Abstract

Uang elektronik muncul sebagai instrumen pembayaran mikro (micro payment) mampu melakukan proses pembayaran secara lebih cepat, mudah, efisien, dan aman. Walaupun mempunyai banyak kemanfaatan dan keunggulan, kesesuaian uang elektronik dengan maqashid syariah masih perlu didiskusikan. Kesesuaian dengan maqashid syariah sangat penting untuk menentukan apakah uang elektronik tersebut telah sesuai dengan syariat Islam atau tidak. Metode yang digunakan dalam penelitian ini adalah metode kualitatif dengan jenis penelitian kepustakaan. Dari hasil penelitian diperoleh secara umum uang elektronik telah sesuai dengan maqashid syariah. Kesesuaian ini didapat dengan terpenuhinya prinsip memelihara harta dan kemaslahatan. Akan tetapi, uang elektronik unregistered dinilai belum sesuai dengan maqashid syariah karena uang elektronik ini tidak dilengkapi dengan PIN sehingga masih menimbulkan kemudharatan apabila kartu ini dicuri atau hilang. Oleh karena itu, penggunaan uang elektronik yang tidak dilengkapi PIN seperti uang elektronik unregistered sebaiknya dihindari karena bertentangan dengan maqashid syariah.

Abstract

Abstract Pesantren as the oldest religious education institution in Indonesia, not only takes part in the field of education but also has a role in improving and empowering the economy through various business units. Several studies mention that pesantren can also influence the economy and empowerment of the surrounding community, contributing to the alleviation of poverty in the community, thanks to the social capital provided by kiaiKiyai and pesantren administrators. However, the wide distribution of pesantren in Indonesia shows that areas with many pesantren have the highest poverty rates. This research focuses on the role of the social and spiritual capital of the pesantren community, especially on employees of pesantren workers, either teachers or other employees. This research uses descriptive qualitative methods and purposive sampling in data collection. The respondents were selected according to the criteria, namely workers or employees in Islamic boarding school. The results of this study indicate that the social capital and spiritual capital of pesantren do not directly affect community empowerment, but employee performance can mediate and influence community empowerment through the performance of employees who work in pesantren. So it is necessary to further study the influence of social and spiritual capital on community empowerment.

Abstract

Work ethic is crucial to the growth of human life. Related to the problem of waste, humans must be able to position themselves with waste around it. As a result, this study will discuss a relationship between one's Islamic work ethic and the form of a Waste Bank in the surrounding area, in order to improve the community's Islamic work ethic. The study is a survey research with a quantitative descriptive approach with primary data obtained from questionnaires distributed to Waste Bank customers. Researchers want to know the influence of the Waste Bank on improving Islamic work ethic of Madiun community. The analysis results show that the value of t-count is greater than the value of t-table (11,788> 1,97612) between the variables Waste Bank (X) and Islamic Work Ethic (Y), indicating that H0 was rejected and Ha was accepted. Thus there is an influence on the existence of a waste bank to increase the Islamic work ethic of the Madiun community. While the amount of influence is 48.4% and 51.6% is influenced by other variables outside the research.

Abstract

This article starts from misunderstanding of some Muslims in reasoning maqashid al-syari'ah. Some of them argue that maqashid al-syari'ah is only what appears of the text to nash, so they reason the nash textually. As a result, Islamic law becomes rigid and it is easy to blame you. Some of them reasoned too much about maqashid al-syari'ah, thus canceling the text of the nash. As a result, he was brave enough to deconstruct a permanent Islamic law. Therefore, this article will examine maqashid al-syari'ah with a fair and moderate study (wasathiyah) that is not as extreme as textual or contextual reasoning. Through a library research study with a descriptive analysis approach, it was found that wasathiyah reasoning in maqashid al-syari'ah reasoning is to distinguish between worship and muamalat matters in terms of the intentions behind them; seek maqashid al-shari'ah before determining the law; and has the principle that the shari'a which is built on the qath'i argument will not conflict with benefit and common sense.

Abstract

Abstract Waqf has become one of the instruments in Islamic economics that has special specifications and is different from other types of philanthropy. Waqf has the characteristic of eternity, which means that if certain assets have been donated, it will not change until the end of the world. However, with the development of the era, a new form of waqf has emerged in the form of cash or cash waqf which is still a debate among scholars about its permissibility. This article aims to analyze the permissibility of cash waqf according to the maqashid sharia review. By using a literature review of writings explaining cash waqf and maqashid sharia, it can be concluded that cash waqf is considered permissible because it has many very important benefits for the country's economy, as a means of transferring the wealth of the rich to entrepreneurs and citizens in financing various religious, social, and educational programs in Islamic countries. Keywords: waqf, cash waqf, maqashid syariah.

