Abstract

The rapid development of insurtech as a digital innovation in the insurance sector has increased efficiency while simultaneously raising the risk of personal data breaches involving policyholders. This study aims to examine the legal certainty and civil liability of insurtech providers in cases of personal data breaches under Law Number 27 of 2022 on Personal Data Protection (UU PDP) and POJK No. 36 of 2024. The research applies a normative legal method using a statute approach, supported by primary legal materials in the form of legislation and secondary materials from scholarly literature. The findings indicate that insurtech providers, as personal data controllers, bear comprehensive responsibilities, including mandatory breach notification within 72 hours, implementation of mitigation and recovery measures, and compensation for material and immaterial losses. While POJK No. 36/2024 emphasizes preventive mechanisms through risk management and governance, the UU PDP provides a more comprehensive framework by incorporating administrative and criminal sanctions. However, gaps remain regarding effective remedial mechanisms and regulatory coordination. Strengthening these aspects is essential to ensure legal certainty, enhance accountability, and protect consumer rights in the digital insurance ecosystem.

Abstract

The inconsistency in judicial reasoning regarding trademark disputes in Indonesia, particularly in determining similarity and bad faith, raises concerns about legal certainty and protection. This study aims to critically analyze the ratio decidendi of the Supreme Court Cassation Decision Number 161 K/Pdt.Sus-HKI/2023 and examine its implications for trademark law enforcement. The research employs a normative juridical method using statute, conceptual, and case approaches, with qualitative analysis of legal materials and judicial considerations. The findings indicate that the judges primarily relied on formal parameters, such as similarity in essence and indications of bad faith, while insufficiently addressing substantive aspects, including consumer protection and the broader objectives of trademark law. Furthermore, the interpretation of well-known trademark criteria and evidentiary standards appears inconsistent, potentially leading to divergent applications in future cases. This decision strengthens legal protection for trademark owners but also highlights the need for more coherent and comprehensive judicial reasoning. Therefore, improving interpretative guidelines and strengthening analytical approaches in judicial decision-making are essential to ensure greater legal certainty, fairness, and effectiveness in trademark law enforcement in Indonesia.

Abstract

This study examines the normative inconsistency in regulating business actors’ liability under Law No. 8 of 1999 on Consumer Protection, particularly in relation to the application of strict liability. The main problem arises from the coexistence of different liability regimes, namely strict liability, fault-based liability, and presumption of liability, without clear conceptual boundaries. This situation creates legal uncertainty and weakens the position of consumers. The research aims to analyze this inconsistency and propose a conceptual reconstruction to achieve legal coherence. This study applies a normative juridical method with statutory, conceptual, and analytical approaches, focusing on Articles 19(1), 19(5), and 28 of the law. The findings show that the overlap of liability models leads to ambiguity in interpretation and inconsistent law enforcement, which enables business actors to avoid responsibility. This condition is not in line with the principles of legal certainty and justice within the welfare state framework. Therefore, clearer differentiation of liability regimes is required through legislative clarification or judicial guidelines so that strict liability can function effectively in protecting consumers and ensuring fair business practices.

Abstract

Penelitian ini bertujuan untuk menganalisis kedudukan hukum perempuan dalam memperoleh hak waris atas rumah tinggal menurut hukum adat Bajawa di Bajawa, Kabupaten Ngada, Nusa Tenggara Timur, serta mengidentifikasi faktor-faktor yang memengaruhi dan membatasi hak waris tersebut. Penelitian ini menggunakan metode yuridis empiris dengan pendekatan fakta dan pendekatan sejarah. Data primer diperoleh melalui wawancara dengan tokoh adat (mosalaki), tokoh agama, kepala desa, serta perempuan yang pernah menerima warisan rumah tinggal. Data sekunder diperoleh melalui studi kepustakaan terhadap peraturan perundang-undangan dan literatur yang relevan. Hasil penelitian menunjukkan bahwa masyarakat adat Bajawa menganut sistem kekerabatan matrilineal yang menempatkan perempuan, khususnya anak perempuan pertama, sebagai penerus utama rumah tinggal keluarga. Perempuan memiliki hak genealogis atas rumah adat, sementara laki-laki berperan dalam pengelolaan dan perlindungan rumah adat tersebut. Namun demikian, hak tersebut tidak bersifat mutlak karena dipengaruhi oleh faktor sosial seperti sistem stratifikasi sosial (rang), perkawinan endogami, pengakuan keluarga, serta legitimasi adat. Selain itu, terdapat perbedaan pandangan mengenai kedudukan anak di luar kawin dalam pewarisan rumah tinggal. Secara keseluruhan, hukum adat Bajawa memberikan legitimasi sosial yang kuat terhadap hak perempuan atas rumah tinggal, meskipun belum memiliki kepastian hukum formal karena tidak dikodifikasi secara tertulis.

Abstract

The formulation of customary law norms for marriage and inheritance needs to be constructed through Awig-Awig (customary law) formulation to ensure legal certainty in strengthening Balinese customary law. The Awig-Awig formulation is a form of codification of Balinese customary law, which regulates traditional village members and their various activities, Parhyangan (temple) as a forum for village members to connect with Ida Sang Hyang Widi Wasa (God Almighty) and at the same time as a means of preserving Balinese culture, Palemahan (land) as a manifestation of the territory and at the same time as an area that becomes the foundation of the source of life and a foothold in living life until death in a harmonious relationship. In the development of the life of village members, which are always in process, it is necessary to confirm the arrangement through Awig-Awig formulation, such as in the field of membership of village members with their rights and obligations, marriage, inheritance with the intention of being enforced consistently and dynamically according to appropriate values ​​in a society that is always developing.

