Abstract

Yulita Ariska Siregar* Edy Yunara** Rafiqoh Lubis***   Depertemen Hukum Pidana, Fakultas Hukum Universitas Sumatera Utara   Abstrak Kejahatan menjadi sorotan dikalangan pemerintahdan masyarakat. Masalah kejahatan bukan saja dilakukan oleh orang dewasa, tetapi anak-anak sudah banyak yang melakukan tindak pidana. Kejahatan ini terjadi akibat perkembangan pembangunan yang sangat cepat, mulai dari teknologi, informasi, komunikasi serta perubahan gaya hidup akibat masuknya berbagai budaya asing. Data Pusat Kajian dan Perlindungan Anak (PKPA) Sumut, Misran Lubis mengatakan berdasarkan advokasi dan pemantauan selama 2017 tercatat 295 kasus kejahatan anak yang mana terdapat 25 kasus pembunuhan anak. Penerapan sanksi yang diberikan oleh hakim harus mengacu pada UU No. 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak. Permasalahan skripsi yakni: bagaimana penyertaan melakukan tindak pidana di Indonesia, bagaimana sanksi yang dapat dijatuhkan terhadap anak yang melakukan tindak pidana menurut hukum pidana di Indonesia, serta bagaimana penjatuhan sanksi pidana terhadap anak yang turut serta melakukan pembunuhan dikaitkan dengan perlindungan terhadap anak dalam Putusan PN No. 5/Pid.Sus-Anak/2017/PN Psp dan Putusan PN No. 6/Pid.Sus-Anak/2017/PN Psp. Metode penelitian yang digunakan adalah metode penelitan hukum normatif, penelitian terhadapperaturanperundang-undangan, putusan pengadilan dan berbagai literatur yang berkaitan dengan permasalahan skripsi ini. Berdasarkan permasalahan diatas dapat disimpulkan bahwa penyertaan (deelneming) dalam hukum pidana di Indonesia terbagi menjadi dua yaitu  pembuat dan pembantu. Pembuat diatur dalam Pasal 55 KUHP yaitu plegen (mereka yang melakukan), doen plegen (mereka yang menyuruh melakukan)   medeplegen(mereka yang turut serta melakukan), uitlokken (mereka yang  menganjurkan). Sedangkan pembantu diatur di dalam Pasal 56 KUHP yaitu pembantuan pada saat kejahatan dilakukan dan pembantuan sebelum kejahatan dilakukan. Sanksi yang dijatuhkan kepada anak harus berdasarkan Pasal 71 UU No. 11Tahun 2012 tentang Sistem Peradilan Pidana Anak. Abstract

ABSTRAK Prima Sakti Sidabutar* Edi Yunara** Rafiqoh Lubis*** Di dalam suatu rumah tangga, yang menjadi korban kekerasan dominannya adalah perempuan sebagai istri. Hal ini disebabkan karena masyarakat menganggap bahwa posisi perempuan berada dibawah laki-laki. Salah satu kekerasan yang tidak dapat dilihat secara kasat mata sehingga sulit untuk mebuktikannya adalah kekerasan psikis yang dapat diketahui oleh seseorang yang mempunyai keahlian khusus mengenai kondisi kejiwaan seseorang. Permasalahan yang diangkat dalam skripsi ini adalah bagaimana pengaturan kekerasan psikis dalam rumah tangga menurut Undang-Undang Nomor 23 Tahun 2004 tentang Penghapusan Kekerasan Dalam Rumah Tangga, kedudukan keterangan ahli dalam pembuktian menurut hukum acara pidana di Indonesia, dan peranan keterangan ahli kedokteran jiwa terhadap kekerasan psikis dalam rumah tangga dalam  putusan pengadilan. Penelitian skripsi ini merupakan penelitian hukum normatif yaitu pengumpulan data sekunder dengan penelitian kepustakaan. Hasil penelitian dianalisis secara kualitatif  yaitu dengan mengumpulkan, mempelajari, dan memahami data yang akan menghasilkan data deskriptif analitis. Dengan adanya Undang-Undang Nomor 23 Tahun 2004, kekerasan psikis merupakan salah satu bentuk kekerasan yang diatur dalam Pasal 5 huruf b dan dijelaskan dalam Pasal 7 serta ketentuan pidana bagi pelaku  diatur dalam Pasal 45   Undang-Undang Nomor 23 Tahun 2004 tentang Penghapusan Kekerasan Dalam Rumah Tangga. Keterangan Ahli merupakan salah satu alat bukti yang sah dalam Hukum Acara Pidana. Kedudukan keterangan ahli dalam pembuktian berupa  keterangan dipersidangan sesuai Pasal 186 KUHAP maupun keterangan secara tertulis sesuai Pasal 187 huruf c KUHAP. Pada putusan Nomor: 1920/Pid.Sus/2015/PN.Mdn, Nomor: 3680/Pid.Sus/2016/PN. Abstract

