Abstract

Agricultural land has a social function whose benefits are very helpful to improve the welfare of the community in order to realize social justice. Land exploitation agreements with production sharing are regulated in customary law based on an agreement between the landowner and the tenant farmer in return for the results agreed by both parties. In its development, the production sharing agreement is regulated through Law Number 2 of 1960 Concerning Production Sharing Agreements. In the Kampar Regency area, which has indigenous peoples and still upholds life based on customs or still maintains local wisdom. Access to agricultural management is an important aspect for indigenous peoples, especially for indigenous groups that are still dependent on natural resources. In managing agricultural land, indigenous peoples in Kampar Regency, one of which is carried out by cooperating in agricultural land management between fellow indigenous peoples. The urgency of this writing is to see the implementation of agricultural management agreements in indigenous peoples in Kampar Regency. The results of this study are that not all indigenous peoples carry out agricultural land management agreements, agricultural management agreements are carried out because the majority of the population works as farmers, but not all people have land for farming. Agreements are made in writing for agricultural management. Obstacles to the Implementation of profit- sharing agreements in the indigenous people of Kampar Regency include when implementing the Harvest, the cultivator does not share the results in accordance with the agreement. Discrepancies in understanding between indigenous peoples are cultivators and indigenous peoples as landowners. The lack of understanding of indigenous peoples regarding agricultural profit-sharing arrangements and tenurial conflicts that still occur in Kampar have also become obstacles in the implementation of agricultural land management agreements in Kampar indigenous peoples.

Abstract

The purposes of Islamic Banking in general are as social institutions and providers of welfare effects for society. The noble goals will not be realized, if not the totality of Islamic Banking in improving service quality to customers as a form of good governance. Service quality in Islamic banking can be seen from the customer satisfaction in enjoying the quality of service desired by the customer and in accordance with the concept of Islam which require glorifying customers. Implement of customer satisfaction is the duty and obedience Islamic Banking regulated in Act No. 21 of 2008 on Islamic Banking.

Abstract

Primordial loyalty that breeds fanaticism is often used by politicians as a shortcut and easy way to gather support. By using primordial interests, politicians do not need to work hard to gain support from the people. This research seeks to explain why Jambi Malay ethnic loyalty, as the dominant group, was not formed in relation to the Mayor Election in Jambi City. What are the factors that cause Malay ethnic sentiment not to appear. The data in this study were obtained through in-depth interviews, documentation, and news in the mass media. It is possible for the results of this study to be replicated in areas outside Jambi City to see whether the ethnic Malays elsewhere also have the same cultural roots, political attitudes, and habits, or vice versa. The results of this study will provide an explanation of the theoretical implications of the political events that occurred in the city of Jambi. The results of this study can be used to predict the future of Malay ethnic politics in the midst of an electoral democratic political system that is taking place in Indonesia.

Abstract

This research was performed to develop a model of legal protection for tenure rights and Indigenous peoples' access to forests based on local and ecological wisdom in Riau Province. Socio-legal research methods are employed to examine the relationship between law and government policy, with a focus on local and ecological issues. This approach facilitates a more fundamental understanding of the law's substance. Using the normative analysis with interdisciplinary dialogue, in a protection model for public interests over the long term is proposed. The research suggests that cooperation between the public and local or regional governments can be pursued to implement a legal protection model for tenure rights, ensuring that the traditional rights of customary law communities are recognized and upheld within judicial processes. The protection of traditional and constitutional rights of customary law communities has not yet implemented in concrete actions. As a result, the private property rights and access to land in Riau Province are currently protected by the local and ecological considerations..

Abstract

Islamic fundamentalist groups played an important role in Indonesia's 2019 presidential election. They openly sided with the number 2 candidate, Prabowo Subianto-Sandiaga Solahudin Uno. Even today, the presidential election was marked by polarization and religious sentiments that are very strong and sharp. This study examined the model of presidential election contestation that will likely take place in 2024, the position of fundamentalist groups in political contestation, and its relation to religious polarization trends. This qualitative research used a case study approach to explore political models and attitudes in presidential election contestation. Interest group theory was placed to analyze the issue. The results showed that the map of contestation that will occur in 2024 will still be the same as the 2019 presidential election contestation. Second, the division between religious groups will still occur in the 2024 presidential election. Third, the alignment of religious fundamentalist groups in the 2024 presidential election will lead to figures willing and able to accommodate their groups.