Abstract

Law enforcement is done to restore the balance between the rights and obligations of the people, in realizing order and security for the members of the community.In a state of law, the rule of law must be manifestly realized, so that when there is a violation of law then the law must be enforced. The decline in the authority of the law is not solely due to the weakness of law enforcement, but there are many factors that cause the dissolution of public confidence in the existence of positive law in Indonesia, among others from the aspects of society itself, legal aspects, both material law and formal law and law enforcement aspects. Law enforcers must be able to portray their respective roles in upholding the law, justice and truth according to the sense of community justice. Through this enforcement, the law is actually implemented so that it can add the image and legal authority and can build public trust on the quality of positive law of Indonesia.

Abstract

Adoption in general is an act of taking someone else's child based on legal provisions that apply to the community concerned. Based on the determination number: 597/Pdt.P/2020/PN Dps and number: 924/Pdt.P/2019/PN Jkt Sel. It is known that there are adoptive parents who already have two biological children, this of course is not in accordance with Government Regulation Number 54 ofx2007 concerning the Implementation of Adoption. The problem in this research is that the cause of adoption is not in accordance with Government Regulation No. 54 ofx2007 and adoption from the perspective of Human Rights. The theory used in the analysis is the theory of justice, distributive justice, which is the balance between what a person gets and what he deserves. This type of research used in this paper is a type ofxnormative legal approach. The cause ofxado ption in this case is because the biological parents cannot fulfill the child's rights, so that the adoption of the child is carried out so that the fulfillment of the child's rights is fulfilled by the adoptive parents. Children's rights have a relationship with human rights and are regulated by the state.Therefore, there needs to be good cooperation between the government and the community through outreach, counseling and assistance activities in order to increase understanding of the requirements, procedures and fulfillment of children's rights in the implementation of adoption. The implementation of adoption explains that one of the requirements for prospective adoptive parents is not having children or only having one child, However, in its implementation, there was a judge's decision that allowed prospective adoptive parents who had biological children before adopting a child. So, There needs to be an update or amendment to the regulations regarding the requirements for adoption, which should prioritize the fulfillment of children's rights.

Abstract

In the current era of digitalization, where information technology continues to develop, accompanied by the competitive demands of the technology-based business world, new business ideas are being seen which are seen as great opportunities by business people. One of the businesses that is currently very popular is the online entrustment service business for purchasing concert tickets via Instagram. The purpose of this research is to determine and analyze the legal responsibility of online entrustment service entrepreneurs who default on consumers due to unclear concert ticket information and related forms of legal protection for consumers for unclear information by online entrustment service entrepreneurs in purchasing concert tickets via Instagram. The research method used is normative juridical using legal materials obtained from primary, secondary and tertiary legal materials. The existence of a breach of contract regarding unclear concert ticket information carried out by online entrustment service entrepreneurs on Instagram means that jastip entrepreneurs who violate the agreement can be held responsible for compensating consumers for losses with sanctions as regulated in the relevant regulations. Therefore, this creates the creation of consumers' rights to obtain legal protection, both preventively and repressively, where in order to realize this legal protection it is also necessary to have joint synergy between the government, society, institutions and related parties.

Abstract

Regional autonomy is the right, authority, and obligation of autonomous regions to regulate and manage their own Government Affairs and the interests of the local community in the Unitary State of the Republic of Indonesia (NKRI) system. The type of research used is normative or doctrinal law, through qualitative descriptive legal analysis. Results and discussion of the implementation of public policy on health services based on Law No. 23 of 2014 concerning Regional Government, namely health services are part of concurrent government affairs because health services are the authority of the Regional Government based on the principle of decentralization, so the regional government has the right to manage all forms of health service provisions, as regulated in Article 12 paragraph (1) which states that government affairs must provide basic services, one of which is in terms of health. The Bali Provincial Government is developing services in terms of traditional health by issuing Governor Regulation No. 55 of 2019 concerning Traditional Balinese Health Services. The Central Government and Regional Government are required to coordinate, especially in making regulations so that they have a socially just impact on all Indonesian people, especially in the field of health services that must reach remote villages. Health service efforts are carried out in a promotive, preventive, curative and rehabilitative manner carried out by the government.

Abstract

Businesses build trademarks to promote products or services while maintaining their reputation and competitiveness. However, the practice of using well-known brands without the license owner's permission is still found. The case of counterfeiting the Arc'teryx brand by PT ATX Asia Sport Products demonstrates a violation of the exclusive rights of the brand owner. This study aims to analyze law enforcement against the circulation of counterfeit Arc'teryx products in Bali based on Law Number 20 of 2016 concerning Trademarks and Geographical Indications and review the role of the TRIPs Agreement in protecting brands in Indonesia. The method used is normative with a literature review of laws, books, journals, and literature related to unauthorized trademark infringement. The results show that the use of the Arc'teryx brand without official permission confirms the weak supervision and law enforcement of foreign brands that have not been registered in Indonesia. Although the first-to-file system applies, Indonesia still provides legal protection for foreign brands through its membership in the Paris Convention and the TRIPs Agreement. This study emphasizes the need to strengthen the role of the Directorate General of Intellectual Property Rights (DJKI), the Commercial Court, and increase public legal awareness to prevent trademark infringement and create legal certainty for rights owners and consumers.