ABSTRACT Tioneni Sigiro* Edy Yunara** Wessy Trisna***     This thesis entitled "The implementation of the accusatory principle by the police in the investigation of crime in Polres Dairi". The principle of the accusator is a rule or norm that contains provisions that must be exercised by law enforcement officers in the case of treating suspects in their positions as human beings having dignity and dignity. A suspect must be sealed in every examination as a subject and not as an object of examination. This thesis discusses how the position of the accusator principle in the process of investigation at the police level, how the implementation of the field, and obstacles and obstacles for investigators in applying the principle. The research method used to answer these problems is empirical research method, using the approach of legislation and sociological approach. The results show that basically the application of the accusatory principle has not been fully implemented. There is an element of violence perpetrated by the police as the investigator of the suspect and there are still violations of the rights of the suspect in the examination process. Some of the obstacles encountered by the investigators in applying the accusatory principle on the investigation of the suspects are the non-professional investigators who are unprofessional in their duties, giving rise to acts contrary to the accusatory principle. In the investigation of the suspect, the investigating investigator also often finds it difficult to get information from the suspect because the suspect is silent, suddenly ill, or convoluted in giving his testimony to the investigator and not cooperating. Thus this becomes the trigger of the birth of attitudes or actions of the investigators themselves to be harsh and repressive. On the other hand, the presence of investigator supervisors is often not in accordance with the objectives that should be because of the assumptions and habits as colleagues, then the function of supervision is not going well and properly. Abstract

  ABSTRAKSI     Bintang David R.Manurung* EdiWarman** Edi Yunara***   Begal merupakan suatu tindak pidana yang berkaitan dengan perlindungan hukum terhadap barang dan harta benda seharusnya menjadi perhatian khusus dari para aparat penegak hukum, tidak hanya bagaimana mengatasi dan menanggulangi tindak pidana begal. Tetapi hal yang sama pentingnya adalah mengetahui apa yang menjadi faktor terjadinya korban tindak pidana begal serta bagaimana peranan korban dalam mempermudah terjadinya tindak pidana tersebut. Inilah yang menjadi bahan pembahasan dalam skripsi ini. Bagaimana aturan hukum begal menurut hukum pidana Indonesia, bagaimana faktor terjadinya korban tindak pidana begal, bagaimana peranan korban, dan bagaimana perlindungan hukum terkait korban tindak pidana begal serta upaya dan hambatan penanggulangan adanya korban tindak pidana Begal di kota Medan.   Metode penelitian dalam skripsi ini adalah metode penelitian hukum normatif, yaitu dengan melakukan penelitian kepustakaan yakni penelitian yang dilakukan dengan meneliti bahan-bahan kepustakaan, khususnya perundang-undangan dan kepustakaan hukum yang berkaitan dengan permasalahan. Sumber data yang digunakan dalam skripsi ini berupa bahan hukum primer dan ataupun bahan hukum sekunder yang ada hubungannya dengan permasalahan yang dibahas dalam skripsi ini. Kemudian dalam menganalisis dilakukan secara kualitatif, yaitu apa yang diperoleh dari penelitian di lapangan dipelajari secara utuh dan menyeluruh (komprehensif)..   istilah begal dalam Hukum Pidana di Indonesia adalah tindak pidana pencurian dengan kekerasan yang di atur dalam pasal 365 KUHP. Faktor-faktor yang menyebabkan terjadinya korban tindak pidana begal di kota Medan adalah faktorinternal: mental, keyakinan, pendidikan; dan faktor eksternal: ekonomi, pergaulan, narkoba. Peranan korban dalam terjadinya tindak pidana begal adalah perilaku lalai;dan sering keluar malam tanpa pengawasan. Adapun perlindungan hukum terhadap korban tindak pidana begal adalah korban berhak untuk memperoleh keadilan dan perlakuan yang adil; berhak atas restitusi, kompensasi; dan bantuan. Upaya yang dilakukan Kepolisian Resort Kota Besar Medan dalam menanggulangi adanya korban tindak pidana begal di Kota Medan terdiri dari upaya preemtif; upaya preventif; dan upaya represif. Abstract

