Abstract

The dynamic development of an area significantly impacts people's living patterns, particularly regarding settlement issues. One major issue in settlement development is the livability of the settlement. This research aims to identify the distribution of settlement livability levels based on waste management conditions and fire protection systems. The study was conducted in Kelurahan Dalam Bugis, East Pontianak District, Pontianak City. A mixed methods approach was used in this research. Spatial quantitative data were analyzed and presented using Geographic Information Systems, while qualitative data were presented through data reduction, documentation, observation, and field interviews. The results showed that 16.4% of settlements are categorized as light slums (livable), 0.7% as moderate slums (quite livable), and 82.9% as severe slums (not livable). Livable settlements cover an area of 32.54 hectares (1,706 housing units). Moderately livable settlements cover an area of 1.33 hectares (97 housing units). Uninhabitable settlements cover an area of 159.13 hectares (2,290 housing units). Mitigation of critical health and safety aspects, such as fire hazards, requires increasing public awareness of waste management and providing adequate waste processing and fire-fighting facilities to prevent unwanted events.

Abstract

The development of social media has become part of everyday life, making it easier for individuals to express opinions, share information, and interact more widely and quickly. However, this convenience also creates legal challenges, one of which is the increase in defamation cases in the digital realm. Defamation on social media is a criminal offense that can harm individuals and institutions, but proving it is not easy. This research aims to analyze the legal aspects related to proof in the criminal act of defamation on social media. The research method used is normative research with data collection through literature study. The collected data is then analyzed with the stages of data filtering, data presentation, and conclusion drawing. The results show that evidence in the crime of defamation on social media refers to Article 27 paragraph (3) of the ITE Law as well as Articles 310 and 311 of the Criminal Code, with evidence regulated in Article 184 of the Criminal Procedure Code, including witness testimony, experts, letters, instructions, and testimony of the defendant. Digital forensics has an important role in ensuring the validity of electronic evidence, such as recorded conversations, screenshots, or metadata, to reveal the perpetrator's digital footprint and ensure data integrity. In addition, prosecutors must prove the element of intent (mens rea) to ensure that the posts were intended to defame and not merely criticize or a legitimate form of freedom of speech.

Abstract

Theft in Indonesia is one of the most frequently occurring criminal offenses, with varying degrees of loss, ranging from minor to significant. However, not all theft cases must be resolved through formal judicial proceedings. Certain criminal acts, including theft, can be settled through restorative justice mechanisms—a humanistic approach to achieving justice. Nevertheless, in practice, the application of restorative justice in theft cases still faces various obstacles that hinder its ideal implementation. This study employs a qualitative method with a literature review to analyze the application of restorative justice in resolving theft offenses. The research aims to examine the effectiveness of restorative justice in theft cases and formulate recommendations to strengthen its implementation. Findings indicate that although restorative justice has been recognized in several legal policies, its application remains suboptimal. Clearer and more comprehensive regulations, training for law enforcement officials, and increased public awareness of the benefits of this approach are necessary. Abstract

Sexual violence is a serious issue with widespread impacts on victims, affecting them physically, psychologically, and socially. The enactment of Law Number 12 of 2022 concerning Sexual Violence Crimes is a significant step in providing legal protection for victims of sexual violence in Indonesia. This research employs a normative juridical method by examining relevant legislation and academic literature to analyze the implementation of the Sexual Violence Crimes Law in fulfilling the rights of victims. The objective of this study is to identify the extent to which the implementation of the Sexual Violence Crimes Law is effective in protecting victims of sexual violence and addressing existing challenges. The findings indicate that although the Sexual Violence Crimes Law provides a strong legal foundation, its implementation still faces significant obstacles such as a lack of understanding among law enforcement officials, limited supporting infrastructure, and negative societal stigma towards victims. Therefore, a collaborative effort from all parties is necessary to comprehensively maximize the fulfillment of victims' rights. Keywords: Sexual Violence Crimes Law, Victims, Sexual Violence

Abstract

Recently the demands of additional building functions have varied. These demands tend to affect structure stability because of the effects of additional mass. For example, Harvard Dormitory Thursina International Islamic Boarding School, located in Dau region, Malang city, East Java, Indonesia, a 11 x 8 m2 swimming pool is relocated on 4th floor. A big mass of pool certainly performs bigger lateral force due to seismic behaviour of structure itself. To reduce that, the IIS method is installed on the 3rd floor as it has damper effect along X and Y axis that is provided by LRB spring systems. IIS is widely used mainly in Japanese high-rise structures such as Shiodome Sumitomo building and Umeda Tower. To analyse the IIS modified structure, it is performed pushover analysis as controlled deformation is stated 18 in at rooftop. The results showed that 465 kN shear force and 160 mm story drift occurred on the 3rd floor which is the largest value compared to other stories. It is also obtained 230 mm lateral deflection of rooftop as the first plastic hinges are formed.

Abstract

Jembatan Kali Lekso, yang terletak di Jalan Raya Jatitengah, Kec. Selopuro, Kab.

Abstract

In this case, the facts in the trial are oriented towards a legal analysis of the Panel of Judges' decision in case No. 12/Pid.Sus/2022/PN Sbr, namely from the application of the article, the differences in witnesses presented, the elements of the crime, the aggravating and mitigating elements, the evidence presented, and the aspect of the sentencing. Considerations affect the injunction/dictum. The legal analysis is seen in the application of the article which deviates from the provisions of the principle of lex specialis derogat legi generali in this case the Public Prosecutor uses general rules in the application of the article and deviates from the Special Rules of Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, in this case the judge uses the Relative Theory which emphasizes the benefits of punishment for the future of the perpetrator. The sentence is not imposed quia peccatum est (because a person commits a crime) but rather ne peccaetur (so that a person does not commit a crime). In other words, the Panel of Judges in considering this decision emphasizes the child's future, so the decision is made which is most beneficial for the child.