Abstract

This study aims to analyze the use of fiqh rules in Islamic economic fatwas issued by the National Sharia Council-Majelis Ulama Indonesia (DSN-MUI). The research method used is library research by using 152 DSN-MUI fatwas as primary data sources. The results showed that of the 152 fatwas studied, there were 4 fatwas (3%) that did not use fiqh rules, while 148 fatwas (97%) used fiqh rules in varying amounts between 1-8 rules per fatwa. The most frequently used fiqh rules are the rules "basically, all forms of muamalah may be carried out unless there is evidence that prohibits it", followed by the rules "dar'ul mafasid muqaddam 'ala jalbi al-mashalih", "ad-dharar yuzal", "al-hajatu tunzalu manzilata adh-dhururah", and "al-'adatu muhakkamah". This study concludes that fiqh rules are the main reference in the preparation of Islamic economic fatwas by DSN-MUI, which shows the urgency of fiqh rules in formulating laws related to contemporary Islamic economic issues.

Abstract

In the 20th century, technological developments experienced very significant growth and brought winds of change to human life in all aspects, such as culture, law, education or economic aspects. The emergence of the digitalization of money is a form of technological development in this era. Electric Money or what is usually shortened to e-money is a trend in terms of buying and selling transactions. As Muslims, we are obliged to carry out all our work in accordance with the provisions that Allah SWT has determined. As for what Allah SWT has determined, it has a sharia maqashid that its servants must know. In carrying out e-money transactions, it is necessary to know the sharia maqashid contained therein. This research aims to find out more about how e-money is from a sharia maqashid perspective. This research uses the qualitative literature study method. The results of this research are that in e-money there is an element of benefit that is a sharia maqashid that can meet human needs, namely hifdzul maal. There are several negative impacts in e-money that need to be avoided in order to maintain the value of maal hifdzul, such as device duplication, theft and malfunction.

Abstract

The purpose of this study is to determine the entrepreneurial practice behavior (EPB) of Chinese groups in running and developing a business. These behaviors will be analyzed using the Islamic business ethics (IBE) perspective to contextualize Islamic values in entrepreneurial practice. This study uses the qualitative approach, and the data collection method uses triangulation such as observation, interview, and documentation. The research object was conducted in Ponorogo, East Java province, where are 67 shops managed by ethics. The result of this study showed that the EPB of Chinese group business ethics shows six (6) behaviors, is high motivation; learning business knowledge through formal and non-formal education; personal savings; commitment to settle all debts on time; fulfilling the rights of employees and costumers properly; and strong determination to develop a business innovation. Then, following contextualization from IBE, four (4) behaviors are al-Quwwah; al-Amanah; al-Hifdz; and al-‘Ilm. In addition, several things cannot be reconciled with Islamic roles there are, orientation business Islam; Islam obliges to study of religious knowledge through debt. Although some scholars allow it, Islamic principles recommend avoiding or at least limiting it as much as possible.

Abstract

Background. Multi-contract (hybrid contract) is currently widely applied in Sharia Banking. The contract is used in various transactions in Sharia Banking products such as the Ijarah Muntahiyah Bit Tamlik and Musyarakah Mutanaqishah contracts. In practice, the application of the multi-contract raises schematic problems, but Sharia Banking still applies the contract. It is interesting to study the practice of multi-contract in Sharia Banking from the aspect of maqasis sharia. Maqasid sharia analysis is used to see the maslahah side. Aim. This study aims to review the practice of multi-contract in Sharia Banking in the perspective of maqasid sharia. Methods. This study uses library research. Results. The results of this study indicate that the jurists (fukaha) agree on the permissibility of multi-contracts, but the validity of the results of the merger depends on what contracts are combined. The elements prohibited by the maqashid sharia in this hybrid contract include coercion, elements of fraud to gain profit, and no one is harmed between the two parties.

Abstract

Waqf Life insurance is a method of planning waqf by making an official/legal will from ownership of assets by providing the waqf in question when there is a risk/death with the consent of the heirs. By handing over the policy as a form of waqf contract to the nazhir. In this case, people who have a unit link life insurance policy from an insurance company that has sharia products after becoming a policy and securities will have the benefits or sum insured and other benefits that will be donated. The aim of this research is to determine the position of sharia insurance waqf in Islamic law according to the Syafii school of thought. The research method used is qualitative normative-empirical for benefit with the benchmark of sharia maqashid. The results of this research show that according to the Shafi school of thought, waqf benefits for sharia life insurance are not permitted. Because the ulama in the Shafi school of thought strongly oppose waqf/cash waqf, where money will run out if used.