This study aims to analyze the position of advocates in carrying out their duties and obligations as part of law enforcement in Indonesia, and to examine the factors that cause advocates to hinder legal actions in investigating corruption crimes carried out by KPK investigators. As well as to examine criminal liability for the actions of advocates that hinder the investigation, prosecution and trial of perpetrators of corruption. This research is a normative legal research. With the nature of descriptive analytical research. This research was conducted using library research and qualitative data analysis. This study also uses interview guidelines as a data collection tool. This study resulted that the SN corruption crime committed by FY advocates in the Central Jakarta District Court Decision No. 09/Pidsus-TPK/2018 in the investigation process carried out by the KPK investigators was hampered, so that the investigation time could be extended and could delay the legal process. The prosecution and trial of the criminal act of corruption is an effort by FY advocates to save suspect SN from the snares of legal prosecution by the Public Prosecutor Criminal responsibility for the actions of lawyers who hinder the investigation, prosecution and trial of perpetrators of criminal acts of corruption is that the act is against the law of Article 21 of Law No. 20 of 2001 concerning amendments to Law No. 31 of 1999 concerning the Eradication of Criminal Acts of Corruption

Abstract

This thesis is motivated by the principle of the rule of law which guarantees human rights to form the concept of pre-trial. Pre-trial in principle aims to carry out horizontal oversight of all acts of forced effort by law enforcers in the interests of criminal cases so that these actions do not conflict with legal and statutory regulations in addition to internal supervision within the apparatus itself. La Nyalla's pre-trial request as a suspect who fled or are in the status of a list of people search (DPO) status was learned that even though he was a DPO, La Nyalla won a pre-trial lawsuit which was stated through Court Decision Number: 19 / Pra.Per / 2016 / PN.Sby. After the pre-trial decision filed by the DPO suspect, the Supreme Court issued a Circular of the Supreme Court (SEMA) No. 1 of 2018 on March 23, 2018, discusses the prohibition on pre-trial submissions for suspects who have fled or are on the status of a search list (DPO). But the rules of SEMA No. 1 of 2018 seems to be deviated from the granting of pre-trial requests from suspects with DPO status through Court Decision Number 23 / Pid.Pra / 2018 / PN Pbr and Court Decision No.8 / Pid.Pra / 2018 / PN. Plw. Determination of DPO is a consequence of suspects who do not attend to the investigator's summons as stated in Article 112 paragraph (2) of the Criminal Procedure Code after proper calling is carried out in accordance with procedural rules. If viewed from Article 79 of the Criminal Procedure Code which regulates the submission of pre-trial, there is a limitation of the right of the suspect to file a pre-trial application for the suspect himself. The problem in this study is how are the pre-trial arrangements in the Criminal Procedure Code and the Criminal Procedure Code? how is the position of SEMA No. 1 of 2018 in legislation? How is the position of the suspect who is a DPO in filing a pre-trial application? This study uses theory. The method used in this study is a normative legal research and  descriptive analytical. This study uses secondary data sources. This secondary data uses 3 (three) sources of data, namely primary legal material, secondary legal material, tertiary legal material. This data collection method is obtained from the library research. Data collection tool is done by studying documents. Analysis using the qualitative method then emphasizes the deductive method. The results of this study indicate that the KUHAP and RKUHAP through the commissioners' judges have given the suspect and the related parties the right to make horizontal supervision efforts on the actions of the investigator. SEMA is not authorized to prohibit citizens' rights. The position of SEMA No.1 Year 2018 is part of the legislation which is the nature of policy rules by binding to Supreme Court agencies as regulators Court Decision Number 23 / Pid.Pra / 2018 / PN Pbr and Decision No.8 / Pid.Pra / 2018 / PN. Plw became a breakthrough for pre-trial single judges in providing justice to suspects with DPO status for filing pre-trial

Abstract

Amid the government efforts to eradicate corruption each year that was formulated in the acceleration corruption eradication program, government and law enforcement agencies were defiant. On one side, the people still believe and wish for the better effort and work hard in progressing the criminal corruption act, bring the cases to the court, and prosecute the perpetrator such crimes based on the Laws so the perpetrator could generate a deterring effect. On the other side, there are a lot of people who assume the law enforcement agencies performance in eradicating corruption are slow and not appropriate within public expectations. Even a little of accusation and mocking deliver to law enforcement agencies that have been working as maximum as possible in revealing to corruption act with several kinds of problems which affect the law process obstacles.The Attorney, one of the law enforcement agencies based on chapter 2 article 1 Law Number 16 of 2004 on Attorney of The Republic of Indonesia that mentioned “The Attorney of The Republic of Indonesia which next in Laws called Attorney is the government agency that performs state powers in enforcing and other authorities based on the Laws,” have legitimation in attempt to accelerating corruption eradication.The formulation of problems in the research was referred to the Article 25 Law Number 31 of 1999 concerning Eradication of Criminal Act of Corruption that was mentioned: “The indictment, prosecution, and interrogation within a court session of a corrupt act shall be conducted on the basis of the existing criminal law procedures unless otherwise stipulated.” The regulation was clearly to prioritize attempting corruption act had to finish immediately in acceleration and punctuality. Looking at the fact, they are not as easy as to imagine many scholars. The settlement of corruption cases act is challenging with several factors, juridical and non-juridical, thus the need for effective ways to combating problems that referred to existing the Laws.

