged with rights and roles thereafter in its application often arises problems, which if there is no one-on-one interpretation or no misunderstanding and if it cannot be resolved the conclusions may end in apparent clashes between the parties. Clashes or clashes can also be established in the labor environment where it relates to parties who are said to be workers and self-employed. Indeed, clashes or clashes between workers and self-employed people do not need to be worried because clashes can have positive consequences for the parties participating if the clashes are not based on enthusiastic violence. If the clashes are based on violence, they will bring about loss and conflict. So far, clashes between workers and the self-employed have often been resolved in insurgent ways such as violent protests, arson, strikes and industrial closures. The clashes should be resolved in harmony and profitability. Sourced from Article 86 of Law Number. 13 of 2003 concerning Manpower says: a. Every worker or employee has the right to get protection for: 1) Security and Health Activities; 2) Morals and Decency; and 3) Treatment that matches the degree and degree of people and religious values. b. To prevent the safety of workers or employees to create maximum productivity of activities organized by security and health activities. c. Protection is also defined in Paragraph (1) and (2) is carried out in accordance with legal laws and regulations.

Abstract

Konvensi Apostille digunakan untuk melakukan penghapusan terhadap syarat legalisasi pada dokumen publik untuk memfasilitasi penggunaan dokumen publik di luar negeri. Indonesia telah menjadi Negara Pihak (State party) pada Konvensi Apostille tersebut, maka setiap negara dapat mempersingkat proses legalisasi tanpa perlu melibatkan kanal diplomatik, melainkan langsung melalui Otoritas Kompeten masing-masing Negara Pihak. Pada saat ini proses legalisasi di Indonesia, yang membutuhkan legalisasi dokumen publik untuk digunakan di negara lain membutuhkan pengesahan oleh kantor publik lokal atau Notaris, maka diperlukan legalisasi lain dari Kemenkumham. Setelah, dokumen yang telah disahkan oleh Kemenkumham, setempat, kemudian akan dilegalisasi lagi oleh Kementerian Luar Negeri Negara masing-masing. Selanjutnya, sebelum dokumen yang akan digunakan di Negara tujuan, dokumen perlu dilegalisasi ulang oleh Kedutaan Besar atau Konsulat Jenderal masing-masing ke negara yang akan dituju. Dalam penelitian ini penulis menggunakan metode kualitatif, dengan jenis penelitian yuridis normative. Adapun yang menjadi masalah dalam penelitian ini adalah mengenai 1) Bagaimana Urgensi Indonesia dalam Mengaksesi Legalisasi Dokumen Publik berdasarkan Konvensi Apostille? 2) Bagaimana Peran dan Tanggung Jawab Notaris dalam Proses Legalisasi Dokumen berdasarkan Konvensi Apostille di Indonesia?. hasil dari penelitian ini adalah penulis ingin menjelaskan mengenai bahwa notaris memiliki peran dan tanggungjawab terhadap proses legalisasi dokumen ini dan tentu saja hal-hal seperti ini sangat penting dan sudah di atur dalam undang-undang dan aturan-aturan yang berlaku di Indonesia.

Abstract

Real estate and housing remain persistent issues for many neighborhoods. There are still issues with the application of law in the realm of land ownership, and these issues frequently lead to disputes and conflicts. This study is a form of normative, doctrinal, or dogmatic legal inquiry. The study found that the buyer/consumer who has paid in full and made a deed of sale and purchase at the PPAT needs to look at the legal repercussions of the developer's failure to solve the certificate from two different angles: the developer's and the court's. While waiting for the certificate split process carried out by the curator as the responsible developer for the developer who has been declared bankrupt, and for consumers who have not yet completed payment on the house purchased from the developer, and only have PPJB, buyers can apply for a name transfer process at the land office. The consumer or buyer of the house whose solution has not been taken care of by the developer who is declared bankrupt can apply as a concurrent creditor so that the curator takes care of it and receives full compensation from the developer as represented by the curator or continues to manage the house. the homebuyer's or consumer's best interests. Since the house has not yet been completely paid off, the consumer/buyer of the house must also fulfill their commitments to pay off the remaining mortgage installments. Additional unfulfilled commitments include finishing the down payment on the developer-purchased home.

Abstract

This study investigates the existence of a court-appointed board that serves as a liquidator. When the liquidator conducts the process of settling assets, problems occur if the Foundation's management is unwilling to work with the liquidator. The approach employed in this study is normative legal research, which is conducted in an effort to acquire the pertinent information regarding the issue. The qualitative juridical analysis method is utilized for data analysis. On the basis of Article 63 of the Foundation Law, the results of the study were obtained on the existence of the Management in the process of settling the assets of the Foundation by the liquidator. If the Foundation is dissolved because its time period and objectives have been met or not met, the Trustees appoint a liquidator; if the Trustees do not appoint a liquidator, the management acts as a liquidator; and if the Foundation is dissolved because of a court order, the court also appoints a liquidator. The court-appointed liquidator is authorized to dispose of the Foundation's assets. The nomination of the Management as Liquidator is inappropriate due to the fact that the liquidator is essentially a former member of the Foundation's management, which might cause conflict and impede the process of settling the Foundation's assets.