Abstract

The form of legal protection for consumers is outlined in Law Number 8 Year 1999 on Consumer Protection and Law Number 1 Year 2024 on Electronic Information and Transactions. Based on the doctrine of caveat venditor, sellers should be careful and cautious in selling products to consumers to protect consumers and prevent losses that can be caused by irresponsible sellers. However, the protection of consumer rights has not gone well. There are still many discrepancies between the type and quality of goods received by consumers and those promised by business actors as stated in the description of the products sold. Therefore, the research objectives of this thesis are first, consumer protection for buying and selling clothing products in the Shopee marketplace. Second, consumer protection that should be based on the doctrine of caveat venditor. This type of research can be classified into the type of sociological research. With the research location located in the online buying and selling site in the Shopee marketplace, while the population and sample are all parties related to the problem under study. This research uses data sources in the form of primary data and secondary data, and data collection techniques are carried out by means of interviews, questionnaires, and literature review. From the results of the problem research, there are two main things that can be concluded. First, consumer protection for buying and selling clothing products in the Shopee marketplace has not been implemented properly. Consumers often suffer losses due to products that do not match the claims of business actors. Second, consumer protection that should be based on the caveat venditor doctrine is manifested in the form of obligations of business actors in accordance with the caveat venditor doctrine, namely related to the quality and accurate and honest representation of goods, disclosure of information relevant to the product, responsibility for damage or loss, providing warranty or compensation to consumers who experience losses, and compliance with the law. The morality and ethics of business actors must also complement each other to create a fair and transparent trading environment. The author's suggestions are first, business actors should provide honest, complete and accurate descriptions of the products sold. Consumers need to increase awareness of their rights, how to transact safely in the marketplace, and understand how to file a complaint if they experience problems with their purchase. Second, in line with the caveat venditor doctrine, legal reforms to Indonesia's Consumer Protection Law are needed to recognise and clarify the responsibilities of businesses in online buying and selling transactions. Business actors must be fully responsible for the quality and safety of the products sold. Marketplaces must also have a mechanism to monitor the activities of business actors on their platforms and take firm action against business actors who violate consumer protection provisions.

Abstract

Banking is something related to banks, including institutions, business activities, and methods or processes in implementing business activities. One of the activities of financial institutions is banking that has credit facilities. In practice, Cessie often causes problems between the parties. Many Cessie cases occur especially between customers and the Bank. This type of legal research is categorized as a type of normative legal research. Normative legal research is library legal research. The data sources used are secondary data consisting of primary legal materials, secondary legal materials and tertiary legal materials. Data collection techniques come from the literature study method. After the data is collected, conclusions are drawn. This normative research data is analyzed qualitatively. From the research results, 2 (two) main points were obtained, namely first, the transfer of receivables through cession does not result in the termination of the credit agreement made between the creditor and the debtor, it only results in the transfer of the right to collect or receivables from the debtor (cessus) to a third party who then replaces the position of the old creditor (cedent) as the new creditor (cessionaris). Second, the transfer (cession) carried out by the old creditor (cedent) to the new creditor (cessionaris) is an act that is justified by law, but the actions taken by the new creditor (cessionaris) against the debtor are unlawful acts. The researcher's suggestion is first, to provide detailed provisions on the transfer of receivables through cession in the form of a Ministerial Decree or other Regulations in the Legislation. Second, for all new creditors (cessionaris) in the future before taking legal action, it is expected to take preventive steps for creditors to find the best ways to resolve bad debts so that the parties get their rights and do not harm each other.