Abstract

Criminalism emphasizes preventive functions aimed at preventing the community from committing a crime. The idea of a criminal proportionality was more related to the objectives of criminal plots by the judge who was contained in his decision, as the defendant had to be sentenced to be convicted with his actions. One example of occurs in cases of perpetrators who circulated narcotics contained in Decision No. 669 / PID.SUS / 2018 / PN.BTM. Based on the background description, the problems studied, namely: how to arrange criminal plotting law against criminal acts, how the philosophy of criminal plotting against the perpetrators of criminal circulation of narcotics, and how to apply the principle of proportionality of criminal law in criminal aride against narcotics circulation perpetrators in the decision no . 669 / PID.SUS / 2018 / PN.BTM. The research method used in this study is a type of normative legal research, which is supported by primary and secondary data sources, and qualitative analysis is carried out. The results of the study, namely the regulation of criminal plotting law on the perpetrators of the crime in Article 54 of the Criminal Code Bill said that in the possession must be considered a form of error of the perpetrators, motives and the purpose of committing a criminal act, and / or the value of law and justice that lived in society. The philosophy of criminal plotting against the perpetrators of criminal circulation of narcotics as a judge in deciding a case must have consideration according to the principle of justice. Application of Proportional Propheorality of Criminal Law in Decision No. 669 / PID.SUS / 2018 / PN.BTM that it is still less proportional between criminalizations with the actions he has done, because the actions taken by the perpetrators are not due to the basis of intention and the intention arranged, but the act of the perpetrators only as people who happen to be invited without knowing what he will do

Abstract

Indonesia is a state based on law, all aspects of life within the territory of the Unitary State of the Republic of Indonesia must be based on the law and all laws in force in the territory of the Unitary State of the Republic of Indonesia. In the process of law enforcement for the protection of protected animals, a provision is needed to regulate it beforehand, rather than the act occurring in accordance with the provisions of Article 1 Paragraph (1) of the Criminal Code, to expect legal certainty for the perpetrators of criminal acts, in particular criminal acts of conservation of living natural resources ecosystem. If in the process of law enforcement, there is a change in a criminal act that regulates sanctions against the criminal act, then the most beneficial law enforcement must be carried out for the perpetrator. So that law enforcers in the process of investigating and prosecuting criminal acts of conservation of living natural resources and ecosystems are expected to have a balance between the preservation of protected animals and the laws and regulations that are still in force prohibiting these acts

Abstract

The purpose of law in general to bring about or create harmony in society is clearly a noble goal as the implementation of the correctional system which is imbued with the spirit of protection which became the forerunner to the formation of a distinctive Indonesian strafrechtstheorien. We want a criminal theory that is built in addition to paying attention to developments in the international/global order, the growth of legislation (top down) but also maintaining legal values that live and are maintained in people's lives. Withdrawal of a complaint is a process in which one of the litigants wants to settle/resolve the problem in good faith because he feels that the case has been resolved by means of a family mechanism. This often happens, especially in cases of a complaint offense, the regulation on the revocation of complaints has been regulated in the provisions of Article 75 of the Criminal Code regarding the period of revocation of complaints within 3 months. In practice, there are several cases that have expired/expired in withdrawing a complaint, it is allowed to be revoked by the panel of judges. It is interesting why, because on the one hand, de jure revocation of complaints over time cannot be withdrawn and must be carried out by law, on the other hand the judge as a mouthpiece of justice overrides this provision with the consideration that "the balance is disturbed if peace and harmony are hindered by regulations". The approach method in this research is the statutory approach, the case approach, and the conceptual approach. By researching primary, secondary, and tertiary legal materials. the technique used is by means of library research. The results of the study explain that the regulation regarding the revocation of complaints that have expired has no provisions that regulate it, only limited to the revocation of complaints with a period of 3 months, namely in Article 75 of the Criminal Code. And the current legal developments, especially the judiciary, there are things that are becoming increasingly legal breakthroughs through the jurisprudence of the Supreme Court no. 1600 K/Pid/2009 which decides may withdraw the complaint even though the time has passed/expired. Of course, this must be considered in order to form rules that specifically regulate the expiration of a complaint revocation process
