Abstract

Two large digital platform companies, Gojek and Tokopedia, officially merged to form a holding company called the GoTo Group that is considered to have anti-competitive behavior and potentially data monopoly. This article aimed to analyze the adequate response to potential violations of the Prohibition of Monopolistic Practices and Unfair Business Competition Regulation and legal issues related to consumer data monopoly issues. This article uses normative legal research with the conceptual research and statute approach. The result shows that it is necessary to define “relevant markets” and the “substituted products” to determine the existence of unfair business competition in the Gojek-Tokopedia merger. It requires analyzing the consumer behavior in other marketplaces other than Tokopedia; when consumers do not "run" to Gojek, it means they are not in the same market. To prevent privacy protection failures in post-merger data integration, companies need to assess data sharing that may be carried out as part of a risk assessment. Regarding the rights of data subjects, The company needs to provide notification to the data subject regarding the Merger and Acquisition (M & A) given the data subject's right to refuse and guarantee that the M & A process will not violate the right to privacy of the customer's dataKeywords: Competition Law; Digital Platform; Merger Menilai Penggabungan Perusahaan Platform Online: Apakah Mengakibatkan Monopoli atau Hanya Ekspansi Bisnis? Mengenai hak subjek data, Perusahaan perlu memberikan pemberitahuan kepada subjek data mengenai Merger dan Akuisisi (M&A) mengingat hak subjek data untuk menolak dan menjamin bahwa proses M&A tidak akan melanggar hak privasi data pelangganKata Kunci: Hukum Persaingan Usaha; Platform Digital; PenggabunganОценка слияний компаний онлайн-платформ: приведет ли это к монополии или просто к расширению бизнеса?

Abstract

This article intended to examine academic freedom in Indonesia, especially in the last decade (2014-2022). As a country that upholds human rights and Islamic values, academic freedom in Indonesia is in chaos, especially on hifz al-nafs and hifz al-‘aql fulfillment. Many forms of thought expression and criticism conveyed by scholars to the government in academic forums are responded to with various terror, threats, and criminalization on the grounds of state stability. Scholars who are critical of government policies fall victim to criminalization, go to prison, and are dismissed from college due to being considered to violate college ethics. The many cases of academic freedom infringement indicate a severe problem where the thought of scientists in an academic forum is being ‘undermined

Abstract

Globalization has a bad impact on the indigenous peoples in Southeast Asia countries. The demands of globalization have led the governments in Southeast Asia countries to exploit and industrialize indigenous regions excessively, resulting in marginalized indigenous peoples and the threat of extinction. Not intended for the benefit and welfare of indigenous peoples, the policy made by the government in several Southeast Asia countries did much to reduce the value of humanity and the rights of indigenous peoples. Even with rapid industrialization in Southeast Asia countries, many indigenous peoples are poor, left far behind, and illiterate due to isolation from the outside world. This paper aims to analyze the legal protection of indigenous people in Southeast Asia, especially in facing digital age. By normative juridical method, this paper found that the government and developers' exploitation of indigenous peoples in the region has always been laden with conflicts between the government, the developers (economic motive), and indigenous peoples, and such conflicts of interest are usually won by the interests of the government and/or developers. Indigenous peoples' right to sue for damages caused is sometimes hampered with difficulty simply because the government holds powerful and dominant standing in courts. Moreover, most countries in the Southeast Asia region does not have customary courts in their judicial institution.

Abstract

For more than five decades (since 1972), the world has increasingly directed its attention toward sustainable development, one of which encompasses the domain of green tourism. Indonesia and China stand as two nations committed to the Sustainable Development Goals and green tourism. Nevertheless, it remains uncertain whether the legal framework on green tourism in both countries has achieved comprehensiveness and the extent of its implementation's effectiveness. This article aims to explore the regulations on green tourism in Indonesia and China, along with their respective impacts. Drawing on a statute approach, this article argues that Indonesia has established multiple levels of regulations concerning green tourism as a part of its commitment to sustainable development and China. In practice, both Indonesia and China have implemented these regulations, leading to discernible positive effects on societal welfare. However, conventional regulatory overlap persists in Indonesia, and the implementation appears less than optimal. In another context, China adopts a streamlined regulatory framework and appears to have achieved greater effectiveness in the implementation of green tourism.