Abstract

Purpose: The primary aim of this study was to address the issue of stunting, a form of chronic malnutrition affecting children’s growth and development. This problem is influenced by various factors, including child characteristics and socio-economic conditions. The lack of knowledge about stunting among village residents necessitated an intervention to provide insight and education. Method: Students from Riau University’s KKN program collaborated with the Sungai Pinang Village Posyandu to conduct stunting prevention outreach activities. These activities were designed to educate parents, particularly mothers, about the importance of adopting a healthy and clean lifestyle. In addition to these outreach activities, the students implemented a program called “Motorbike Taxi for Healthy Children’s Food”. This program aimed to provide examples of nutritionally balanced food menus beneficial for children’s growth and development. Practical Applications: The practical application of this study lies in its potential to increase community awareness about stunting prevention and healthy food menus. By providing practical examples and education, the residents of the village can make informed decisions about their children’s nutrition. Conclusion: The desired outcome of these activities is a community that has sufficient knowledge about stunting prevention and healthy food menus. The hope is that village residents will no longer feel unfamiliar with the concept of stunting and will know how to prevent it. Furthermore, they will be able to provide healthy food for their children, contributing to the overall reduction of stunting in the community.

Abstract

Tidak sedikit korban kekerasan seksual mendapatkan perilaku Victim Blaming atau penyalahan korban dari media sosial yang sangat berdampak buruk karena sekaligus mendapatkan dua kejahatan yaitu kejahatan karena kekerasan seksual yang dialami dan kejahatan atas pandangan buruk netizen terhadap dirinya. Tujuan dilakukannya penelitian ini adalah untuk mengetahui pengaruh perlindungan hukum korban dan menemukan peranan realisme hukum dalam mengatasi perilaku Victim Blaming di media sosial. Metode penelitian yang digunakan adalah analisis yuridis normatif yang bertumpu pada filsafat hukum. Hasil penelitian ini menunjukkan bahwa terdapat beragam akibat yang disebabkan victim blaming dan realisme hukum berperan untuk mengontrol kepribadian manusia dalam memandang sesuatu berdasarkan gerakan sosial untuk tidak menyalahkan korban atas kejahatan yang terjadi terhadap dirinya.

Abstract

Upah adalah hak pekerja/buruh yang diterima dan dinyatakan dalam bentuk uang sebagai imbalan dari pemberi kerja atau pemberi kerja kepada pekerja/buruh yang ditetapkan dan dibayarkan menurut perjanjian kerja. Perjanjian, atau peraturan perundang-undangan, termasuk tunjangan bagi pekerja/buruh dan keluarganya atas suatu pekerjaan dan/atau jasa yang telah atau akan dilakukan. Dalam pemberian upah pekerja/buruh oleh pengusaha sering terjadi pelanggaran. Salah satu pelanggaran yang dilakukan oleh pengusaha adalah memberikan upah pekerja/buruh di bawah upah minimum. Bahwa dalam pasal 88 e ayat 2 undang-undang nomor 11 tahun 2020 tentang penciptaan lapangan kerja dengan jelas disebutkan bahwa; “Pengusaha dilarang membayar upah lebih rendah dari upah minimum, dan sanksinya tercantum dalam pasal 185. Dari tahun 2020 hingga 2022 ada 10 pengaduan yang masuk ke atasan dinas tenaga kerja provinsi riau tentang pelanggaran upah. mengetahui bagaimana proses penegakan hukum yang dilakukan oleh pengawas ketenagakerjaan terhadap pelanggaran pengupahan yang dilakukan oleh pengusaha, apa yang menjadi kendala bagi pengawas ketenagakerjaan, dan untuk mengetahui upaya yang dilakukan untuk mengatasi masalah pengupahan. Selain itu, penelitian ini juga mengkaji tentang peran hukum perburuhan dalam penyelesaian masalah hubungan industrial. Dari hasil pembahasan penelitian dapat disimpulkan bahwa kedudukan hukum perburuhan dalam sistem hukum nasional Indonesia secara teoritis dapat dipisahkan menjadi 3 bidang, yaitu bidang administrasi, bidang perdata, dan bidang pidana. Namun dalam prakteknya harus dijalankan secara bersamaan karena berkaitan satu sama lain. Hubungan hukum yang dilakukan oleh pekerja/buruh dengan pengusaha termasuk dalam bidang hukum perdata. Namun dalam proses pembuatan, pelaksanaan, dan pengakhiran hubungan tersebut, pemerintah diawasi agar dapat menjalankan 3 fungsinya. Jika selama proses tersebut terjadi pelanggaran (tidak sesuai dengan ketentuan yang berlaku), maka sanksi pidana dapat diterapkan