Abstract

This study aims to analyze the influence of TAP MPR in Indonesia. Placement of MPR Provisions in Law No. 12 of 2011 on the hierarchy of Legislation in Indonesia becomes one of the problematics that needs to be discussed, on the grounds of the position of MPR provisions that are under exactly the Constitution of 1945. This is based on the position of the MPR Decree itself which will automatically become a reference to the rules under it, in accordance with the theory of stairs put forward by Hans Kelsen. Although from the point of view of the position of MPR determination is still understandable if Hans Nawiasky theory is used as the basis. But in terms of testing itself of course this will raise a big question mark for all of us because in the Constitution of 1945 institutions or institutions that have the right to conduct a test of the Law is the Constitutional Court and the Supreme Court, but within its own scope the Provision of MPR is outside the juridical territory of the two Institutions themselves. Therefore, there needs to be a solution if at any time the MPR Decree is not in accordance with the basis of the 1945 Constitution so that there will be no defects in one of the legal sources of the State of Indonesia.

Abstract

This article aims to examine the phenomenon of cooperation among Southeast Asian countries in dealing with the case of maritime security and counter-terrorism. The study uses the legal approach covering both international law and Islamic law perspectives. The finding of this article reveals that the implementation of the ASEAN Convention on Counter-Terrorism (ACCT) plays a crucial role in combating terrorism in the context of maritime security. Furthermore, relevant ASEAN member state authorities need follow-up support to enhance cooperation. The supports are important to counter, prevent, and suppress terrorism, terrorist organizations, associations, and networks' plans of the act. Yet, the implementation of ASEAN cooperation has faced the challenging reality of the paradox of maritime sovereignty among states in the region. The problem is likely encouraged by the factor of the internal political dynamics within each state involving the instrumentalization of the issue of national security. Instead of remaining as the problem on the surface, the conceptual initiation of the cooperation forged by religious doctrine such as ta'awun may be considered.

Abstract

In a democratic rule of law like Indonesia, delegated legislation emerges as a necessity. Unfortunately, Article 8, paragraph (1) of Law Number 12 of 2011 concerning the Establishment of Laws and Regulations, in conjunction with Law Number 13 of 2022 concerning the Second Amendment to Law Number 12 of 2011, fails to articulate a clear hierarchy of delegated regulations. Employing a juridical-normative research approach encompassing statutory, historical, and conceptual dimensions, this study sheds light on the prevailing legal vacuum. The research reveals that a staggering 24,052 regulations at the level of Ministries, Agencies, and State Institutions run the risk of overlapping and becoming subject to judicial review in the Supreme Court. The definition of Delegated Legislations in Indonesia, as interpreted herein, is confined to regulations whose legal construction is executed by the executive, as long as formal legal norms continue to confer the authority of delegation in the legislative domain to implement superior regulations. This paper identifies three distinct models governing the structuring of Delegated Legislations within the hierarchy of laws and regulations in Indonesia. These models include the Hierarchical model based on the legal foundation of institution formation, the Hierarchical model based on the position of the institution, and the Hierarchical model based on the source of delegated authority in forming rules. This nuanced exploration seeks to address the complexities surrounding delegated legislation, aiming to provide clarity and coherence within the Indonesian legal framework.

Abstract

Abstract— This paper analyzes the application of norms concerning supply chain of business competition in commission for business competition decisions. The case study in this paper is in the case of supply chain of business competition conducted by PT Forisa Nusapersada in Case Decision Number 14/ KPPU-L/2015. As a comparison, this study also compares the application of SCM in cases that are almost similar, namely the Decision of the Case KPPU Number 14/KPPU-L / 2015 with the Decision of the Case KPPU Number: 06 / KPPU-L / 2004. Differentiation strategy and agile supply chain strategy had a significant impact on the firm performance under the low uncertainty. In conclusion, the companies are supposed to use environmental uncertainty as a determinant of the perceptions in setting their strategies.
